Abstract

This study examines the role of judicial review (Peninjauan Kembali/PK) as a corrective mechanism for judicial error in narcotics cases, focusing on Supreme Court Decision Number 2473 PK/Pid.Sus/2025. Using normative legal research and case analysis, the study finds that the Supreme Court identified errors in the judex facti’s assessment of legal facts and sentencing proportionality, particularly regarding the quantity of evidence and the offender’s role. Consequently, the sentence was reduced from 13 years to 9 years of imprisonment. This decision reflects the application of substantive justice by prioritizing proportionality and material truth while maintaining legal certainty.

Abstract

This study examines the challenges of proving cases of sexual violence against children, particularly molestation and intercourse, within the Indonesian criminal justice system. Despite being serious crimes with significant impacts on victims and society, many cases result in acquittals not because the crime did not occur, but due to the failure to meet formal evidentiary requirements under the Criminal Procedure Code (KUHAP). This research uses a normative juridical approach with a qualitative method to analyze the evidentiary system and its implications for judicial decision-making. The findings reveal that the rigid application of the minimum two pieces of evidence rule and the unus testis nullus testis doctrine creates major obstacles, especially when the child victim is the only witness. Testimonies given without oath are often reduced to circumstantial evidence, making it difficult for prosecutors to meet the burden of proof. As a result, judges, bound by legal positivism and Article 183 of the KUHAP, tend to issue acquittals. This situation indicates that such decisions reflect systemic weaknesses in procedural law rather than the absence of material truth, highlighting the need for reform in evidentiary rules to better accommodate the nature of child sexual violence cases.

Abstract

The management of crude oil in Indonesia is vulnerable to corruption involving abuse of authority by public officials and business actors. The case of Riza Chalid and his son, Kerry Adrianto Riza, reflects the serious impact of abuse of power in the energy sector. This study analyzes the application of Article 3 of Law No. 31 of 1999 jo. Law No. 20 of 2001 in combating corruption in the energy sector. Using a qualitative approach and normative juridical method, the study shows that the implementation of Article 3 can deter corruption perpetrators and promote more transparent and accountable governance. Corruption in this sector harms state finances and worsens public welfare, particularly through rising fuel prices

Abstract

This study examines the liability of individuals in corporate tax crimes under Indonesian tax criminal law. The focus of the study is directed at the position of individuals, whether as taxpayers, corporate managers, authorized representatives, or parties who in fact possess the authority to determine corporate policies leading to tax crimes. The problems addressed in this research are how the form of criminal liability of individuals in tax crimes is regulated and how personal liability applies to individuals who are part of a limited liability company when tax violations occur. This research employs a normative legal method using statutory and conceptual approaches through an analysis of the Law on General Provisions and Tax Procedures, the Law on Harmonization of Tax Regulations, the Limited Liability Company Law, the New Criminal Code, and Supreme Court Circular Letter Number 4 of 2021. The findings show that criminal liability in the field of taxation is not only imposed on corporations, but may also be imposed on individuals who commit, order, participate in, or actually control tax criminal acts for the benefit of a corporation. Therefore, harmonization between tax law, criminal law, and company law is necessary in order to ensure legal certainty, justice, and effective tax law enforcement.

Abstract

This study examines the transformation of labor law protection in Indonesia by focusing on the level of workers’ legal awareness regarding their rights within industrial relations. The reform of labor regulations through Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja and its subsequent reinforcement in Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Perppu Cipta Kerja has significantly altered the structure and orientation of the national labor system. This research employs a descriptive qualitative approach through a literature study, analyzing statutory regulations, academic literature, and empirical phenomena related to labor practices. The findings reveal that although regulatory reforms aim to enhance investment and economic growth, they also generate complex implications for labor protection. These include the weakening of job security, expansion of flexible work arrangements such as outsourcing, and persistent imbalance in bargaining power between workers and employers. Furthermore, the study highlights that the effectiveness of legal protection is not solely determined by the existence of regulations, but is also influenced by the level of legal awareness among workers, accessibility to legal remedies, and the consistency of law enforcement. The low level of legal literacy among workers contributes to their vulnerability in facing unfair labor practices. Therefore, the study concludes that labor law reform must be accompanied by strengthening institutional oversight, improving legal education, and fostering a legal culture that supports social justice. A balanced approach between economic development and labor protection is essential to ensure sustainable and equitable industrial relations in Indonesia.
