Abstract

In online buying and selling, a salam contract is a pre-order arrangement in which the buyer pays up front and the items are delivered at a later date and time. The payment system carried out in the application of the salam contract is at the beginning of the sale and purchase agreement which can be done through bank transfer, debit, COD (Cash On Delivery), minimarket, ShopeePay, and various other partners. This study employed a qualitative research methodology that using literature studies from a variety of sources, including books, journals, and student research findings in the form of theses and other similar works. Based on the Qur'an, Hadith, and Ijma, the study's findings indicate that the use of the salam contract in the Shopee marketplace is allowed as an economic activity because the transactions will be advantageous to both parties, which in this case are sellers and users. Users will get facilities that make it easier to find the items they want to buy, while sellers will be able to receive orders directly and send the goods.

Abstract

BRILink agent is an officeless banking service expansion initiated by BANK BRI. The presence of BRILink agents really helps the community to take advantage of banking services as needed. In addition, BANK BRI also invites its customers to become BRILink agents, so that they can serve banking transactions to the public, just like coming to a bank or ATM machine. The convenience offered by BRILink to the public raises a separate problem in setting tariffs at the agent level, where BRILink agents have uniform tariffs for their customer transactions. The research tries to reveal the reasons for the difference in tariffs in transactions in each BRILink agent in the Repaking Village, Wonosamodro District, Boyolali Regency and reviews how the fee scheme is in the concept of Islamic Law.

Abstract

This study aims to explore the global development of Sharia-compliant stock investment by examining renowned international journal publications. This study employs a methodical literature review approach to look for papers using the term “Islamic Stocks” utilizing the Scopus aggregator. The author reviewed 71 research publications on Islamic shares published between 2014 to 2023. Based on these findings, the diversification of Islamic stocks provides notable benefits as it considers economic groupings ranging from industrialized to emerging nations. Islamic investment principles and mood are significant factors in the dynamics of the financial market. The Islamic stock market is often less dangerous during times of extreme events. Despite the COVID-19 pandemic affecting the stability of the Sharia stock index, some stocks have demonstrated their ability to withstand changes in investor state of mind. Essentially, this literature aims to provide basic guidance for decision-makers in investing and risk management in Islamic financial markets. It covers topics such as the potential of Islamic markets, risk, exposure, and interactions with external factors.

Abstract

In the practice of gold pawning in Islamic banking there are several costs that must be burden by customers. These costs include ujrah, administration, stamp duty, and insurance. Gold pawning transactions in Islamic banking must be identified whether they are in accordance with the concept that was stated or not. On the other hand, the practice of gold pawning is different from the policies issued by DSN. This study aims to determine the review of Islamic compliance and Islamic law against gold pawning in Islamic banking. The research method used is to use literature review, which is taken from books, articles, internet, and opinions of experts in their fields. Viewed from the aspect of sharia compliance, the reality of sharia banks uses as in the theory of sharia compliance policies in the gold mortgage financing process, namely the process of selling collateral and excess sales. While viewed from the aspect of Islamic law, the merging of the rahn and ijarah contracts is related to ta'alluq where the rahn contract is interdependent with the ijarah contract. The matter is permitted by DSN-MUI because between the rahn contract and the ijarah contract have different objects. While seen from the hadith gold pawn contract there are two contracts in one transaction, namely rahn contract and ijarah contract. This matter is prohibited in Islamic teachings.

Abstract

This study aims to determine the basis for Alternative Dispute Resolution (APS) which includes mediation, negotiation, conciliation, and arbitration in Islamic law taken from the Qur'an and Al-Hadith. The essence of the problem to be revealed in this study is to find models of Dispute Resolution at the time of the Prophet Muhammad SAW. The research method used in this study is a literature study research model by relying on books, articles, journals, and turots as sources of research data. The results of this study found that at the time of the Prophet Muhammad SAW had encountered the practice of resolving disputes through Alternative Dispute Resolution (APS). This is proven by, first, the finding of the arguments for negotiation, mediation, conciliation and arbitration from the Qur'an and Hadith, secondly, the prophet Muhammad SAW negotiated with Suhail Bin 'Amr as a negotiator for the polytheists in the form of a hudaibiyah agreement, the three prophets Muhammad SAW became a mediator in reconciling two people from the ansor circles who were in dispute over material rights, fourth it was found that the prophet Muhammad SAW justified the arbitration carried out by Abu Shuraykh and Sa'ad Bin Muadz.

Abstract

Financing based on Islamic principles actually to increase employment opportunities and economic prosperity in accordance with the Islamic values. The existence of BMT run financing based on Islamic principles not only for profits and enliven the financing business in Indonesia, but also to create a safe business environment with Islamic principles that do not burden the debtor. One of the financing with the principles of Syariah is financing with the murabahah system. Murabahah financing is a type of purchase contract item with the acquisition price and profit (margin) as agreed by the seller and the buyer where the refund loans by the customer can be done in the form of a mortgage or loan. Loans granted certainly has risk so required ability and effectiveness in managing credit risk and minimize the potential losses. Experienced credit risk is a breakdown of murabahah financing so that need to design a settlement in such financing.

