Abstract

The basis of belief in civil law is the rule contained in an agreement, whether it is between an individual and an individual or between individuals with a legal body; a standard contract removes the basis of freedom of contracting. If the standard contract does not provide a balance of interests for each party, a reaction will emerge. As a result, the foundation of faith in the formulation and implementation of the agreement must be placed in a "fine" place. Section 3 of article 1338 of the Code of Civil Procedure states that "the consent shall be executed in good faith". Good-hearted people really trust people they think are honest. They don't hide things that could potentially cause problems later on. Each contract must be subjected to credibility testing during the pre-manufacturing, manufacture (sign-up), and post-production phases. (implementation).

Abstract

Various regions in Indonesia have a history of land abduction. Taking, occupying, or taking another's land illegally is known as land abduction. The following factors cause land abduction: human greed or greed, economic factors, employment factors, and educational factors. The process of settling a case of land abduction in the Criminal Procedure Law is as follows: report or complaint, filing of a case to the prosecutor general, the plaintiff, the indictment, the trial, the reading of the charges, the exemption, the examination of the means of proof, the complainant, the defence of the replica, the duplication, the judgment of the court, the ordinary and extraordinary legal effort.

Abstract

If the fishing sector is well managed and expert, the volume of exports can increase. It will increase the country's income so that the country can the goal of creating a just and prosperous society. The use of materials or tools that may jeopardize the sustainability of fish resources or the environment that exists around fish habitats falls within the category of fishing offences regulated in the Fisheries Act No. 45 of 2009. Victims affected by corporate action in the field of fishing are expected to get help from the use of repressive and restorative techniques. The restoration of traditional fishermen in such conditions will allow the fisherman to return to a decent life.

Abstract

New sanctions for liquidation if other sanctions can't solve the problem. According to article 503 of the Code, interference in the vicinity of a building for the conduct of authorized worship or interruption in the proximity of the building for conducting authorized service is punishable by imprisonment for a maximum of three days or a maximum fine of two hundred twenty-five rupees. According to Book III of the Covenant, the profits obtained by the perpetrator of a criminal offence are as follows: penal sanctions fine preserving the good name or honour of perpetrators of the offence and does not create a bad impression on the person concerned; penal sanction fine prevents bad influence and prevents stumbling.

Abstract

Applying the principle of justice before the law, also known as equality of law, when giving remission to prisoners involved in corrupt crimes. The study is normative. Remission will be given to qualified prisoners. The institute seeks to establish a system of seizure that enables the rehabilitation and re-socialization of prisoners involved in corrupt crimes. In short, the state must punish all criminals by providing good socialization to its society.
