Abstract

The problem studied is the implementation of the legislative function of DPRD in the formation of Central Sulawesi Provincial Regulations 2019-2023 and the role of the Central Sulawesi Provincial DPRD in forming Regional Regulations that articulate public interests. Method the research used was normative legal research which was library materials or secondary data applied Conceptual Approach and Legislative Approach (Statute Approach), and then described in descriptive terms to obtain a picture that can be understood clearly and directed to answer problems studied. The research results reveals that the implementation of legislative function of the Regional People's Representative Council in preparation of Central Sulawesi Province Regional Regulations for 2019-2023 can be seen in every stage of the formation of Regional Regulations, namely stages of planning, preparation, discussion, determination and promulgation in 2019-2023, DPRD of the Central Sulawesi Province adopted 39 regional regulations consisting of 15 DPRD initiatives and 24 regional government initiatives. Role of the Board Regional People's Representatives in forming regional regulations articulating public interests is carried out through public participation by involving the community in the drafting stage of regional regulations, involving the community in the discussion of stages of draft regional regulations and involving the community in the implementation stage of regional regulations.

Abstract

​This research aims to determine and analyze the government's efforts to fulfill children's rights to basic immunization. Conceptually, human rights contained in Pancasila accommodate aspects of humans as individual and social creatures. Health Law Number 17 of 2023 article 44 paragraph 2 states that every baby and child have the right to receive immunization to provide protection. Immunization is carried out to prevent diseases that can be prevented by immunization. This research uses empirical legal research with qualitative analysis methods. The research results show that the government's first efforts are to provide free vaccinations, increase vaccine availability and immunization coverage, seek to add 3 types of vaccines and the government is also actively conducting campaigns and training to increase public awareness. In Palu City, if the targets set are not met, the person in charge of the program will take action by carrying out a sweep to ensure that all toddlers can get their right to complete basic immunization. Second, the implementation of immunization has been carried out in accordance with operational standards involving competent workforce and promotion in the form of counseling has been carried out optimally so that the majority of the community understands the importance of basic immunization for children. However, there are still obstacles regarding the mindset of people who refuse immunization based on an understanding of the long-term function of immunization for children.

Abstract

The writing of this research aims to determine and analyze criminal law policies regarding the offenses of unauthorized radio frequency spectrum usage and the use of telecommunication equipment that does not meet technical standards according to Law Number 36 of 1999 concerning Telecommunications, and to analyze changes in criminal law policies regarding the offenses of unauthorized radio frequency spectrum usage and the use of telecommunication equipment that does not meet technical standards after the enactment of Law Number 6 of 2023 concerning the Ratification of the Omnibus Law on Job Creation. The research method used is the Normative Juridical method with a literature review approach relying on secondary data because the main focus of this research is on criminal law policy issues in legislation related to unauthorized radio frequency spectrum usage and the use of telecommunication equipment that does not meet technical standards. The research findings indicate that the imposition of criminal Penulisan penelitian ini bertujuan untuk mengetahui dan menganalisis kebijakan hukum pidana mengenai tindak pidana penggunaan spektrum frekuensi radio tanpa izin dan penggunaan alat dan atau perangkat telekomunikasi yang tidak memenuhi standar teknis menurut Undang-Undang Nomor 36 Tahun 1999 tentang Telekomunikasi, dan untuk menganalisis perubahan kebijakan hukum pidana mengenai tindak pidana penggunaan spektrum frekuensi radio tanpa izin dan penggunaan alat dan atau perangkat telekomunikasi yang tidak memenuhi standar teknis setelah diundangkannya Undang-Undang Nomor 6 Tahun 2023 tentang Pengesahan Omnibus Law Cipta Kerja. Metode penelitian yang digunakan adalah metode Yuridis Normatif dengan pendekatan studi kepustakaan dengan mengandalkan data sekunder karena fokus utama penelitian ini adalah pada masalah kebijakan hukum pidana dalam peraturan perundang-undangan terkait penggunaan spektrum frekuensi radio tanpa izin dan penggunaan alat dan atau perangkat telekomunikasi yang tidak memenuhi standar teknis. Hasil penelitian menunjukkan bahwa pengenaan sanksi pidana terhadap penggunaan spektrum frekuensi radio tanpa izin dan penggunaan peralatan telekomunikasi yang tidak memenuhi standar teknis.