Abstract

As time progresses, human needs and problems become increasingly complex. Cash waqf presents a strategic solution to these challenges, particularly in Indonesia, where the practice is relatively new. The rapid development of cash waqf in Indonesia is expected to contribute to improving the nation's welfare. Currently, many problems remain, such as the difficulty of accessing education for children in remote or poor areas, and the lack of adequate school facilities and infrastructure. The Indonesian economy also faces challenges such as low growth, high poverty, unemployment, and food issues. Cash waqf has significant potential to address these issues if managed optimally. This qualitative research aims to examine the development of cash waqf in Indonesia and its role in advancing education and the economy. The study results show that cash waqf became widely known in Indonesia following the 2012 fatwa from the National Sharia Council (DSN MUI), and its popularity continues to grow. In the field of education, cash waqf plays a significant role through material support for the advancement of educational institutions. In the economic sector, cash waqf has proven vital for reducing poverty, empowering the community's economy, and providing business capital for MSMEs.

Abstract

Nazhir's problem is one of the problems in waqf practice that is often encountered in the management of waqf today. These obstacles are due to the low quality of human resources, lack of understanding of Nazhir, and lack of guidance given to Nazhir. This paper will discuss about the security of waqf in the city of Semarang, selling nazhir and implementing strategies by the Indonesian Waqf Board in order to create Nazhir professionalism. The purpose of this research is to find out the problems between waqf assets, Nazhir and the Indonesian Waqf Board and to formulate what solutions can solve them. This study uses a qualitative method with a descriptive approach, data observation, observation, and document review. The results showed that there were still many waqf assets found without complete administration so that representatives of BWI Central Java were focused on strategies to control existing waqf assets and the training received by Nazhirs in Semarang City was not sufficient to produce professional Nazirs. The mindset, understanding and work ethic of the Nazhirs are still traditional to create a productive climate of waqf which is beneficial for the economy of society.

Abstract

This study discusses e-commerce business ethics that realize business continuity, but there are problems between buyers and sellers not meeting face to face which can harm consumers. Therefore, the importance of the trust of both parties is an absolute requirement in buying and selling online. This is implementing business ethics based on the provisions of Islamic law and the presence of maqashid sharia and the DSN-MUI Fatwa regarding online shops. This study aims to analyze the application of the DSN-MUI Fatwa regarding online shops that pay attention to TikTok e-commerce business ethics. This research method is a normative research using maqashid sharia theory by Wahbah Zuhaili. The results of the study, that the authors argue find the relevance of e-commerce that is aligned with the DSN-MUI Fatwa regarding online shops as Islamic legal rules that maintain trust in sellers and buyers in the continuity of business ethics, such as the findings of fathanah ethics (professional), amanah (trusted), shiddiq (honest), and tabligh (transparent). Thus, the implications of TikTok e-commerce contribute to maintaining the stability of the continuity of seller's business ethics for the people's economy.

Abstract

Pertumbuhan dan perkembangan ekonomi di suatu  negara tidak terlepas dari peran institusi di dalamnya, misalnya lembaga keuangan. Semakin banyak jumlah lembaga keuangan yang sehat mengindikasikan aktivitas dan produktivitas ekonomi suatu negara tersebut sangat baik. Tolok ukur pertumbuhan dan perkembangan dapat dilihat dari indikator diantaranya tingkat inflasi di bawah 5%, turunnya jumlah angka pengangguran, Pendapatan Domestik Brutto (PDB) yang meningkat, turunnya jumlah angka kemiskinan, cadangan devisa bertambah, dan lain sebagainya. Indonesia pada tahun 2017 tergolong negara yang memiliki kondisi ekonomi yang prospektif, hal ini dapat dilihat dari indikator ekonomi yang tergolong baik. Maka tidak heran bila lembaga keuangan baik bank maupun non bank tumbuh pesat di Indonesia, tidak terkecuali lembaga pembiayaan syariah. Indonesia, dengan jumlah penduduk hampir 260 juta jiwa yang  terdiri dari 70% penduduknya berusia produktif (15-64 tahun) merupakan sumber daya yang tidak bisa diabaikan dalam menggerakkan roda perekonomian. Bagi bisnis syariah ini merupakan peluang yang sangat besar, kondisi ini juga didukung oleh hampir sebagian besar atau mayoritas penduduk Indonesia beragama islam.Bisnis adalah suatu aktivitas yang selalu berhadapan dengan resiko dan return. Bank syari’ah adalah salah satu unit bisnis. Dengan demikian, bank syari’ah juga akan menghadapi resiko manajemen bank itu sendiri. Bahkan kalau dicermati lebih mendalam, bank syari’ah merupakan bank yang syarat dengan resiko, karena dalam menjalankan aktivitasnya banyak berhubungan dengan produk-produk bank yang banyak mengandung resiko, seperti produk mudharabah. Demikian pula resiko yang diakibatkan karena ketidakjujuran atau kecurangan nasabah dalam melakukan transaksi. Oleh karena itu, para pejabat bank syari’ah harus dapat mengendalikan resiko seminimal mungkin dalam rangka untuk memperoleh keuntungan yang optimum.Paling tidak ada 4 (empat) hal yang berkenaan dengan resiko yang perlu dikelola secara baik, yaitu resiko pasar, resiko pembiayaan, resiko likuiditas dan resiko operasional. Apabila ke empat hal ini mampu di kelola dengan baik, maka keberhasilan bisnis syariah akan mampu tumbuh dan berkembang dengan baik serta mampu bersaing dengan lembaga pembiayaan lainnya.Kata Kunci : Manajemen Resiko, Mudharabah, Syariah, Lembaga Keuangan, Bisnis.
