Al-Aqad is an interdisciplinary journal published twice a year online (e-journal) by the Department of Sharia Economic Law of Sharia Faculty of the Pontianak State Institute of Islamic Studies. It would be maintained every year to come up as a properly online journal included the reviewing process. The special issue would be made available for a particular condition. The regular issue includes August and November editions in each year which would be managing in journal archives.

Abstract

The objectives of this study are to determine: 1) the implementation of the e-court system at the Pontianak Religious Court; 2) to examine factors affecting access to justice in the implementation of the e-court at the Pontianak Religious Court.  The research method used by the researcher is descriptive-qualitative with a field research type and uses a normative-empirical approach. Data was obtained from two sources, namely primary data sources in the form of structured interviews conducted with the junior clerk for law, the e-court administrator, and litigants who did not use the e-court, regarding the data needed to support this research. And secondary data sources in this study were obtained by reading and studying documents relevant to this research, such as archived case documents, and through other media sourced from literature and related data. The results of this study indicate that the e-court system implemented at the Pontianak Religious Court has brought about a significant transformation in judicial administration, electronically integrating processes from registration to court hearings. Factors that influence access to justice include crucial challenges, such as the digital divide, which encompasses limited access to devices and the internet, as well as a lack of technological literacy among some members of the public.

Abstract

The objectives of this study are: 1) To understand the practice of the paddy seed gantang system carried out by the community of Sungai Nilam Village; and 2) To determine the legal status of the paddy seed gantang system in Sungai Nilam Village from the perspective of Imam Syafi’i’s Al-Umm. The research method used was field research with a descriptive-qualitative approach. This study used primary data sources in the form of in-depth interviews. Secondary data sources were translations of Imam Syafi'i's Kitab Al-Umm. Data collection techniques were carried out through structured interviews and document studies. Data validity techniques used source and technique triangulation. Data analysis techniques consisted of data collection, data reduction, data presentation, and conclusion drawing. The results showed that: 1) the practice of the paddy seed gantang system is a tradition passed down from generation to generation that reflects the values of mutual cooperation, carried out through the exchange of similar goods using the same measure, even though there is an imbalance in the quality of the goods; 2) from the perspective of the Book of Al-Umm by Imam Syafi'i, it is in accordance with the provisions of muqayadhah, but does not fully meet the requirements due to differences in the quality of goods. However, this practice remains relevant to the principles of muamalah in Islam, which emphasizes justice.

Abstract

The expansion of platform-based e-commerce has significantly transformed muʿāmalah transactions, including the operation of khiyār, which in classical fiqh muʿāmalah functions as an individual right to affirm or rescind a contract. In Shopee’s e-commerce transactions, khiyār is no longer exercised personally and flexibly, but is mediated through platform procedures such as escrow mechanisms, fixed complaint periods, and internal dispute resolution. This shift raises normative questions regarding the function and legitimacy of khiyār in contemporary muʿāmalah. This study employs normative legal research using fiqh muʿāmalah and maqāṣid al-sharīʿah approaches, drawing on classical fiqh literature, maqāṣid theory, and Shopee’s transaction policies. The findings show that khiyār has transformed into an institutionalized procedural mechanism. From a maqāṣid perspective, this transformation is functionally acceptable insofar as it protects property and prevents harm, though rigid administrative limits may undermine substantive justice. The study highlights the need to reinterpret khiyār as a maqāṣid-oriented protective instrument adapted to digital transactions.

Abstract

This research is motivated by the continued circulation of frozen food products that do not have halal certification, even though clarity of halal status is a Muslim consumer right and has been regulated in Law Number 33 of 2014 concerning Halal Product Guarantee. This study aims to determine the practice of selling frozen food products that do not have halal certification at Om Jack Store in Pontianak City and analyze the halal status of these products based on the provisions of the Halal Product Guarantee Law. The type of research used is empirical juridical research with a qualitative approach. Data were obtained through interviews, observations, and documentation, then analyzed using qualitative descriptive data analysis techniques by means of data reduction, data presentation, and drawing conclusions. The results of the study indicate that the practice of selling frozen food products at Om Jack Store is carried out as is the practice of trade in general, but some of the products traded do not have halal certification. Based on Article 4 of Law Number 33 of 2014, products circulating and traded in the territory of Indonesia are in principle required to be halal certified, so the practice of selling frozen food products without halal certification is not fully in accordance with applicable legal provisions. Therefore, it is necessary to increase supervision and awareness of business actors regarding the importance of halal product guarantees as a form of legal protection for consumers, especially Muslims.
