Abstract

The research analyzes the use of patents in a field other than industry and how they have a wider impact than the monetary gain of the patent holder. In recent years, patents have been taken out on organisms and gene sequences, which has a flow-on effect of jeopardizing any further research in that area and possible future developments. This is a serious issue in the fast-moving field of medical biotechnology. For example, researchers patented and developed a test that utilized and identified a gene sequence that was later patented by another party. The researchers may have to discontinue the test due to the risk of patent infringement. The development of new technologies and useful products is encouraged by the patent system; however, patents on gene sequences and organisms are too wide-reaching and generally obstruct further research in the same area. This is a big contrast from the original purpose of the patent law. To provide insight into the complex relationship between patent law and biotechnology, the paper will first provide a brief overview of why and how patent law came about to show the contrast in reasons why it was originally used and the way it is used today. The paper will then consider the different economic and social impacts that patents can have on the public surrounding medical biotechnology. Finally, a brief overview will be presented on the current view of biotechnology patents in international law and the upcoming changes that will serve to solve the problems outlined in this paper.

Abstract

With the evolution of technology and changes in societal needs, regulations in the telecommunications industry should be adaptable in order to maintain accessibility, affordability, and quality of service standards. The ITU has developed an extensive assessment model for regulations that consists of five generations. This model evaluates telecommunication regulatory policies’ effectiveness and efficiency under fast evolving technological circumstances. Each generation will be broken down according to such indicators established by the ITU as policy effectiveness, adaptability to technological change, and impact on users of telecoms services. Through various regulatory stages this evaluation model brings out comprehensive understanding about achievements made as well as challenges faced during these periods that supports sustainable digital transformation.

Abstract

Rahasia Dagang dan Paten merupakan 2 (dua) rezim hak kekayaan intelektual yang sangat dekat. Untuk melindungi bisnisnya, Pelaku Usaha dapat memilih Rahasia Dagang dibandingkan Paten atau sebaliknya. Tentunya akan didasarkan pada pertimbangan tertentu. Dalam konteks lisensi teknologi, rahasia dagang dan paten tidak dapat berdiri sendiri, khususnya terhadap kemungkinan munculnya rahasia dagang yang merupakan hak paten. Terdapat dua potensi isu yang muncul berkaitan dengan hubungan keduanya, yakni apabila terjadi perselisihan ataupun berakhirnya masa pelindungan paten yang dalam perjanjian lisensinya melekat juga terkait rahasia dagang. Atas dasar ini, maka Pemilik Lisensi akan menjadi pihak yang berpotensi dirugikan. Untuk itu, diperlukan terobisan dalam bentuk 3 (tiga) strategi optimalisasi baik dari sisi klausula dan bentuk Perjanjian Lisensi maupun Penetapan Royalti dengan mendasarkan pada Natural Right Theory.

Abstract

Keunikan Netflix dinilai menjadi nilai tambah terjadinya perkembangan yang sangat pesat pada Netflix yakni penambahan fitur menarik sekaligus penyelesaian terkait isu proteksi orang tua. Dimulainya streaming serial dan film (2006), kemitraan streaming berkembang dari yang semulai hanya streaming di Xbox360, pemutar Blu-Ray dan Dekoder TV (2008) berkembang menjadi dapat streaming dari TV yang terhubung dengan internet (2009), dan dilanjutkan ke streaming di perangkat seluler (2010). Selanjutnya, tombol Netflix yang pertama hadir di remote control (2011), fitur “Profil dan Daftar Saya” mulai diluncurkan pada streaming (2013), Netflix memulai streaming dalam format 4K Ultra HD (2014), fitur download ditambahkan untuk dapat menonton secara offline dan selama dalam perjalanan (2016). Munculnya tombol lewati intro memberi anggota lebih banyak pilihan untuk menyesuaikan pengalaman menonton mereka (2017), audio spasial untuk menghadirkan pengalaman sinematik di perangkat apapun dan menambahkan hub Kategori ke menu TV (2022) serta streaming live (2023). Dari timeline Netflix tersebut, pengembangan signifikan terjadi dalam rentang waktu tahun 2008 sampai dengan tahun 2014 dimana selama periode itu juga terjadi kenaikan pelanggan yang mencapai 5 kali lipat. Sebagai penyeimbang, fitur proteksi orang tua juga telah dikembangkan berupa perlindungan Personal Identification Number/PIN (2018)

Abstract

Digital transformation in Indonesia's banking industry has created new opportunities and challenges for the national financial system. The increase in digital banking transactions is supported by digital economic growth of USD 90 billion, reflecting significant changes in consumer preferences and banking structures. However, this pace of development has been accompanied by a 50% increase in cybersecurity incidents from 2021 to 2023, threatening public trust and financial system stability. Regulations set by the Financial Services Authority (OJK) through POJK No. 12/POJK.03/2021 and POJK No. 12/POJK.03/2018 have attempted to accommodate the needs of digital banks, but challenges in technology oversight, cybersecurity, and cross-border compliance remain significant. Regulations issued by the Financial Services Authority (OJK) through POJK No. 12/POJK.03/2021 and POJK No. 12/POJK.03/2018 have attempted to accommodate the needs of digital banks, but challenges in technology supervision, cybersecurity, and cross-border compliance remain significant. This study uses a normative legal method with a legislative and comparative approach. The results show fundamental differences in the supervision of digital banks and conventional banks, where digital banks place more emphasis on technology-based supervision such as RegTech and SupTech, while conventional banks use traditional methods that focus on asset quality and credit risk management. There is no difference in the sanctions imposed on digital and conventional banks, but the sanctions are adjusted to the type of violation and the form of operational activities. A comparison with ASEAN countries such as Singapore, Malaysia, and Thailand shows that Indonesia's supervisory framework still needs to be strengthened, especially in the adoption of supervisory technology to address risks and support innovation. This study concludes that banking supervision must be adaptive to technological developments to maintain financial stability and inclusion in the digital era.

