Abstract

This paper aims to trace the practice of polygamy by the prophet's companions (khulafa al-rasyidin). Polygamy is part of Islamic teachings engraved in the Alquran and practiced by the Prophet Muhammad as written in history; besides that, the references of polygamy by Prophet Muhammad are straightforward to find, those have been written and translated into various languages in the world while the manuscript that explains about polygamy practices of Khulafa al-Rasyidin is still lacking. This paper is carried out with a historical normative approach by tracing the classical books (turast), while the data comes from primary and secondary data. From various classic references, it was found that the practice of polygamy carried out by Abu Bakar and Umar bin Khathab, no history was found; however, in some narrations, it is said that Umar bin Khathab and Abu Bakar had many wives, without explaining whether they were polygamous, divorced or caused by death. Unlike Ali bin Abi Thalib, he never practiced polygamy during his marriage to Fatimah. Usman bin Affan married two daughters of the Prophet, the first wife named Ruqayyah binti Rasulullah. After Ruqayyah died, Usman remarried Ummu Kaltsum binti Rasulullah. Usman never did polygamy while marrying the Prophet's daughter. Although Ali bin Abi Talib and Usman bin Affan did not mix the Prophet's daughters after they died, Ali and Usman remarried many women.Tulisan ini bertujuan untuk menelusuri praktik poligami yang dilakukan oleh para sahabat nabi (khulafa al-rasyidin). Poligami merupakan bagian dari ajaran Islam yang terukir secara nyata dalam Alquran dan dipraktikkan oleh Nabi Muhammad saw sebagai mana yang ditorehkan dalam sejarah. Selain itu, sangat mudah ditemui referensi terkait praktik poligami nabi bahkan sudah ditulis dan diterjemahkan ke berbagai bahasa di dunia. Hal ini ternyata jauh berbeda dengan poligami yang di praktikkan oleh para sahabat nabi (khulafa al-rasyidin). Ini tentu menarik untuk dikaji karena sangat minimnya referensi terkait praktik poligami para sahabat nabi. Pendekatan yang digunakan dalam tulisan ini adalah normative historis dengan menelusuri kitab-kitab klasik (turast), sementara data yang digunakan berasal dari data primer dan data sekunder. Dari berbagai referensi yang penulis telusuri dalam kitab klasik, ditemukan bahwa praktik poligami yang dilakukan oleh Abu Bakar dan Umar bin Khathab, tidak ditemukan riwayat, hanya saja dalam beberapa riwayat dikisahkan bahwa Umar dan Abu Bakar mempunyai Istri yang banyak, tanpa menjelaskan apakah di poligami, dicerai atau ditinggal mati. Berbeda halnya dengan dua khalifah setelah mereka, Ali bin Abi Thalib misalnya, selama menikah dengan Fathimah tidak pernah melakukan praktik poligami. Begitu juga dengan Usman bin Affan yang menikahi dua putri Rasulullah, istri pertama bernama Ruqayyah binti Rasulullah, setelah Ruqayyah wafat Usman menikah lagi dengan Ummu Kaltsum binti Rasulullah, Usman tidak pernah melakukan poligami selama menikahi putri Rasulullah. Walaupun Ali bin Abi Thalib dan Usman bin Affan tidak memadu putri-putri Rasulullah, namun setelah mereka wafat Ali dan Usman menikah lagi dengan wanita lain dalam jumlah yang banyak.

Abstract

The provision of Islamic banks' facilities to their customers is practically still applied as collateral, as a form of trust that binds both parties until a contract ends. However, if the customer fails to pay, the opportunity to carry out the collateral may be carried out by the bank as a solution; the last is the customers' obligation that cannot be fulfilled. The bank, as an economic institution, basically does not want to suffer losses. This study aims to analyze the element of ignorance at the auction of Murabaha contract items. The research method uses a normative juridical approach with analytical descriptive data analysis. The findings of this study are that the practice of the execution of collateral still contains the element of death, this can be seen from collateral items that will be auctioned from the beginning of the contract, the value is higher than the facility received by the customer, and sometimes does not involve the customer to determine prices selling collateral, it is not uncommon for the owner of the collateral not to be informed of the execution of the guarantee so that the bank sells collateral at a price not following the wishes of the customer.Pemberian fasilitas yang diberikan bank syariah kepada nasabahnya secara praktik masih diterapkan barang jaminan, sebagai bentuk kepercayaan yang mengikat kedua belah pihak sampai suatu akad berakhir, namun dalam hal nasabah gagal bayar peluang untuk melaksanakan eksekusi atas barang jaminan mungkin saja dilakukan oleh pihak bank, sebagai solusi terakhir atas kewajiban nasabah yang tidak dapat ditunaikan dan pihak bank sebagai lembaga ekonomi pada dasarnya tidak mau mengalami kerugian. Tujuan dari penelitian ini yaitu untuk menganalisis unsur kezaliman pada lelang barang jaminan akad murabahah. Metode penelitian menggunakan pendekatan yuridis normatif dengan analisis data deskriptif analitis. Temuan penelitian ini yaitu praktik proses eksekusi atas barang jaminan masih mengandung unsur kedholiman, hal ini terlihat dari barang jaminan yang akan di lelang sejak awal akad, nilainya lebih tinggi dari fasilitas yang diterima nasabah, dan dalam proses lelang terkadang tidak melibatkan pihak nasabah untuk menentukan harga jual atas barang jaminan, bahkan tidak jarang pihak pemilik barang jaminan tidak diberi tahu pelaksanaan proses eksekusi jaminan itu, sehingga pihak bank menjual barang jaminan dengan harga yang tidak sesuai dengan keinginan pihak nasabah.

