Abstract

The Constitutional Court (Mahkamah Konstitusi/MK), as the guardian of the Constitution, plays a crucial role in reviewing the constitutionality of legal norms, including Government Regulations in Lieu of Law (Perppu). Although Article 24C paragraph (1) of the 1945 Constitution normatively mentions only “laws” (undang-undang), jurisprudential practice has categorized Perppu as part of statutory law, thus allowing its constitutionality to be reviewed. This study aims to examine the Constitutional Court's authority to review Perppu from the perspective of the theory of separation of powers, while also critically assessing its implications for the stability of Indonesia’s constitutional system. The research method employed is a normative juridical approach with qualitative analysis based on literature review, supported by secondary data including Constitutional Court decisions, statutory regulations, and academic literature. The findings indicate that the Court's authority to review Perppu opens up space for checks and balances on executive power. However, it also carries the potential for disharmony among branches of state power and biased interpretations of the condition of “compelling urgency.”The study concludes that while the Constitutional Court legally holds the legitimacy to review Perppu, clearer juridical boundaries are needed to prevent disproportionate expansion of its authority. This research contributes to the discourse on constitutional law reform in Indonesia by upholding constitutional supremacy and maintaining the balance of powers.

Abstract

Elections in Indonesia are a cornerstone of democracy, but the complexity of vote counting often presents challenges in maintaining the integrity of election results. Political party witnesses play a strategic role as supervisors to ensure transparency and accuracy in the vote counting process at polling stations (TPS). This research aims to analyze the strategic role of political party witnesses in maintaining the integrity of vote counting, identify the challenges they face, and recommend strategies to enhance their effectiveness. The study uses a qualitative-descriptive approach with in-depth interviews and document analysis. Data was obtained from political party witnesses, election organizers, and relevant documents. The findings indicate that witnesses play an essential role in preventing vote manipulation and reporting violations. However, they face challenges such as political pressure, limited technical training, and logistical issues, especially in remote areas. The study recommends intensive training, the use of technology, better legal protection, and collaboration with independent institutions to improve the effectiveness of witnesses. In conclusion, political party witnesses are a key element in ensuring the transparency and legitimacy of election results, and adequate support is needed to strengthen democracy in Indonesia.

Abstract

Gayo Lues Regent Regulation No. 4 of 2021 is a strategic step in managing tourism potential in Agusen Village, Gayo Lues Regency, which is known for its natural beauty, culture, and local traditions. This study aims to analyze the implementation of the policy through the Fiqh Siyasah Tanfidziyah approach, which prioritizes benefit and sustainability. qualitative research method with data collection through observation, interviews, and document analysis. The implementation of Gayo Lues Regent Regulation No. 4 of 2021 in Agusen Village has had a significant positive impact on local tourism management. Then the implementation of tourism policy in Agusen Village is in line with the principles of Fiqh Siyasah Tanfidziyah, which emphasizes sustainability and community benefit. Therefore, it is important for the government to continue to evaluate and adapt existing policies, so that they can be more responsive to the needs of local communities. In addition, there needs to be increased education and socialization about the importance of sustainable tourism to the community. It is also recommended that local governments strengthen collaboration with various parties, including NGOs and the private sector, to attract more investment and technical support in tourism development. With these steps, it is hoped that tourism management in Agusen Village can be optimized, contribute to the local economy, and preserve the local culture

Abstract

The use of social media as a means of information, especially in the political sphere, is expected to provide educational political information that can increase public political participation. On the one hand, social media provides great benefits as a space for communication and political participation, but on the other hand, it also presents various negative influences such as disinformation, pseudo-participation, and manipulation of public opinion. This study is a systematic review conducted through a literature search using Google and Google Scholar search engines with the keywords “political participation,” “social media,” and “the influence of social media on political participation.” The results of the study show that social media, especially among young voters or millennials, can increase the level of political participation quantitatively. Social media functions not only as a source of political information but also as a platform for participation and a tool for political communication. This condition is a strategic opportunity for political candidates to gain support, considering that most active social media users are millennials who are also first-time voters. This study discusses the use of social media by the younger generation in obtaining election information, including the features that are most frequently used. The findings show that millennial political participation tends to be superficial, such as following political issues, liking, sharing, and commenting.

Abstract

Apostasy in Islam has long been a controversial and sensitive issue, revealing the ongoing tension between classical Islamic jurisprudence and contemporary human rights principles. Traditional fiqh, particularly within classical Islamic legal texts, often prescribes harsh punishments for apostates, including the death penalty. In contrast, modern human rights frameworks emphasize freedom of religion and belief as non-negotiable, fundamental human rights. This article seeks to critically examine the legal status and punishment of apostasy through the dual lenses of fiqh siyasah (Islamic political jurisprudence) and international human rights discourse, using a normative-contextual approach grounded in maqāṣid al-sharī'ah (the higher objectives of Islamic law). The research adopts a qualitative method with library research as the main data collection technique. The findings suggest that classical juristic rulings on apostasy were shaped more by political and security considerations than purely theological concerns, particularly during the formative periods of Islamic governance. Viewed through the maqāṣid lens, these laws can be reinterpreted to prioritize justice, public welfare, and individual freedom. This article argues that reformulating Islamic criminal law on apostasy in light of constitutional guarantees and universal human rights does not necessarily conflict with core Islamic teachings. Instead, it offers an opportunity to bridge religious tradition and contemporary legal norms while preserving the ethical foundations of Islam. Such a balanced approach is essential to uphold both religious integrity and human dignity in pluralistic societies today.

