Abstract

The development of insurance in Indonesia has grown very rapidly, various types of insurance companies are offered to the public to participate in an agreement. In this study using normative juridical research methods using statutory approach (statue approach) and analytical approach (analytical approach). The focus of this research is how legal protection is against life insurance claims that are rejected by insurance companies and how cases of insurance claims are resolved by underage heirs. The purpose of this study is to determine legal protection for insurance claims that are rejected by insurance companies and settlement of insurance claim cases by heirs who are still underage. The results of this study produce a legal protection for heirs in submitting insurance claims that are rejected by insurance companies in the form of preventive and repressive legal protection. who are underage to claim insurance with the help of a power of attorney from a guardian or parent.

Abstract

The purpose of this research is to examine how the legal framework in Indonesia regulates the dissolution of companies, particularly when it has been approved by shareholders in a General Meeting of Shareholders (GMS). This study also aims to conduct a comparison with the company dissolution mechanism in Malaysia. The method used is a literature review, which involves examining laws and regulations as well as analyzing relevant legal concepts. The findings indicate that there are similarities and differences between the legal systems of the two countries. These differences stem from the distinct legal traditions each country follows: Indonesia adopts a civil law system, while Malaysia follows a common law system. Consequently, the approaches and regulatory styles in each country differ,

Kosep perlindungan hukum data pribadi menjamin setiap warganya memperoleh hak-hak asasi dan perlakuan tanpa diskriminasi di tengah masyarakat. dalam penerpaanya hukum data pribadi ini sagat di butuhkan hukum yang tegasnya dalam upaya untuk mewujudkan tujuan bangsa indonesia yang ada di pembukan UUD 1945 alenia ke 4. selain hal tersebut tujuan lain adlaha mengurangi tindakan kriminal, pelecehan, bullying, penipuan dalam penyalah gunaan data yang bocor tersebut Untuk mengatasi masalah ini, pemerintah harus mengadakan kampanye pendidikan publik tentang undang-undang perlindungan data untuk meningkatkan kesadaran di antara warga negara tentang hak-hak mereka di bawah hukum. Hal ini akan mendorong warga untuk melaporkan pelanggaran hukum bila diperlukan sehingga mereka dapat mengambil manfaat darinya bila diperlukan. Selain itu, bisnis juga harus didorong untuk mematuhi persyaratan hukum sebanyak mungkin sehingga mereka tidak dihukum karena melakukannya secara sukarela oleh konsumen atau regulator. Abstract

Doctors are a noble profession. Doctors provide services to patients in the health sector with the aim of recovering from their illness. Doctors in carrying out their practice are guided by all the regulations that function in providing legal protection to themselves. Doctors do their best to seek health for patients regardless of the results. Sometimes the patient does not accept all medical actions performed by the doctor where the patient feels aggrieved. Especially if the patient dies, often the patient's family blames the doctor who treated the patient by saying that the doctor has committed medical malpractice. Therefore we need a legal certainty that regulates medical practice carried out by doctors in order to provide justice and legal protection for doctors in carrying out their duties.

Abstract

Insulting judges and courts not only occurs during court proceedings, but can also be done outside the courtroom through media or publications. The term Scandalizing the Court is actually part of contempt out of court, but is specifically aimed at undermining the authority of judges or courts. This article will discuss an overview of the concept of Scandalizing the Court, followed by a discussion of efforts to regulate violations of Scandalizing the Court after the enactment of the National Criminal Code. The research method used is normative, using a statutory approach, conceptual approach, and comparative approach. The results of the study conclude, firstly, that the philosophical principles or foundations regarding the issue of defamation, especially the concept of Scandalizing the Court, are to maintain the atmosphere of honor in the courts and to protect society from attempts to make the courts appear shameful in the eyes of the public. Secondly, various efforts to regulate violations of Scandalizing the Court in Indonesia have been carried out by the legislature, as the Criminal Code (WvS NI) is not sufficient to accommodate violations that attack the integrity and impartiality of the courts (Scandalizing the Court).