Abstract

Based on the results of the research, the Investigator of Subdit II Eksus Ditreskrimsus Polda Central Sulawesi in investigating banking crimes, namely conducting investigations of banking crime cases by a series of receiving a person's report or complaint from a person of a banking crime based on the principle of legality as regulated in the Criminal Procedure Code relating to the authority of investigators and banking laws, the results of investigations during the last three years of banking crimes have fluctuated, In general, banking crimes related to bank businesses include bank officials or bank employees and obstacles to the investigation process in banking crime cases by Subdit II Eksus Ditreskrimsus Polda Central Sulawesi, are strongly influenced by legal factors from related laws and regulations, the spread of banking crimes in various laws, apparatus / officer factors including law enforcement morals, personnel conditions, law enforcement skills and inadequate supporting facilities / equipment in the implementation of law enforcement. Berdasarkan hasil penelitian bahwa Penyidik Subdit II Eksus Ditreskrimsus Polda Sulteng dalam melakukan penyidikan tindak pidana perbankan yaitu melakukan penyidikan perkara tindak pidana perbankan dengan rangkaian menerima laporan seseorang atau pengaduan dari seseorang adanya tindak pidana perbankan berdasarkan asas legalitas sebagaimana diatur dalam KUHAP berkaitan dengan kewenangan penyidik serta undang-undang perbankan, hasil penyidikan selama tiga tahun terakhir tindak pidana perbankan bersifat fluktuatif, pada umumnya adalah tindak pidana perbankan yang berkaitan dengan usaha bank diantaranya pejabat bank atau pegawai bank dan Hambatan proses penyidikan dalam perkara tindak pidana  perbankan oleh Subdit II Eksus Ditreskrimsus Polda Sulteng, sangat dipengaruhi oleh faktor hukum dari peraturan-perundang-undangan berkaitan, tersebarnya tindak pidana perbankan dalam berbagai undang-undang, faktor aparat/petugas meliputi moral penegak hukum, keadaan personil, keterampilan penegak hukum serta faktor fasilitas/peralatan pendukung yang kurang memadai dalam pelaksanaan penegakan hukum.

Abstract

Based on the results of the study that doctors as victims of patient family violence have not been regulated in special legislation in the field of health and medicine only in the Criminal Code as repressive protection, in statutory regulations, doctors have not received preventive legal protection as victims in carrying out the medical profession, but in providing medical services, The legal protection of doctors in carrying out their profession is regulated in various laws and regulations, so that doctors always take refuge in medical risks, namely the possibility of something unwanted by patients and doctors in a series of medical action processes both from the risk of injury, disability, to death and doctors have implemented Service Operational Standards (SOPs) because the purpose of passing Law No. 36 of 2009 concerning Health and Law No. 36 of 2009 concerning Health. 36 of 2009 concerning Health and Law No. 29 of 2004 concerning Medical Practice to provide protection to doctors in carrying out their duties does not discuss patient protection, so that the position of doctors is stronger and emphasizes the resolution of medical disputes through professional code of ethics hearings whose sanctions are only administrative. Berdasarkan hasil penelitian bahwa Dokter sebagai korban kekerasan keluarga pasien belum diatur dalam peraturan perundang-undangan khusus dibidang kesehatan dan kedokteran hanya dalam KUHPidana sebagai perlindungan represif, dalam regulasi perundang-undangan, dokter belum mendapatkan perlindungan hukum preventif sebagai korban dalam menjalankan profesi dokter, tetapi dalam memberikan pelayanan medik, profesi dokter sebagai terduga pelaku malpraktek mendapatkan perlindungan dalam berbagai peraturan perundang-undangan dan Perlindungan hukum terhadap dokter dalam melaksanakan profesinya diatur dalam berbagai peraturan perundang-undangan, sehingga dokter selalu berlindung pada risiko medis yaitu kemungkinan terjadinya suatu hal yang tidak diinginkan oleh pasien maupun dokter dalam rangkaian proses tindakan medis baik dari risiko cidera, cacat, hingga kematian dan dokter sudah menerapkan Standar Operasional Pelayanan (SOP) karena tujuan disahkan UU No. 36 Tahun 2009 tentang Kesehatan dan UU No. 29 Tahun 2004 Tentang Praktik Kedokteran untuk memberikan perlindungan kepada dokter dalam melaksanakan tugasnya tidak membahas perlindungan pasien, sehingga kedudukan dokter lebih kuat dan lebih menekankan penyelesaian sengketa medik melalui sidang kode etik profesi yang sanksinya hanya administrasi.

