Abstract

One skill of economics students that is still lacking today is the skill in managing zakat and waqf. In fact, the need for zakat and waqf managers for zakat and waqf institutions is immense. the lack of experts in the field of zakat and waqf management, the researcher is interested in conducting research intended for graduates of zakat and waqf management at IAIN Kudus, where this major is still rare in Indonesia and has few enthusiasts, even though the scope of work is very broad and much needed. This research uses a quantitative descriptive research design with a survey approach.The subjects of this research are graduates of the Zakat and Waqf Management Study Program IAIN Kudus from 2017 to 2020, totaling 56 people. Graduates of the Zakat and Waqf management program have found employment, with 35 people or 63% of graduates from 2017 - 2020. This is very good, considering that it is still difficult to get a job at this time. However, although the waiting period also shows good numbers, this is not the case with the suitability of the field of work, which still chooses to work that is not in accordance with their field.

Abstract

Seeing the tasks of zakat institutions that are so complex, certainly indicates that the performance of zakat institutions need special attention to be evaluated in terms of management of zakat funds. Because zakat has a strategic role to assist the government in poverty alleviation programs and development programs. This study aims to explain the model of zakat institution performance measurement. The models described in this study consist of National Zakat Index (IZN), Zakat Village Index (IDZ), Center of Islamic Business and Economic Studies (CIBEST), Balance Scorecard, Indonesia Magnificence of Zakat (IMZ) and International Standard of Zakat Management (ISZM). The method used in this study is Library Research, and from the results of this study shows that each measurement model has the characteristics of each with different measurement methods with each other.

Abstract

Waqf property in principle are the property of the people, as suchbenefits must also be felt by the people and therefore at the level of the waqfproperty is ideally collective responsibility to maintain it’s exist.Indonesian state has a Muslim majority society. This conditioncertainly makes the problem of managing endowments, become a very urgentproblem and very vulnerable. In addition, problems sometimes arise seizureof waqf land ownership rights between the heirs wakif nadzir even there is aperson who has dared to be against the law to transfer or assign ownership toanother party. Those problems need to be addressed as well as law enforcementboth litigation and non-litigation order berkepastian law, justice and legalexpediency. Indonesia is a country of law as in Article 1 (3) of the Constitutionof the Republic of Indonesia (UUDNRI) 1945, so that all activities in ourcountry governed by law.Dispute resolution based on traditional endowment Indonesianpositive law is: Non-Litigation. (A). Peace and Alternative Dispute Resolution(ADR). The legal basis of dispute resolution outside of court can be deliveredas follows: Article 3, paragraph (1) of Law No. 14 of 1970, Article 1851 ofthe Civil Code, Article 1855 of the Civil Code, Article 1858 of the Civil Code,alternative dispute resolution is only regulated in one article, namely Article6 of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution.(B). Procedures and dispute settlement procedures of Article 62 of Law No.perwakafan 41/2004 explains: perwakafan dispute settlement be reachedthrough negotiation to reach an agreement, if the dispute resolution referredto in subsection (1) does not succeed, the dispute can be resolved throughmediation, arbitration, or court. Article 62 of Law No. 41/2004 explains thatin solving the problems of the waqf property to first prioritize the attitude ofdeliberations to reach a consensus. Litigation: In the context of endowments,the Institute for Religious Courts through Article 49 of Law No. 7 of 1989as amended by Act Number 3 of 2006 on the Religious Courts. EndowmentsAct No. 41 of 2004, there are criminal provisions, which is still limited targetNazdhir and Officer Deed of Pledge Waqf. This is explained in Article 67paragraph (1) and paragraph (3).

Abstract

The purpose of this study is to examine Indonesia's waqf development pattern. Waqf-related research includes, among other things, the study of waqf law, productive waqf schemes, empowering waqf for poverty, stock waqf, and waqf connected to sukuk. The most popular articles are frequently those that discuss how waqf can reduce poverty and promote economic empowerment. Studies on the professionalism of waqf institutions in Indonesia are relatively few. A review of the literature on the management of waqf institutions in favor of professionalism was done by the researchers in light of this. This study is a quantitative investigation that makes use of bibliometric analysis. A quantitative strategy for examining bibliographic information in papers and journals is called bibliometrics. In this study, a waqf journal that Google Scholar has indexed served as the population. Publish or Perish 8 was used to select the samples for this study, which were publications with the keywords "management of waqf institutions," "waqf institutions," and "professionalism of Nazhir" in Indonesia. The information demonstrated an increase in the number of publications since the average year. According to Google Scholars, there were 82, 89, 110, 141, 147, 143, and 195 more publications about endowment per year from 2015 to 2021. The research's key themes were the effects of waqf on the role of nazhirs, effective waqf management, and nazhir certification. Future research plans are anticipated to concentrate on the professional behavior of waqf institutions and how to best foster professionalism through waqf institutions. In Indonesian waqf institutions, there is a level of professionalism known as nazhir certification. This study is intended to advance waqf research both domestically and internationally so that waqf research can expand with new topics and become more diverse.