Abstract

This paper explains the thoughts of Indonesian jurisprudence from Ahmad Qadri Azizy's perspective. This study's focus includes, first, how is the epistemological thought of A. Qodri Azizy about Indonesian Jurisprudence, and second, how is the Indonesian Jurisprudence on A. Qodri Azizy's perspective. The method of this study is descriptive-analytical critical with normative legal approaches. The study's findings are, first, the epistemology used by A. Qodri Azizy is the integration between the common law and the Islamic law with a democratic and scientific approach known as a legal eclecticism in Indonesia. Simultaneously, the Indonesian legal science concept that the jurist designed is the effort to implement Islamic law in Indonesia. The effort to implement the Islamic law was carried out scientifically, academically, with democratization following the pluralist legal system in Indonesia.Tulisan ini menjelaskan pemikiran ilmu hukum Indonesia perspektif Ahmad Qodri Azizy. Fokus kajiannya meliputi, pertama bagaimana epistemologi pemikiran A. Qodri Azizy tentang ilmu hukum Indonesia Indonesian Jurisprudence, dan kedua, bagaimana konsep ilmu hukum Indonesia Indonesian Jurisprudence perspektif A. Qodri Azizy. Metodologi penulisan bersifat deskriptif analitis kritis dengan pendekatan hukum normatif. Temuan tulisan adalah, pertama, epistemologi yang digunakan A. Qodri Azizy adalah integrasi antara ilmu hukum umum dan ilmu hukum Islam dengan pendekatan demokrasi dan keilmuan yang dikenal dengan eklektisisme hukum di Indonesia. Sedangkan konsep ilmu hukum Indonesia yang dirancang adalah upaya posistivisasi hukum Islam di Indonesia. Upaya postivisasi dilakukan secara keilmuan, akademik dengan proses demokratisasi sesuai sistem hukum pluralis yang ada di Indonesia.

Abstract

Why QS. al-Maidah 51 is often used as a reference in determining the legitimacy and justification of the leadership of government elections? How to understand the symbolic (semiotic) meaning of using the awliya word in al-Maidah 51 in the context of leadership politics in Indonesia? To answer that question, this study uses literature (library research) by asking for semiotics. The results of the study state that the meaning of awliya is QS. Special Al-Maidah 51, in a semiotic manner, is tentative, open, and plural because of the nature of language that is not always arbitrary and universal (multiplicity meaning). Signifiers are significantly influenced by the background of institutional structure, paradigm, and the basis of political stretcher or their support. At the paradigmatic level, both symbolic (textual and contextual) meanings of awliya have a basis for scientific epistemology. While the aspects of his semiotic pragmatism (Peirce) can be measured, determine to what extent awliya's symbolic meanings is effective and followed by Muslims as part of citizenship; and how far awliya’ is accommodated in the instruments of the state legal system (legislation).Mengapa QS. al-Maidah 51 kerap dijadikan referensi menentukan legitimasi dan justifikasi kepemimpinan jabatan Pemerintahan? Bagaimana memahami makna simbolik (semiotik) penggunaan kata awliya’ dalam al-Maidah 51 itu dalam konteks politik kepemimpinan di Indonesia? Untuk menjawab pertanyaan itu, kajian ini menggunakan kajian pustaka (library research) dengan pendekatan semiotik. Hasil penelitian menunjukkan bahwa pemaknaan awliya’ QS. al-Maidah 51 secara semiotik bersifat tentatif, terbuka, dan plural karena sifat langue yang tidak slalu arbitrer dan universal (multiplicity meaning). Pemberi makna (signified) sangat dipengaruhi oleh latar struktur institusi, paradigma, dan basis politik usungan atau dukungannya. Pada level paradigmatik, kedua makna simbolik (tekstual dan kontekstual) awliya’ memiliki basis epistemologi keilmuan. Sementara aspek pragmatisme semiotiknya (Peirce) dapat diukur sejauhmana pemaknaan simbolik awliya’ itu berlaku efektif dan diikuti oleh umat Islam sebagai bagian dari kewarganegaraan; dan sejauhmana awliya’ itu diakomodir dalam instrumen sistem hukum negara.

