Abstract

Abstract: “Sanctions for Givers and Recipients of Gratification Based on Islamic Criminal Law.” In various Hadith literature, the status of gratification perpetrator has not been fully explained. This can be seen from differences among scholars whether it is included into bribery or a halal gift. On the other hand the status of bribes and giving prizes is clear enough, unlike the status of gratification which still in debate among scholars. Similarly, sanctions for the perpetrators of gratification are not mentioned explicitly. The sanctions are more dominated by moral aspect that still needs further interpretation. The results of this study conclude that gratification in the sense of giving prizes in the form of money, bonuses or other services that are lawful to officers or officials is essentially legal as long as there is no agreement in the beginning, not excessive, and not given in advance (before the affairs are completed). However, the sanctions for those perpetrators of gratification in the sense of giving the prizes promised at the initial term, or granted before the completion of the affairs, in Islamic criminal law those givers and the recipients may be subject to punishment or in Islam known as takzir (the form and size of the punishment shall be submitted to an official judge appointed by the legitimate government).

Abstract

Abstracts: This paper discusses the review of Maslahah Mursalah on Fines for Cancellation of Engagement in the Sub-district of Pesisir Bukit Sungai Penuh. The research objectives in this paper are: (1) How is the practice of engagement cancellation fines in Pesisir Bukit Sungai Penuh? (2) How is the Maslahah Mursalah review of engagement cancellation fines in Pesisir Bukit Sungai Penuh? The research method used in this research is field research, namely collecting data through the field directly. The research location is on the Bukit Coast of Sungai Penuh. The informants in this study were local traditional leaders, and both parties who had canceled the engagement and then paid a fine at Pesisir Bukit Sungai Penuh. Data collection techniques were carried out by direct interviews with related parties and documentation. The results of the study are (1) The determination of fines on the cancellation of the engagement (tundum malau) is a way to make up for the shame of the party who was canceled or abandoned by his fiancée and as a form of compliance with local customs. (2) From the perspective of maslahah mursalah, the cancellation of engagement can damage the honor and brotherhood of Muslims even though there is no prohibition, while the fine is considered as maslahah muursalah for the injured party with certain conditions.Keywords: Cancellation of engagement, maslahah mursalah, and Sungai Penuh Abstrak: Tulisan ini membahas tinjauan Maslahah Mursalah terhadap Denda Pembatalan Pertunangan Kecamatan Pesisir Bukit Sungai Penuh. Tujuan penelitian tulisan ini yaitu: (1) Bagaimana praktik denda pembatalan pertunangan di Pesisir Bukit Sungai Penuh? (2) Bagaimana tinjauan maslahah mursalah terhadap denda pembatalan pertunangan di Pesisir Bukit Sungai Penuh?. Adapun metode penelitian yang digunakan dalam penelitian ini yaitu penelitian lapangan (field research) yaitu pengeumpulan data melalui lapangan langsung. Lokasi penelitian di Pesisir Bukit Sungai Penuh. Informan pada penelitian ini adalah Tokoh Adat setempat, dan kedua belah pihak yang pernah membatalkan pertunangan  lalu membayar denda di Pesisir Bukit Sungai Penuh. Teknik pengumpulan data dilakukan dengan wawancara langsung terhadap pihak terkait dan dokumentasi. Hasil dari penelitian adalah (1) Penetapan denda pada pembatalan pertunangan (tundum malau) adalah cara agar penebusan malu terhadap pihak yang dibatalkan atau ditinggalkan oleh tunangannya dan sebagai bentuk kepatuhan terhadap adat setempat. (2) Perspektif maslahah mursalah, pembatalan pertunangan dapat merusak kehormatan dan persaudaraan umat Muslim meskipun tidak ada pelarangan, sementara hukuman denda dianggap sebagai maslahah muursalah bagi pihak yang dirugikan dengan syarat tertentu.Kata kunci: Pembatalan Pertunangan, maslahah mursalah, dan Sungai penuh

