Abstract

Women in Islam have a high position and dignity. Raden Ajeng Kartini and Rahma El Yunusiah are two generations of female fighters who have inspired and played a role in fighting for Islamic education for women. Therefore the author wants to examine his thoughts from the perspective of Islamic education for women. The research approach used in this study is a descriptive qualitative approach and the type of research used Library research, by method Content Analysis. Based on data analysis, it can be concluded that Islamic education for women according to Kartini and Rahma El Yunusiah is aqidah education and moral education. Both of his thoughts also have relevance to Islamic education today, including human beings as the goal of education, the principle of equality as a basic concept and education that is just and without discrimination which has relevance to the current national education system. They have differences in family background, region of origin and nuances of education, but they have the same ideals, namely proper education for women. This explains that her thoughts on Islamic education for women have not been eroded by the times and we still apply them today.

Abstract

The phenomenon of dual-career couples has become a trend in the Modern family life. There is a shift in dual-career couple's household life pattern where they work and have other activities outside the home. It is certainly being faced with problems in family such as work-family conflicts if they cannot balance work and family problems. This study examines how the management of the dual-career couple in maintaining family resilience and harmony in Islamic Perspective. This research is qualitative approach with type of library research. Data obtained from several scientific papers and literature then analyzed with family concept theory in Islam. The results showed that there are several principles, including: dual-career couples must divide their time in conducting work and household obligations such as caring for children, washing or drying clothes, cooking, cleaning and tidying the house, keep the limits determined by Allah SWT., must be willing to each other, must be feasibility, must be sincere, try to create a good atmosphere, deliberation, and peace. Family relations must be maintained in fulfilling their obligations to obtaining their rights. Of course, the family harmonization could be realized, there must be a shared commitment in the family vision.

Abstract

One contemporary issue in family law today concerns the division of responsibilities between parents who both have jobs, particularly in balancing their roles in child rearing. The normative construction of the duty to balance parenting roles between working couples, viewed from the perspective of gender equality, needs to be addressed. The purpose of this research is to formulate normative provisions regarding the duty of balancing childcare responsibilities by working couples. This study adopts a library research method with an interdisciplinary approach, examining the problem from various perspectives, including law and gender. The research results indicate that the formulation of normative duties in childcare is not entirely adequate in protecting the rights of the child. This inadequacy leads to gender injustice, specifically the double burden placed on women. The gender injustice is also caused by the absence of clear and explicit legal provisions regulating the balancing of childcare roles by working couples. Therefore, it is proposed that the balancing of childcare roles be implemented by amending Article 45 of Law No. 1 of 1974 concerning marriage, incorporating language that mandates the duty of balancing childcare roles by working couples.

Abstract

There is no denying that the tradition of hadith thought is at the center of global debate. Of course, varied discourses will always arise in presenting the existence of hadith according to the context, including in the leadership of Indonesian women. The purpose of this study is to provide an overview of Mernissi's position and influence on the leadership thinking of Indonesian women in the 21st century. The method used is a type of literature research. The results showed that: 1) The origin of Fatima Mernissi's thought lies in her criticism of misogynistic hadiths that forbid women to be equal to men in being leaders. According to him, the hadith is not true because it has long been proven that women are able to compete fully, e.g. Aisha. 2) In the Indonesian context, Mernissi's idea is used as the basis of public figures that are always imitated by Indonesian women. Since Megawati became the first female president, many women have joined the government in the 21st century, including Sri Mulyani, Tri Rismaharini, and Khofifah. The data also showed an increase in women in parliament from 9% (2001-2004) to 20.5% (2019-2024).

Abstract

The Ministry of Women's Empowerment and Child Protection (PPPA) noted that 45% of the 14,571 cases of violence against children were cases of sexual violence. In Aceh, the UPTD-PPA noted that during 2021 there were 697 cases of sexual violence against women and children. The impact on victims of sexual violence can be said to be very heavy and prolonged. So far, the settlement of cases of violence against children, especially in Aceh, refers to the implementation of Aceh Qanun 6 of 2014 concerning the Jinayat Law. When compared with the loss of the victim, the punishment of Ta'zir Whip is still considered unable to provide a deterrent effect to the perpetrators. Therefore, this study aims to examine the effectiveness of the Qanun Jinayat in preventing cases of sexual violence against children. Overall, the Qanun Jinayat has not been able to provide psychological protection and recovery for victims of violence, especially children as victims. Apart from not being able to provide a deterrent effect to the perpetrators, the release of the perpetrators after the sentence creates further psychological trauma to victims of sexual violence.

