Abstract

In the essence of NGO as living organization in public domain which is born from the public, acted as public agent and perform the mission on behalf of public, actually the public have the right to demand its accountibility. The accountability of NGO should be horizontally and vertically spread out into interrelated stakeholder. The expected accountability should be supported by the responsibility of their actions in the midst of public. The accountability will be effective if supported by trust and political will from the whole of stakeholder, so the accountability will manifest as founded control interaction on the base of positif social value of public. Abstract

In regard to political aspirations shown by many Papuans and supporters and the ideal objective of mediation as a peaceful process of conflict management, this paper raises two questions: firstly, how is the likelihood of a third-party mediation to take place in Papua? Secondly, if a mediation facilitated by international actors took place in Papua, how should it be pursued? The objective of this paper is to investigate the opportunity for a third-party mediation to take place in Papua and for the problems in the region to be settled properly. This research will be guided by a synthesis of structural and social-psychological perspectives of third party mediation which emphasises not only the importance of resolving the problems but also the significance of improving communication between conflicting parties in seeking acceptable and applicable agreements. With such a perspective this research will examine how biased and facilitative mediation is able to frame the mediation and bring the low-intensity of conflict but complex problems in Papua to a sustainable peace settlement.This paper shows optimism that the problems in Papua can be settled peacefully. It also provides ground for an internationally mediated negotiation to happen for the GoI and Papuans find peaceful settlements. Based on both theoretical ground as well as empirical observation, the protracted but low-level conflict in the region is overlapped by security and development problems. Instead of continuing the fight and allowing the problems unsettled, the parties of GoI and Papuans believed that the problems to be better settled in peace, including the possibility of third party mediated negotiation. While the Papuans, supported by other parties outside Papua, have called for the international community to facilitate negotiation or dialogue between the GoI and Papuans, the GoI is hesitant. A third party mediator that could preserve the territorial integrity of Indonesia and at the same time protect and promote the lives of Papuans is the key for a mediated negotiation take place in Papua and be successful.Key words: conflict resolution, third-party mediation, international relations, Papua

Abstract

Autonomy, at the moment, misinterpreted as auto-money; is providing money as much as possible for the local autonomy government. Therefore, since UU No. 22 tahun 1999 is implemented, a lot of local regulation problems has emerged, especially entail to local taxes and local retributions that may distort economic activities. Some cases in West Java Province, Kota Bandung, Kabupaten Garut, Kabupaten Ciamis, and also Kabupaten Cirebon showed the problem. To prevent the appearance of local regulations problem, experiences in some state, such as : United States of America, Australian, English, Denmark, Dutch, and Japan, they run a cheerful concept Regulatory Impact Assessment (RIA), as a representation of Good Regulatory Governance. There are four matters which are need to be paid attention in policy formulation --especially entail to local taxes and retributions-- namely: The Principle of Competitive Neutrality, The Principle of Minimum Effective Regulations, The Principle of Transparency Participation and The Principle of Costs-Benefits Effectiveness.

Abstract

The process of Public Policy Formulation is filled with paradoxical relations between democracy and bureaucracy. This paper starts by illustrating the paradoxical relations between democratic values and bureaucratic values. Then the author suggests a mechanism for reconciliation between these two values. The first precondition for the success of the mechanism is the positioning of the relationship between government and society in the formulation of public policy. The government role should be changed into its previous role as agent, while the role of the society should replace the government as the principle. The second precondition is the dialogical democratic atmosphere which is the dialogical process between policy maker and policy stakeholder. Conceptual reconciliation will succeed if the bureaucracy and society are mature and independent. Furthermore empirically reconciliation must be supported by reciprocal and equal communication between public administrations and the public, mechanisms for checks and balances, strong civil society and responsive and dynamic beureaucracy. Pluralism is important in Public Policy Study. When democracy is strongly incorporated into public policy formulation, pluralism could potentially cause conflict or form the basis for democratic processes. The next important issues are social justice and gender justice. Both are important, especially in public policy study which is developed in the framework of democratization with the values of freedom, egalitarianism and justice.