Abstract

This study evaluates the impact of banking liberalization in Indonesia, particularly in relation to the presence of foreign banks, and compares the requirements for establishing foreign banks with those of other ASEAN countries. Using a doctrinal method, this study analyzes regulations and legislation, including Law No. 14 of 1967, Law No. 7 of 1994, and POJK No. 12/POJK.03/2021. The results of the study show that banking liberalization has brought significant benefits such as knowledge and technology transfer, increased competition, access to international markets, and economic stability. A concrete example is the role of foreign banks in rescuing troubled domestic banks during the 1997-1998 monetary crisis, such as Standard Chartered taking over Bank Bali. However, liberalization also poses challenges, including the potential for foreign domination that could threaten national economic sovereignty and limited access to credit for the MSME sector. A comparison with other ASEAN countries, such as Singapore, Thailand, and Malaysia, shows that Indonesia has a more lenient policy on foreign ownership, with a share ownership limit of up to 99%. This study emphasizes the importance of strict regulation and supervision to reap the benefits of liberalization while mitigating potential risks, ensuring that the presence of foreign banks contributes positively to the national economy.

Abstract

The Indonesian government continues to strive to develop infrastructure, including electrical infrastructure, which serves as the main driver and foundation of the economy. The task of managing the electricity sector is entrusted to the state through state-owned enterprises, with PT PLN (Persero) as the main implementer. The planning for these electricity infrastructure projects has been outlined in the 2021-2030 Electricity Supply Business Plan (RUPTL). To support the realization of these projects, substantial funding is required, one of which is through a syndicated loan scheme. Syndicated loans, which involve a number of financial institutions, offer organized and efficient financing solutions with proportionally shared risks. This scheme has become a major financing alternative to support infrastructure projects and other strategic sectors in Indonesia, providing a significant impact on sustainable economic growth.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) are the backbone of Indonesia's economy, absorbing 97% of the non-agricultural workforce and making a significant contribution to GDP. However, limited access to formal financing remains a major obstacle. Conventional banks often view MSMEs as high-risk, making it difficult for them to obtain loans. Peer-to-Peer (P2P) lending emerges as a technology-based solution, offering easier access to financing with lighter requirements and faster processes. This study aims to examine the role of P2P lending in enhancing financial inclusion and the capacity of MSMEs, focusing on the case study of Kampoeng Batik Laweyan in Solo. The research uses a normative juridical approach, combining legal analysis with field data. This study analyzes regulations related to P2P lending and its implementation in supporting MSMEs financial inclusion. The findings show that P2P lending not only improves access to financing but also fosters innovation, market expansion, and the sustainability of MSMEs. Strong regulation is needed to maintain public trust and ensure the sustainability of this sector. Therefore, P2P lending plays an important role in supporting the growth of inclusive and competitive MSMEs. It is recommended that the government strengthen regulations and provide training to MSMEs to utilize P2P lending as an alternative financing option that is more accessible.

Abstract

Lending by banks is generally covered by insurance as mitigation in the event of the borrower's death. The insurance can be in the form of insurance issued by general insurance companies or life insurance companies that have the aim of protecting not only the bank as a creditor but also the borrower's heirs so that the borrower's heirs do not need to be burdened to repay the remaining loans and on the other hand the bank's liquidity and profitability are maintained. At an ideal level, if the borrower dies, the bank will make an insurance claim to the insurance company, then the insurance company will check the completeness of the file and transfer some funds to the bank as stipulated on the insurance agreement. This research will focus on the corruption case of misappropriation of credit insurance claims on the death of borrower that occurred at Bank Jateng Kaligawe Sub-Branch Office, Semarang.

Abstract

Climate change and the need to reduce energy consumption make energy efficiency an important solution to achieve sustainability. Energy Services Companies (ESCOs) play a central role in the implementation of energy efficiency technologies through various services such as consulting, project development, and verification of energy savings. However, one of the main challenges in this implementation is the need for significant initial investment, which is often an obstacle for project owners, especially in developing countries where high financial risk is a major obstacle. Islamic financing, based on the principles of Islamic law, offers an attractive alternative to overcome such challenges. The key principles of Islamic financing, such as the prohibition of riba (interest), gharar (uncertainty), and maysir (gambling), emphasise the value of fairness and transparency in financial management. The method used in this research is doctrinal research method by analysing and evaluating legal provisions, regulations, and applicable legal principles related to the dynamics of Islamic financing in Energy Service Company (ESCO) in supporting energy efficiency. The results show that in the context of ESCOs, Islamic financing can be applied through two main business patterns, namely ‘guaranteed energy savings’ and ‘shared energy savings.’ Under the ‘guaranteed energy savings’ scheme, the ESCO guarantees certain energy savings to the project owner. If the savings do not reach the promised target, the ESCO will bear the loss, in line with Shariah principles that promote a mutually beneficial relationship. The ‘shared energy savings’ pattern allows the ESCO and the project owner to share the risks as well as the returns from the achieved energy savings. The advantage of Islamic financing in this context lies in its ability to overcome capital barriers, expand access to more diverse financing, and increase the attractiveness of ESCOs, especially in developing countries.