Abstract

This study comprehensively reveals the intellectual and social dynamics of the significant impact of patriarchal norms embedded in tradition on the limited understanding of gender roles in the Islamic context. By integrating the approaches of literature study and analysis comprehensively, this study offers a strong theoretical foundation for understanding the evolution of views on the role of women in Islam. The study's results highlight the important role of feminist criticism in dismantling the social construction of gender roles in Islam. Patriarchal norms that limit the role of women in Muslim society are not an essential part of the teachings of Islam but the result of interpretation by men in power. It also gave rise to debates about ambiguous interpretations of religious texts, opening up opportunities for interpretations in favor of gender equality and women's rights. Moreover, feminist criticism is not a threat but a constructive attempt to revive equality in Islam and promote an inclusive and progressive understanding of the role of women in modern Muslim society.

Abstract

The Feminist movement became a forum to voice women's injustice which then caused social changes. However, some organizations oppose the understanding and movement of Feminism, one of them is Muslimah Hizbut Tahrir Indonesia (MHTI). This study aims to find out the rejection movements and thoughts of MHTI against Feminism. There are three things discussed, The first is the development history of Indonesia Muslimah Hizbut Tahrir (MHTI). The second is MHTI’s thoughts on the role of women, and the third is MHTI’s rejection of feminism. The method type of this research is the history method, these are heuristic, verification, interpretation, and historiography. This study results are MHTI was an HTI's autonomous organization that wished to establish an Islamic Caliphate based on Kaffah Islamic Syari’a. Then, MHTI argued that women's main role was to be housewives who are responsible for caring for children and fostering a harmonious family. MHTI firmly rejected feminism because it is considered as destroying the structure of men's and women's roles that had been determined in Islam. So, they acted in various regions to spread their ideas.

Abstract

In the Quran, it explains that the husband has an obligation to provide Nafkah for his wife. However, in the Indonesian Islamic Law Compilation, Article 80 Paragraph 6, it is explained that a wife can nullify her husband’s obligation to provide Nafkah. That Article is used as a legal basis for husbands to instruct their wives to be the main backbone of family. This is a problem that burdens the wife. The aim of this writing is to criticize Article 80, Paragraph 6, of the Indonesian Islamic Law Compilation. So that husbands will not let go of their responsibilities. The writing method used is a literature review method. The author tries to find the legal basis for Article 80, Paragraph 6 of the Indonesian Islamic Law Compilation. The Article will be analyzed in the context of a fiqh perspective. The results of the writing can be summarized as follows: this Article has no legal basis. In fiqh, Nafkah that cannot be paid will become a debt that eventually needs to be paid later. And the wife can nullify her husband’s obligation to pay that debt. But not for the Nafkah that has not been paid yet.

Abstract

Gender equality which is implemented correctly can have positive impacts on all social aspects. As in the case of aspects of women's leadership that need to be respected without any discrimination. The aim of this research focuses on how to understand gender equality and women's leadership through the perspective of the Qur’an and Sayyidah Aisyah Radhiyallahu'Anha that can be applied to fulfill society's understanding regarding all issues in the aspect of gender equality. The research method used in this research is a qualitative descriptive method with data collection techniques through literature study by collecting relevant data from books, journals, etc. without having to conduct field reviews. The research results that contain the concept of gender equality and women's leadership from the perspective of the Qur’an, are explained in several surahs; some of them are Surah An-Nisa:124, An-Nahl:97, Al-Hujurat:13, An-Naml:23-44, Al-Furqan:74 and also understanding the leadership of Sayyidah Aisyah Radhiyallau'Anha; such as her leadership of the Jamal war, as well as the military. She was also involved in politics and most importantly she was a defender of women. Viewed from these two perspectives, it proves that Islam recognizes gender equality. Men and women have the same right to be leaders.

Abstract

Family is the most important element in the formation of a society. Islam has a very fair concept in family leadership. In Islam, rights and duties are always regulated in balance. This balance results in the establishment of a harmonious relationship between husband and wife in the family. This paper uses an analytical descriptive method that examines Qiwamah issues related to women's leadership in the household. And the aim of this research is to find out how the concept of Qiwamah and gender justice in Islamic family law against the concept of Qiwamah in its implications for gender justice. This paper uses analytical descriptive method. The results of this study found that Islam gives leadership in the family to husband and wife, if both have the qualifications to be leaders. Leadership is not only given to men (husbands) only. Leadership is given to both parties if both have leadership qualifications, be it wives or husbands. In Islam, leadership/ Qiwamah in the family aims to create harmonious conditions so that the family can achieve happiness both in this world and in the Hereafter.
