Abstract

The controversy surrounding the handling of the One Piece flag by government officials has sparked debate about the limits of state authority in regulating citizens' symbolic expression in public spaces. The regulation of the flag, which originates from popular culture, under the pretext of maintaining public order and security is considered to have the potential to limit freedom of expression. This article aims to analyze the handling of the One Piece flag by government officials from the perspective of Administrative Law (HAN). This research uses a normative legal research method with a statutory and conceptual approach. The results of the study indicate that restrictions on symbolic expression can only be justified if they are based on law, have a legitimate purpose, and are implemented proportionally. Thus, the actions of government officials must remain within the framework of human rights protection and the principles of the rule of law.

Abstract

Marriage should serve as the foundation for creating a prosperous and harmonious family. However, social realities in Indonesia indicate that many marriages occur without sufficient economic preparedness. This condition often leads to social problems such as domestic conflict, violence, divorce, and the violation of children's rights. This study aims to analyze the impact of inadequate economic conditions on achieving the objectives of marriage as stipulated in Law Number 1 of 1974 in conjunction with Law Number 16 of 2019, as well as to examine the urgency of prohibiting marriage under economically unfit conditions as a means of protecting children’s rights and family welfare. The research employs a normative juridical method with statutory and conceptual approaches. The findings show that economic readiness is a fundamental factor in achieving a prosperous marriage. Therefore, it is necessary to reformulate marriage policies by including economic preparedness as a substantive requirement and strengthening the marriage dispensation mechanism to consider financial conditions and children's welfare. Consequently, such policy reforms are expected to establish a marriage system that is not only legally valid but also just and dignified.

Abstract

Generation Z currently dominates the voter composition within Indonesia's demographic structure, making their role a primary determinant in realizing the vision of an Advanced and Sovereign Indonesia 2045. However, the sheer number of young voters is not proportional to the depth of their political literacy. This paper aims to analyze the urgency of increasing Generation Z's understanding of active participation in general elections. The main issues addressed include high levels of political apathy, the influence of echo chamber phenomena on social media, and the threats of the post-truth era and money politics that can distort rational choices. Through a literature review and analysis of contemporary situations, it is found that the active participation of Generation Z is not merely the exercise of voting rights, but a strategic investment to safeguard national sovereignty and ensure the stability of development policies. A creative, adaptive, and digital-based transformation of political education is required to bridge the gap between digital native characteristics and civic awareness. In conclusion, strengthening political understanding among Generation Z is the primary key to producing leadership with strong legitimacy to lead Indonesia in the global arena.

Abstract

Bullying in high schools is a problem that can negatively impact students' social, emotional, and psychological development. One effort to prevent bullying is through socialization of the role of the principle of justice in understanding students' rights and obligations. This activity aims to increase students' awareness and understanding of the importance of implementing the principle of justice in school life to create a safe, comfortable, and respectful environment at State Senior High School 6,  Padang City. The methods used in the socialization activity include delivering material, interactive discussions, and case studies related to bullying. The results of the activity show an increase in students' understanding of rights and obligations and the formation of attitudes of justice, empathy, and social responsibility. Thus, the socialization of the principle of justice plays an important role in preventing bullying and building a positive school culture at State Senior High School 6, Padang City.

Abstract

The presence of Street Vendors (PKL) on Permindo Street, Padang City, often creates a conflict between economic interest and the function of public space. Socialization indicates that many vendors still utilize sidewalks and roadsides in a way that obstructs pedestrian access and causes traffic congestion, violating the Regional  Regulation (perda) of Padang City Number 11 of 2005 concerning Public Order. As a preventive and persuasive effort, a socialization activity was conducted for PKL in the Permindo area through direct dialogue and educational dissemination regarding the importance of public space functions. This activity aims to analyze the legal awareness of vendors and the effectiveness of socialization in realizing an orderly urban environment. The results show that while vendors understand the regulations, economic factors remain the primary challenge. Consistent socialization and the provision of relocation solutions are expected to be strategic steps in maintaining public order without neglecting the community’s economy.

