Abstract

Within the framework of the legal norm system of the Republic of Indonesia, Pancasila occupies a position as the fundamental norm and the highest legal norm. The hierarchy below it is occupied by the 1945 Constitution. As the basic norm of the state, the discourse on the potential for constitutional amendments, especially related to the 1945 Constitution, is an issue that often arises in public discourse. Constitutional amendment is a process of changing the constitution of a country. This process can have significant implications for state institutions, including the structure and function of state institutions, for example in Indonesia. The results of the analysis show that constitutional amendments can have positive and even negative implications for state institutions. In the reform era, amendments to the 1945 Constitution have resulted in significant changes in the structure of the country's higher institutions.

Abstract

This study aims to examine the role of Larvul Ngabal customary law as an alternative to resolving disputes that occur in virtual space in the Kei Islands community. This study uses a socio-legal research method with a qualitative approach. Data were collected through observation and in-depth interviews with traditional leaders and the community in the Kei Islands. The results of the study indicate that Larvul Ngabal customary law has significant potential in resolving disputes in virtual space, especially because it emphasizes the principles of deliberation, consensus, and restoration of social relations. The Kei Islands community tends to choose customary law because it is considered cheaper, fairer, faster, and able to provide comprehensive recovery compared to state law.

Abstract

This research examines the criminal liability of debt collectors involved in forcibly seizing motorized vehicles from consumers. Such actions, often conducted by third parties representing finance companies, frequently occur without proper legal procedures and involve violence, coercion, or violations of consumer rights. The study responds to ongoing incidents where debt collectors act with force, while legal enforcement remains insufficient. Utilizing an empirical normative legal approach, the study combines a review of relevant laws—such as the Criminal Code (KUHP), Consumer Protection Law, and Financial Services Authority regulations with field research, including interviews with victims and observations in Kayubulan Village, Limboto Subdistrict, Gorontalo Regency. The findings reveal that debt collectors who repossess vehicles without official documentation, prior notification, or through intimidation may be committing criminal acts under Article 368 of the KUHP (extortion) and Article 335 (unpleasant acts). These actions clearly conflict with legal norms and consumer protection principles. The study recommends that finance institutions strengthen oversight of third-party collectors and ensure all collection activities comply with legal and ethical standards. Additionally, raising public legal awareness is essential, particularly regarding consumer rights and available legal remedies against coercion or unlawful conduct during debt collection. This dual strategy enhancing institutional accountability and empowering consumers aims to bridge the gap between law and practice, ensuring justice and legal protection in financial transactions.

Abstract

Corporate crime within PT Permodalan Nasional Madani (PNM) Palu Branch reflects the vulnerability of state-owned financial institutions to practices of abuse of authority and violation of the law by internal elements. This case caused state losses and damaged public trust. This research aims to analyze the criminal sanctions and obstacles faced by law enforcement officials in cracking down on corporate crime, as well as formulating solutions for handling it. This research uses a normative juridical approach with the support of empirical data from cases in the Palu District Attorney's Office. The results show that criminal sanctions against individual perpetrators have been applied, but have not yet touched on aspects of institutional corporate responsibility. The main obstacles in law enforcement include limited evidence, the complexity of the organizational structure, the apparatus' lack of understanding of corporate law, and external pressures that interfere with the independence of the investigation. Suggestions include the need to increase the capacity of investigators in forensic audit and corporate law, strengthening the internal monitoring and whistleblowing system at PNM, and collaboration between law enforcement agencies. Thus, law enforcement against corporate crime can be carried out more effectively, fairly, and able to prevent the recurrence of similar crimes in the future.

Abstract

Peace agreements serve as an alternative solution for resolving debts between debtors and creditors, aiming to enable debtors to restructure their debts and maintain business continuity. The peace agreement process is governed by strict procedures, including the submission of a peace plan by the debtor, approval by concurrent creditors through voting, and ratification by the Commercial Court through a homologation hearing. A ratified peace agreement is binding on all concurrent creditors but can be annulled if the debtor fails to fulfill their obligations, as illustrated in the case of PT Perindustrian Njonja Meneer. This study employs a normative legal method with a statutory approach and qualitative data analysis. The findings indicate that the success of a peace agreement depends on the debtor’s compliance and the creditors’ approval.

