Abstract

The utilization of technology in environmental law has become crucial in enhancing the efficiency of monitoring and enforcement of environmental violations, with the use of technology-based monitoring systems such as sensors and drones enabling more accurate and real-time monitoring. Engaging inclusive and sustainable community participation is also a key step in achieving environmental justice, with efforts to improve accessibility of environmental information to the public and address challenges such as information gaps and access limitations. Furthermore, addressing the equitable distribution of environmental burdens and benefits among all members of society is a primary focus, by applying the principles of environmental justice and strengthening community involvement in environmental decision-making to reduce social and economic inequalities. Finally, creating an adaptive and responsive environmental legal system is increasingly important as environmental issues continue to evolve in complexity, requiring flexible environmental regulations, monitoring institutions capable of keeping pace with technological and environmental advancements, and collaboration among stakeholders to effectively address future challenges in a comprehensive manner.

Abstract

Housing is a collection of houses as part of settlements, both urban and rural, which are equipped with public infrastructure, facilities and utilities as a result of efforts to provide livable houses. If you look at the definition of housing, you can see that infrastructure, facilities and public utilities are requirements that must be completed in housing. In fact, when the housing is still under construction, housing marketing through a preliminary sale and purchase agreement system can only be carried out after there is certainty about several things, one of which is the availability of infrastructure, facilities and public utilities. Quantitative data from interview results is described in a frequency table qualitatively and descriptively. The data that has been obtained through research activities is analyzed qualitatively. Qualitative analysis is used to describe the data obtained, both primary data and secondary data, which is then followed by interpretation and conclusions. Implementation of the procurement of public facilities and social facilities is a mandatory requirement that must be provided by the developer/developer to obtain a building construction permit (IMB) from the Spatial Planning and Building Service. Where housing is a collection of houses as part of settlements, both urban and rural, which are equipped with infrastructure, facilities and public utilities as a result of efforts to provide livable houses. Abstract

According to the state, all constructs of crime, especially domestic crime, are included with human rights violations, crimes against human dignity and discriminatory practices. Domestic crime, usually abbreviated as domestic violence, is a phenomenon that often occurs in or around the family. The majority of domestic violence is experienced by women or children because there are many aspects of life that are less or even unfair to them, thus providing opportunities for crimes against them. Physical abuse or violence, exploitation, neglect, and sexual abuse by spouses, children, or household staff are just some of the many forms of domestic crimes that can occur. In real life, there are many documented and unusual instances of domestic abuse. The purpose of this research is to determine and assess the impact of withdrawing a domestic violence report on the legal standing of the perpetrator. To examine the ambiguous standards surrounding the revocation of domestic crime reports, this research was written using normative legal research techniques with a statutory approach. The research findings show that, in accordance with Article 44 of Law Number 23 Year 2004 on the Elimination of Domestic Violence, husbands who commit violence against their spouses can be subject to sanctions. Domestic crimes are included in the relative complaint offense but are only covered in Articles 51 and 52, which basically do not make it painful or difficult for someone to carry out daily activities or hold a job or other position. Shortly after the perpetrator was named as a suspect in this domestic violence case, the victim withdrew the domestic violence report. As a result, the revocation of this report has legal consequences with the issuance of a Letter of Termination of Investigation in accordance with Article 75 of the Criminal Code.

Abstract

In carrying out their duties, general practitioners have limitations both in terms of knowledge and medical facilities they possess. Furthermore, based on the Omnibus Health Law 2023, there are regulations that govern general practitioners regarding the medical procedures they can and cannot perform. Several articles that regulate referral issues are Article 19, Article 32, Article 189, and Article 360. Meanwhile, the regulation regarding specialist doctors is listed in Articles 233-235. However, it is important to emphasize that the authority of specialist doctors and general practitioners is not directly regulated in the Omnibus Law. Thus, the study that can be conducted is an interpretative study that compares it simultaneously with similar legal products. Other references that can be used are Presidential Regulation no. 31 of 2019 and Minister of Health Regulation no. 36 of 2019. Based on a comparative study and judicial analysis of the Omnibus Health Law 2023, specialist doctors have their own independence, and therefore, if they delegate authority to general practitioners, it is guaranteed by the law, including the Omnibus Health Law 2023, especially because the Omnibus Health Law 2023 opens up flexibility for specialist doctors to practice. If delegation occurs, general practitioners can be legally protected as long as the basis for this delegation is emergency for patient safety, secondly is the delegation of authority to ensure patient safety, and thirdly is part of the education for specialist doctors. Although not explicitly stated, these implications are strongly implied in the articles mentioned in the Omnibus Health Law. Nevertheless, there are certain limits that specialist doctors must follow to ensure that patients' rights are well protected, and in the future, there needs to be a strengthening of regulations so that both general practitioners and specialist doctors do not face criminalization.

Abstract

In today's criminal justice discourse, restorative justice has gained traction. A restorative justice system has been included into the institutional policy of several law enforcement agencies. Additionally, it is included in the 2020–2024 National Medium-Term Development Plan (RPJMN). Since restorative justice is beneficial to and compatible with environmental conservation, it has also been developed in the field of environmental law. In light of this, the present study examines restorative justice as a broad idea within the context of Indonesian environmental legislation. This paper also highlights issues and considers critically whether the normative juridical approach of restorative justice may be used to address environmental crimes.

Abstract

This research aims to analyze the revision of the Constitutional Court Law (UU MK) which has the potential to cripple the independence of judges and perpetuate authoritarian power in Indonesia. The research method used is critical analysis with a qualitative approach, which involves analysis of legal documents and related literature. This research reveals that the revision of the Constitutional Court Law could have a significant impact on the democratic system in Indonesia, with the risk of weakening the basic principles of the rule of law, separation of powers, and protection of citizens' constitutional rights. It is hoped that the research results will provide a comprehensive picture of the risks and impacts of the revision of the Constitutional Court Law and provide recommendations for strengthening the independence of the Constitutional Court and supporting the democratic system in Indonesia.