Abstract

Abstract : This research is to analyze the urgency of marriage agreements in forming a sakinah family, and the perspective of Islamic family law regarding marriage agreements in order to form a sakinah family. This research method is a qualitative method, with a type of library research. The results of this study are: First, the urgency of the marriage agreement in controlling the use of husband and wife's assets is that the marriage agreement has good benefits as a preventive measure in the event of a divorce because the making of a marriage agreement will facilitate the distribution of assets here and there. The marriage agreement regulates the consequences of marriage related to assets, the marriage agreement is also carried out to minimize and avoid disputes between husband and wife, as well as provide legal certainty between the rights and obligations of each party. The urgency of a marriage agreement in forming a sakinah family is to form a happy family, make a marriage agreement which includes communication issues, personal and joint property, biological needs, economic issues, and appearance. The marriage agreement includes a form of mashlaahaah for husband and wife to achieve maqaasiid asy-shari'ah. Through the marriage agreement, what is the aim of the Shari'a, namely to achieve benefit, can be realized/achieved. Second, the marriage agreement in order to form a sakinah family in the perspective of Islamic family law is to build a sakinah family, and overcome problems that arise in the family and society. The marriage agreement demands his goodness and does not demand it other than that whatever happens, mawaddah has decorated one's heart. Who owns it, he will never break ties no matter what. If so, this word carries the meaning of love, but it is love plus. The meaning of this word is similar to the meaning of the word grace. It's just that, mercy is addressed to those who are blessed, while those who are blessed are in a state of need. Keywords: Marriage Agreement, Sakinah Family, Islamic Family Law Abstrak: Penelitian ini untuk menganalisis urgensi perjanjian perkawinan dalam membentuk keluarga sakinah, dan perspektif hukum keluarga Islam tentang perjanjian perkawinan dalam rangka membentuk keluarga sakinah. Metode penelitian ini adalah metode kualitatif, dengan jenis penelitian library research. Adapun hasil penelitian ini adalah : Pertama, Urgensitas perjanjian perkawinan dalam mengantur penggunaan harta suami dan istri adalah bahwa perjanjian perkawinan mempunyai manfaat yang baik sebagai tindakan prefentif apabila terjadinya perceraian karena dibuatnya perjanjian perkawinan akan mempermudah pembagian harta gono-gini. Perjanjian perkawinan mengatur akibat perkawinan yang berhubungan dengan harta kekayaan, perjanjian perkawinan juga dilakukan untuk meminimalisir dan menghindari terjadinya perselisihan antara suami istri, serta memberikan kepastian hukum antara hak dan kewajiban masing-masing pihak. Urgensi perjanjian perkawinan dalam membentuk keluarga sakinah yakni membentuk keluarga yang bahagia, membuat perjanjian perkawinan yang meliputi masalah komunikasi, harta pribadi maupun bersama, kebutuhan biologis, masalah ekonomi, dan penampilan. Perjanjian perkawinan termasuk bentuk mashlaaha bagi pasangan suami istri untuk tercapainya maqaasiid asy-syari’ah. Melalui perjanjian perkawinan, apa yang menjadi tujuan syariat yaitu untuk mencapai kemaslahatan bisa terwujud/tercapai. Kedua, Perjanjian perkawinan dalam rangka membentuk keluarga sakinah dalam perspektif hukum keluarga Islam adalah untuk terbangunnya keluarga sakinah, dan mengatasi permasalahan yang timbul dalam keluarga dan masyarakat. Perjanjian perkawinan menghendaki untuknya kebaikan serta tidak menghendaki untuknya selain itu apa pun yang terjadi mawaddah telah menghiasi hati seseorang. Siapa yang memilikinya, dia tidak pernah akan memutuskan hubungan, apa pun yang terjadi. Jika demikian, kata ini mengandung makna cinta, tetapi ia adalah cinta plus. Makna kata ini mirip dengan makna kata rahmat. Hanya saja, rahmat tertuju kepada yang dirahmati, sedangkan yang dirahmati itu dalam keadaan butuh. Abstract

