Abstract

This research analyzes the legal impact on skincare brand owners who violate BPOM regulations. The focus of the research is on legal sanctions applied to skincare brand owners who do not meet product safety and quality standards. The results show that skincare brand owners who violate BPOM regulations can be subject to administrative, criminal, and civil sanctions. This research aims to provide a better understanding of the legal consequences for skincare brand owners who violate BPOM regulations. In addition, this research uses a normative juridical approach by examining applicable laws and regulations, such as Law Number 36 of 2009 concerning Health, Law Number 8 of 1999 concerning Consumer Protection, and BPOM regulations related to the circulation of cosmetic products. Secondary data from court decisions, regulations, and legal literature are also analyzed to strengthen the study. With this approach, the research is able to systematically map the forms of legal liability that must be faced by skincare brand owners who violate the provisions. The findings of this study emphasize the importance of skincare manufacturers' compliance with BPOM regulations as a form of protection for consumers and public health. Violations of regulations not only have implications for consumer losses, but can also damage brand reputation and cause financial losses due to lawsuits. Therefore

Abstract

This study examines the role of legal protection of copyright in ensuring legal certainty for book printing businesses in Indonesia. Although Law No. 28 of 2014 on copyright provides a fairly clear legal framework, its implementation in practice still faces various obstacles, such as low understanding among business actors, weak socialization, and complicated administrative procedures. Through a qualitative approach using normative legal and sociological legal methods, this study finds that copyright protection has not yet fully provided a sense of security and legal certainty for the printing industry, particularly for small and medium- sized businesses. Therefore, there is a need to strengthen legal education, simplify legalization processes, and develop inter-institutional strategies for the legitimate, sustainable, and competitive development of the industry in the era of an intellectual property-based economy.

Abstract

This study discusses the importance of halal certification in the food industry in Indonesia, particularly for Micro, Small, and Medium Enterprises (MSMEs). Although halal certification has become an urgent need for consumers, many businesses face challenges such as high costs, lack of understanding of regulations, and procedural complexity. Clear and transparent information about halal products is essential to help consumers make informed decisions. Therefore, more intensive educational efforts, collaboration among stakeholders, and the digitization of certification processes are needed to improve accessibility and understanding of halal products, thereby promoting the growth of the food industry in accordance with halal principles.

Abstract

Frozen food has become a popular food alternative among Indonesian society due to its practicality and long shelf life. This study aims to analyze the legal and economic impacts of the frozen food business on Indonesian society, particularly in terms of regulatory compliance and the economic opportunities and challenges it presents. This research employs a qualitative method with a descriptive-explorative approach, using secondary data obtained from academic literature, relevant legislation, and previous studies. Legally, the findings indicate that many business actors fail to meet licensing requirements such as distribution permits from BPOM and halal certification, which compromises consumer safety. Economically, the frozen food industry offers new entrepreneurship opportunities, increases community income, and provides an economic solution during the pandemic. The expected outcome of this research is to enhance understanding of the importance of legal compliance in the processed food industry and to encourage the strengthening of the community’s economy through a legally compliant and sustainable frozen food sector.

Abstract

This research aims to analyze how technology can enhance the competitiveness of entrepreneurs, particularly in the Micro, Small, and Medium Enterprises (MSMEs) sector in the digital era. Using the case study method and a qualitative approach, this research examines various relevant literature, documents, and secondary data without conducting direct field observations. The analysis results show that digital technology plays a very important role as the main driver of innovation, improving operational efficiency, and expanding market access. In addition, legal regulations such as consumer protection, intellectual property rights, and data security become factors that support the creation of professional and sustainable businesses. Innovation, business adaptation, and the use of data and analytics have proven to enhance the ability of SMEs to face market changes and build stronger relationships with customers. Collaboration between technology, sustainable innovation, customer focus, and data-driven decision-making is the key to creating competitive entrepreneurship amidst the rapidly changing times.

