Abstract

The implications of Law No. 3 of 2006 on religious courts,  that the authority of the religious court expanded that includes Islamic economics were  showcased in Article 49, that the logical consequence aspects of constitutional courts religion to be the only court with jurisdiction  over issues  that occur  against Islamic economics , Writing in this thesis aims to know how the setting and execution of a security interest  in the post of Islamic Banks law No. 3 of 2006. In terms  of the types and  nature, this research includes the study of normative law, because it is done  from a juridical standpoint. The approach used  in this research is descriptive analysis, the authors describe all the existing materials and then analyze the content analysis  method. From  the  research found  that  setting  the  execution of Responsibility  Rights in Islamic  banks is through  the religious court  and  use  the settings  general  civil law and  the execution of Responsibility  Rights in Islamic banks initiated by filing a subpoena in a religious court so that the court religion did session aan maning  form of reprimand against  customer default  to meet its obligations  as an Islamic  bank  customers, and  than  if customers do not do it next Islamic banks  apply for the execution of Responsibility Rights to the customer. Head of religious courts provide execution Responsibility  Rights determination to further  instruct  the  religious  court  bailiff accompanied by two  witnesses to the execution of the seizure of the object. Then notified of the seizure to all agencies associated with the land and the buildings on it were  confiscated

Abstract

Abstract: Law Number 16 of 2019 article 7 aims to ensure that prospective husbands and wives are ready in body and soul to realize the goal of a good marriage without ending in divorce and to have healthy and quality offspring. This type of research is a type of field research using a qualitative descriptive approach. The results of the research show that the judge's considerations are seen from the first side, considering the reasons for applying for a Marriage Dispensation, secondly considering the evidence at the trial which consists of written evidence and witnesses, finally legal considerations which include positive law and Islamic law, where the judge looks at on the aspects of harm and benefit that will be obtained. There are three aspects to reviewing the benefits of Murlah. The first aspect of the problem is the aspect of child protection, the second aspect is preventing unregistered marriages and the third is to maintain honor, while from the mafsadat aspect, namely the maintenance of religion is not achieved (hifzh al-din), there has been a violation of Islamic law regarding the prohibition of adultery. When two things come together between problemat and madharat then it must be returned to the original rule, namely "Resisting damage must take priority over bringing benefit".Keywords: Marriage dispensation, Maslahah Murlah. Abstrak : Undang-Undang Nomor 16 Tahun 2019 pasal 7 bertujuan untuk memastikan calon suami dan istri telah siap raga dan jiwanya demi mewujudkan tujuan perkawinan secara baik tanpa berakhir pada perceraian dan mendapat keturunan yang sehat dan berkualitas. Jenis penelitian ini adalah jenis penelitian lapangan dengan menggunakan pendekatan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa Pertimbangan hakim dilihat dari sisi pertama pertimbangan alasan pengajuan Dispensasi Kawin, kedua pertimbangan alat bukti di persidangan yang terdiri dari alat bukti tertulis dan saksi-saksi, yang terakhir pertimbangan hukum yang meliputi dari segi hukum positif dan hukum Islam, dimana Hakim melihat pada aspek kemudharatan dan kemaslahatan yang akan didapatkan. Adapun tinjauan maslahat mursalah ada tiga aspek. Aspek masalahat yang pertama adalah aspek perlindungan anak, kedua aspek mencegah terjadinya pernikahan siri dan yang ketiga adalah untuk menjaga kehormatan, sedangkan dari aspek mafsadatnya yaitu pemeliharaan agama tidak tercapai (hifzh al-din), telah terjadi pelanggaran syari’at Islam tentang larangan zina. Ketika berkumpul dua hal antara masalahat dan madharat makal harus dikembalikan kepada kaidah asal yaitu  “Menolak kerusakan harus didahulukan daripada mendatangkan kemaslahatan”.Kata kunci : Dispensasi kawin, Maslahah Mursalah.