Maqasid  Syariah  is the  objective  of recommendation for Islamic law, while Isbat marriage  is the  endorsement  of marriages  that have been  held according  to Islamic Shari’a,  but not recorded by Religious Affairs Office (KUA) or the Marriage Registry Official (PPN) authorized. The compilation of Islamic Law which has the power  of Inpres limits the permissible  cases to be attributed. The formulation of this research  problem  is how the basis of judges’ consideration as well as how the analysis of maqasidsyariah to the determination of the case Number  0110  / Pdt.P  / 2016  / PA.AGM and  Number  0128  / Pdt.P  / 2016/ PA.AGM about  isbat marriage. The research  method was used  qualitative  descriptive  analysis  that was the data  processing obtained in the field study result which then combined with data  obtained from literature  study, in order  to obtainthe accurate data.  The approach was used  the juridical approach. The location  of the research  was conducted in Arga Makmur  Religious Court. Primary data  sources obtained through  interviews with Judges  involved in the establishment of isbat marriage. Second- ary data  sources  was included  the legislation and  court decisions,  coupled  with literature  relevant  to marriageisbat issues. The result of the research  was found  that judge consideration in the determination of case Number  0110  / Pdt.P  / 2016  / PA.AGM and Number  0128 / Pdt.P / 2016 / PA.AGM on marriage  isbat based  on juridical, philosophical and sociological considerations. The juridical isbat marriage  regulated in the Compilation of Islamic Law through  Presidential  Instruction  Number  1 of 1991. The determination of marriage  isbat was supported by the evidence  on the facts in the hearing.  Maqasid  sharia  in the case of marriage  isbat in Islamic law that is to realize and maintain mashlahat mankind on marital status and status of child in marriage.. Abstract

Abstrak: Penelitian ini bertujuan untuk menganalisis proses internalisasi nilai-nilai moderasi beragama dalam membangun ASN moderat sebagai upaya menangkal ekstremisme di lingkungan Dinas Kesehatan Provinsi Bengkulu. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan rancangan studi kasus. Data dikumpulkan melalui wawancara mendalam, observasi, dan dokumentasi terhadap aparatur sipil negara (ASN) di lingkungan Dinas Kesehatan. Hasil penelitian menunjukkan bahwa internalisasi nilai-nilai moderasi beragama dilakukan melalui sosialisasi kelembagaan, keteladanan pimpinan, dan pembiasaan budaya kerja yang inklusif. Faktor pendukung internalisasi meliputi komitmen pimpinan, dukungan regulasi pemerintah, serta partisipasi aktif ASN dalam kegiatan pembinaan moderasi. Adapun hambatannya terletak pada rendahnya literasi digital keagamaan dan pengaruh media sosial yang memunculkan polarisasi ideologis. Penelitian ini menawarkan model pembinaan ASN berbasis moderasi maqashidi, yang memadukan nilai-nilai wasathiyah Islam dengan etika profesional ASN untuk mencegah ekstremisme di sektor birokrasi. Penelitian ini berkontribusi dalam pengembangan teori internalisasi nilai moderasi di lembaga pelayanan publik dan memberikan rekomendasi praktis bagi pemerintah daerah untuk membangun ASN moderat, humanis, dan adaptif terhadap keberagaman.Kata kunci: Moderasi Beragama, Internalisasi Nilai, ASN Moderat, Ekstremisme, Moderasi Maqashidi. Abstract : This study aims to analyze the process of internalizing religious moderation values in developing moderate civil servants (ASN) as a preventive effort against extremism within the Bengkulu Provincial Health Office. The research applied a descriptive qualitative approach with a case study design. Data were collected through in-depth interviews, observations, and documentation involving civil servants within the institution. The findings indicate that the internalization of religious moderation values is implemented through institutional socialization, leadership role modeling, and the habituation of inclusive work culture. Supporting factors include leadership commitment, regulatory support, and active participation of ASN in religious moderation training programs. In contrast, the obstacles lie in the low level of digital religious literacy and social media influences that trigger ideological polarization. This study proposes a maqashidi-based moderation model, integrating Islamic wasathiyah principles with ASN professional ethics to prevent bureaucratic extremism. The study contributes theoretically to developing the internalization model of religious moderation within public institutions and provides practical recommendations for local governments to foster moderate, humanist, and diversity-sensitive civil servants.Keywords: Religious Moderation, Value Internalization, Moderate Civil Servant, Extremism, Maqashidi Moderation.

