Abstract

The protection provided by state law against women and children as victims of the crime of trafficking in persons scattered in several laws and regulations either general or specific nature, such as: Criminal Law, Criminal Procedure Code, Law No.21 of 2007 on Combating Criminal Acts trafficking in Persons, Law No.13 of 2006 on Protection of Witnesses and Victims. It is still not supported by the implementing regulation (Government Regulation) with regard to the mechanism of compensation or restitution which is a form of direct protection to the victim.

Abstract

This research discusses on the issue of reducing Indonesian migrant workers by cultivating local and natural sources. Data were collected from interview and participative observation. This is a case study based on qualitative approach. In Kudus, some Indonesian migrant workers faced problems in the countries where they worked. In some cases families are lost contact with the workers, some workers were sent back home dying or in critical health condition while some other are sent back home in a coffin. Those who came back healthy faced other problems such as adultery, divorce, or father raped his daughters. There are also who came back in a good health and wealth. Discussing this matter, the government together with the society need to identify and cultivate local sources to help and empower those immigrant workers to find and establish their economic sources in their home town.

Abstract

This study aims to knowing attitudes toward the double bourden of Muslim women who work (pretest and posttest) and the effectiveness of the implementation of Islamic-based group guidance to improve attitudes toward the double bourden of women. Location of research in Noyontaasari. Research approach is quantitative with experimental methods. The results showed that, the guidance of Islamic-based groups effectively increased attitudes toward the double bourden of woman Muslim workers. This is evident from the statistically significant wilcoxon test (probability <0.05). Therefore, there needs to be an Islamic-based group guidance service to improve attitudes toward women's double bourden, or to prevent the negative impact of Muslim women's double bourden on themselves and their families.

Abstract

This paper will reveal a feminist interpretation as a reading that can transform Islamic social, because social understanding of society has long been eroded by the reading of classical interpretation, which tends to be biased and discriminative against women, so through reading the feminist interpretation of Nasarudin Umar, Opening a just horizon of reading (equality), peace for both men and women. Due to his tafsir exposure which tends to be more concerned with social conditions, Nasaruddin Umar tries to give a new color in interpreting the Qur'an with etymological analysis, hermeneutics and using history to examine many words in the Qur'an. So the pattern of interpreter is more to consider the macro-social aspects than the micro in each verse, in order to produce a reading of tafsir that can transform the social state of Islamic society.

Abstract

The female‟s body is something that very dangerous if it is not controlled. Different views of stereotypes and negative labels are given to women. In fact, women serve as commodities and a capitalist political instrument through beauty and sexuality often addressed to women and occur under the hegemony and dominance of certain rulers who are to control commodities and politicization over the female‟s body. The correlation of female's body control with their environment raises a women's movement in need of religion in which all activities and movements of women must be based on several alternatives of life ethics that must be held like having to cover „aurat‟, while working in a safe environment, and others. If the respectable women are able to survive and understand the feminine authenticity of the self as a counterweight to the masculinity that has been produced in general and all areas of public life.

Abstract

Penelitian ini merupakan penelitian deskriptif kualitatif yang menggambarkan fakta bahwa mahasiswa Tadris Bahasa Inggris IAIN Salatiga memiliki sensitivitas yang cukup tinggi terhadap isu “Indonesia Darurat Kekerasan Seksual pada Anak”. Hal ini terlihat dari jumlah presentase yang menunjukkan 77% mahasiswa peka terhadap isu nasional tersebut. Adapun ditinjau dari ranah gender, mahasiswa laki-laki lebih update terhadap kasus nasional tersebut terlihat dari hasil presentase yang menunjukkan 80% mengetahui kasus kekerasan seksual pada anak dibandingkan mahasiswa perempuan yang hanya mengetahui 73% issue nasional tersebut. Penelitian ini juga menganalisis reaksi, tanggapan, dan respon mahasiswa terhadap isu tersebut dilihat dari ranah bahasa dan gender melalui personal essay pada mata kuliah academic writing bahasa Inggris. Hasilnya menunjukkan mahasiswa laki- laki lebih banyak merespon isu dengan memberikan solusi dari sudut pandang hukum serta mendorong pemerintah untuk memberatkan hukuman pada pelaku kekerasan seksual anak, serta mereformasi hukum khususnya pada sistem peradilan anak sedangkan mahasiswa perempuan lebih dominan menunjukkan empatinya kepada para korban kekerasan seksual anak dan hanya sedikit menyinggung tentang gagasan, solusi, dan usaha untuk menyelesaikan kasus- kasus kekerasan pada anak.

Abstract

This article examines the issue of human trafficking at once how did the Prophet effort in countering it in the early period of Islam. Indeed, the term of human trafficking has not arisen yet in the Prophet‟s period. However, because the human trafficking was considered as a modern slavery, then the hadith that narrated regarding slavery practices at the time it can be as data of this study. This study concludes the practice of the elements human trafficking have been in the Prophet‟s period, even it far away before that. Precisely Prophet Muhammad with Islam eradicates the practice of slavery bit by bit. At least, there are four efforts that the Prophet did exterminate the slavery at the time: First, to elevate the slave‟s level for equaling the normal human being and to act good to the slave. Second, to motivate the Companions in order to compete to liberate the slave. Third, to intimidate those who do the practices of human trafficking. Fourth, to make the liberation of slavery as the mechanism to apply the sanction for the infraction of religion teachings (kaffārah).

Abstract

the traditional market are identically with women, because in any traditional market, especially in Indonesia as much as 85% of trades are dominated by women, even buyers in traditional markets are mostly (90%) also women and of course the merchandise being sold is also related to women or identical with domestic needs. These conditions make women (traders) have economic power and dominate the flow of trade, ranging from the determination of the price of goods, capital, produc relations and division of labor, even determinants of social and cultural relations that exist in traditional markets. Women traders as key actors who have power and dominance in traditional markets, must be central in building patterns of relationships with various other subjects, who play a role in the market. For example: with husbands, with other traders, with buyers, with owners of capital, with suppliers of goods, with porters and laborers carrying. Relationship patterns built by women traders with these subjects, some involving gender sentiments and some that are not, there are a vertical relationship and there are a horizontal relationship.

Abstract

The paper criticizes the construction of law, the existing legal arrangements concerning polygamous marriage in the perspective of legal feminism. The argument is that the legal construction of polygamous marriages in Indonesia is in fact not value-free, ambitious and adheres to a conventional patriarchal paradigm. The findings and analysis show that, Law Number 1 Year 1974 on Marriage is not value-free, ambiguous and gray, thus perpetuating the uncertainty in marriage law. The marriage law of conventional patriarchal paradigm just legitimizes husband's sexuality for polygamy by placing steorotif on women as her ordinate platform.