Abstract

The rapid development of e-commerce in Indonesia, particularly through platforms like TikTok Shop, has brought various conveniences to buying and selling transactions, especially for Micro, Small, and Medium Enterprises (MSMEs). However, this progress has also led to various legal issues, such as a lack of oversight, consumer rights violations, and unhealthy business competition practices. The government responded by prohibiting direct transactions on social media platforms like TikTok Shop and mandating a separation between social media and e-commerce functions. This research employs a normative juridical method with a statutory and analytical approach to examine e-commerce legal regulations, the impact of the prohibition, and the adjustments made by TikTok Shop. Data was obtained from primary, secondary, and tertiary legal materials. The research findings indicate that the prohibition of direct transactions on TikTok Shop has had a significant impact on MSMEs and consumer spending patterns. Although this regulation strengthens consumer protection and legal order in digital transactions, businesses face challenges in adapting to the changes. TikTok Shop itself has made various adjustments, such as seller verification and compliance education regarding the regulations. The government continues to conduct socialization and provide assistance to MSMEs in navigating regulatory changes. Furthermore, TikTok Shop and other platforms need to build more transparent and legally compliant systems to support a healthy, fair, and sustainable e-commerce ecosystem.

Abstract

This study discusses the development of palm sugar MSMEs in Sikeben Village through the use of digital technology. Palm sugar MSMEs play an important role in the local economy, but traditional marketing methods limit their market reach. This study used observation, interviews, and project development methods during the implementation of the 2025 Community Service Program (KKN) by students of the State Islamic University of North Sumatra. The results show that the palm sugar production process is still carried out traditionally, but business actors face obstacles in terms of digital skills and a lack of marketing innovation. As a solution, an integrated sales website with social media was designed to facilitate ordering and expand the market. In conclusion, digital transformation can be an effective strategy to increase the competitiveness of SMEs, but ongoing assistance and training are needed so that this program provides long-term benefits for the village economy..

Abstract

The rapid growth of e-commerce platforms such as TikTok Shop and Shopee has created significant opportunities for entrepreneurs to expand their market reach and boost sales. However, in the midst of intense competition, a registered trademark becomes a critical factor in distinguishing one seller from another. The core issue addressed in this study is the lack of awareness among many sellers about the importance of trademark registration and protection, which can lead to brand disputes or identity theft. This study aims to analyze the strategic role of trademarks in building consumer trust and increasing product value on these two digital platforms. A descriptive qualitative approach was employed, using case studies of 10 active sellers on TikTok Shop and Shopee. Data were collected through in-depth interviews, observation of branding activities, and documentation of shop profiles. The findings indicate that sellers with registered trademarks and consistent branding strategies are more likely to attract consumers, gain customer loyalty, and enjoy legal protection for their products. In contrast, sellers without trademarks often struggle to build market trust and are more vulnerable to product imitation. In conclusion, a trademark serves not only as a business identity but also as a strategic asset that significantly impacts the sustainability and growth of online sellers in the digital era. Therefore, it is crucial for online entrepreneurs to understand and apply trademark protection from the outset of their business journey.

Abstract

The rapid advancement of digital technology has encouraged Micro, Small and Medium Enterprises (MSMEs) to shift to online-based commerce. This transformation offers greater market access and operational convenience, but also brings legal risks such as online fraud, contract disputes, and misuse of personal data. This research aims to examine the legal protections available to MSMEs in online transactions under Indonesian law and to identify the challenges faced in its implementation. This research uses a normative juridical method by analyzing relevant laws and legal literature. The findings show that legal protection for MSMEs is regulated in several legal frameworks, including the Electronic Information and Transaction Law (ITE Law), Consumer Protection Law, and regulations regarding MSMEs. However, its implementation is still hampered by several issues such as low legal literacy among MSME actors, limited access to legal aid, and weak supervision of digital platforms. Therefore, it is important to improve legal education, develop a more responsive legal framework, and encourage collaboration among stakeholders to build a safe and fair digital transaction ecosystem for MSMEs

Abstract

In an era of increasingly tight market competition, local products face major challenges to be able to compete at the national level. Branding strategy is an important key in increasing competitiveness, expanding market reach, and building consumer trust. However, the success of this strategy cannot be separated from legal protection, especially in the context of the Consumer Protection and Intellectual Property Rights (IPR) Law. This article aims to analyze how local business actors can design an effective branding strategy by utilizing the legal framework as a basis for protecting and strengthening brand identity. The approach used is qualitative descriptive with a literature study of applicable regulations and case study analysis. The results of the study show that understanding and implementing legal aspects such as trademark registration, industrial design protection, and transparency of product information are determining factors for branding success. The synergy between marketing strategy and legal protection not only maintains product originality, but also increases consumer trust and the competitiveness of local products in the national market.
