Abstract

Intellectual Property Rights basically have economic value. Therefore it is not excessive if the results of human intellectual work are given adequate legal protection. Through this way Intellectual Property Rights will get a decent place as one form of rights that has economic value. E-Book is included as a protected work because it is an adaptation of the initial creation in the form of a book that each has its own copyright after being realized in a real form.

Abstract

This research background by the existence of Dewi Rengganis Batik which is the characteristic of Jatiurip Village, Krejengan District, Probolinggo Regency, where each batik motif tells about the figure of Dewi Rengganis who is the daughter of Prabu Brawijaya from the Majapahit Kingdom, but the batik has not been registered. This resulted in the owner of Batik Dewi Rengganis not getting legal protection. The results of this study using normative Legal Research with statute approach and conceptual approach are to provide an explanation and understanding of the importance of copyright registration to protect the copyrighted works of Batik Dewi Rengganis, and  describe  legal  protection  for  owners  of Batik Dewi Rengganis works in Jatiurip Village, Krejengan District Probolinggo Regency.

Abstract

Legislation Number 34 of 2007 concerning Bankruptcy and Postponement of Obligations of Debt Payments is not fully complete in order to protect the rights of creditors, in connection with the dispute of PT. Golden Adishoes has no clarity about repayment in full if it turns out that the debtor's assets are insolvent is not enough to pay all of his debts, indirectly the creditor is required to accept the fact that all of his debts will not be repaid in full by bankrupt debtors without any actions and what solutions can be made by the creditor before the bankruptcy application is filed by the bankrupt debtor to the Commercial Court.

Abstract

The active role of the customary law community in the process of economic development is very large supported by abundant natural wealth spread across the archipelago. This considerable potential will be better and can be supported by reliable human resources. Customary law communities can be included to participate in economic development. Empowerment of indigenous peoples with their local knowledge through economic development based on local wisdom can provide support, use and management of natural resources while maintaining the strength of their customary law, their spiritual abilities and the beliefs they embrace.

Abstract

The postponement of a State Administrative Decision which becomes the object of the dispute may be granted, since there is still a continuous factual action to be taken, namely the appointment of a definitive Regional Secretary, the inauguration or handover of the position of the dismissed Regional Secretary to the appointed Secretary of the Region whose contents as statements (declarations) of submission of all duties, powers and duties. Decree of the Governor of Maluku Number: 125.a Year 2014 dated May 20, 2014 concerning the Transfer of Civil Servants, on behalf of Kapressy Charles, SH. MSi, NIP: 19560911 198603 1 009 from Southwest Maluku District in Tiakur to the Government of Povinsi Maluku in Ambon, so Kapressy Charles, SH. Msi, felt his interest was damaged by the decision issued by the Governor of Maluku as the State Administration Officer. Therefore the concerned filed a lawsuit to the State Administrative Court of Ambon with Case No. 23/G/2014/PTUN.ABN, concerned requested to carry out the postponement of the transfer from the Government of the Southwest Maluku District to the Government of Maluku Province in due to the contradiction of the principles general good governance or prevailing laws and regulations.

Abstract

Constitutionalism is not just a matter of dismantling pairs of texts and their institutions through the constitution, but rather as a leap of critical thinking and concrete actions to provide assurance of social welfare rights as basic rights of citizens who cannot be neglected at all by the organizers of power. That is one way to interpret constitutional theory and law to be more substantive, dignified and grounded for all citizens.

Abstract

Indonesia is a unitary state that determines all regions of the country without exception constituting a unity of administrative and legal territory. However, in the territory of Indonesia there are also regions and unity of customary law communities, in this case the traditional village which has special characteristics that are special because it has existed before the formation of the State and has the right of origin in the administration of its government, and is recognized and respected by the State, so that the interaction between the State and customary villages allows conflicts between State law and customary law and traditions in the administration of government. For this reason, an ideal interaction between the State and the traditional village is needed which can create harmony and balance between the Country and the traditional village.

Abstract

This study will focus discuss to changes in the authority of the constitutional court in indonesia. That since given authority decide a dispute the outcome of an election both at the central and local the constitutional court as if stuck to the award political reasons and there are several judge involved a corruption scandal decisions dispute the outcome of an election . So the establishment of judicial special election into a the substance of things not cleared by the formation of function constitutional court (M.K) as a squire the constitution where whose main duty is interpret the act. This research uses the method juridical normative by comparing function m.k in some countries and how the application of ideal in Indonesia.

Abstract

The State has the duty and role in protecting and guaranteeing the human rights of its citizens. Violations of human rights often occur against vulnerable groups, one of which is children. Children as vulnerable groups have special rights due to their limitations, so they need protection. Countries in the world agree to review the protection of children by signing and ratifying Convention on the Right of the Child 1989. This Convention specifically regulates the protection and guarantee of the rights of the child to be undertaken by States Parties. However, violations of child rights continue to occur, one of them being child labor. Working causes children to lose their right to grow, grow, play and receive education. Writing method used is normative juridical research, that is by analyzing the legal issues contained in legislation related to the problem under study. The problem approach used by the conceptual approach and the legislative approach, using the source of primary legal material as a reference to complete the writing and collection of legal materials is done by using literature study techniques which are then analyzed through qualitative techniques. The results show that the state should be responsible for child labor under the Convention on the Right of the Child 1989, but the binding force of the rule has not been implemented by the state in accordance with the existing material and conditions. The evidence can be seen from various cases of child rights violations that still occur, such as children who are still employed.

Abstract

The protection of these cross-border refugees has already been regulated in international law, namely the Geneva Convention 1951 and the 1967 Protocol, but Indonesia is not a party to ratify the Convention. So far Indonesia has only dealt with the problem of cross-border refugees from a priesthood perspective. This resulted in many violated human rights. Indonesia as a transit country must cooperate with the country of origin, destination country and UNHCR to overcome and provide protection for cross-border refugees. The role taken is based on humanity's consideration of the suffering of cross-border refugees and the protection of Human Rights.
