Abstract

This article reveals the fact that in Islamic Family Law, there are a number of anomalies and crisis, for instance, Islamic Law Compilation (KHI) on polygamy and mixed-religion marriage which contains discrimination and intolerance. This, however, is caused by its enforcement bound by civil law and merely to theMoslem communities. The article introduces the nationalization and internationalization of Islamic family law in the KHI, thus eliminating discrimination and intolerance. This will be sought by creating coherence between KHI and modernity issues such as: Human Rights, democracy, civil society, nation state and constitutionalism in the effort to desacralization. When added with the term desacralization, it will mean to liberate people from superstitious constraints (mythology) in some aspects, yet reserving the sacralization, not undermining or abandoning religious orientation in the norms and values of society, especially in the Islamic Family Law. Understanding this fundamental, desacralization of Islamic family law is, hence, Quo Vadis Islamic Family Law, that will eventually create progressive Islamic Family Law consistent with modernity and Indonesian ideology

Abstract

This study is conducted in order to analyze the fiqh of tolerance in traditional and modern pesantren. This study is a kind of Islamic sociology of law which analyzes empirically how the response of community toward the value of tolerance. This study uses quantitative method in order to know the level of tolerance of five pesantren in Java. Those pesantren are Darunnajah Pesantren in Jakarta (1961), Rafah Pesantren in Bogor (1997), Ibnu Abbas Pesantren in Klaten (2007) which represent modern pesantren and Babussalam Pesantren in Bandung (1981), Al-Ishlah Pesantren in Kediri (1954) which represent traditional pesantren. The result of this study indicates that the traditional pesantren is better than the modern pesantren on the level of external tolerance, while the modern pesantren is better than the traditional pesantren on the level of internal tolerance.

Abstract

This article offers a method of identifying and examining the challenges facing Islamic law studies in Indonesia today in two steps. Firstly, it argues that the study of Islamic law is more than just the study of fiqh and usul al-fiqh; it includes three broad areas of philosophy, normative studies, and empirical studies, all of which have to be studied congruently and imbalances on any part of which will constitute the challenge itself. Secondly, by classifying and examining the topics of doctoral dissertation submitted to the UIN Syarif Hidayatullah Jakarta in terms of those three areas of studies of Islamic law, it was found that in the last 30 years (1982-2011) out of some 836 dissertations that had been submitted to the university the highest proportion of which was on Islamic law (34, 7 %) and mostly on normative conventional Islamic laws. Very little of those studies were devoted to empirical and philosophical studies of Islamic law, probably because of the lack of familiarity with various fields of social sciences and humanities as the auxiliary sciences to the study of law. This is the challenge that has to be remedied in the future.

Abstract

This article discusses the head of family in Islam by examining surah al-Nisa: 34. This paper is a qualitative study using the Charles Sanders Peirce semiotic approach. This research is study literature. The sources in this study are kitab, books and journal articles that are relevant to the theme. Interpretation of QS. An-Nisa (4): 34 by taking some references to the views of the previous ulama, it can be concluded that men are the head of the "leader" family in a family setting.

Abstract

This paper argues that a judge has a huge impact on solving a dispute of a joint wealth for a divorced couple in Indonesia as the judge has his/her own way to establish justice in allocating the wealth not only for the divorced husband, but more importantly for the divorced wife equally.  This article bases this argument on normative resources of Islamic law about the joint wealth of the divorced couples and on western views about the same issue, and compare them to the case of this issue brought in the Mataram Religious Court, in the Mataram High Religious Court, and in the national Supreme Court.   Keywords: joint wealth dispute, solution, normative views of the joint wealth, and a case study of the dispute in the Mataram Religious Court.

Abstract

The author examines the religious specifics of Banten during the early Islamizing of the region. The main characteristics of the process resided in a link between commerce and Muslim networks, a strong cosmopolitism, a variety of the Islam practices, the large number of brotherhood followers and the popularity of esoteric practices. These specificities indicated that the Islamizing of the region was very progressive within 16th century and the processes of conversion also generated inter-influence with local religious practices and cosmologies. As a consequence, the widespread assertion that Banten is a bastion of religious orthodoxy and the image the region suffers today as hosting bases of rigorist movements may be nuanced by the variety of the forms that Islam took throughout history. The dominant media-centered perspective also eludes the fact that tide connection between religion and ritual initiation still composes the authority structure. This article aims to contribute to the knowledge of the religious aspects in the Bantenese society.