Abstract

The development of the Nusantara Capital City (IKN) in East Kalimantan presents significant legal challenges regarding local communities' land ownership. Although regulations such as Law Number 3 of 2022 on the National Capital, Law Number 2 of 2012 on Land Procurement for Public Interest Development, and Law Number 5 of 1960 on Basic Agrarian Principles provide legal protection mechanisms, the reality on the ground indicates various obstacles in implementing these laws. Therefore, this study aims to analyze the legal protection available for land ownership held by local communities in the development of IKN. Additionally, it seeks to identify challenges related to the implementation of the prevailing legal framework. An empirical juridical approach is employed to examine legislative provisions and field realities, including conflicts arising in the land acquisition process. The findings reveal that legal protection remains hindered by a lack of transparency, weak access to justice for local communities, and uncertainty in the compensation mechanism. Consequently, improving transparency, strengthening regulations, and ensuring active community involvement in every stage of land procurement are crucial to prevent the development of IKN from compromising the rights of local communities.

Abstract

Bankruptcy regulations in Indonesia, particularly in Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations, are often contentious due to the absence of strict limitations on the filing of bankruptcy petitions. This has the potential to ensnare debtors who are still financially solvent, overriding the principle that bankruptcy should be the last resort in debt settlement. Law Number 37 Year 2004 on Bankruptcy and Suspension of Debt Payment Obligations only requires the existence of two creditors with debts that are due and collectible through simple proof. This study aims to analyze in depth the legal arrangements and determination of insolvency in Law Number 37 of 2004. By using a normative juridical research method, as well as a statute approach that focuses on Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations and other related regulations, secondary data will be collected through literature studies. Insolvency is defined as a condition where the debtor's total debt to all creditors exceeds the value of all its assets, otherwise known as a state of inability to pay. In Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations, the term "insolvency" differs from commonly used terms, such as balance sheet insolvency, which means debts exceeding assets, or cash flow insolvency, which means the inability to pay debts due to liquidity. Unlike the practice in the common law system, the determination of insolvency in Indonesia does not involve mandatory financial audits or court decisions based on independent financial analysis.

Abstract

Interlocutory decisions and final decisions are two forms of court decisions that have strategic functions in ensuring the application of the principles of procedural justice. In Indonesian judicial practice, procedural irregularities, norm inconsistencies, and lack of transparency often occur which hinder the achievement of legal justice. This research aims to analyze the role and position of interlocutory decisions and final decisions in the Indonesian judicial system, and identify normative and practical obstacles faced in their implementation. The type of research used is normative juridical with conceptual and statutory approaches. The results showed that regulatory weaknesses, low quality of judicial consideration, and limited access to information were the main obstacles in realizing procedural justice. Therefore, it is recommended to harmonize procedural laws, increase the capacity of judges, and digitize open decisions to ensure effective, transparent, and dignified justice in the national justice system.

Abstract

The conflict involving Armed Criminal Groups (KKB) in Papua presents a serious dilemma between law enforcement and the protection of human rights. On one hand, KKB’s actions—such as attacks on civilians and security personnel—are classified as gross human rights violations, posing threats to national security and obstructing regional development. On the other hand, law enforcement efforts by state authorities are often criticized for alleged human rights abuses, especially in military operations that may involve excessive use of force. This study aims to analyze the conflict from both legal and human rights perspectives using a normative juridical approach. The analysis is based on relevant legal frameworks, including the 1945 Constitution of the Republic of Indonesia and Law Number 39 of 1999 concerning Human Rights. The article proposes strategic measures to achieve a balanced resolution, such as inclusive dialogue with Papuan communities, human rights-based training for security forces, independent oversight of security operations, and adherence to humanitarian principles. These approaches are expected to foster stability and peace while ensuring the protection of human rights. Ultimately, this study emphasizes that the resolution of the Papua conflict must not rely solely on repressive measures but must also prioritize justice, humanity, and long-term sustainability.

Abstract

The development of digital technology has brought various innovations to the financial system, one of which is sharia crowdfunding. As a form of technology-based fundraising based on sharia principles, this mechanism aims to avoid elements of usury, gharar, and maysir which are prohibited in Islam. This article discusses the legal aspects and operational mechanisms of sharia crowdfunding from the perspective of Islamic law and regulations in Indonesia. By using a qualitative research method based on literature analysis, sharia crowdfunding has a strong legal basis through the fatwa of the National Sharia Council-Indonesian Ulema Council (DSN-MUI) and the regulations of the Financial Services Authority (OJK). In practice, sharia crowdfunding uses various contracts such as mudharabah, musyarakah, and wakalah bil ujrah to ensure fair and transparent transactions. Although it has promising prospects, challenges such as lack of sharia financial literacy, limited specific regulations, and digital security aspects are still major obstacles in its implementation. Therefore, collaboration between regulators, industry players, and the community is needed to encourage a more inclusive and sustainable sharia crowdfunding ecosystem.