Abstract

Abstract : In Islamic law, the relationship between Complete Systematic Land Registration and Maqasyid Al-Sharia is through land registration, the rights of citizens to protect their objects in the form of land can be realized and that is also the goal of Maqasyid Al-Shariah to be achieved. It is described in this paper, how is the implementation of PTSL, how is the legal certainty of ownership of land rights in PTSL, and how is the Islamic legal perspective on the implementation of PTSL and ownership of land rights. In order to speed up the land registration process in Indonesia, a new breakthrough was issued, namely the Complete Systematic Land Registration or abbreviated as PTSL which is regulated through the provisions of the Minister of Agrarian Regulation Number 6 of 2018 concerning Complete Systematic Land Registration. Regarding legal certainty, things that need to be considered in land registration are the principle of publicity, installation of boundary signs and the application of the principle of Contradicture Delimitation or the presence of the owner and witnesses bordering. The relationship between Islamic law and land registration is a form of government responsibility in carrying out the mandate of the Basic Agrarian Law. This research is a qualitative-empirical research by means of field research or observation and conducted by interview. Keywords: Complete Systematic Land Registration, Maqasyid Al-syari’ah Abstrak : Di dalam hukum Islam hubungan antara pendaftaran Tanah Sistematis Lengkap dan maqasyid Alsyariah adalah melalui pendaftaran tanah, hak-hak warga negara untuk melindungi bendanya berupa tanah dapat terwujud dan itu juga merupakan tujuan dari maqasyid Al-Syariah yang hendak dicapai. Dijelaskan di dalam tulisan ini, bagaimana pelaksanaan PTSL, bagaimana kepastian hukum kepemilikan hak atas tanah dalam PTSL, dan bagaimana Perspektif hukum islam terhadap Pelaksanaan PTSL dan kepemilikan hak atas tanah. Guna mempercepat proses pendaftaran tanah di Indonesia, dikeluarkanlah terobosan baru yaitu Pendaftaran Tanah Sitematis Lengkap atau yang disingkat PTSLyang diatur melalui ketentuan Peraturan Menteri Agraria Nomor 6 Tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap. Terkait kepastian hukum, hal-hal yang perlu diperhatikan dalam pendaftaran tanah yaitu, asas publisitas, pemasangan tanda batas dan penerapan asas Contradicture Delimitasi atau kehadiran pemilik dan saksi berbatasan. Hubungan hukum islam dan pendaftaran tanah merupakan sebuah bentuk tanggungjawab pemerintah dalam menjalankan amanat Undang-undang Pokok Agraria. Abstract

