Bilancia : Jurnal Studi Ilmu Syariah dan Hukum
Bilancia is an academic peer-reviewed journal that publishes the current articles and results of research of scholars and students who are deeply concerned with Shariah and Law issues. Bilancia is regularly published twice a year (June and December). The study focuses on the latest discourse in Islamic Law, Islamic Criminal Law, Criminal Law, Civil Law, Civil Court, Islamic Economic Law, Islamic Politic Law, Humanities Law and International Law in Islam, Humanity law and International Law, Sociological Law, Customary Law, Interpretation of Legal Verses and Legal Hadith also Legal Statue, and shariah opinion in astronomy. This is an Open-Access Journal, meaning all content is freely available without charge to users or/institutions. <![CDATA[Mediation is one of the means and efforts to resolve disputes that occur between husband and wife in a peaceful manner that is appropriate, effective, and can open wider access to the parties to obtain a satisfactory and just settlement. In response, the Supreme Court release the regulation of supreme court governing mediation procedure in proceedings in court. Beginning with the SEMA (Surat Edaran Mahkamah Agung) or Supreme Court Circular Number 1 year 2002 on the Empowerment of the First Tribunal Applying the Peace Institution, instructed all the judges who tried the case, in order to sincerely seek peace among the litigants. However, because some basic matters have not been explicitly stipulated in the SEMA, the Supreme Court issued Perma (Regulation of the Supreme Court) RI Number 2 Year 2003 on Mediation Procedure in Court, which was then revised and refined by Perma Number 1 Year 2008, which further reinforce the obligation to pursue mediation procedures related to litigation in court. And its peak on February 4, 2016 Supreme Court renewed by ratifying Perma Number 1 Year 2016 on Mediation Procedure. This paper discusses about how the implementation of this Perma, what are the supporting and inhibiting factors in the success of mediation and the extent of its effectiveness in the settlement of divorce cases in the Religious Court of Palu.]]>

<![CDATA[This paper discusses "the strategy of cooperative service, UMKM, and labor force of Palu in empowering micro business in market of Inpres Manonda Palu". The purpose of this paper is to find out the strategic steps of Cooperative service and UMKM of Palu City in empowering micro business in market of Inpres Manonda Palu, The results of this study show the general picture of micro business in market of Inpres Manonda Palu is the number of business actors as many as 1040 traders are recorded on Market Office with the largest number of traders is mixture of merchants / agricultural products totally 205 trades. All the needs of society generally can be fulfilled in market of Inpres Manonda Palu. The dominant tribe is the Buginese tribe. The strategic steps of cooperative service, UMKM, and labor force of Palu City have been implemented through the planning, implementation and evaluation process based on the 5th Annual Plan. The steps that have been implemented are data collection, product marketing through e-commerce, socialization, formation of cooperatives, training, construction of partnership network.]]>

<![CDATA[This research discusses financing risk management in sharia financing institutions. Financing risk is a risky risk and can lead to systemic risk one of which occurred the global financial crisis. Sharia financing institutions are identical with those risks, so that the application of proactive risk management should be done so as not to be affected. The purpose of this research is to know the risk management of financing at PT XYZ, which in this research is qualitative decriptive. Data analysis used is data reduction, data presentation, verification andconclusion. The results of this study indicate that the implementation of risk management of financing at PT XYZ is categorized not good enough. this means that to create financing risk management it is necessary to apply a reliable and consistent risk management system. Seeing the results of the research that during the period 2014 to 2016 has increased the value of NPF, which requires companies to act quickly to mitigate the value of NPF ratio]]>

<![CDATA[Debt is permissible in Islam, but debt can bring a person to heaven because of his intention to please help his fellow human beings (hablun minannaas), debt can also bring a person into the fire of hell when not managed properly. So the debt becomes the last alternative is not the first done if the household finances are not stable. Financial management with the corridor of the fulfillment of the benefit can reduce the risk of household financial instability, by making family financial planning aimed at achieving falah (prosperous world and the hereafter), avoiding maisir ways, gharar, riba and unjust both in collecting income and in spend it, give priority to sadaqah even though rizki is narrow, and away from nature wasteful.]]>

<![CDATA[Every regency government has issued Regulation on the allocation of village funds (ADD) ADD funding as a reference. Granting rights ADD is a form of fulfillment of village autonomy within the framework of the implementation of the village. The implementation on the ground quite well, begin from planning phase has been implemented well until completion of the ADD planning in village regulations. Furthermore, the implementation phase is also running smoothly and fairly good. But there are still a few obstacles which funds ADD does not coincide with the time the cause of a delay so that the activity is late to be implemented as well as the distribution system funds change often.]]>

<![CDATA[The imposition of fatwa as a source of law is varies in every Muslim-majority country. Some consider it as a source of legal hierarchy and government structure. Some of which place it outside the system. The difference also affects the independence of the fatwa as well as the issuing institution. In Brunei Darussalam, fatwa has a very important position because it includes in the legal structure of the country. In Malaysia, its position is very importan too because the position of mufti level under the sultan in religious affairs. In Indonesia itself, fatwas can only bind when absorbed into the legal system prevailing in Indonesia. Different Position fatwa is also affect the regulation of Islamic banking. This study compiles the imposition of fatwas against shariah banking regulations in Indonesia and Malaysia. Qualitative method used in preparing this research. The data were collected from related literature. The results of this study indicate that the position of fatwa in sharia banking regulation in both countries is very significant. In Malaysia, the Fatwa is issued by the Shariah Advisory Council (SAC) directly under the auspices of Bank Negara Malaysia and is binding upon the approval of the Majlis Raja-raja and issued in the form of a gazette. In Indonesia, the Indonesian Council of Ulama issued Fatwas through the badan Pengawas Syariah (DNS) which was then absorbed into Bank Indonesia Regulation (PBI)]]>

<![CDATA[Kafa’ah or kufu’ in marriage became a polemic among the laity. This study aims to find out how marriage sekufu in Islamic perspective in the area of Napradu Pattani Province, Southern Thailand. The data were obtained by interviewing Imam - Imam, bilal or preacher mosque in Napradu. From the analysis of interview results, found 3 main ones in the concept of kafa'ah, they are religion, degree / nasab, and work / profession. The balance for starting a family should be the match between couples. It became a perception for the people of Napradu to reach a harmonious family. Forms of marriage implementation sekufu in Napradu region must follow syafi'i Mazhab. Therefore there are several indicators that must be met, namely; a) the male partner asks the parent to seek a spouse or ask to see the woman he wants, intent to align the parents' appetite with the child; b) a bridgehead between the prospective husband's family and the prospective wife's family on the matter of marriage; c) a suitable and equivalent female candidate to a potential male partner.]]>
