Abstract

The purpose of this study is to examine the influence of sharia service quality, Islamic values ??and destination image toward loyalty with visitors? satisfaction as an intervening variable, a study on the great mosque of Demak tourism. This is a field research using quantitative approach. The data used are primary and secondary data taken with survey method. There are three independent variables, namely: (X1) the quality of sharia service, (X2) Islamic values, and (X3) the destination image. The dependent variable (Y1)/loyalty and intervening variable (Y2) are visitor satisfaction. The population of this study is all visitors or pilgrims of the great mosque of Demak in 2018. The sampling technique used is purposive sampling with 167 respondents. The results of this study indicate that: (1) the sharia service quality does not affect the loyalty, (2) the Islamic values ??have a direct positive and significant effect on the loyalty, (3) destination image has a direct positive and significant effect on loyalty, (4) the sharia service quality has no effect on the visitors? satisfaction, (5) the Islamic values ??have no effect on the visitors? satisfaction (6) the destination image has a direct positive and significant effect on the visitors? satisfaction, (7) the visitors? satisfaction has a direct positive and significant effect on the loyalty, (8) the visitors? satisfaction does not mediate the relationship between the sharia service quality and loyalty (9) the visitors? satisfaction does not mediate the relationship between the Islamic values ??and loyalty, and (10) the visitors? satisfaction mediates part of the relationship between destination image and loyalty.

Abstract

This article aims to examine the position of adopted children, determine the position of adopted children's inheritance rights, as well as the application of the distribution of inheritance for adopted children in Customary Law and Compilation of Islamic Law in Kudus Regency. The method used is qualitative with a comparative approach. The results showed that the teachings of Islam did not deny the existence of adopted children as far as giving welfare and education to children. The position of adopted children in customary law is influenced by the family or family system. Their position from one region to another varies. In the case of the application of the distribution of inheritance for adopted children in adat law in Kudus District, several provisions of customary law state that the portion of adopted children is equated with the portion of biological children (if there is inheritance rights), or through the will of their adopted parents. While the application of Islamic Law Compilation in the distribution of inheritance in Kudus Regency also regulates wasiat wajibah, a will determined by law even though the person concerned does not inherit it.

Abstract

This paper aims to investigate the resilience of millennial Muslim families in Indonesia in the face of the COVID-19 outbreak. The indicators examined were their resilience in gender partnerships, health and security, economic conditions, social-psychological resilience, and social-cultural resilience. The sample of data used in this study were 403 respondents. This research is a quantitative descriptive. The SPSS tool is used to describe the percentage of respondents' answers. The results showed that the gender partnership, health and safety, psychological social resilience, and socio-cultural resilience were in a quite good condition, but the economic conditions of the millennial Muslim family were the opposite. Family science practitioners can estimate millennial Muslim family behavior after the COVID-19 pandemic through this article. As for academics, this article is used for further research by integrating millennial Muslim family endurance. Empirically this research is useful to increase understanding of family resilience in the face of crisis. Millennial Muslim family resilience is a relatively new phenomenon for practitioners and academics. This research is a preliminary study that investigates the resilience of millennial Muslim families. Therefore, this investigation will serve as an investigation of knowledge about the resilience of millennial Muslim families when a virus outbreak occurs in Indonesia and the world.

Abstract

Revealing the Prophetic Maqasid in the Hadith About Relationships between Men and WomenThe textual reading of the Prophet's hadith about the relationship between men and women often results in discriminatory and subordinating attitudes towards certain genders. This article aims to reread the hadith about the relationship between men and women. It emphasizes the disclosure of prophetic Maqasid or the orientation and purpose of prophethood in the hadith. This study uses a descriptive-analytical method by criticizing the traditions about the relationship between men and women contained in the books of Sunan Abi Dawud, al-Tirmidzi, and al-Darimi. The result shows that revealing the prophetic Maqasid in these traditions is urgent considering that the purpose of Muhammad's sending was to spread love to the universe based on monotheism (Tawhid). Tawhid is not only a verbal statement. It becomes the main foundation in building a socio-political-cultural order that promotes equality and balance between men and women. A balanced and harmonious relationship between the two becomes the Maqasid of the Prophet in every utterance and policy he established. The balance of relations between men and women by relying on a correct and comprehensive understanding of the hadith of the Prophet opens opportunities for women to perform and play the roles that need them for the good of humanity universally

