Abstract

Pandemi COVID-19, yang dimulai pada akhir tahun 2019 silam telah mengubah lanskap kehidupan global secara drastic, membawa dampak besar pada sektor Kesehatan, sosial, dan ekonomi. Di Indonesia, penanganan pandemi ini memerlukan perhatian khusus, terutama dalam kaitannya dengan hak-hak individu, perlindungan tenaga medis, serta implementasi kebijakan Kesehatan Masyarakat. Artikel ini bertujuan untuk mengkaji peran hukum Kesehatan dalam penanganan COVID-19, di Indonesia, dengan focus pada aspek hukum yang mengatur ha katas Kesehatan, kewajiban vaksinasi, pelaksanaan karantina, dan perlindungan tenaga Kesehatan. Dalam kajian ini, digunakan beberapa dasar hukum yang relevan, antara lain UU No. 36 Tahun 2009 tentang Kesehatan, serta berbagai peraturan presiden yang mengatur pengadaan vaksin dan pembatasan sosial berskala besar. Isu utama yang muncul selama pandemi COVID-19, terkait hukum Kesehatan meliputi dilemma antara kepentingan public dan privasi individu dalam hal pelacakan kontak dan pengelolaan data Kesehatan, serta implementasi kewajiban vaksinasi yang menimbulkan peradaban mengenai kebebasan individu versus keselamatan Masyarakat. Perlindungan hukum bagi tenaga Kesehatan juga menjadi perhatian penting, mengingat resiko tinggi yang mereka hadapi selama menjalankan tugas di garis depan. Selain itu, pemberlakuan sanksi hukum bagi pelanggar protokol Kesehatan seperti penggunaan masker dan pembatasan mobilitas menimbulkan tantangan terkait dengan prinsip keadilan, khususnya dalam penegakan hukum yang adil dan setara.

Abstract

Peraturan Menteri Kesehatan No. 2 Tahun 2025 telah menimbulkan polemik karena dianggap membatasi akses terhadap dianggap membatasi akses terhadap layanan kesehatan seksual dan reproduksi, khususnya bagi perempusn dan kelompok rentan. Artikel ini bertjuan untuk mengkaji isi regulasi tersebut serta mengidentifikasi pasal-pasal yang menimbulkan kontroversi. Dengan pendekatan yuridis normatif dan disukung analisis data sekunder, artikel ini menekususri kesesuaian regulasi tersebut dengan hukum nasional dan standar hak asasi manusia internasional. Selain itu, kajian ini menyertakan studi kasus dan pandangan dari berbagai pihak, termasuk LSM dan tenaga medis, untuk menggambarkan dampak nyata regulasi terhadap hak kesehatan masyarakat. Temuan ini menunjukkan bahwa Permenkes No. 2 Tahun 2025 berpotensi bertentang dengan prinsip otonomi tubuh, hak atas layanan kesehatan yang aman, serta beberapa undang-undnag dan konvensi internasional. Artikel ini merekomendaiskan revisi regulasi serta peningkatan partisipasi publik dalam penyusunan kebijakan kesehatan.

Abstract

This study aims to analyze the dynamics of public opinion on the legality of President Jokowi's bachelor's degree from a legal, ethical, and political perspective. This study uses a qualitative approach with a literature study method, examining legal documents, online news, and academic studies from 2019–2024. The results of the study show that legally, President Jokowi's diploma has been declared valid by the court and related educational institutions. However, public perception is still influenced by narratives on social media that are not based on legal evidence. From an ethical perspective, legal leadership is still required to be transparent and ethical so as not to lose moral legitimacy. The discussion also shows the importance of legal literacy and fair public communication in responding to political issues that contain the potential for disinformation. These findings conclude that synergy between law, ethics, and politics is needed to strengthen public trust in state institutions and legitimate leaders.

Abstract

This research aims to analyze the loss of shame among perpetrators of corruption in Indonesia and its relationship to the culture of impunity and the ineffectiveness of punishment from the perspective of legal sociology. This study uses a descriptive qualitative approach with a literature study method on academic documents, research reports, and current news. The analysis was carried out using content analysis and critical interpretation of secondary data. The results of the study indicate that shame as a social sanction no longer functions in corruption cases due to the weak social reaction and tolerance of society towards deviant elites. On the other hand, the inconsistent and often symbolic legal system fails to have a deterrent effect on perpetrators. The culture of impunity that occurs systematically causes the delegitimization of law in the eyes of the public. This article emphasizes the need for a more holistic legal approach based on the reconstruction of social values ​​so that corruption is no longer a practice that is normally accepted in public life.

Abstract

This research examines how cultural values influence the development and structure of commercial law across different societies, addressing the critical question of whether business regulations simply reflect technical economic requirements or embody deeper cultural values about appropriate commercial conduct. The study employs a qualitative methodology based on systematic literature review, analyzing over 200 academic sources from multiple disciplines including law, sociology, anthropology, and economics to identify patterns in how cultural values shape commercial law development. The research utilizes thematic analysis to examine cultural transmission mechanisms and contemporary challenges in cultural-legal interactions within commercial regulatory frameworks. The findings reveal that cultural values serve as fundamental determinants of commercial law structure, influencing property rights concepts, corporate governance frameworks, and regulatory enforcement mechanisms across different societies. The research identifies specific cultural transmission mechanisms including legal education institutions, judicial decision-making processes, professional organizations, and international legal transplantation that embed cultural values within commercial law systems. Contemporary challenges including globalization, digital transformation, and environmental governance create new tensions between universal commercial law principles and culturally specific regulatory approaches. The study concludes that cultural values continue to play a persistent and fundamental role in shaping commercial law development, requiring greater sensitivity to cultural diversity in international commercial regulation and legal harmonization efforts.

Abstract

This study aims to analyze environmental law enforcement mechanisms in ASEAN member countries and examine their implications for regional environmental sustainability. Using a normative legal approach combined with comparative case studies, this study analyzes secondary data in the form of laws and regulations, international agreements, scientific journals, and official reports from Indonesia, Malaysia, Singapore, Thailand, and Vietnam. The analysis is conducted qualitatively using comparative techniques to identify differences in legislative frameworks, institutional capacity, oversight mechanisms, and enforcement effectiveness. The results show significant variations in the effectiveness of environmental law enforcement, with Singapore having the most effective system (Environmental Performance Index ranking 39) and Vietnam (ranking 141). This disparity impacts regional environmental sustainability, as evidenced by transboundary environmental problems such as haze, which causes economic losses of USD 16.1 billion per year. Countries with effective law enforcement exhibit better air quality (Singapore's PM2.5 12 μg/m³ vs. Vietnam's 35 μg/m³) and higher levels of industrial compliance (Singapore's 94% vs. Vietnam's 48%). This study recommends strengthening national capacity, regional harmonization, and increasing ASEAN cooperation to achieve optimal environmental sustainability.