This research raises  the problem about  sexual  deviation  in the relationship of husband and wife of Islamic law perspective and Law No. 23 of 2004 on Domestic Violence. Based  on the analysis can be disipmulkan that form of sexual deviation  husband to wife like: (1) sexual  sadism which  is one form of variation in relationship of husband and wife. The behavior  of sexual sadism involves giving a stimulus to her partner in a sadistic way. This behavior  is usually accompanied by the act of tying his partner, close his partner’s  eyes, and silenced his partner’s  mouth. (2) Fucking at the wife’s rectum because it can be likened  to liwath (homo sex), because the rectum is a dangerous and dirty place. Analysis of Islamic law against sexual deviation (sexual sadism) also contains elements of persecution and danger. Which element of persecution and danger  is prohibited by Islam. Because it can harm yourself and others,  and not in accordance with the goals of Islam that brings grace to the universe that requires all human beings to live in a state of serenity and at the same time eliminate the danger  to mankind. While in some verses, the Qur’an has hinted  that Allah Almighty. Do not like people who like to do damage and persecution (kemafsadatan). Sexual lapses  of husbands against wives according to Article 8 Letter A of Law no. 23 of 2004 includes violent acts defined  as any act of coercion of sexual  intercourse, coercion of sexual  intercourse in an unnatural way and or disliked by a wife.

Abstract

Abstract: The purpose of this study was to determine the inheritance distribution system based on customary kinship in XIV Koto District. Second, to analyze the inheritance distribution based on customary kinship in XIV Koto District, Mukomuko Regency. This type of research is qualitative descriptive research. This study concludes that: First, the distribution of inheritance according to customary law in XIV Koto District, Mukomuko Regency is: carried out by deliberation. The types of inherited property are high inheritance property and low inheritance property, namely joint property between husband and wife. Heirs according to customary law are biological children, the husband or wife of the testator and parents if the testator does not have a wife and children. Women are given priority in the distribution of inheritance so that they get a larger or equal share than men. Second, deliberation in the distribution of customary inheritance property in XIV Koto District can be said to be 'urf sahih because it does not conflict with Islamic teachings. When viewed from the area of validity or generality, the distribution of inheritance based on customary kinship in XIV Koto District is included in the 'urf khas (special customs), namely customs that apply in certain areas and communities and do not apply in other areas or communities in general. However, according to the customary system of the people in XIV Koto District, women receive a larger inheritance or can be the same as men, although this is decided through deliberation, which is different from the Islamic inheritance system.Keywords: customs, inheritance, kinship. Abstrak : Tujuan penelitian untuk mengetahui sistem pembagian harta warisan berbasis kekerabatan adat di Kecamatan XIV Koto. Kedua, menganalisis pembagian warisan berbasis kekerabatan adat di Kecamatan XIV Koto Kabupaten Mukomuko. Jenis penelitian ini adalah penelitian deskriptif kualitatif. Penelitian ini menyimpulkan bahwa: Pertama, pembagian warisan menurut adat kaum di Kecamatan XIV Koto Kabupaten Mukomuko adalah: dilakukan dengan cara musyawarah. Jenis harta yang diwariskan adalah harta pusaka tinggi dan harta pusaka rendah yaitu harta bersama suami isteri. Ahli waris menurut adat kaum adalah anak kandung, suami atau istri pewaris dan orang tua jika pewaris tidak mempunyai isteri dan anak. Pihak perempuan lebih diutamakan dalam pembagian waris sehingga memperoleh bagian yang lebih besar atau sama dengan pihak laki-laki. Kedua, bermusyawarah dalam pembagian harta warisan adat kaum di Kecamatan XIV Koto dapat dikatakan sebagai ‘urf shahih karena tidak bertentangan dengan ajaran Islam. Jika dilihat dari wilayah keberlakuan atau keumumannya, pembagian warisan berbasis kekerabatan adat di Kecamatan XIV Koto ini termasuk dalam ‘urf khas (adat kebiasaan khusus), yaitu kebiasaan yang berlaku di daerah dan masyarakat tertentu dan tidak berlaku di daerah atau masyarakat lain secara luas. Hanya saja, menurut sistem adat kaum di Kecamatan XIV Koto pihak perempuan mendapatkan harta waris lebih besar atau bisa sama dengan laki-laki, meskipun hal ini diputuskan melalui musyawarah adalah hal yang berbeda dengan sistim kewarisan Islam.Kata kunci: adat, warisan, kekerabatan.