Abstract

This article aims to examine the thoughts of Imam al-Syatibi on maqashid al-shariah and its actualizations in modern life. The method used is qualitative, while the data analysis technique used is content analysis to analyze the substance of maqashid al-shariah. It is then correlated with the context of current human life. The results of the study show that the theory of maqashid al-shariah initiated by Imam al-Syatibi has presented shariah in its elastic face. Maqashid al-shariah has transformed Islamic theory into universal human values, such as benefit, justice, and equality in Muslims' lives in the world. This can be seen at least in two ways: first, maqashid al-shariah as a developing Islamic law method. The development of the theory of maqashid al-shariah has inspired the philosophy of Islamic laws. It becomes the basis of thinking and analysis, which is fundamental to Islamic legal thinking in this globalization era and dynamic social changes. Second, maqashid al-shariah in building shariah economics; maqashid al-shariah's theory occupies a very central and vital position in formulating a shariah economic development methodology. In the context of shariah economics, the purpose of maqashid al-shariah is to safeguard human benefits. A Muslim is encouraged to produce and consume goods/services, of course, within valuable considerations.

Abstract

This article is the result of research that aims to explain the importance of study about socio-legal. The rapid development of society can lead to problems in life. Human beings must immediately fulfill the demands of practical interest. Therefore, sociolegal development as a discipline of law closely related to real-life in society becomes an urgent role. Various problems in social relations require the role of the law to solve them. We see how the law of life and development in society becomes essential in the science of law because law and society can not be separated. The research method used is a literature review with a philosophical approach. The research results show that sociolegal study is significant to see and understand the law in real life in society. The method of generalized inductive reasoning becomes sociolegal to understand it, and its practical value of use makes sociolegal a legal discipline that can follow the realities of the times.Artikel ini adalah hasil penelitian yang bertujuan untuk menjelaskan pentingnya studi tentang sociolegal. Perkembangan masyarakat yang pesat dapat menyebabkan masalah dalam kehidupan. Tuntutan kepentingan praktis harus segera dipenuhi oleh manusia. Oleh karena itu, pengembangan sociolegal sebagai disiplin ilmu hukum yang erat kaitannya dengan kehidupan nyata dalam masyarakat menjadi peran yang mendesak. Ada berbagai masalah dalam hubungan sosial yang membutuhkan peran hukum untuk menyelesaikannya. Melihat bagaimana perkembangan hukum dan pembangunan dalam masyarakat menjadi penting dalam ilmu hukum, karena hukum dan masyarakat tidak dapat dipisahkan. Metode penelitian yang digunakan adalah studi pustaka dengan pendekatan filosofis. Dari hasil penelitian menunjukkan bahwa kajian sosiologi hukum sangat penting untuk melihat dan memahami hukum dalam kehidupan nyata di masyarakat. Metode penalaran generalisir induktif membuat sociolegal untuk mendapatkan pemahaman tentang itu dan nilai praktis penggunaannya membuat sosiologi hukum merupakan disiplin hukum yang dapat mengikuti realitas zaman.

Abstract

This study examines the social factors and coping models of women as victims of domestic violence after divorce. This research used the qualitative approach while the data collection techniques are included an interview, observation, and documentation. This study's conclusions are (1) social factors, from an education point of view, they consist of the lowest education, namely junior high school and the highest in college. From their social status consisting of low, medium, and high social status, and from environmental factors, it can be concluded that respondents come from various social environments. Other factors that trigger the violence occur to women such as age, economy, independence, career women, etc. (2) The coping model of women as the victims of violence in facing post-divorce stressors in Ponorogo Regency is divided into two; namely, the problem focuses coping and emotional focused coping.Penelitian ini mengkaji bagaimana faktor sosial dan model coping  perempuan korban kekerasan dalam rumah tangga pasca perceraian. Pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan kualitatif. Sedangkan teknik pengumpulan datanya meliputi wawancara, observasi dan dokumentasi. Kesimpulan dari penelitian ini adalah: 1) faktor sosial apabila dilihat dari pendidikan, mereka terdiri dari pendidikan terendah yaitu SMP dan tertinggi perguruan tinggi, dilihat dari status sosial mereka terdiri atas status sosial rendah, sedang, dan tinggi, dan jika dilihat dari faktor lingkungan, sehingga bisa disimpulkan responden berasal dari lingkungan sosial yang beragam, dan ada faktor lain yang menyebabkan kekerasan terjadi terhadap perempuan seperti masalah usia, ekonomi, kemandirian isteri, pekerjaan isteri, dan lain-lain. Dan 2) model coping perempuan korban kekerasan dalam menghadapi stressor pasca perceraian di Kabupaten Ponorogo terbagi menjadi dua yaitu; Problem Focus Coping dan Emosional Focused coping.