Abstract

Abstract : This research aims to narrate the understanding of the concept of the sakinah family for perpetrators of underage marriages in Enggano District, North Bengkulu Regency and its implementation for perpetrators of underage marriages in Enggano District, North Bengkulu Regency. This research is a type of qualitative research, namely a research process that produces descriptive data in the form of written or spoken words from the people interviewed and the behavior observed, where the descriptive data is data collected in the form of words, pictures and not numbers. The results of this research show that the understanding of the concept of sakinah mawaddah warahmah family among early marriage couples in Enggano District, North Bengkulu Regency is understood by various opinions, namely a family founded on love, a family where everyone respects each other and can overcome difficulties in a family way and live in harmony. , a family that is able to create a religious life within the family, accept the strengths and weaknesses of a partner and complement and understand each other, a family that is happy and has time to gather and communicate with each other. The implementation of the sakinah mawaddah warahmah household concept for underage marriage actors in Enggano District, North Bengkulu Regency is as fulfilling each other's rights and obligations as husband and wife, mutual trust, forgiving each other, understanding and advising each other, giving each other love.Keywords: Underage marriage, implementation, sakinah family. Abstrak: Penelitian ini bertujuan untuk menarasikan pemahaman konsep keluarga sakinah pada pelaku pernikahan dibawah umur di Kecamatan Enggano Kabupaten Bengkulu Utara dan implementasinya bagi pelaku pernikahan dibawah umur di Kecamatan Enggano Kabupaten Bengkulu Utara. Penelitian ini termasuk jenis penelitian kualitatif yaitu suatu proses penelitian yang menghasilkan data-data deskriftif yang berupa kata-kata tertulis atau lisan dari orang-orang yang diwawancarai dan prilaku yang diamati, dimana data-data deskriftif tersebut merupakan data yang dikumpulkan berupa kata-kata, gambar dan bukan angka. Hasil dari penelitian ini menunjukkan bahwa pemahaman konsep keluarga sakinah mawaddah warahmah pada pasangan perkawinan usia dini di Kecamatan Enggano Kabupaten Bengkulu Utara dipahami dengan berbagai pendapat yaitu keluarga yang didirikan atas dasar cinta, keluarga yang setiap orangnya saling menghormati dan bisa mengatasi kesulitan secara kekeluargaan dan hidup rukun, keluarga yang mampu menciptakan kehidupan religius dalam keluarga, menerima kelebihan dan kekurangan pasangan serta saling melengkapi dan memahami, keluarga yang bahagia dan punya waktu untuk berkumpul dan saling berkomunikasi.   Adapun implementasi konsep rumah tangga sakinah mawaddah warahmah bagi pelakum pernikahan dibawah umur di Kecamatan Enggano Kabupaten Bengkulu Utara adalah sebagai Saling memenuhi hak dan kewajiban sebagai suami dan istri, Saling Percaya, Saling Memaafkan, Saling Mengerti dan menasehati,  Saling memberi kasih sayang.Kata Kunci: Pernikahan dibawah umur, Implementasi, Keluarga sakinah.

Abstract

Abstracts: This study raises the issue of the process of restorative justice in crimes committed by children at the Bengkulu City Police and the perspective of Islamic law on the application of restorative justice to juvenile crimes. To answer this problem, empirical juridical research was used with direct interviews with investigators on the protection of women and children (PPA) at the Bengkulu City Police. After the data can then be analyzed based on normative descriptive analysis. The results of the study show that: (1) The process of implementing restorative justice for crimes committed by children at the Bengkulu City Police can be carried out in 2 ways; (a) restorative justice can be carried out outside the police office. (b) Restorative justice can be carried out at the police office. (2) The application of restorative justice to juvenile crimes in the perspective of Islamic law prioritizes peace or forgiveness through mediation, reconciliation between perpetrators, victims, law enforcers and the wider community directly participating in solving problems. Islamic law is aligned in law enforcement against children who are in conflict with the law.Keywords: Restorative Justice and Child Crime Abstrak : Penulisan menjelaskan tentang proses restoratif justice pada tindak pidana yang dilakukan anak di Polresta Kota Bengkulu dalam perspektif hukum Islam. Untuk menjawab permasalahan ini digunakan penelitian yuridis empiris dengan wawancara secara langsung kepada penyidik perlindungan perempuan dan anak (PPA) pada Polresta Kota Bengkulu. Hasil penelitian menunjukan bahwa: (1) Proses pelaksanaan restoratif justice pada tindak pidana yang dilakukan anak di Polresta Kota Bengkulu dapat dilakukan 2 cara;(a) restorative justice dapat dilakukan di luar. (b) Restorative justice dapat dilakukan di kantor kepolisian.(2) Penerapan restoratif justice terhadap tindak pidana anak dalam perspektif hukum Islam lebih mendepankan perdamaian atau pemaafan dengan mediasi, rekonsliasi antara pelaku, korban, para penegak hukum dan masyarakat luas ikut secara langsung berpartisipasi dalam menyelsaikan permasalahan. Hukum Islam selaras dalam penegakan hukum terhadap anak yang berhadapan dengan hukum.Kata kunci: Restoratif Justice dan Tindak Pidana Anak