Abstract

Drug abuse by addicts is a complex legal and social issue because it relates not only to criminal aspects but also to health and human rights. However, in Indonesian law enforcement practices, drug addicts are still often positioned as criminals sentenced to imprisonment, rather than as victims requiring rehabilitation. This situation raises legal issues regarding the effectiveness of implementing the rehabilitation model as mandated by laws and regulations. This study aims to analyze the application of the rehabilitation model for drug addicts and assess its suitability for the purposes of punishment and human rights protection. The research method used is normative legal research with a legislative and conceptual approach, through a review of primary, secondary, and tertiary legal materials. The results indicate that rehabilitation has been normatively regulated as the primary mechanism for handling drug addicts, but its implementation still faces obstacles, such as differing interpretations by law enforcement officials and limited rehabilitation facilities. Therefore, policy strengthening and consistent law enforcement are needed so that the rehabilitation model can be optimally implemented.

Abstract

This study examines the impact of drug rehabilitation on reducing recidivism rates among drug users in Indonesia using a normative-juridical approach, enriched by empirical methods through a case study of the National Narcotics Agency (BNN) rehabilitation institution. The legal basis includes Law Number 35 of 2009 concerning Narcotics and Government Regulation Number 17 of 2021 concerning the Handling of Drug Addict Rehabilitation, which shifts the paradigm from a retributive to a restorative one. National Narcotics Agency data from 2020 to 2025 shows that conventional recidivism reaches 60 to 70 percent, but decreases to 30 to 40 percent in integrated rehabilitation programs such as the National Narcotics Agency Rehabilitation House and the Integrated Empowerment of Disabled Citizens Program. Determining factors for success include service accessibility, quality psychosocial therapy, post-rehabilitation monitoring, and cross-agency coordination. The findings confirm that rehabilitation is effective in reducing recidivism if supported by strong regulations and adequate funding. Recommendations include mandatory rehabilitation for non-drug users and reform of the 2023 Criminal Code to integrate restorative justice. This study contributes to the optimization of national anti-narcotics policy

Abstract

The North Natuna Sea is Indonesia's Exclusive Economic Zone located in the Riau Islands Province, namely Natuna Regency, the emergence of territorial disputes in the North Natuna Sea due to China's claim to the nine-dash line or nine dashed lines. China's violation attitude is part of the country's strategic culture because it is the main factor that causes China's aggressive actions. Where the Republic of Indonesia has sovereign rights to conduct exploration and exploitation, management and conservation of living and non-living natural resources from the seabed and the land beneath it and the water above it and other activities.

Abstract

The development of aerospace technology has advanced rapidly over the past decades, resulting in significant changes in the utilization of airspace and outer space. These advancements include innovations such as unmanned aerial vehicles, communication satellites, and flight technologies capable of operating in the boundary area between the atmosphere and outer space. Nevertheless, these technological developments give rise to complex legal challenges due to fundamental differences between the air law regime, which recognizes full state sovereignty over national airspace, and the space law regime, which is based on the principles of freedom and the prohibition of national appropriation. This study employs a normative legal research method using statutory and conceptual approaches to examine the legal implications of aerospace technological developments on both legal regimes. The findings indicate that the rapid advancement of aerospace technology requires the harmonization and adaptation of existing legal frameworks to ensure their continued relevance in protecting state sovereignty and national interests in the modern era.

Abstract

Cyberbullying is a form of digital bullying that is increasingly prevalent in the information technology era, involving actions such as insults, threats, and defamation through electronic media. A legal analysis of this phenomenon in the Electronic Information and Transactions Law (ITE Law) Number 19 of 2016 in conjunction with Law Number 1 of 2024 shows the main provisions in Article 27 paragraph (3), Article 45 paragraphs (3) and (4), and Article 45B which criminalizes the electronic distribution of content containing insults, threats, or persecution. Perpetrators can be subject to imprisonment of up to 6 years and/or a fine of IDR 1 billion, with a normative legal approach that integrates the Criminal Code as a complement. However, implementation challenges include the weakness of digital evidence, freedom of expression, and the need for restorative justice for child victims. This study recommends a revision of the ITE Law to clarify the definition of cyberbullying and victim protection mechanisms, for the sake of effective law enforcement in Indonesia.
