Abstract

The Suspension of Debt Payment Obligations (PKPU) within the Indonesian legal system is not merely a mechanism for deferring payments; rather, it serves as a debt restructuring instrument enabling debtors and creditors to reach a settlement through a collective process. A settlement ratified by the court (homologation) creates binding legal consequences and establishes a foundation of certainty for the parties involved. However, the effectiveness of a settlement does not always correlate directly with the achievement of homologation. Failure to implement the settlement can give rise to moral hazard issues, particularly when debtors exploit PKPU protections without sufficient financial capacity or good faith. This research aims to analyze the effectiveness of PKPU settlements as debt restructuring instruments and to formulate a legal framework that strengthens legal certainty while simultaneously preventing moral hazard. The study employs a normative legal research method, utilizing statutory, conceptual, case-based, and limited comparative approaches. Primary legal materials include Law No. 37 of 2004, Supreme Court rulings, Commercial Court decisions, and relevant Constitutional Court rulings. The research demonstrates that the effectiveness of a settlement must be measured by the quality of the settlement plan, the assurance of implementation, transparency, creditor protection, and the effectiveness of enforcement. The study proposes a post-homologation monitoring model to strengthen the PKPU mechanism.

Abstract

  This paper examines the concept of governmental management and leadership as a systematic process of planning, organizing, and mobilizing resources to achieve public objectives effectively, efficiently, and with integrity. The urgency of shifting the paradigm from rigid technical bureaucracy toward social institutions focused on public welfare is highlighted. The Integrated Service Improvement Concept is introduced as an innovative management philosophy that integrates SMART culture (Self-Driven, Motivation, Action Oriented, Responsible Regulation, Team Collaboration), measurable targets (Smart Goals), and innovative leadership. Through four main pillars—system appreciation, variation understanding, leadership governance, and SMART psychology approach this concept transforms bureaucracy into a humanistic and adaptive social organism. Its implementation aims to create a work culture oriented toward excellent, transparent, and timely outcomes to modernize public sector management in Indonesia, enabling bureaucracy to operate as a service organism for public happiness.

Abstract

Islamic inheritance law normatively and dogmatically governs the allocation of inheritance shares. However, its societal implementation reveals disparities in understanding that trigger a shift toward a sociological perspective, particularly regarding the inheritance rights of second and subsequent wives. This study aims to analyze the legal construction of inheritance rights for multiple wives based on legal pluralism. This approach examines the operation of Islamic inheritance law amidst personal-social forces, complex social realities, and the interplay between legal systems. The findings demonstrate that the functioning of Islamic inheritance law is influenced by individual Muslim social behavior, social complexities, and intersecting legal systems, prompting communities to adopt distinct legal pathways grounded in rational and sociological choices. The resulting model is a prismatic-plural construction driven by the feedback of Personal Social Forces (PSF), prominently characterized by its bidimensional and pluralistic nature. A comparative analysis indicates that Indonesia, Brunei Darussalam, and Singapore exhibit similar patterns of inheritance legal pluralism, transitioning from normative-dogmatic to sociological frameworks. In contrast, Saudi Arabia and Malaysia strictly adhere to normative-dogmatic faraidh principles via their Sharia courts.

Abstract

Global environmental degradation and the climate crisis have transformed into one of the most pressing non-traditional security threats in contemporary international relations. This problem reflects the "tragedy of the commons," where greenhouse gas emissions are transboundary, demanding collective action among sovereign states. This article aims to analyze the dynamics and effectiveness of international environmental cooperation within the Paris Agreement 2015 framework through the lens of Neoliberal Institutionalism. Employing a qualitative-descriptive approach with desk-based library research, this study examines secondary literature, policy reports, and official treaties. The findings reveal that the Paris Agreement introduced a paradigm shift from a rigid top-down structure (such as the Kyoto Protocol) to a flexible bottom-up architecture via Nationally Determined Contributions (NDCs) and the Enhanced Transparency Framework. International institutions and epistemic communities (such as the IPCC) successfully facilitate information exchange, reduce transaction costs, and establish collective compliance norms. Nevertheless, its institutional effectiveness remains hindered by classic anarchic structural challenges, including the absence of coercive enforcement mechanisms, free-rider vulnerabilities, and disparities in climate finance commitments between the Global North and Global South.

Abstract

Islamic inheritance law is fundamentally normative-dogmatic in governing an individual’s inheritance rights and shares. However, its practical implementation in society often experiences disparities in understanding, triggering a shift toward a sociological perspective. Based on this phenomenon, this study examines how Islamic inheritance law operates concerning the legal standing and inheritance rights of second and subsequent wives within the context of unregistered marriages (nikah siri). Employing a legal pluralism approach, this research investigates the influence of personal factors, social dynamics, and the coexistence of multiple legal systems. Empirical findings reveal that the operation of Islamic inheritance law is influenced by the social behavior of Muslim individuals in navigating complex social realities. The interaction and mutual intervention among legal systems lead the community to adopt rational and sociological choices in practicing inheritance law. Furthermore, the prevalence of unregistered polygamous marriages results in the loss of a wife’s civil rights. This condition necessitates creative legal-cultural awareness among relevant parties (role occupants) to actively pursue and secure their inheritance entitlements. The study recommends that the legal and judicial systems governing Islamic family law in Indonesia maintain consistency in enforcing regulations to accelerate ideal implementation. Concurrently, the Muslim community must consistently adhere to the formal jurisdiction and legal mechanisms provided by the state to ensure legal certainty.

