Abstract

Abstract

In classical fiqh, murâbahah is a simple sale and purchase contract that requires the seller to tell the truth about the cost and profit. This concept was later transformed in Islamic banking into murâbahah li al-âmir bi al-syira’, which introduced a credit sales system as a form of financing. This study reveals some contemporary world fatwas regarding the murâbahah li al-âmir bi al-syirâ’ contract with a qualitative-descriptive approach through library research. The results of the study show that there is ikhtilaf among contemporary scholars regarding the permissibility of the practice of this contract, with some critics calling the dominance of Murâbahah in Islamic banking products a ‘deviation from Islamic principles’ and encouraging Islamic banking to switch to a financing model based on profit loss sharing. However, some scholars in Islamic countries have issued fatwas accepting this contract with some stipulations that should not be violated by Islamic banks, otherwise, the validity of this contract should be doubted.

Abstract

The rapid advancement of artificial intelligence (AI) has transformed various sectors, including education. This research explores the implications of AI chatbot utilization in fiqh learning at Islamic universities, analyzing its benefits, challenges, and ethical considerations. Employing a qualitative descriptive approach, data were collected through observations and closed-ended questionnaires distributed to lecturers and students from three Islamic universities: Sekolah Tinggi Dirasat Islamiyah Imam Syafi’i Jember, Safwa University Egypt, and International Quran University Gambia. The findings indicate that AI chatbots, particularly ChatGPT, are widely adopted among students (59%), while lecturers' usage remains relatively low (14%). This research reveals that AI chatbots enhance accessibility, engagement, and understanding of fiqh concepts, with 74% of respondents considering the responses accurate. However, concerns arise regarding misinformation, ethical accountability, and the risk of diminishing human interaction in religious learning. Despite their advantages, AI chatbots require continuous improvement to align with Islamic teachings and maintain scholarly rigor. This research recommends a balanced integration of AI chatbot technology with traditional fiqh instruction to ensure the depth and accuracy of religious education while addressing ethical and pedagogical challenges.

Abstract

The Ministers of Religious Affairs of Brunei Darussalam, Indonesia, Malaysia, and Singapore (MABIMS) have reached a consensus to modify the existing criteria (criteria [2, 3, 8]) by employing the recently developed MABIMS criteria (criteria [3° - 6,4°]) as the foundation for determining the onset of the Hijri month. Following its implementation in 2022, the Neo MABIMS criteria have encountered numerous challenges and intricate implementation challenges. The application of these criteria has been met with both advantages and disadvantages. This study aims to analyze the application of the Neo MABIMS criteria by the Ministry of Religious Affairs in determining the beginning of the Hijri month in Indonesia. The study will assess the effectiveness of the policy in harmonizing differences and addressing implementation challenges. This research explores the dynamics of applying the new criteria, including technical and social aspects that affect the implementation process in the field. The research method employed is qualitative-descriptive with a documentary research approach. The analysis technique entailed three stages: data presentation, data condensation, and interpretation. The findings indicate that the implementation of these criteria has been hindered by persistent differences in determining the start of the Hijri month in Indonesia. The utilization of the Neo MABIMS criteria is characterized by inconsistency, which is a substantial impediment to this process. This finding underscores the necessity for a comprehensive evaluation of the consistency and application of the Neo MABIMS criteria, particularly in addressing rukyat reports that deviate from the established astronomical parameters.

Abstract

This research aimed to explore the meaning of hijab from traditional and modern perspectives, as well as analyze the controversy related to its use by transgender individuals in the context of religion and gender identity. This research employed a qualitative approach based on literature review and case study, as well as Durkheim's sacredness theory and queer theory as analytical frameworks. The results showed that the hijab undergoes a transformation of meaning from a mere religious obligation to a more inclusive social symbol, triggering debates between conservative and more inclusive groups in Muslim society. The case of Isa Zega, a transgender woman who wore the hijab during Umrah, became a critical point in the discussion about the limits of the sacredness of the hijab and individual rights in spiritual expression. While some consider the use of hijab by transgender people as a violation of religious norms, others see it as a form of spirituality that is not limited to gender categories. This debate reflects the tension between established religious understandings and the dynamics of gender identity in modern society. Therefore, a more open dialogue is needed between scholars, academics, and the wider community to find a balance between Islamic teachings and inclusivity values, so that the hijab remains a meaningful and relevant symbol in various social contexts.

Abstract

The article aims to emphasize the communication approach of the Indonesian halal certification authority on Instagram in explaining halal policy changes, including the halal logo change and the halal certification authority. The article’s method is qualitative, with a content analysis approach. Data was collected by observing the official Instagram accounts of the Indonesian Ministry of Religious Affairs and the Halal Product Guarantee Agency (BPJPH). The posts observed were from March to December 2022. The data obtained were then analyzed using the Miles and Huberman interactive qualitative analysis model: data display, data reduction, and conclusion. The study found that public communication implemented by the Ministry of Religious Affairs and the Halal Product Guarantee Agency (BPJPH) on Instagram is aimed at convincing the public of the arguments for changing the halal logo and the authority of halal certification in Indonesia. The design and rhetoric of posts are aimed at building narratives and arguments that the new halal logo is more representative of Indonesian identity than the previous logo. The narration is also built to convince the public that the change in the authority to issue halal certificates to the Halal Product Guarantee Agency (BPJPH) is not to eliminate the role of the Indonesian Ulama Council but to make its role and function more explicit in halal certification. The study also found that the Halal Product Guarantee Agency (BPJPH) posted positive testimonials from influential public figures exposed to changes in logos and halal certification policies in Indonesia. These testimonials are used to legitimize arguments and narrations to gain public acceptance, approval, and trust.
