Abstract

Technological developments have resulted in increasingly complex forms of crime or criminal acts in society. Of course, this must be balanced with legal policies so that perpetrators do not allow negligence which could have an impact on the interests of individuals, society and the interests of the state. The author in this research examines legal policies regarding information and electronic transaction in Indonesia. Research was conducted using normative research, juridical and conceptual approaches. The research results show that the existence of Law No. 19 of 2016, which is an amendment to Law No. 11 of 2008 concerning Information and Electronic Transactions, is a positive policy amidst the legal vacuum regarding the resolution of criminal acts using technological means. Even though the Criminal Code was previously used, it was not effective. The policy in the formulation of the ITE Law has included corporations as legal subjects and the use of cumulative punishment for criminals. This can have a fear effect on the community so that it can minimize the occurrence of criminal acts in the ITE sector; Next, the Chief of Police of the Republic of Indonesia issued a Circular Number SE/2/11/2021 concerning Ethical Cultural Awareness to Create a Clean, Healthy and Productive Indonesian Digital Space. The mandate of the Circular is to prioritize the use of restorative justice to reduce overcapacity in correctional institutions.

Abstract

In carrying out its functions, the Women's Correctional Institution faces challenges related to the role of male security officers who work in it. The limited number of male security officers is a sensitive and complex issue that affects aspects of security, privacy and the human rights of women. In conducting this research the author used empirical research methods with juridical, conceptual and sociological approaches. The research results show that one important aspect in securing women's prisons is the availability of male security officers because they have greater physical strength, which can help in controlling situations that may require physical force. A lack of male security officers can make women's prisons more vulnerable to conflict, violence or chaos that is difficult to control. The implementation of security activities carried out at the Tenggarong Class II A Women's Correctional Institution is slightly different from prisons in general, especially in securing the main door. Firstly, there are no clear legal regulations or regulations regarding standards regarding the minimum number of male security officers in women's prisons and secondly, the lack of male security officers in women's prisons shows that there is a gap in the understanding and implementation of regulations relating to the number and placement. officer. So this condition needs to be immediately addressed through revision of regulations that are more comprehensive and responsive to the needs of the Women's Correctional Institution for male security officers.

Abstract

Sopi is a traditional drink that contains alcohol. Its existence raises pros and cons among the people of East Nusa Tenggara. Sociologically, Sopi is considered to have certain values that are respected by the local community, but if consumed excessively, the alcohol content contained can also be the cause of criminal acts. In this research, the author conducted a sociological study of the existence of Sopi in Fat village, East Nusa Tenggara and the role of Bhabinkamtibmas in efforts to handle Sopi production. The research results show that social, cultural and economic problems are very complex factors that are always considered in relation to the existence of sopi in society

Abstract

This research aims to examine the effectiveness of the Home Waste Sorting Program (PILSADAR) in Tanjung Karang Village, Sekarbela District, Mataram City Based on Mataram City Regional Regulation Number 1 of 2019 concerning Waste Management. This thesis examines the following problems, namely; What is the effectiveness of the Home Waste Sorting Program (Pilsadar) in Tanjng Karang Village, Sekarbela District, Mataram City; and what are the obstacles faced in implementing the Home Waste Sorting Program (Pilsadar) in Tanjung Karang Village, Sekarbela District, Mataram City. This research is research that examines data and legal materials, both from primary data obtained from field observations and interviews, and from secondary data consisting of primary legal materials in the form of statutory regulations and other regulations. related. From the results of this research, it can be concluded that; Sapaia's PILSADAR program is currently not running effectively because this program has only been implemented in the Sembalun area and is only implemented twice a week. The author says that there needs to be more intensive evaluation and coordination as well as follow-up to ensure that PILSADAR is implemented according to expectations and achieves appropriate results. Overall, this could have a positive impact on the entire Tanjung Karang Village; Furthermore, the obstacles faced by the Government in implementing the Segregate Waste from Home (Pilsadar) Program in Tanjung Karang Subdistrict are the limited budget in the subdistrict which is the main obstacle in implementing the pilsadar program. This shows that limited financial resources can limit the expansion of the program to other areas. Apart from that, the lack of limited three-wheeled vehicles is also an inhibiting factor. This can hinder the distribution of rubbish sacks or transport of rubbish from home to waste management centers.

Abstract

Security Institution is a means to provide legal protection for creditors in order to obtain debt repayment from debtors. Fiduciary Guarantee is a material guarantee in the form of movable and immovable objects that are not included in the objects of Mortgage and Mortgage. Fiduciary guarantees are characterised by the transfer of ownership rights from the fiduciary grantor to the fiduciary recipient. The control of the object of fiduciary guarantee is vested in the fiduciary. Law No. 42/1999 on Fiduciary Guarantee grants preferential rights. The fiduciary beneficiary also has the right to execute the object of the fiduciary guarantee if the debtor defaults. Starting from the Decision of the Constitutional Court (MK) Number 18/PUU-XVII/2019 which interprets Article 15 of Law Number 42 of 1999 that if the debtor defaults, the creditor has no right without a court decision to execute the object of fiduciary security. The problem in this research is what causes legal uncertainty of fiduciary security institutions in Indonesia in the perspective of good faith creditors? The result of this research is the cause of legal uncertainty is the implementation in the field is not in accordance with Law Number 42 Year 1999. The decision of the Constitutional Court (MK) Number 18 / PUU-XVII / 2019 further complicates good faith creditors to obtain rights in the form of returning their debts from debtors.