Abstract

The hegemonic rivalry between the United States and China has extended into the domain of Artificial Intelligence (AI), catalyzing a new autonomous arms race. This article examines how military AI activates the security dilemma and undermines global stability. Grounded in Kenneth Waltz’s Neorealism and Robert Jervis’s offense-defense differentiation, this qualitative study utilizes process tracing and critical documentary analysis. It reveals that the intangible and dual-use nature of AI erodes the boundary between defensive and offensive postures. Consequently, integrating AI into warfighting doctrines—such as the U.S. JADC2 and China's Intelligentized Warfare—fuels a spiral of uncertainty, severely compresses human command deliberation, and heightens the risk of algorithmic flash wars. At the macro level, battlefield transparency compromises nuclear deterrence stability, while multilateral diplomacy in Geneva remains deadlocked. This study concludes that the pursuit of algorithmic military superiority engenders profound strategic fragility, underscoring the urgent need for institutionalized confidence-building measures and a binding taboo against AI in nuclear command.

Abstract

The post-Paris Agreement transformation of global energy governance necessitates a fundamental reorientation in the relational dynamics between advanced industrialized economies and developing nations. Among the most salient manifestations of contemporary climate diplomacy is the Just Energy Transition Partnership (JETP), negotiated between the Government of Indonesia and the International Partners Group (IPG). This article critically examines the institutional dynamics, effectiveness, and structural frictions inherent in Indonesia's JETP through the theoretical lens of Neoliberal Institutionalism. Employing a descriptive-qualitative approach rooted in extensive library research and policy document analysis, this inquiry explores how JETP operates as a minilateral climate regime. The analytical findings reveal that while JETP has successfully institutionalized policy coordination, mitigated technical information asymmetries, and lowered transactional costs, its substantive efficacy remains hampered by systemic inequalities. The disproportionate reliance on commercial debt instruments over non-repayable grants has exacerbated domestic apprehensions over fiscal sovereignty costs. Simultaneously, contentious negotiations regarding off-grid captive coal-fired power plants powering nickel smelters illuminate the intractable friction between national developmental imperatives and global decarbonization norms. Ultimately, this partnership illustrates that international institutions can effectively orchestrate technical governance, yet struggle to resolve the deep-seated dilemma of distributive climate justice between the Global North and Global South.

Abstract

The South Pacific has experienced a tectonic shift in the 21st-century international security landscape, transforming from a historically tranquil maritime sanctuary into a primary epicenter of geostrategic friction between the United States, its traditional allies, and a rising People's Republic of China (PRC). This article provides a critical narrative analysis of regional security dynamics by synthesizing the Copenhagen School's Securitization Theory with the concept of Asymmetric Agency among developing small island states. The core analytical inquiry focuses on the fundamental dissonance between the conventional military securitization pursued by external great powers and the non-traditional existential security imperatives of Pacific Island Countries (PICs), who formally declared climate change as their principal security threat under the 2018 Boe Declaration. Employing a qualitative-exploratory research design grounded in policy discourse analysis and systematic desk research, this study argues that Pacific island states are actively rejecting their reductionist portrayal as passive pawns in a renewed Cold War rivalry. Instead, through the collective framing of the "Blue Pacific" continent and the foreign policy doctrine of "Friends to all, enemies to none," regional leaders exercise calculated strategic hedging. This mechanism allows them to leverage Sino-American competition to secure developmental infrastructure and climate adaptation financing, while resolutely resisting the militarized polarization that threatens regional strategic autonomy and enduring peace.

Abstract

The rise of minilateral security pacts such as AUKUS and the QUAD in the Indo-Pacific poses fundamental disruptions to ASEAN Centrality within the regional security architecture. This study analyzes the strategic implications of AUKUS and QUAD on ASEAN's strategic autonomy and explains the internal fragmentation among its member states. Integrating Structural Neorealism (balance of power and security dilemma) with Neoclassical Realism (domestic intervening variables), this qualitative-explanatory study relies on library research and defence policy analysis. The research reveals three principal findings: first, minilateralism constitutes a hard external balancing strategy by the US and its allies against Chinese assertiveness, reflecting systemic frustration with ASEAN's sluggish, consensus-based mechanisms. Second, these minilateral coalitions intensify regional security dilemmas, exacerbating internal fissures between neutrality-oriented states (Indonesia and Malaysia), frontline claimant states embracing military deterrence (the Philippines), and mainland states economically tethered to Beijing (Cambodia and Laos). Third, ASEAN centrality faces functional marginalization, relegated to consultative dialogue while actual deterrence architecture shifts to minilateral pacts. Preserving ASEAN centrality necessitates operationalizing the ASEAN Outlook on the Indo-Pacific (AOIP) supported by institutional flexibilities such as the ASEAN Minus X formula.

Abstract

The intensifying hegemonic rivalry between the United States and China in the Indo-Pacific has entangled Southeast Asian states in geopolitical and geo-economic polarization. Rejecting binary alignments between Western minilateral alliances (AUKUS and Quad) and China's Belt and Road Initiative, Indonesia has enacted a strategic hedging posture to safeguard strategic autonomy and uphold ASEAN centrality. Employing a qualitative descriptive-explanatory method grounded in Cheng-Chwee Kuik's hedging framework, Structural Neorealism, and Constructivism, this study investigates Indonesia's foreign policy trajectory from 2014 to 2024. The findings reveal that Indonesia's hedging operates across four concurrent pillars: economic pragmatism through Chinese investment absorption, institutional diversification with Western partners (IPEF and OECD accession), defensive maritime modernization (indirect balancing) in the North Natuna Sea, and normative leadership via the ASEAN Outlook on the Indo-Pacific (AOIP). However, the efficacy of this posture is increasingly constrained by domestic elite policy fragmentation, Beijing's persistent gray-zone maneuvers in the Natuna EEZ, and eroding ASEAN internal cohesion. This article concludes that preserving Indonesia's strategic autonomy necessitates domestic maritime governance unification and sovereign defense industrial capability