Abstract

Imam Maliki is one of the Imam of the Four Schools who has great influence in some areas of Islam. The characteristic that became one of Imam Malik's privileges was that he was a figure in fiqh and hadith. With this mastery of science and method of ijtihad, Imam Malik became a famous scholar in the hemisphere, people from every corner came to him and they jostled in his majlis and gathered to study. He gave fatwas and taught people about 70 years old. The scholars agree on his character, glory, religion, wara ', and grip against the sunnah. There are several characteristics in the jurisprudence of the Maliki School of Islam that make the method special, which influences the development of the Maliki School and makes it different amongst him and other scholars: First, the Maliki School of Medina holds the Meditative deed because Medina is the place of the Messenger of Allah. Secondly, he made mashalih al-mursalah as a source of law. Mashalih al-mursalah are things that aim for human benefit, but not specified by the shari'ah in particular. Third, Imam Malik clings to the fatwas of the sahabah (qaul sahabi) because they are the forerunner of the hijrah with the Prophet or the aid class (Ansor). Fourthly, Imam Maliki uses Istihsan in various problems, such as employee guarantees, helping the owner of the bread kitchen and the mill, the pay of the bathroom for everyone is the same and the implementation of qisas which should present some witnesses and oaths. Fifth, a special sunnah position before Imam Malik.

Abstract

Penelitian yang berjudul “Implementasi Kualitas Layanan Syariah Pada Biro Perjalanan Wisata OTW Tour Pati”. Penelitian ini merupakan penelitian konklusif. Adapun pendekatan penelitian ini kualitatif yang berlandaskan fenomenologi melalui pengamatan, wawancara dan studi dokumen terhadap Biro Perjalanan Wisata OTW tour. Hasil dari penelitian ini yaitu: model layanan syariah yang dilakukan yaitu proses dan jenis persiapan menuju tempat wisata tidak bertentangan dengan syariah, karyawan OTW tour dan pengguna jasa berpakaian islami, edukasi tentang cara shalat bagi musafir, tempat dan rumah makan serta hotel yang tidak betentangan dengan syariah. Sementara implikasinya yaitu: akad syariah, memberi buku petunjuk, rumah makan dan hotel tersertifikasi halal. Sedangkan respon masyarakat terhadap layanan syariah yaitu puas memilih biro travel OTW tour karena mendapatkan nilai ibadah dalam perjalanan. Sementara respon kurang positif yang didapat pengguna travel yaitu pada kenyataannya lagu/video yang diputar kadang pemerannya tidak menutup aurat, tempat penginapan tidak selamanya berbasis syariah, dan di tempat wisata masih banyak bersama-sama dengan lawan jenis. Dalam analisis penelitian perlu adanya konsep baku tentang konsep biro travel syariah. Maka, peneliti memberikan tawaran konsep biro travel syariah yaitu: adanya Dewan Pengawas Syariah, menitikberatkan aspek tafakkur dan tadabbur, bentuk layanan harus sesuai dengan syariah.

Abstract

تهدف هذه المقالة تبيين دور القيم الاجتماعية والثقافية في تأسيس القانون الإسلامي في إندونيسيا. وهذه الدراسة مستندة على أساس البحث النوعي. وأما طريقة تحليل البيانات المستخدمة هي تحليل المحتوى على الرسائل الواردة عن القيم الاجتماعية والثقافية في تأسيس القانون الإسلامي .ونتيجة هذا البحث ان اللقاء بين الإسلام والثقافة مهم جداً، لأنه إذا حدث ذلك فإن الأرضية الوسطية للإسلام كدين رحمة للعالمين لن يفقد هويته وسط الأوقات المتغيرة. في هذا السياق، يخضع الدين والثقافة لعملية بناءة من الاختلاط. لقد أثرت العوامل الاجتماعية والثقافية ومستوى التمدن في المجتمع على ظهور مختلف المذاهب الفقهية في الإسلام. تتأثر الفقه الإسلامي في إنتاج الأفكار وأعمال القانون الإسلامي تأثرا قويا بالعوامل البيئية الاجتماعية والثقافية. منذ عام ١٩٧٥ وحتى الآن، أصدرت مجلس العلماء الإندونيسي (MUI) أكثر من ١٣٨ فتوى تغطي محتوياتها العديد من مجالات الحياة: العبادة والزواج والأسرة والغذاء والثقافة ومسائل العلاقات بين الأديان والمسائل الطبية وتنظيم الأسرة وقضية الحركات المنحرفة .توضح الفتوى كيف أثرت العوامل الاجتماعية والثقافية على منتجات التفكير القانوني الإسلامي. وهكذا كان للعوامل الاجتماعية والثقافية تأثير هام في تلوين منتجات الفكر القانوني الإسلامي، مثل تكوين الفقه القانوني، وفتاوى العلماء في التشريع في البلدان الإسلامية، وقرارات المحاكم.
