Abstract

Ulayat rights are the rights of customary law communities which in essence are the authority possessed by certain customary law communities. The customary land law of the Tolaki Mekongga tribe is land that is controlled or owned by a family, either because the family has directly cultivated it, or because the land has been inherited from generation to generation. The main objective of this research is to find out the concept of customary land ownership of the Tolaki Mekongga tribe and its relation to inheritance and customary rights. The type of research used in this study is normative legal research (doctrinal legal research), namely research on law as a norm and reality (behavior) or as something to aspire to and as a living reality or law. The Tolaki Mekongga indigenous people still exist today and occupy certain areas, but until now there are no regional regulations regarding customary rights over these areas, so efforts are needed to obtain legal certainty and justice for customary law communities in managing their customary rights.

Abstract

This study aims to determine Police Law Enforcement in Disclosing Narcotics Crimes Using the Undercover Buy Technique at North Kolaka Police Station. The formulation of the problem posed is: What are the legal strengths and consequences for undercover buys made by non-Police members (informants)? and What are the obstacle factors in uncovering narcotics crimes with the Undercover Buy Technique?. The type of research used by the author in the preparation of this thesis final project is research that uses empirical research methods. The empirical legal research method is a legal research method that functions to see the law in a real sense and research how the law works in society. Covert Purchase as stipulated in Law No. 22 of 1997 which has been changed to Law No. 35 of 2009 is an addition to the investigator's authority in efforts to eradicate narcotics trafficking. This is because narcotics crimes are organized, secret crimes, and in practice they use sophisticated modus operandi and technology, making it difficult to collect evidence. Unlike other criminal acts, the implementation of covert purchases in narcotics crimes is not contrary to human rights if carried out in accordance with applicable regulations. However, it will be different if it is not implemented in accordance with applicable regulations. This is because the implementation of covert purchases cannot be separated from the participation of the community, so that the rights of the people who participate must be protected. In order to reduce errors and the implementation of covert purchases, it is necessary to know and understand clearly by investigators regarding the implementation of covert purchases themselves as stipulated in Law No. 35 of 2009. Abstract

Vigilantism (eigenrichting) is the act of punishing another person without going through the applicable legal process. This action can be categorised as a criminal offence, because it is contrary to the provisions of Article 1 of the Criminal Code which states that every person is prohibited from committing acts prohibited by law. The purpose of this study is to determine the concept of the criminal offence of vigilantism (eigenrichting) according to positive criminal law in Indonesia as well as to know and understand the form of criminal liability for the perpetrators of vigilantism (eigenrichting). This research uses normative-empirical legal research methods. The results showed that the concept of vigilantism (eigenrichting) according to positive criminal law in Indonesia that has been applied by the Public Prosecutor at the Konawe District Prosecutor's Office is Article 170 of the Criminal Code on Robbery, Article 338 of the Criminal Code on Murder, and Article 351 of the Criminal Code on Maltreatment. Criminal responsibility for the perpetrators of vigilantism (eigenrichting) in Decision Number: 194/Pid.B/2022/PN, the perpetrators are responsible for their actions based on their position and the form of their actions. The Panel of Judges applied Article 55 Paragraph (1) to 1 of the Criminal Code which regulates the position of the perpetrator in the participation of a criminal offence declared as a pleger (perpetrator) by the Panel of Judges of the Unaha District Court.

Abstract

Pembatasan jumlah jamaah haji setiap tahunnya menyebabkan tingginya minat masyarakat indonesia untuk menunaikan ibadah umrah sebagai alternatif ibadah haji. Ibadah umrah, yang dapat dilaksanakan kapan saja sepanjang tahun tanpa terikat musim haji, menjadi solusi bagi mereka yang ingin segera beribadah ke Tanah Suci tanpa harus menunggu antrian panjang kuota haji. Di Indonesia penyelenggaraan ibadah umrah berdasarkan undang-undang diserahkan kepada Penyelenggara Perjalanan Ibadah Umrah (PPIU). fenomena yang terjadi saat ini terdapat beberapa kasus dimana seorang jamaah transgender berhasil mendapatkan visa dan berangkat melaksanakan ibadah umroh. penelitian ini bertujuan untuk mencari tahu bagaimana tanggung jawab Penyelenggara perjalanan ibadah umrah (PPIU) atas keberangkatan jamaah transgender. penelitian yang digunakan dalam penulisan ini adalah metode penelitian hukum normatif, yang lebih menekankan pada analisis terhadap data sekunder. Dalam sistem hukum positif di indonesia jenis kelamin hanya dikenal dua jenis yaitu laki-laki (Pria) dan perempuan (Wanita), hal itu secara jelas termuat dalam berbagai macam peraturan perundang-undangan. adanya fenomena jamaah transgender yang berhasil berangkat umroh secara hukum tidak dapat dibebankan kesalahan dan tanggung jawab kepada Penyelenggara Perjalanan Ibadah Umrah (PPIU). Sistem pengecekan data yang sifatnya hanya administrasi akan menjadi cela tersendiri bagi siapa saja yang memenuhi persyaratan secara administrasi untuk bisa berangkat umroh termasuk transgender. namun apabila ditemukan ada penyelenggara perjalanan ibadah umrah (PPIU) yang dengan sengaja memalsukan identitas jamaah untuk mendapatkan visa dapat dikenakan sanksi pidana sesuai dengan peraturan perundang-undangan di Indonesia dan jika merugikan negara tujuan maka negara tujuan dalam hal ini arab saudi dapat melarang penyelenggara perjalanan ibadah umrah (PPIU) untuk mengajukan visa dan masuk ke Arab saudi.

Abstract

The community service program in Gumanano Village, Mawasangka Subdistrict, Central Buton Regency aims to empower the community through the utilization of coconut shell waste into economically valuable products in the form of briquettes. Gumanano Village has abundant coconut potential; however, coconut shell waste has generally not been optimally utilized and is often discarded or burned, providing no added value. Through this program, training was provided along with the introduction of appropriate technology, including a coconut shell carbonizer, charcoal crusher, mixer, and briquette molding machine. The community was equipped with skills covering the entire production process, starting from raw material selection, processing, molding, to product packaging. The results of the program showed an increase in community knowledge and skills in managing coconut shell waste into environmentally friendly and marketable briquettes. In addition, the availability of production equipment supports work efficiency and product quality, thereby increasing the potential of briquettes as an alternative energy source as well as a new business opportunity for the community. Thus, this program is expected to improve household income, reduce environmental pollution, and promote economic independence for the people of Gumanano Village.