Abstract

This study aims to describe and analyze the process of adapting Islamic law, particularly fiqh, to local customs and cultures in Indonesia, as well as to identify the factors that influence its success or hindrance. The research method used is qualitative, employing a literature review and case study approach in several regions such as Aceh, Minangkabau, and Java. Data were collected through literature studies, document analysis, and interviews with Islamic scholars and traditional leaders. The results show that the adaptation of Islamic law in Indonesia occurs through the mechanism of ijtihad, emphasizing the principles of maslahah (public interest) and urf (custom) as its main foundation. The integration of fiqh and local customs enhances public acceptance of Islamic law, maintains social harmony, and establishes Islamic law as a contextual living law. However, differences of opinion among scholars and the challenges of modernization remain obstacles that must be wisely managed.

Abstract

Elections are a stage for political parties and an embodiment of Indonesian Democracy as stated in article 1 paragraphs 2 and 3 of the 1945 Constitution. In the context of modern politics, social media has become a significant campaign tool for political parties to attract the attention of voters, influence public opinion, and expand the reach of political communication. Social Media impact on the Party's Popularity or Electability. This research aims to analyze the influence and impact of social media on the electability of political parties in the 2024 General Election (Pemilu), as well as the implementation of campaigns using social media from the perspective of Law no. 7 of 2017 concerning Elections, case study of political parties in Cirebon. The method used by researchers is a qualitative method using a Normative Juridical and Empirical Juridical Approach. Data collection techniques are observation, interviews and documentation. The conclusion of this research is that the effective use of social media has a positive correlation with increasing the electability of political parties, especially new parties that do not yet have high electability, on the other hand, parties that are old and have many cadres and have political figures who have been in parliament for a long time do not have much influence through social media on increasing the party's electability

Abstract

This study explores the integration of Islamic values into local governance through participatory leadership within the context of Indonesian local government. As the world’s largest Muslim-majority country, Indonesia provides a unique socio-political environment where religion and governance intersect. The research emphasizes how participatory leadership, grounded in Islamic ethical principles such as justice (‘adl), consultation (shura), and accountability (amanah), contributes to policy-making processes that are inclusive, transparent, and culturally resonant. By employing a qualitative approach with case studies in West Sumatra, this article analyzes how local leaders incorporate Islamic values into decision-making mechanisms, particularly in areas related to social welfare, community participation, and sustainable development. Findings indicate that participatory leadership practices inspired by Islamic values strengthen trust between government and society, enhance legitimacy of policies, and encourage broader civic engagement. However, challenges remain in balancing traditional Islamic values with contemporary governance demands, particularly in maintaining policy effectiveness amid political pluralism and bureaucratic constraints. The academic contribution of this study lies in advancing the theoretical linkage between participatory leadership and Islamic governance values, proposing a context-specific governance model that enriches leadership studies and public policy scholarship. It also extends the discourse on religion and governance by demonstrating how local practices in Indonesia can inform global debates on ethical leadership in diverse societies. Practically, this study provides policy insights for governments seeking to design governance structures that respect cultural-religious values while adhering to democratic principles. Abstract

The 2025 DPR demonstration was one of the biggest political events in Indonesia, triggered by controversial policies that caused public unrest and widespread rejection. This phenomenon highlights the dilemma between the obligation to obey the authorities and the urge to resist policies that are considered unjust. Previous studies in classical fiqh tend to emphasise the principle of obedience, while contemporary fiqh discourse has not fully elaborated on the legitimacy of political resistance in the modern context. This study aims to analyse the 2025 DPR demonstrations through a futuristic fiqh perspective, focusing on the ethics of obedience, the legitimacy of resistance, and maqāṣid al-syarī‘ah as an ethical framework. The research method uses a normative-philosophical qualitative approach with critical discourse analysis (CDA), based on classical and contemporary fiqh literature, futuristic fiqh theory, official documents of the 2025 DPR, and secondary data in the form of news and public opinion on social media. The results of the study show that although classical fiqh emphasises obedience to the authorities, futuristic fiqh opens up space for peaceful, moral, and constructive political resistance. This study affirms the contribution of futuristic fiqh as a new approach in Islamic political ethics, which is more responsive to the dynamics of modern society and can be the basis for the development of regulations and socio-political advocacy strategies in the future

Abstract

Generation Z, as the largest demographic group in Indonesia, played a decisive role in the 2024 General Election. Their political participation reflects a new pattern influenced by digitalization and socio-political transformation. While most existing studies discuss Generation Z from the perspective of modern political science, little attention has been given to their role through the framework of Islamic constitutional law (siyasah dusturiyah). This study aims to analyze the political engagement of Generation Z in the 2024 election by contextualizing classical Islamic principles such as syura (consultation) and amar ma’ruf nahi munkar (enjoining good and forbidding evil) within a modern democratic setting. This research employs a qualitative normative-sociological approach. Primary data were obtained from reports of the General Election Commission (KPU), the Election Supervisory Agency (Bawaslu), and voter surveys, while secondary sources include classical fiqh siyasah, contemporary journals, and relevant media coverage. Data analysis applied a descriptive-analytical method combined with the maqāṣid al-syarī‘ah framework. Findings show that Generation Z demonstrated high voter turnout, strong engagement in digital activism, and issue-based preferences, prioritizing justice, environment, education, and healthcare over party loyalty. These behaviors align with siyasah dusturiyah values, framing elections as a modern form of syura to achieve just leadership. This study contributes theoretically by integrating Islamic constitutional thought with youth political participation, and practically by offering insights for policymakers, educators, and political actors to strengthen democratic participation rooted in justice and welfare.