This article discusses the comparison of ombudsman commissions in Sweden and Indonesia. In particular it explores the historical background, the legal basis and how ombudsman works in both countries. Abstract

Keberadaan sebuah Organisasi Berbasis Masyarakat dalam sebuah entitas negara seringkali disalahgunakan oleh pemegang kekuasaan untuk mendapatkan image positip tentang tingkat partisipasi masyarakat dan desentralisasi. Namun masih terdapat perdebatan mengenai apakah Organisasi Berbasis Masyarakat sungguh memainkan peranan penting sebagai wadah untuk menggerakkan masyarakat perkotaan. Abstract

Sumber daya manusia birokrasi pemerintahan daerah merupakan salah satu sentral permasalahan dalam era otonomi daerah. Sumber daya manusia birokrasi dengan mutu yang rendah, bagaimanapun, tidak akan mampu merumuskan kebijakan publik yang berkualitas dan mencapai kinerja optimal, apalagi jika tidak memiliki moralitas yang terpuji dan tanggung jawab atas profesinya. Di samping sumber daya manusia, juga terdapat dimensi lain yang menentukan potret birokrasi pemerintahan, seperti : struktur, kultur, prosedur dan figur yang kesemuanya belum kondusif bagi birokrasi pemerintahan daerah untuk melaksanakan otonomi daerah.Untuk itu diperlukan usaha-usaha pemberdayaan birokrasi untuk membenahi potret birokrasi pemerintahan yang wajahnya makin carut marut. Satu hal penting ialah kemauan elit politik dan pemerintahan untuk menempatkan profesionalisme di atas yang lain. Ini dapat dilakukan dengan mempertimbangkan beberapa upaya pembenahan seperti: sistem manajemen kepegawaian, proses seleksi pegawai, netralitas birokrasi, gaya hidup birokrasi, budaya kerja birokrasi. Pembenahan dilakukan secara simultan dan menyeluruh di semua lini melalui review seluruh pejabat publik oleh badan independen, misalnya, Komite Etika PNS independen, jujur dan non partisan yang keanggotaannya diakses dari berbagai kalangan.

Abstract

Bureaucracy is main executor for reform agendas. Therefore in realizing all of reform agendas in Indonesia, then bureaucratic reform is an underlying effort supposed to do. There are two prerequisite should be fulfilled for the reform. Abstract

Since independence until now, the of public law, especially in the field of Indonesian administrative law, has not been able to serve as reinforcement in community empowerment and things connected with public control over the government. Empirically, it is evident, that the implementation of development activities requires at least five conditions simultaneously engaged in achieving the ultimate goal of equitable public welfare. The respective requirements are the rule of law and human rights; democratic governance, equitable laws, material, and non-material aspects of development, and a more genuine community empowerment.This article tries to necessitate, firstly, that the development activities cannot be carried out by ignoring each other of any such conditions. Secondly, it is a warning the failure to achieve the planned development goals in the result of a partial way of thinking, both at the level of policy formulation as well as its implementation. In addition, to eliminate the adverse impact on the implementation of the general welfare, development must be based on a development policy that is oriented to human development which requires wider participation of a people. That is, the main focus of planning humans in the development, in addition to having ethical arguments. Also has legal dimensions in the level of its implementation.

Abstract

This work argues that developing democracy from the grassroots level is demanded in order to develop democracy in a broad scale. To issue and implement the new policies of decentralization after the fall of Suharto era should be noted as the radical change in managing the public affairs democratically. Even the local autonomy policies are implemented at the lowest level such as village area by introducing the modern democratic things i.e. the new political structure and the new political mechanism. One that should be emphasized that those political engineering is oriented to develop the public accountability as well. However, avoiding the local culture which is still exist in a such society will in fact raise problem, especially in the high pluralistic society like Indonesia. Local culture could be the fundamental element in developing democracy from the grassroots level.Kata kunci: desentralisasi, demokratisasi, kultur, akuntabilitas
