Abstract

Terms of women's emancipation or gender equality is often touted in almost all corners of the world, able to open a general idea to rethink creature named women to become leaders, even heads of state. The discussion will be more interesting when the position of women in the social facts are also removed. It is of course behind the reconstruction of the position of women in the historical and political arena. Both studies and evidence from the Quran, the Hadith, and the explanation of the experts in the field, shows that women do not experience gender barriers to explore her potential and release energy to become a leader in the community when the community around it has not considered taboo and acknowledged benefits. In addition, the permissibility of being a leader must also be supported by personal qualities include: ability, capacity, faculty, and skills.

Abstract

The tradition of pre-Islamic Arabian society known as the position of women as imperior. Prophet as a feminist fight for equality derarat (egalitarian) between men and women. The struggle of the Prophet raise the dignity of women is very opposite to trasidi Arab society. Many traditions and fi'li qauli recommending that treat women well. Even at the time of the Prophet women taking a role in the public sphere-sphere were previously considered taboo for women. As in politics known Aisha, Umm Salama, Safia Bint Abdul Muttalib and others, in the field of education known in economics Aisha and Khadija bint Khuwalid known.

Abstract

This study just want to expose on the constitutional rights of women workers in Indonesia within the legal framework of the welfare state. Indonesia as a state welfare law, of course, the duty to enforce the welfare of all citizens, both men and women without discrimination, including the constitutional rights of women workers. The state is obliged regulate wages, provide protection, social security and guarantee of other rights, fairly and without discrimination in accordance constitutional rights of women workers as the provisions contained in the Constitution of the Republic of Indonesia 1945.

Abstract

Issues on the Status of Women in Islam will always be a discourse which is always inviting pros and cons. Although in terms of women's rights has been codified in revelation and tradition of the Prophet (Hadith), but it turns out after him after the death, the condition of Muslim women considered to be undergoing drastic changes. The amendment relates to the concept of women's liberation, along with changes in the interpretation of the validity of the scholars of fiqh sources-formal legal about women's rights in Islam. The emergence of stigmatization in our society, that women do not need to play outside the home also play a role worsen climate of freedom for women.

Abstract

This study discusses about what and how the patriarchal system perpetuates gender inequality in the reality of social life, with women as victims. Patriarchy is the magic system because of its ability to power that is no longer in the realm of the family but in all areas of the world that demonstrate extraordinary cognitive. This system is a system of male dominance and superiority -laki for control and domination of women. Gender roles are deliberately constructed by this ideology, understood by women as something natural or nature, so that in many areas of life this system perpetuates gender inequality.

Abstract

The choice of a partner in marriage is a fundamental right of women that is often hampered by dominant social and cultural norms, especially in rural areas such as Grobogan Regency, Central Java. Despite increasing awareness of gender justice, women in the area still face various obstacles in expressing their right to choose a life partner. This study aims to explore how women's rights in choosing a partner in marriage are viewed from the perspective of gender justice and its impact on women's empowerment in Grobogan Regency. The method used is qualitative research with a legal social approach through case studies. Data were collected through in-depth interviews with five women; Rabiah, Suliyem, Hartini,Kasmiyati, and Surati in Grobogan and participatory observations. The results show that despite the increased understanding of the right to choose a partner, many women are still affected by social and family pressures in making these decisions. Gender justice in the selection of spouses has been proven to have a positive impact on women's empowerment, both in social, economic, and psychological aspects, by increasing their autonomy and well-being. The implications of this study are the importance of education, advocacy, and local policies that better support women's rights to choose a partner, as well as women's social and economic empowerment at the local level. This research contributes to the understanding of the importance of gender justice in marriage practice, as well as the need for more proactive policy changes in supporting gender equality in society.

Abstract

The application of custody rights in Indonesia generally uses sole custody. As stipulated in the Compilation of Islamic Law in Articles 105 and 156, priority for custody rights is automatically given to the mother. This is considered a problematic issue from a gender equality perspective, as child custody is not always monopolized by one gender but should consider aspects of quality, integrity, morality, and ability to fulfill the best interests of the child. At the same time, several court rulings in Indonesia have now established joint custody rather than sole custody. The purpose of this study is to re-examine the concept of joint custody of minor children as an effort and legitimization of the best interests of the child based on an analysis of legal norms and gender equality. This research is qualitative and uses a descriptive analytical method from library data sources. The results of this research can be concluded that joint custody is the granting of custody or care of the child to both parents alternately after divorce until both are required to take joint responsibility for their child. Although the granting of joint custody appears to deviate from existing provisions, it is not based on the provisions of the KHI but rather on the principle of the best interests of the child and the judge's legal interpretation. Furthermore, within the paradigm of gender equality, the role of men in contemporary society is equal to that of women, including in the care of minor children. This concept could serve as an alternative solution in resolving child custody disputes in Indonesia, simplifying the often complex and problematic process of determining custody rights.

Abstract

This study aims to analyze the legal culture and the existence of women in grassroots democratic contestations in Sumenep Regency. Legal culture refers to the perceptions, attitudes, and behaviors of the community toward prevailing laws, which are often influenced by social, cultural, and historical factors. The existence of women in grassroots democratic contestations is crucial, as women play a vital role in social and political development at the local level.This research employs a qualitative approach, utilizing data collection techniques such as in-depth interviews, participatory observations, and document studies. The findings reveal that, despite growing awareness of the importance of women's participation in grassroots democracy, structural and cultural barriers still constrain their roles. Key obstacles include a strong patriarchal culture, limited access to education and information, and a lack of support from the social environment.Nonetheless, there are local initiatives striving to strengthen women's roles through various empowerment and legal education programs. Efforts to enhance women's participation in grassroots democracy in Sumenep Regency must adopt a holistic and sustainable approach, focusing not only on legal aspects but also on social and cultural transformation.Based on the research findings, it is recommended that local governments strengthen affirmative policies supporting women's involvement, expand access to political and legal education, and promote cross-sectoral collaboration in creating inclusive and gender-responsive participatory spaces. The active role of civil society organizations is also crucial in fostering legal culture change and enhancing women's leadership capacity at the local level.

Abstract

This article examines how a woman seafarer uses an image to create her identity and struggles in a male-dominated job. Photovoice and online interviews were used to gather data. While the purpose of the interview was to gather the narratives, the SHOWeD approach helped her think about the picture. Content analysis was used to examine the data to find themes and recount the tales of her identity creation. The results demonstrate that while regulations have been put in place to safeguard women working on ships and to ensure that male and female seafarers have equivalent workloads, there is no assurance that harassment and discrimination won't happen. The male counterpart's unfavorable stigmatization of women working on ships regrettably confirms that women seafarers continue to be a high-stakes profession with possible hazards. One important identity construction that emerges is that women seafarers do not pursue careers that last a lifetime because other jobs are seen as more fulfilling, such working in an office and raising children.

Abstract

Women's political participation in Indonesia can be categorized as low, even though the government has provided special policies for women. Patriarchal political culture is a major obstacle in increasing women's political participation, because it builds perceptions that women are inappropriate, unsuitable and unfit to engage in the political domain. The notion that women are more appropriate in the domestic area; identified politics are masculine, so women are not suitable for acting in the political domain; Weak women and not having the ability to become leaders, are the result of the construction of a patriarchal political culture. Efforts must be doing to increase women's participation, i.e: women's political awareness, gender-based political education; building and strengthening relationships between women's networks and organizations; attract qualified women political party cadres; cultural reconstruction and reinterpretation of religious understanding that is gender biased; movement to change the organizational structure of political parties and; the implementation of legislation effectively.
