Abstract

Provinsi Lampung dikenal sebagai wilayah penghasil singkong terbesar di Indonesia, namun pengelolaan industrinya masih menghadapi sejumlah tantangan, di antaranya ketidakstabilan harga, posisi tawar petani yang rendah, serta proses hilirisasi yang belum berkembang optimal. Penelitian ini bertujuan mengevaluasi efektivitas implementasi kebijakan pemerintah daerah dalam memperkuat tata kelola industri singkong di Lampung dengan memanfaatkan model implementasi George C. Edwards III, yang mencakup dimensi komunikasi, sumber daya, disposisi pelaksana, dan struktur birokrasi. Pendekatan penelitian menggunakan metode kualitatif melalui studi literatur dan analisis dokumen kebijakan, dengan menelaah berbagai regulasi resmi seperti Surat Edaran Gubernur Lampung Nomor 7 Tahun 2025 dan Instruksi Gubernur Nomor 2 Tahun 2025, serta referensi akademik dan laporan yang berkaitan dengan tata niaga singkong dan kebijakan harga komoditas pertanian. Temuan penelitian mengindikasikan bahwa pelaksanaan kebijakan belum berjalan secara efektif, ditandai oleh lemahnya penyebaran informasi kebijakan, keterbatasan sumber daya manusia dan pembiayaan, rendahnya komitmen pelaksana di tingkat operasional, serta struktur birokrasi yang belum terkoordinasi dengan baik. Kebijakan yang ada cenderung bersifat administratif dan normatif sehingga belum mampu mendorong peningkatan kesejahteraan petani maupun penguatan sektor hilir. Penelitian ini merekomendasikan penguatan koordinasi lintas sektor, peningkatan kapasitas dan dukungan sumber daya, pembentukan lembaga khusus yang menangani tata niaga singkong, serta penerapan mekanisme evaluasi berkelanjutan guna memastikan tata kelola industri singkong yang lebih efektif dan berorientasi hasil.

Abstract

The Jakarta–Bandung High-Speed Railway (KCJB) project, operated by PT Kereta Cepat Indonesia China (KCIC), represents Indonesia’s strong ambition to accelerate national strategic infrastructure development and strengthen bilateral cooperation with China. Nevertheless, behind its physical progress, the project has encountered serious challenges characterized by investment failure, including cost overruns, construction delays, and potential legal disputes. This article aims to analyze the failure of the KCJB investment from a legal perspective by examining the gap between infrastructure ambitions and Indonesia’s regulatory realities. This study employs a normative legal research method using statutory and conceptual approaches, supported by an extensive review of primary, secondary, and tertiary legal materials. The analysis reveals that the KCJB investment failure is largely driven by weak regulatory harmonization, legal uncertainty, imbalanced contract structures, and the complexity of financing schemes that were insufficiently anticipated within the existing legal framework. Furthermore, the absence of competitive tendering processes, overlapping authorities between central and regional governments, and limited legal protection for public interests have significantly increased investment risks. These conditions have ultimately undermined legal certainty and the effectiveness of project governance. The article concludes that strengthening regulatory frameworks, enhancing contractual transparency, and restructuring public–private partnership mechanisms are essential to mitigate the risk of investment failure in future large-scale infrastructure projects and to ensure that development ambitions align with the principles of legal certainty and good governance.

Abstract

The development of the Celukan Bawang Coal-Fired Power Plant Phase II has generated an environmental dispute that resulted in the Denpasar Administrative Court Decision Number 2/G/LH/2018/PTUN.DPS. This case is significant as it concerns the application of the audi et alteram partem principle, a fundamental principle guaranteeing the right of parties to be heard fairly, particularly in environmental disputes that are preventive in nature and involve broader public interests. This study aims to analyze the application of the audi et alteram partem principle in the decision and to examine its implications for access to justice for affected communities. This research employs a normative legal research method using statutory and conceptual approaches, with secondary legal materials analyzed through qualitative descriptive analysis. The findings show that the panel of judges only fulfilled the formal hearing requirement by allowing the parties to submit their claims, but failed to meet the substantial hearing requirement by not seriously considering empirical evidence and substantive arguments presented by the plaintiffs. The termination of the case at the preliminary stage without examining the merits undermined the precautionary principle and weakened the protection of community environmental rights. In conclusion, the application of the audi et alteram partem principle in this decision was not optimal and resulted in a denial of justice in environmental law enforcement.