Abstract

Istihsan is a dalil (source and method) of Islamic law validated by the Hanafi school. Al-Shafi’i strongly rejected istihsann (juristic preference) and considered those who practice it as trying to compete with God as the Ultimate Authority and taking a careless decision. However, the istihsan way of thinking in the Shafi’i school is not uncommon but is considered valid. In the discipline of al-qawa’id al-fiqhiyah (Islamic legal maxims), the existence of mustathnayat (exceptions) cases with istithna’ (exception) method is showing istihsan method. This research compares mustathnayat/exception cases in qawa’d al-fiqhiyyah in Shafi’i madhhab and istihsan in Hanafi madhhab. The origin of the legal decision of exception in mustahnayat is judged from istihsan’s point of view. This research accepts that mustathnayat cases in Shafi’i madhhab result from thinking methods like istihsan in Hanafi madhhab in all aspects (its reality, method, and purpose).

Abstract

This work aims to examine the responsibility of online shop sellers from the perspective of Islamic business ethics. This issue is urgent to discuss because the transformation of transactions between sellers and buyers in e-commerce has an impact on the behavior of the sellers who often ignore the rights of the buyers, such as sending goods that are not according to the order, hidden defects for the sent goods, the unfriendly behavior of the sellers, etc. The method used to answer the problem is a literature study that discusses Islamic business ethics, the study material obtained then reduced and analyzed using the logic of deductive thinking. The results show that several online shop sellers did not serve consumers well according to business ethics in Islam, such as not answering chat with polite sentences, sending goods that were not according to the order, items sent hid some defects or packing and shipping processes for the item is often too long. For this reason, the responsibility of the online shop seller is to guarantee the availability of goods, the goods delivered according to the agreement at the time of booking, to provide an explanation of the estimated length of delivery of goods, to provide order returns, and no fees, and to serve buyers politely.Tulisan ini bertujuan mengkaji bagaimana tanggung jawab penjual onlineshop dalam pandangan etika bisnis Islam. Topik ini perlu dikaji karena beralihnya transaksi antara penjual dengan pembeli ke media e-commerce berdampak pada perilaku penjual yang seringkali mengabaikan hak-hak pihak pembeli. Misalnya mengirimkan barang yang tidak sesuai pesanan, barang dikirim namun terdapat cacat tersembunyi atau dikirim namun terlambat sampai ke konsumen, melayani konsumen via chat tidak ramah. Metode yang digunakan adalah studi pustaka yang membahas etika bisnis Islam, bahan kajian yang diperoleh lantas direduksi kemudian dianalisis dengan menggunakan logika berpikir deduktif. Hasil penelusuran penulis di beberapa seller online shop menemukan realita bahwa beberapa dari mereka tidak melayani konsumen dengan baik sesuai etika bisnis dalam Islam seperti tidak menjawab chat dengan kalimat yang santun, mengirimkan barang tidak sesuai pesanan, barang yang dikirim terdapat cacat tersembunyi atau proses pengepakkan dan pengiriman barang terlampau lama. Untuk itu tanggungjawab penjual online shop adalah menjamin ketersediaan barang, barang yang dikirimkan sesuai kesepakatan saat pemesanan, memberikan penjelasan mengenai estimasi lama waktu pengiriman barang, menyediakan layanan retur order dan tanpa biaya, serta melayani pembeli dengan santun.

Abstract

The fundamental principle of human rights is that all people are born free and have equality in human rights. Equality requires equal treatment; it means that anyone should be treated equally in any condition before the law. The idea of Human Rights in the Draft of the Law on Criminal Procedure Code, which will be upheld, will become a new legalized law in the future, not apart from lifting and placing a suspect, defendant, and convicted dignified position as a creature of God. Moreover, in the end, declarative human rights principles will not mean much if the stage of the rule of law does not follow them.Fundamental dari hak asasi manusia adalah ide yang meletakkan semua orang terlahir bebas dan memiliki kesetaraan dalam hak asasi manusia. Kesetaraan mensyaratkan adanya perlakuan yang setara, dimana pada situasi sama harus diperlakukan dengan sama, dimana pada situasi yang berbeda diperlakukan dengan berbeda pula.  Pemikiran HAM dalam RUU KUHAP  yang akan diundangkan menjadi UU kedepan, tidak terlepas  mengangkat dan menempatkan seorang tersangka, terdakwa dan terpidana dalam kedudukan yang bermartabat sebagai makhluk ciptaan Tuhan. Dan pada akhirnya, prinsip-prinsip HAM yang bersifat deklaratif tidak akan banyak berarti apabila tidak diikuti dengan tahap supremasi hukum.