Abstract

Husband’s i’radh In Islamic And Positive Law Perspective, i’radh is the husband who turns away, husband’s i’radh is the beginning  of the cause  of the emergence of nusyuz. In the positive law of Law No. 1 of 1974  concerning Marriage and compilation of Islamic Law does  not  mention  the  problem  of the  husband’s husband explicitly. However,  according  to the author, a husband can be considered as an iadrad  if inside him contains  the elements  of the husband who violate taklik talak. differences and similarities in the views of husbands in the perspective of Islamic law and positive law, among  others.  In Islamic law, it is explicitly mentioned that i’radh in positive law does not explicitly mention  i’radh or nusyuz husband. In Islamic law and positive law both use the path of peace, but when the peace  that is done  is unsuccessful,  the wife can file a divorce. So that this husband could be the cause  of the wife’s divorce  case against  the husband when  he was already  in the behavior, while when he was still within the boundary he could not be the reason  for the divorce

Abstract

Abstract: There is a unique tradition in Bima that takes place before a wedding ceremony, known as kaboro co’i. Kaboro co’i is a communal activity in which people help a fellow resident who is about to get married by collecting funds for the dowry, bride price, and piti ka’a (wedding expenses), with the aim of ensuring the smooth running of the wedding event. This research focuses on the form of the kaboro co’i tradition in Bima's wedding customs and the perspective of legal pluralism theory on this tradition. This study is an empirical legal research using a sociological approach, examining law in relation to social aspects. Data were obtained through interviews and documentation, and then processed through data reduction, data presentation, and conclusion drawing. The results show that: (1) The kaboro co’i tradition arises from the awareness of the Bima community, which is characterized by strong kinship and mutual assistance. This tradition provides benefits to families preparing for a wedding, particularly by contributing additional funds for the dowry, bride price, and piti ka’a (non-refundable wedding funds), to support the smooth execution of the ceremony. (2) The tradition reflects values of kinship, mutual cooperation, and customary norms. These values are the foundation for the continued practice of kaboro co’i today. (3) The kaboro co’i tradition is a clear example of strong legal pluralism within the Bima community. In the perspective of John Griffiths’ theory of legal pluralism, law does not originate solely from the state, but can also emerge from the customs and informal rules practiced in daily life. This tradition is based on natural customs followed by the community without state intervention. Therefore, the recognition and protection of customary law are essential for developing an inclusive and contextual legal system.Keywords: Tradition; Kaboro Co’i; Legal Pluralism.Abstrak: Terdapat tradisi yang unik di Bima sebelum dilaksanakannya pernikahan, yaitu tradisi kaboro co’i. Kaboro co’i merupakan kegiatan masyarakat untuk membantu salah seorang warga yang akan melaksanakan pernikahan guna mengumpulkan uang mahar, maskawin, dan piti ka’a (uang untuk biaya pernikahan), yang bertujuan memperlancar keberlangsungan acara perkawinan. Penelitian ini menyoroti bentuk tradisi kaboro co’i dalam perkawinan masyarakat Bima serta perspektif teori pluralisme hukum terhadap tradisi tersebut. Penelitian ini merupakan jenis penelitian hukum empiris dengan pendekatan sosiologis yang mempelajari hukum dalam kaitannya dengan aspek sosial. Hasil penelitian menunjukkan bahwa: (1) Tradisi kaboro co’i muncul dari kesadaran masyarakat Bima yang identik dengan rasa kekeluargaan yang kuat dan saling membantu satu sama lain. Tradisi ini memberikan manfaat, khususnya bagi keluarga yang akan melangsungkan pernikahan, berupa tambahan dana untuk mahar, maskawin, dan piti ka’a (uang hangus) guna memperlancar acara perkawinan. (2) Tradisi ini mengandung nilai kekeluargaan/kekerabatan, nilai gotong royong, dan nilai adat istiadat. Nilai-nilai inilah yang menjadi dasar mengapa tradisi kaboro co’i masih dilaksanakan hingga kini. (3) Tradisi kaboro co’i merupakan contoh nyata pluralisme hukum yang kuat dalam masyarakat Bima. Dalam perspektif pluralisme hukum John Griffiths, hukum tidak hanya berasal dari negara, tetapi juga dapat lahir dari kebiasaan dan aturan yang dijalankan masyarakat sehari-hari. Tradisi ini muncul atas dasar kebiasaan dan aturan alami masyarakat Bima tanpa intervensi negara. Oleh karena itu, pengakuan dan perlindungan terhadap hukum adat menjadi penting dalam membangun sistem hukum yang inklusif dan kontekstual.Kata Kunci: Tradisi; Kaboro Co’i; Pluralisme Hukum.