Abstract

Poverty has many definitions, parameters, and standards. From the viewpoint of Islam, many theologians define and measure poverty by various terms and sizes. The difference among theologians’ opinion is caused by poverty terms contained in the Qur’an and Hadits. “Fakir” and “poor” have many meanings. It allows a wide interpretation of the verse and word from theologians. It is also seen from the regulation point in Indonesia, there are many definitions, standards and parameters of poverty. The difference of point of view on determination of poverty criteria and regulations according to Islam in Indonesia shows that the ways of ijtihad by theologians and the government elements is very open. The absence of standard stipulation held, encouraging the writer to conduct a comparative research in this paper; through literacy research. Syafi’i sect does not specify a quantitative standard for poverty. Poverty is only categorized on requirement. As long as people are not able to cover 50% of their basic needs, they are called as fakir. If people are only able to cover close to 70% of their basic needs then they are categorized as poor. Meanwhile, according to Hanafi sect, the qualitative standards turned to the Syafi’i sect. Poor conditions are more severe than the fakir. Besides,the quantitative standard of poverty is one nisab of zakat or the equivalent of 85 grams of gold. On the other hand, BPS and BKKBN formulate the concept and standard of poverty by economic concepts. Poverty is conceptualized as the inability of someone to meet basic consumption needs of the formulation adapted to local conditions respectively.

Abstract

AbstractManagement of waqf professionally will be able to empower potential productive endowments. Endowments have played an important role in driving the economy and meet the needs of Egyptian society. Pioneers first waqf in Egypt was a judge in the era of Hisham bin Abdul Malik, named Tauba bin Namir al-Hadrami who became a judge in the year 115 H. He is donating the land to build the dam and its benefits are developed productively for the benefit of the people. Wakaf pioneered by Tauba this very rapid growth, and even become a major asset for the people of Egypt. Efforts to modernize Egypt endowments managed by the issuance of Law No. 48 Year 1946 regarding waqf law covering the terms of endowments and endowment. Then in 1971 published Law No. 80 that inspired the establishment of an Egyptian Waqf Board specifically address the issue of endowments and development. Egyptian Waqf Board referred to in this law then promulgated by decree of the President of Egypt on 12 Sha'ban 1392 AH (20 September 1972), which is responsible for doing the same work and empower endowments, in accordance with the mandate of the law and the program of the Ministry Egyptian Endowments. Waqf Board's task is to coordinate and implement all the distribution of endowments, as well as all activities perwakafan to comply with the objectives set by the Shari'ah.

Abstract

Waqf is one of the resources with enormous potential for Islamic economic growth in Indonesia. This is evident in the existence of waqf land reaching 420.000 hectares which has not been fully optimized, leading to the classification of the land as traditional work. The phenomenon showed the need to manage waqf land properly to ensure more productivity. Therefore, this study aimed to explore the appropriate strategy to manage waqf land in Indonesia with a focus on the problems and solutions. This was achieved using a qualitative method through the application of the Analytic Network Process (ANP). Primary data were collected through the assessment of the problems by the respondents and subsequently categorized using a numerical scale. The results showed that the six problems to be prioritized in ensuring productivity in waqf lands include human resources, literacy comprehension, management system, socio-cultural, legal certification, and government policy. Meanwhile, the solutions required to be prioritized in solving these problems include increasing the supervision term for waqf land, socialization within the community, nadzir competence, reducing the cost of certification, minimizing operational costs, and improving the standard of recruitment into nadzir. The results are expected to serve as an alternative approach to elevating the quality of management as well as addressing human resource, institutional, and regulatory challenges within the Indonesian waqf system.

Abstract

The purpose of this study is to find out how the utilization of zakat, infaq and alms in BAZNAS Rembang for free ambulance operation and to know the obstacles and solutions in the implementation of free ambulance operational program in BAZNAS Rembang. This research uses qualitative method described descriptively with field research approach (field research). The results show that ZIS funds in BAZNAS Rembang are empowered through the program of orphan and poor benefit, the development of Islam, educational scholarship, rehap house unfit for habitation, revolving capital and ambulance and its operation for free. The utilization of ZIS fund for free ambulance operation in BAZNAS Rembang includes driver, fuel, oil, toll road cost, car wash, replacement of spare parts, renewal STNK, service, and repair cost in case of accident. Constraints and solutions in the implementation of the free ambulance operational program in BAZNAS Rembang is the uneven distribution of ambulance cars, the solution that must be done is to increase fundraising of ZIS funds to increase the number of ambulances.

Abstract

Nowadays, zakat paid by muzakki is channeled through an educational empowerment model, including scholarships for poor children. In addition to scholarships, the empowerment model also improved, zakat funds are also used for the development of Educational and Da'wah Institutions, including for schools, campuses, dormitories, and mosques. In At-Taubah 60, there is no mention of the Board of Education and Da'wah included in the asnaf who are entitled to receive zakat. Thus, the question arises as to how the legal position of the use of zakat funds for the benefit of the development of educational institutions and da'wah, whether the law is allowed according to sharia or not. This study used a qualitative library research method. The conclusion of this article states that zakat funds are allowed for the construction of educational and da’wah institutions, by using the reason for the "generality of interpretation" of the word sabilillah (في سبيل الله) in At-Taubah: 60 as one of the parties entitled to receive zakat. If the zakat funds for asnaf sabilillah still use the classical meaning, which means only for war, then the scope will be very narrow. In addition, at this time, jihad, which means war on the battlefield no longer exists, because it is considered a violation of human rights, and even if this kind of war is still being financed by the state.

Abstract

Increased accountability zakat management institutions are urgently required, as zakat management institutions accountable, will be able to increase confidence muzakki that pay their zakat through zakat management institutions, so that the utilization of zakat can be measured and properly channeled. Increased accountability zakat management institutions can be done through increased supervision and internal control systems.