Abstract

Jamaah Tabligh merupakan dakwah Islam yang lahir dibidani oleh Maulana Muhammad Ilyas pada tahun 1926 di distrik Deoband India, mulai masuk dan berkembang di Jawa Timur pada awal dekade delapan puluhan. Namun demikian sampai sekarang institusi Islam tersebut masih merupakan sesuatu yang sangat mesteri bagi mayoritas umat Islam di Jawa timur. Berdasar realita sosial di atas tulisan ini berusaha untuk dapat mengungkap visi dan misi yang ingin dicapai gerakan sosial Islam tersebut, dengan cara melakukan telaah dokumentasi yang diperoleh dari literature bacaan hasil karya para tokoh dan praktisi amalan jama‘ah tersebut. Kemudian studi ini juga menyingkap fenomena sosial dari perspektif kehidupan sehari-hari, dalam komunitas Jamaah Tabligh desa Temboro, Magetan, Jawa Timur sehingga pendekatan yang digunakan adalah analisis visi, misi dan pendekatan fenomenologis.Melalui telaah dokumentasi diperoleh temuan Jamaah Tabligh mempunyai  dua visi pokok yaitu : meningkatkan kualitas keilmuan Islam bagi umat seluruh alam, dan berusaha memproduk kembali, agar umat Islam seluruh alam, memiliki  perilaku sosial keagamaan persis seperti pada zaman Nabi dan sahabatnya di kota Madinah, sedang misi yang diupayakan ada dua bentuk kegiatan yakni: melaksanakan sosialisasi ta‘lim dengan cara gerak dari satu masjid ke masjid yang ada di seluruh alam, dan berupaya untuk membentuk suasana belajar di setiap masjid umat Islam di seluruh alam. Berdasar studi latar diperoleh temuan bahwa komunitas Jamaah Tabligh desa Temboro, Magetan, telah berhasil membentuk individu warganya, memiliki skema kognitif, sehingga individu tersebut telah memiliki kepahaman tentang perlunya belajar agama, pentingnya belajar agama dan kebutuhan untuk membentuk suasana belajar agama, sehingga skema kognitif tersebut mempunyai peran yang cukup signifikan dalam membentuk masyarakat belajar dan berperan dalam mewujudkan perubahan perilaku sosial keagamaan.

Abstract

It is predicated that Islam, which penetrated in Lombok, was brought by Muslim merchants in the 15th century. However, according to the local sources, Islam was brought to Lombok by Sunan Prapen from Java, and not in 15th, but in 16th. Islam had been developed within the center of Islamic Kingdoms, established less than two centuries. The kingdoms had become the ruling powers. During the great periods of the Islamic kingdoms, Islam spread out massively and became the official religion of the states. Employing historical approach with three phases: heuristic, analytic or interpretative and historiography, this research discusses the penetration method of Islam in Lombok in 15th century and how it had been developing since its arrival to the 19th century.

Abstract

This paper argues that a key success of the implementation of waqf (wakaf/Islamic endowment) is the degree to which a nazir (nazhir/waqf supervisor) qualifies him/herself to develop waqf property in a trustworthy and productive way; therefore, he/she is capable of building trust of Muslim society (ummat) him/her. Additionally, success or failure of socializing and communicating this waqf execution to the society depends on the physical endowments; that is, at least the ummat know about the distribution of waqf. Here, the nazir is a key point in developing the waqf. The reason would be the fact that a prospective endower candidate often establishes fit and proper test to a nazir candidate. If the test convinces the endower candidate to trust the nazir, this candidate will automatically endow his/her own property for the sake of waqf. In opposite, if the test does not assure this potential endower, he/she will not accomplish his/her own property for the sake of waqf. This study found that a strategy of communication, which is employed by the nazir, helped convince him/her to lead the ummat to constitute the waqf of land inhabited by people of different areas. This research recommends that the nazir publicize waqf as well as Muhammadiyah organization has done it by its magazine; therefore, the ummat recognize the development of waqf, and this publicized waqf practice can become a good example of how the umat should execute their waqf programs.