Abstract

Abstract: The research discusses the concept of supervision carried out by the Supreme Court in realizing a clean judiciary. The research method used is library research which is a search for library resources. This resarch used the syar’i approach which is an approach to the provisions of Islamic teachings and a juridicial approach which is an approach to the main legal materials by examining theories, concept, principles and laws and regulations. The research found an existanceof supervisory system that can be accomplished which consist of a self-control system, an In-Depth Control Systems which meant a supervisory system that accomplished by the leaderto his subordinates which performed by the supervisory apparatus specifically appointed in a work unit known as the Supervisory Body of the Supreme Court of the Republic of Indonesia Keywords: Supervision, Self-Control Systems, In-Depth Control Systems, Functional Surveillance Systems Abstrak: Penelitian tersebut membahas tentang konsep pengawasan yang dilakukan Mahkamah Agung dalam mewujudkan peradilan yang bersih. Pendekatan yang digunakan yaitu pendekatan syar’i merupakan pendekatan terhadap ketentuan dalam ajaran Islam dan pendekatan yuridis yaitu pendekatan terhadap bahan-bahan hukum utama dengan menelaah teori, konsep, asas dan peraturan perundang-undangan. Abstract: A criminal act is an act that is prohibited by a rule of law, which prohibition is accompanied by threats or sanctions in the form of certain crimes, for anyone who violates the prohibition. It can also be said that a criminal act is an act which is prohibited by a rule of law and is punishable by punishment, as long as it is kept in mind that the prohibition is aimed at an act, namely a situation or an event caused by a person’s behavior, while the criminal threat is directed at a person who causes a crime. that incident. Between prohibition and punishment there is a close relationship, because between the incident and the person who caused the incident there is also a close relationship, which cannot be separated from the others. Sexual intercourse is any act that ranges from sexual harassment to the act of forcing someone to have sexual intercourse without the victim’s consent or when the victim does not want it, and/or having sexual intercourse in ways that are unnatural or not liked by the victim and distances him from his sexual needs. Abstract: Currently, cases of infidelity leading to divorce are frequently encountered. In Islamic law, if a husband finds out about his wife’s adultery without any witnesses, they can resort to li’an based on the evidence from Surah al-Nur, verses 6-10. Similarly, in positive law, a husband can sue his wife for adultery. There arises a new issue concerning the status of children resulting from li’an in the perspectives of Islamic law and positive law, which exhibit differences. In the field of Quranic exegesis, understanding the content, intentions, and laws within Quranic verses is known as kajian dalalah al-fadh ala al-ahkam in the Quran. Furthermore, as Indonesian citizens, there's a bond with national laws. Therefore, this study examines from two viewpoints: Islamic law and positive law. The aim is to examine Quranic verses regarding li’an using the approach of dalalah al-fadh ala al-ahkam in the Quran and also from the perspective of positive law. The research method employed is descriptive qualitative through library research. The findings indicate that Surah al-Nur, verses 6-10, fall under dalalah al-ibarah as it distinctly reveals the purpose, intent, and law it encompasses, specifically the law of li’an In the perspective of Islamic law, the status of a couple engaged in li’an will be terminated, and there can be no reconciliation; the child resulting from li’an is not attributed to their biological father and does not inherit any rights from him. However, according to positive law, the proven adulterous party may face a maximum penalty of nine months' imprisonment, provided there's a report from the aggrieved party. The status of a couple involved in li’an is divorce, and reconciliation is not possible. The child from li’an can still be attributed to the biological father through legal means in positive law.Keywords: Alquran, Dalalah, Li’an, Positive Law.  Abstrak: Pada saat ini sering ditemui kasus perselingkuhan hingga menyebabkan perceraian. Sekiranya seorang suami mengetahui istrinya berzina sedangkan tidak ada saksi yang menyaksikannya maka dalam hukum Islam pasangan ini dapat melakukan li’an dengan dalil surat al-Nur ayat 6-10. Begitu juga dalam hukum positif, seorang suami dapat menggugat istrinya karena selingkuh. Terdapat masalah baru dalam status anak dari li’an dalam perspektif hukum Islam dan hukum positif yang memiliki perbedaan. Dalam kaidah tafsir untuk mengetahui kandungan maksud dan hukum dalam ayat Al-Qur’an dikenal dengan kajian dalalah al-fadz ala al-ahkam dalam Alquran. Selain itu sebagai warga negara Indonesia tentu terikat juga dengan undang-undang sehingga penelitian ini mengkaji dari dua perspektif, hukum Islam dan hukum positif. Penelitian ini bertujuan mengkaji ayat-ayat Alquran tentang li’an dengan pendekatan dalalah al-fadz ala al-ahkam dalam Alquran dan juga perspektif hukum positif. Metode yang dipakai artikel ini adalah kualitatif deskriptif dengan pendekatan library research. Hasil penelitian menunjukkan bahwa surat al-Nur ayat 6-10 termasuk dalalah al-ibarah karena terlihat jelas maksud, tujuan dan hukum yang dikandungnya yakni hukum li’an. Status pasangan yang li’an perspektif hukum Islam akan terputus dan tidak dapat rujuk selamanya, anak dari li’an tidak dinasabkan kepada bapak biologisnya dan tidak mendapat hak apapun darinya. Sedangkan menurut hukum positif pihak yang terbukti selingkuh mendapat hukuman paling lama sembilan bulan penjara dengan catatan ada laporan dari pihak yang dirugikan. Status pasangan yang terlibat li’an adalah cerai dan tidak bisa rujuk. Anak dari li’an masih bisa dinasabkan kepada bapak biologis dengan jalur hukum.Kata kunci: Alquran, Dalalah, li’an, Hukum Positif.