Abstract

Abstract: The formulation of the research problem is: 1) How is the fulfillment of children’s livelihood rights due to divorce in Ulu Talo District, Seluma Regency? 2) How is the implementation of the fulfillment of children’s livelihood rights due to divorce in Ulu Talo District, Seluma Regency, from a Islam law perspective?. The type of research is field research (field research). Data collection uses observation, interview and documentation techniques which are analyzed based on reading and quoting information. This study concludes that: 1) Fulfillment of the Child’s Livelihood Rights Due to Divorce In Ulu Talo Subdistrict, Seluma Regency, the fulfillment of the responsibility to meet the needs of the child after divorce, only the mother of the child (ex-wife) and assisted by the mother’s parents in mutual cooperation , by the way the mother works and has a business. 2) According to the Compilation of Islamic Marriage Law on Child Care Article 156 (d) in the event of a divorce “All hadhanah costs and child maintenance are the responsibility of the father according to his ability, at least until the child is an adult able to take care of himself (21 years old). Keywords: Children’s Livelihood Rights Due to Divorce. Abstrak: Rumusan masalah penelitian ini adalah : 1) Bagaimana pemenuhan hak nafkah anak akibat perceraian di Kecamatan Ulu Talo Kabupaten Seluma? 2) Bagaimana pelaksanaan pemenuhan hak nafkah anak akibat perceraian di Kecamatan Ulu Talo Kabupaten Seluma perspektif hukum Islam?. Jenis Penelitian adalah penelitian lapangan (field reseacrh). Pengumpulan data menggunakan teknik observasi, wawancara dan dokumentasi yang di analisa berdasarkan dengan membaca dan mengutif informasi. Penelitian ini menyimpulkan bahwa: 1) Pemenuhan Hak Nafkah Anak Akibat Perceraian Di Kecamatan Ulu Talo Kabupaten Seluma, pemenuhan tersebut yang menanggung untuk memenuhi kebutuhan anak setelah bercerai, hanya ibu dari anak (mantan istri) dan dibantu oleh orangtua dari pihak ibu secara bergotong-royong, dengan cara ibu bekerja dan mempunyai usaha. 2) MenurutKompilasi Hukum Islam Perkawinan tentang Pemeliharaan Anak Pasal 156 (d) jika terjadinya perceraian “Semua biaya hadhanah dan nafkah anak menjadi tanggung jawab ayah menurut kemampuannya, sekurangkurangnya sampai anak tersebut dewasa dapat mengurus diri sendiri (21 tahun). Kata Kunci: Hak Nafkah Anak Akibat Perceraian

Abstract

This research raised  problems response the  public  about  free  and  marriage marriage paid  at  home in the kecamatan kua largest  city bengkulu .The purpose of this study is to find response the  public  about  free and  marriage marriage paid  at home in the  kecamatan kua  largest  city bengkulu .This research use  method juridical  empirical , to technique data collection interview,  chief and documentation, after data obtained were  analysed according to miles and huberman in sugiyono  to analyze  qualitative  may be done  by means reduction the data  reduction) , presentation of the data  display)  , conclusion (verification) , so that it can  be drawn  a conclusion to answer of any the  existing problems. The research showed response the  public  about  free  marriage in the  kecamatan kua  largest  city bengkulu who  gives responnya through  chief and interview  known  that the community kecamatan largest city bengkulu less responding well, this is proven  than 100 % the results  of the answer informants them  do not know  with the establishment of pp .48 2014 that marriage at the kua free then the community kecamatan largest city bengkulu does not agree with marriage at the kua although free this is proven from the answers of the informants 86 % does not agree with marriage at the kua and response the public about  marriage paid at home welcome positive although must spend money  which is not a little .This is proven from the answer chief informants said that they did not mind spent budget  of rp .600,000,—when married at home of 94 %, then the community approve marriage outside the kua equal  to 100 %
