Abstract

This qualitative study aims to identify the sociological construction of the implementation of legal principles in the inheritance system in Indonesia and its relevance to the Islamic inheritance system. The theory of receptio a contrario and the theory of structural functionalism as a legal sociology perspective are used to see how social construction is related to the implementation of the principle of justice, the principle of freedom of will, and the individual principle in the implementation of the inheritance system in a plural Indonesian society. This study finds the construction of social relations related to legal principles in the implementation of the national inheritance system with Islamic inheritance in Indonesia. The relational construction of these principles leads to the implementation of harmony between the implementation of the national inheritance legal system and the Islamic inheritance system so that both can run in an orderly and well-integrated manner. This study confirms that in sociological construction, the relationship between the principle of law enforcement and the social and cultural values of society cannot be dichotomized.

Abstract

The application of ukhuwah values in society faces challenges such as social polarization, inter-group conflicts, identity discrimination, and radicalism, which shows that the ideality of ukhuwah in Pancasila has not been achieved. The purpose of this study is to identify the values of ukhuwah in Pancasila. This research uses a literature study approach with indicators of ukhuwah contained in Pancasila. The research data was obtained through journal reviews, and the analysis was conducted with data verification. The findings of this study confirm that the values of ukhuwah basyariyah, watthoniyah, and islamiyah have strong relevance to Pancasila as a moral framework in building brotherhood and harmony amid the diversity of Indonesian society. The theoretical implications of this study show that the values of ukhuwah in Pancasila can be a universal foundation for building harmonious social relations. The limitation of this study is the difference in interpretation regarding the deep meaning of the values of ukhuwah basyariyah, watthoniyah, and islamiyah, especially in its implementation in the life of the nation and state.

Abstract

This study aims to identify the application of habituation methods at SDIT Umar Bin Khathab Juwana in strengthening student religiosity. The research used a descriptive qualitative approach with data collection methods through interviews, observation, and documentation. Data were analyzed using the Miles & Huberman analysis technique, including data reduction, presentation, and conclusion drawing. The results showed that habituation methods, such as congregational prayer, dhikr, daily prayer, and memorization of the Qur'an, contribute to increasing student religiosity. Implementing this method requires synergy between teachers and parents to create a continuity of learning at school and home and overcome the main obstacle, which is maintaining the consistency of students' focus during habituation activities. In conclusion, the habituation method at SDIT Umar Bin Khathab Juwana supports the thoughts of Abdullah Nashih Ulwan, who emphasizes spiritual value-based education as the basis for moral formation.

Abstract

The covid 19 pandemic that hit Indonesia caused several impacts on Indonesian society that had not happened before. one them, the phenomenon of Juma'at prayers that are carried out virtually. This study aims to examine the pattern of mass communication in harmonizing the MUI (Indonesian Ulema Council) fatwa on virtual Friday prayers, its effectiveness in building public understanding, and its influence on the implementation of the fatwa during the pandemic. Qualitative studies in the form of literature studies that collect and analyze literature sources. The results show that MUI (Indonesian Ulema Council) fatwa has three broad communication functions, namely helping to maintain religious values and norms in society, as legal guidelines and social tools that influence people's behavior, and showing unique changes in devotional practices in the digital era. MUI (Indonesian Ulema Council) fatwas show an important role in disseminating religious guidance and maintaining social cohesion in the midst of change. This study strengthens the theory of mass communication as an instrument of social influence in religious contexts by focusing solely on communication patterns and community responses to fatwas.

Abstract

This research aims to identify the effective role of multidisciplinary perspectives in the study of women’s fiqh. Data collection methods included a questionnaire to 112 Madrasah Aliyah Negeri (MAN) Buleleng and one of Madrasahs Aliyah Negeri (MAN) Jakarta (whose name was not mentioned based on the request of the Head of the Madrasah in Jakarta) students, in-depth interviews, and analysis of Fiqh textbook documentation. Data were analyzed using a theoretical framework that combines Ahmed's Islamic feminism, Ainscow's inclusive education, and Crenshaw's intersectionality. Key findings reveal a gap between theoretical acceptance of menstrual rules (91.1%) and their practical implementation (82.1%), as well as the lack of representation of feminist and intersectional perspectives in the official curriculum. This study contributes to the development of a new analytical framework that integrates three theoretical approaches to understand the complexity of teaching women's fiqh. Limitations of the study include a limited sample size and a narrow focus on the issue of menstruation. Further research is recommended to expand the geographic scope, explore other aspects of women's fiqh, and conduct longitudinal studies to understand the long-term impact of women's understanding of fiqh on students' religious and social practices.

Abstract

The purpose of this qualitative research with a philosophical normative approach is to identify the paradigm of mass communication function in the construction of the 2004 fatwa of the Indonesian Ulema Council on Terrorism. The research data was obtained through documentation techniques. Meanwhile, the analysis approach uses content analysis, and the data is analyzed through reduction, presentation and verification. This study concludes that there is a paradigm of mass communication functions in the construction of the fatwa on terrorism, including the function of social supervision in formal forms such as government regulations and informal laws such as social norms and values held by the community. Then, the function of social transmission in the positive aspects of attitudes, values, beliefs, and habits taught to the public on the importance of human values, and internalized through strict laws against perpetrators of terrorism.  This research confirms that preventive efforts against terrorism can be internalized through religious literacy as a social communication tool.
