Abstract

This descriptive paper examines contemporary philosophical thought concerning the nexus of language, modern human existence, power, and technology, signifying a paradigm shift from rationalism toward critique and deconstruction spurred by scientific leaps. In the legal realm, the disruption of artificial intelligence (AI) necessitates a transition from anthropocentric jurisprudence toward algorithmic justice anchored in ethics and human rights. The proliferation of AI technology and global digitalization presents profound challenges, including autonomous machine decision-making without full human oversight, the erosion of traditional territorial sovereignty due to blurred borders, and algorithmic bias perpetuating historical social prejudices. These realities engender tension between procedural efficiency and substantive justice, ignite debates over the conferral of new legal status (electronic personhood), and complicate the attribution of legal liability for system failures.Addressing these dynamics, the future trajectory of legal philosophy must reinstate ethics and morality as foundational pillars of positive law to resist technological capitalism. Beyond fostering adaptive regulations responsive to rapid innovation, legal philosophy bears the fundamental imperative to safeguard human dignity. Consequently, humans must remain the ultimate arbiters in legal decision-making to uphold freedom, equality, and high-quality substantive justice for all.

Abstract

This paper is an inquiry into the conceptual understanding and philosophical reflections on the aspiration for high-quality equality, which constitutes a fundamental right for all global citizens, without exception to the people of Indonesia. In philosophy, the concept of equality centers on fundamental questions regarding how human beings ought to be treated and how resources and opportunities should be equitably distributed. The caliber of philosophical thought on this issue relies heavily on the clarity of the core variables used to define it. Furthermore, it addresses how high-quality equality can be realized in the contemporary era amidst the rapid advancement of Artificial Intelligence (AI). The quality of philosophical thought regarding equality is not judged by the enforced uniformity of final outcomes, as forcibly leveling results often infringes upon individual liberty. Instead, ideal philosophical equality is appraised by a system’s capacity to eliminate structural discrimination, compensate for natural disadvantages (brute luck), equalize basic human capabilities to flourish, and cultivate mutually respectful social relations free from oppressive power hierarchies. Ultimately, high-quality equality in the contemporary era must be inclusive, technologically adaptive, and sensitive to diverse backgrounds. True equality today is achieved not by making everyone identical, but by ensuring that differences never serve as a pretext for marginalization or discrimination