Abstract

The purpose of this study is law enforcement against violations of the neutrality of the Village Head in the implementation of General Elections and legal consequences for Village Heads who cannot maintain neutrality in General Elections, using normative research methods. Based on the results of the study that law enforcement against violations of the neutrality of the Village Head in the General Election as a form of violation of the principles of direct, general, free, confidential, honest and fair is regulated in Law No. 7 of 2017 concerning Elections and Law No. 6 of 2014 concerning Villages which regulates material and formal criminal law, the provisions of formal criminal law are very different from criminal acts in general starting from the investigation process to the court's decision, namely the handling of election crimes processed through the Gakkumdu center. The provisions of material criminal law, the perpetrators of Village Head neutrality violations that can be categorized as decisions or actions of a Village Head such as making decisions and / or actions that benefit or harm election participants, actions or actions that lead to favoritism to election participants that are indicated to harm one of the election participants as a formal offense, and legal consequences for Village Heads who cannot maintain neutrality in elections through law enforcement of election crimes by applying criminal liability in the form of imprisonment and fines. Tujuan penelitian ini adalah adalah penegakan hukum terhadap pelanggaran netralitas Kepala Desa dalam penyelenggaraan Pemilihan Umum dan akibat hukum bagi Kepala Desa yang tidak dapat menjaga netralitas dalam Pemilihan Umum, menggunakan metode penelitian normatif. Berdasarkan hasil penelitian bahwa Penegakan hukum terhadap pelanggaran netralitas Kepala Desa dalam Pemilu sebagai bentuk pelanggaran terhadap asas langsung, umum, bebas, rahasia, jujur dan adil  diatur dalam dalam UU No. 7 Tahun 2017 Tentang Pemilu dan UU No. 6 Tahun 2014 tentang Desa yang mengatur hukum pidana materil dan formil, ketentuan hukum pidana formil sangat berbeda dengan tindak pidana pada umumnya mulai dari proses penyelidikan sampai putusan pengadilan yaitu penanganan tindak pidana Pemilu diproses melalui sentra Gakkumdu. Ketentuan hukum pidana materilnya, pelaku pelanggaran netralitas Kepala Desa yang dapat dikategorikan sebagai keputusan atau tindakan seorang Kepala Desa seperti membuat keputusan dan/atau tindakan yang menguntungkan atau merugikan peserta pemilu, perbuatan atau tindakan yang mengarah keberpihakan kepada peserta pemilu yang terindikasi merugikan salah satu peserta pemilu sebagai delik formil, dan akibat hukum bagi Kepala Desa yang tidak dapat menjaga netralitas dalam Pemilu melalui penegakan hukum tindak pidana pemilu dengan menerapkan pertanggungjawaban pidana berupa sanksi pidana penjara dan denda.

Abstract

The purpose of this paper is to analyze: 1) Protection of customary law communities' rights in forest utilization and management. 2) The perspective of human rights in the economic, social and cultural fields related to forest management by indigenous peoples. The writing method used is normative legal research or library legal research using a statutory approach, case approach, and conceptual approach. The results of the research show that: 1) Protection of the rights of indigenous peoples in the utilization and management of forests by providing prior recognition to indigenous peoples through Regional Regulations, after the existence of indigenous peoples is recognized, the status of customary forests is determined by the Minister of Environment and Forestry, both of which are conditions for indigenous peoples to get protection for the utilization and management of their customary forests. Forest management carried out by indigenous peoples based on their local wisdom is utilized to meet their daily needs and community needs. 2) In the perspective of human rights, the rights of indigenous peoples are respected and protected in the context of protecting and upholding human rights as long as they do not conflict with the principles of the rule of law which is based on justice and the welfare of the people, one of the recognized rights of indigenous peoples is the right to manage their customary forests to fulfill their daily needs and their communities. In the International Covenant on Economic, Social and Cultural Rights, which has been ratified into Law No. 11/2005, the most essential right of indigenous peoples is the right to land and natural resources.

