Abstract

This research is motivated by the widespread formation of Regional Regulations and Regional Head Regulations without harmonization by the Regional Offices of the Ministry of Law (Kanwil Kemenkum). Such practices risk creating legal disharmony, overlapping regulations, and violations of the hierarchy of laws as stipulated in Law No. 12 of 2011 on the Formation of Legislation and its amendments. The study aims to analyze the legal status of unharmonized regional regulations, the juridical implications of neglecting harmonization, and the institutional role of the Ministry’s Regional Office in preventing regulatory conflicts. A normative juridical approach was employed, combining statutory, conceptual, and case analyses based on primary and secondary legal materials as well as audit findings from the Ministry’s Inspectorate General (2024–2025). The research confirms that Regional Regulations (Perda) and Regional Head Regulations (Perkada) that have not undergone the harmonization phase retain administrative validity, but contain formal legal flaws. This not only increases the vulnerability to vertical norm conflicts but also degrades the quality of legislation at the regional level. Therefore, the harmonization process is a crucial instrument in protecting the integrity of the national legal system while ensuring coherent synchronization between central and regional policies.

Abstract

This study aims to analyze the principle of proof and the position of evidentiary instruments in the examination of Suspension of Debt Payment Obligations (PKPU) cases, as well as to examine the judges’ considerations in assessing the validity and evidentiary strength of photocopied documents as evidence in Decision Number 2/Pdt.Sus-PKPU/2023/PN Niaga Jkt.Pst. The research employs a normative juridical method using statutory and case law approaches through the examination of legislation, legal doctrines, and relevant court decisions. The results indicate that evidentiary proceedings in PKPU cases are based on the principle of simple proof, requiring the applicant to demonstrate, in a concise manner, the existence of a due and payable debt and the presence of more than one creditor; however, the evidentiary process must still comply with civil procedural law requirements regarding the validity of evidence, meaning that documentary evidence should possess valid evidentiary force, particularly when accompanied by original documents. In the analyzed decision, the panel of judges held that all evidence submitted by the applicant consisted solely of photocopied documents without the presentation of the originals, thereby lacking sufficient evidentiary strength to legally establish the existence of debt, resulting in the rejection of the PKPU petition. The study concludes that although the principle of simple proof applies, the formal validity of evidence remains a decisive factor in PKPU proceedings, thus requiring greater diligence from litigants in preparing evidence and the strengthening of regulations concerning the recognition of copied or electronic documents to ensure legal certainty in commercial court practice.

Abstract

Indonesia is the largest archipelagic state in the world, consisting of approximately 17,508 islands and possessing the second-longest coastline globally after Canada. The intensity of maritime traffic in Indonesian waters, particularly along the Indonesian Archipelagic Sea Lanes (ALKI), has given rise to various issues, one of which is marine pollution. Article 192 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) stipulates that every state has the obligation to protect and preserve the marine environment, emphasizing that marine ecosystems must be safeguarded and sustained by all nations. This study aims to analyze the applicability of international maritime law instruments in addressing marine pollution and to examine the accountability of foreign states for marine pollution occurring within the Indonesian Archipelagic Sea Lanes (ALKI), particularly in the Riau Islands and the Java Sea, which form part of ALKI I. The research employs a normative juridical method. The data sources are supported by both primary and secondary materials, referring to statutory regulations and relevant literature concerning the control of marine pollution in the Indonesian Archipelagic Sea Lane I (ALKI I). Foreign vessels navigating through ALKI I are required to comply with Indonesian laws and regulations. The measures undertaken by Indonesia to address violations include the application of the principle of strict liability, holding foreign vessels absolutely responsible for acts of ocean dumping in Indonesian waters to prevent the spread of adverse environmental impacts.
