Abstract

This study examines the criminal liability of wives as perpetrators of domestic violence against their husbands from the perspective of Indonesian positive law and Islamic criminal law (fikih jināyah). The method used is descriptive-analytical qualitative through literature study, regulatory analysis, and secondary data from the 2022–2025 period. The results show that, normatively, fiqh jināyah allows for the punishment of perpetrators of domestic violence through ta‘zīr sanctions without distinguishing between genders, while in positive law, the main basis is Law Number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT Law) as lex specialis with the Criminal Code as a general reference. However, law enforcement still faces obstacles in the form of stigma against male victims, barriers to reporting, and limited data on cases of wives as perpetrators against their husbands, thus requiring more inclusive and gender-neutral policies.

Abstract

Aceh is a special autonomous region within the Unitary State of the Republic of Indonesia, as recognized in Article 18B of the 1945 Constitution. The prolonged conflict between the Central Government and the Free Aceh Movement (GAM) was resolved through the Memorandum of Understanding in Helsinki, which laid the foundation for the establishment of the Wali Nanggroe Institution (LWN). The existence of the LWN is regulated under Law Number 11 of 2006 on the Governance of Aceh, as well as Aceh Qanun Number 8 of 2012 and Qanun Number 9 of 2013. The LWN is positioned as an independent customary leadership institution functioning as a unifying body for the Acehnese people under the leadership of the Wali Nanggroe. This study examines whether the existence of the LWN aligns with the concept of Aceh’s special autonomy, evaluates its effectiveness, analyzes its participation in governance, and formulates an ideal framework for its future role. The research employs a normative juridical method with a prescriptive analytical specification, complemented by an empirical juridical approach through literature review and field interviews. The findings indicate that the LWN has not functioned effectively. Its large institutional structure is disproportionate to its duties and functions, resulting in significant budgetary burdens. The perceived political alignment of the Wali Nanggroe has reduced public trust and weakened its neutral role as a unifying figure, particularly amid political dynamics between the Aceh Government and the Aceh Regional People’s Representative Council (DPRA). In addition, the lack of harmonious relations between the LWN and the Katibul Wali has hindered institutional performance. The study recommends revising the relevant qanun by simplifying the institutional structure, clarifying internal relations, and strengthening the independence and moral authority of the Wali Nanggroe within the framework of Aceh’s special autonomy.

Abstract

Fraud in banking often occurs through credit manipulation, including fictitious loans or fictitious collateral using customers’ documents, even after previous loans have been settled. Such practices undermine the trust principle that underpins the bank–customer relationship as reflected in Article 29(4) of Law No. 10 of 1998, which requires banks to conduct their business in ways that do not harm the bank or customers’ interests and to maintain public trust. This study examines the urgency of the trust principle in banking and analyzes legal protection for customers harmed by credit manipulation committed by bank employees. The research employs an empirical juridical approach, combining normative analysis of relevant banking and civil law rules with field-based data on how credit manipulation is carried out and addressed in practice. The findings show that customer protection should be structured through preventive measures (internal controls, verification, complaint-handling mechanisms) and repressive measures (dispute resolution and law enforcement) across civil, criminal, and administrative avenues. From a civil law perspective, Articles 1365 and 1367 of the Civil Code provide the basis for holding both the employee and the bank institutionally liable for unlawful acts and vicarious responsibility, including compensation for customers whose identities or credit files are misused. Nevertheless, the quantification of damages remains case-specific and depends on proven material and immaterial losses.

Abstract

This study aims to analyze the implementation of the authority of the National Narcotics Agency of Aceh Province in providing rehabilitation for narcotics abusers, to identify the obstacles encountered, and to explain the efforts undertaken to optimize the implementation of rehabilitation. This research employs a qualitative method with a socio-juridical approach. Data were obtained through library research and field research in the form of interviews with relevant parties, and were then analyzed descriptively and analytically. The findings show that BNN Aceh has a strategic authority in the implementation of rehabilitation, which is carried out through the stages of assessment, medical rehabilitation, social rehabilitation, and follow-up guidance. However, the implementation of this authority has not yet been optimal due to several obstacles, including low public participation and understanding, stigma toward narcotics abusers, limited facilities and infrastructure, a shortage of human resources, insufficient budget allocation, and suboptimal inter-agency coordination. To address these obstacles, BNN Aceh has undertaken various efforts through strengthening public outreach, cross-sectoral coordination, community empowerment, as well as the application of social, situational, and community-based crime prevention approaches. This study confirms that the effectiveness of rehabilitation is determined not only by the normative legal authority, but also by institutional capacity and social support in its implementation.

Abstract

Conventional legal research in Indonesia has generally been dominated by a normative-doctrinal approach that emphasizes systematic analysis of legal texts (law in books). In contrast, empirical or sociological approaches (law in action) focus on social realities and legal behavior within society. This article undertakes an epistemological comparison of these two approaches in the context of contemporary legal issues, examining their respective strengths and limitations, and proposing a reflective-integrative methodological model. The study demonstrates that the normative approach excels in system construction and prescriptive analysis, whereas the empirical approach is stronger in generating evidence and contextual understanding. Accordingly, the integration of normative, empirical, and socio-legal approaches through a reflective-integrative methodological framework is necessary to produce legal research that is more comprehensive, adaptive, and evidence-based.