Abstract

The  purpose of this study  is to first describe  the  views of Quraish  Shihab  and  Siti Musdah  gloriously looking  at polygamy  verses, the practice of polygamy  of the Prophet and  the fair terms of polygamy,  secondly  to describe  a fair concept in polygamy  according  to Quraish  Shihab  and Siti Musdah  Mulia, third to describe  the legal arguments of Quraish  Shihab  and Siti Musdah  His Majesty of fair concepts  in polygamy.  This research  method is literature  research  using qualitative  description research  method. Based on the results of research  and discussion can be drawn the following conclusions:  First, in understand- ing the verses of polygamy,  Quraish  Shihab  argues that based  on the demands of fair treatment of orphans as an accentuation of this paragraph, the context of emphasis  on the command to be fair and polygamy  verses do not make regulations  about  po- lygamy, because it has been  known and implemented by adherents of various shari’a religion and community traditions before the decline of this verse. Siti Musdah Mulia sees that of the whole verse of marriage, First, polygamy  is contrary to the principle and  purpose of marriage  of Islam. Secondly,  QS. An-Nisa verse 3 does  not speak  in the context  of polygamous justification, but in the context of protection for orphans and  women  from injustice behavior. Second, M. Quraish  Shihab  gives insight into the practice of polygamy of the Prophet (s), nor can it be said that Rasulullah SAW marries more than one, and such marriages should  be imitated,  because not all what is done  by the Prophet needs  to be imitated.Sedangkan Siti Musdah  Mulia, the as- sumption  that polygamy  Prophet is a sunnah that can be made  hujjah.  Thirdly, Justice  of polygamy  according  to M. Quraish Shihab  is fair in the field of immaterial  (love). Siti Musdah  Mulia gives the view that there are two main points in looking at the fair concept  in polygamy.  First, the just is meant  not only in terms of material  things such as livelihood but also in the immate- rial matter,  namely  the tendency of love and  compassion. Second, fair criteria covering two aspects  in it, impossible  or hardly anyone can afford to fulfill the prophet SAW