Abstract

Children are a particularly vulnerable age group to the effects of drug abuse. When they are exposed to and try illicit substances, it can disrupt their physical health, education and social life. Prolonged use can even cause permanent damage to the body. Given their vulnerability, children have special rights guaranteed by legislation, including protection from the dangers of drugs. This paper examines two main issues: first, the impact of drug abuse on children as victims; second, the role of the state in protecting children from this threat. This study aims to understand the level of vulnerability of children to drug abuse and the forms of legal protection that can be provided. The research used is normative research. Repressive approaches such as criminalization are not the main solution. The state needs to prioritize a restorative approach through physical and mental health recovery and social reintegration. The goal is to ensure that children can return to live a healthy, productive life and have a bright future

Abstract

Polarisasi politik menjadi salah satu tantangan yang sering hadir dalam penyelenggaraan Pemilu di Indonesia. Polarisasi tidak jarang memicu perselisihan hingga konflik horizontal. Kajian ini akan fokus mengkaji fenomena polarisasi politik di masyarakat Indonesia dalam Pemilu dalam kajian sosiologi hukum. Penelitian ini merupakan penelitian doktrinal dengan menggunakan pendekatan konseptual dan kasus. Bahan-bahan hukum dihimpun melalui studi kepustakaan dan kemudian dianalisis menggunakan teknik deskriptif-analitis. Hasil kajian menyimpulkan bahwa polarisasi politik yang terus berlanjut kan berimplikasi buruk bagi integrasi bangsa, apalagi Indonesia akan menyelenggarakan Pemilu dan Pilkada Serentak 2024. Pada dasarnya dilihat dari penyebabnya, masifnya polarisasi politik sangat relevan dengar teori Arnold Rose dimana faktor seperti teknologi, budaya hingga gerakan sosial sangat mendorong terjadinya polarisasi. Alternatif yang cukup ideal untuk mengurangi polarisasi politik adalah melalui penguatan komunikasi publik yang berlandaskan etika dan dijiwai nilai-nilai kebangsaan Indonesia.

Abstract

This research aims to analyze the Balinese Customary Inheritance Law in the context of inheritance for Hindu women in Bali. The Balinese customary inheritance law has a strong tradition and significant influence on the distribution of inherited wealth among the Hindu community in Bali. This research explains the principle of "pandeka sawah" as the foundation of the Balinese customary inheritance system, where the eldest son has greater rights to inheritance compared to daughters. However, this research also highlights the social and cultural developments that have influenced changes in gender equality values and the protection of women's rights. In this context, the research analyzes how traditional inheritance practices have undergone revisions and adjustments to respect women's rights. The research also describes how Balinese families or communities adopt fair inheritance rules for women, including providing equal rights in inheritance. The study involves an analysis of the development of national laws in Indonesia, particularly the Marriage Law, which protects women's rights in inheritance. Through this research, it is expected to provide a better understanding of the Balinese customary inheritance law regarding the inheritance of Hindu women in Bali and its implications for gender equality in cultural and legal contexts.

Abstract

Climate issues are a growing concern that governments around the world recognize need to be addressed. Climate change and its devastation are being felt around the world. Especially the issue of greenhouse gas emissions in 2015. This study aims to analyze a comparison of the implementation of the Polluter Pays Principle as an effort to implement carbon taxes in Indonesia. This type of research is descriptive qualitative normative. The specification of this research is analytical descriptive. With regard to the impact of climate change that has become a global challenge that needs to be handled together, the government is therefore seeking various ways and systems to achieve the GHG emission reduction target in the medium to long term. The government must carefully prepare the collection system, tax base, and rates for the correct use of earnings. Implementation must also be supported by simple administration, clear rules and effective outreach.

Abstract

This study aims to determine the legal position of the bankruptcy filing application for business entities in the form of cooperatives. This research is normative-juridical research using a conceptual approach method. The data used are primary, secondary and tertiary data. The results of this study will focus on the mechanism of filing a bankruptcy application by the Ministry of Cooperatives and Small and Medium Enterprises of the Republic of Indonesia (Kemenkop) against cooperatives in Indonesia according to Supreme Court Circular Letter No. 1 of 2022. The results of the study concluded that based on the provisions of the Supreme Court Circular Letter SEMA Number 1 of 2022 concerning Special Civil Procedures governing PKPU and Bankruptcy Mechanisms, explaining that Cooperatives can no longer be filed PKPU and Bankruptcy directly but related to the application for bankruptcy filing against cooperative bankruptcy filings can only be done by the Ministry of Cooperatives