Abstract

The purpose of this paper is to analyze: 1) Application of the Principles of Human Rights in Crimes of Sexual Violence against Children. 2) How to Prevent Criminal Acts of Sexual Violence against Children. The writing method used is normative legal research or library legal research using a statute approach, case approach, and conceptual approach. The results showed that: 1) the application of the Principles of Human Rights in Criminal Acts of Sexual Violence on Children. there are four principles of human rights, namely universality, indivisibility, interdependent, and intrrelated, which are derivative principles from the principle of universality. Sexual violence committed against children can hinder their progress and prevent them from enjoying human rights and freedoms and also hinder the achievement of the principle of equality. 2) Efforts to prevent criminal acts of sexual violence against children preventive efforts or preventive efforts and repressive efforts. Preventive efforts, namely by conducting socialization related to education, guidance, and awareness to the general public about various forms of crime including sexual violence against children within the family. While repressive efforts are a form of effort made in order to show how the eradication of crimes that occur by being realized through criminal law.

Abstract

The results of the research show that: 1) The concept of the responsibility of expedition service companies can be classified based on the element of fault (fault liability principle), based on the presumption of liability principle, based on absolute liability principle and based on the limitation of liability principle. 2) Efforts to resolve compensation by the expedition service against delays in damage and loss of goods must be in accordance with the Civil Code and KUHD if proven to have committed errors or omissions in the delivery of goods, then the expeditor must compensate in accordance with applicable procedures because the purpose of the enactment of Law No. 8 of 1999 concerning Consumer Protection and Presidential Regulation No. 16 of 2018 concerning Government Procurement of Goods and Services is to provide protection to the parties, both business actors and consumers in carrying out their duties. Metode penulisan yang digunakan adalah penelitian hukum normatif atau penelitian hukum kepustakaan dengan menggunakan pendekatan undang-undang (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual  (conceptual approach). Hasil penelitian menunjukkan bahwa: 1) Konsep dari tanggung jawab perusahaan jasa ekspedisi dapat digolongkan berdasarkan atas unsur kesalahan (fault liability principle), berdasarkan atas praduga (presumption of liability principle), berdasarkan atas tanggung jawab mutlak (absolute liability principle) dan berdasarkan atas pembatasan (limitation of liability principle). 2) Upaya penyelesaian ganti rugi oleh pihak jasa ekspedisi terhadap keterlambatan kerusakan dan hilangnya barang harus sesuai dengan KUHPerdata dan KUHD apabila terbukti melakukan kesalahan atau kelalaian dalam pengiriman barang, maka pihak ekspeditur harus mengganti kerugian sesuai dengan prosedur yang berlaku karena tujuan disahkannya UU No. 8 Tahun 1999 tentang Perlindungan Konsumen dan Perpres No. 16 Tahun 2018 tentang Pengadaan Barang Dan Jasa Pemerintah untuk memberikan perlindungan kepada para pihak baik itu pelaku usaha dan juga konsumen dalam melaksanakan tugasnya.

Abstract

The research results obtained conclusions 1). The dispute over the territorial boundaries of Pasangkayu Regency and Donggala Regency has gone through a non-litigation and litigation resolution process through judicial institutions. In this case, mediation or facilitation was carried out 4 (four) times by the Ministry of Home Affairs, until the Supreme Court issued Decision Number: 5 P/HUM/2023 dated March 23 2023, which declared the Minister of Home Affairs Regulation Number 60 of 2018 concerning Regional Boundaries of Pasangkayu Regency void. West Sulawesi Province with Donggala Regency, Central Sulawesi Province dated July 18 2018. As for legal action, in the form of a judicial review of the regional formation law at the Constitutional Court, there is still an opportunity. However, it is known that the Constitutional Court in several recent decisions considers territorial boundary disputes within the Republic of Indonesia not to be a constitutional issue that deserves to be tested by the Constitutional Court. Rather, it is the authority of the government in stages, namely the authority of the governor, or the Minister of Home Affairs. 2). The legal consequences of the Supreme Court's decision Number: 5 P/HUM/2023 dated 23 March 2023 on the administration of regional government in border areas, have consequences for: Aspects of legal certainty in the administration of regional government; Aspects of public service certainty, which must be carried out by the West Sulawesi Provincial Government and Pasangkayu Regency, in providing basic services to residents of the community; and Fulfillment of the political rights of citizens, both voters and those elected (candidates), by providing services and building polling stations in the implementation of election and regional election contestation.
