Abstract

The article concludes that the preservation of environment better prevails when is prevails when is applied Islamic based customary law. The strict implementation of the Islamic based customary law will lead healthier environment. The customary forest based on this law would be the best religious practices deals with the environmental crisis. This forest would be resilient against the damage on the protection and preservation of Islamic based customary law. Moreover, this should be supported by religious, social-political, and educational values.

Abstract

Khilafah Islamiyah merupakan konsep pemerintahan yang pada akhirakhir ini kembali mengemuka dan menjadi tuntutan sebagian umat Islam. Pasca reformasi, tepatnya tahun 2000-an, Hizbut Tahrir di Indonesia mengadakan seminar khilafah pertama kali. Setelah itu, mereka sangat gencar menggaungkan khilafah sebagai sistem negara ideal. Mereka sering melakukan kritik terhadap sistem demokrasi yang dianggapnya sebagai produk Barat. Isu khilafah kembali mencuat setelah gerakan yang menamakan dirinya Islamic State of Iraq and Syam(ISIS) yang mendeklarasikan Umar AlBaghdadi sebagai khalifah.Model yang disebutkan terakhir ini bahkan melayangkan aksi-aksi kekerasan. Jauh sebelum keduanya menggelorakan khilafah di tengah negara modern, Jemaat Ahmadiyah Indonesia (JAI) sudah menerapkannya. JAI menerapkan khilafah jauh sebelum Ikhwanul Muslimun mewacanakan sistem pemerintahan Islam tersebut.Sebab itu konsep dan sisten khilafah yang diterapkan Ahmadiyah menjadi menarik untuk diteliti. Masalah yang akan dijawab dalam artikel ini adalah bagaimana JAI di Kampung Gondrong menafsirkan dan mengimplementasikan Khilafah ala Minhaji anNubuwwah dalam konteks keindonesiaan? Dan mengapa khilafah ala Ahmadiyah dapat berjalan beriringan dengan sistem politik negara-negara, khususnya dengan sistem negara di Indonesia? Untuk menjawab pertanyaan itu maka dilakukan observasi partisipatif dan wawancara

Abstract

This paper will discuss the meaning of the word semiosis syirik in the hadith. This paper is a qualitative study using the Umberto Eco semiotic approach. Umberto Eco is a philosopher, essayist, semiotic expert, critic of literary works, and novelist. His most famous work is The Name of the Rose, a story that combines intellectual fictional mysteries, biblical analysis, and literary theory. The sources of this paper are books and journals that are relevant to the theme of the writing. The formulation of the problem in this paper is: what is the meaning of shirk semiosis?

Abstract

This article depicts the life and works of Nukman Sulaiman descriptively. He is a Muslim learned man and a teacher who was born on 17 April 1917 in Perbaungan. Perbaungan is a district in Serdang Bedagai in North Sumatera, Indonesia. His parents are H. Abdul Aziz bin H. Sulaiman and Hj. Maimunah binti H. Mohd. Arif.  At his at of 25, Nukman Sulaiman married a woman, Hajjah Siti Radiah binti Ahmad Anjang,  on 14 Syawwal 1361 Higera or 25 Oktober 1942 AD. They live on STM Street or Sukajadi Street, Number 17, Medan.1 Nukman Sulaiman had eleven (11) children. Some of them live in Indonesia, and some other abroad.2 Durin his life, Nukman Sulaiman had a simple ideal; that is, to serve people as much as possible and to die with a good end  (husnul khotimah). In fact, he realized this dream by developing al-Washliyah. Here, Nukman Sulaiman was directly involved in establishing Universitas Al-Washliyah (UNIVA/University of Al-Washliyah), and he had been serving himself as a rector of this university for about seventeen years (1970-1987). By this university, he aimed to generate Muslim learned men (`ulama’) as the heirs of the prophets’ teachings in Islam.

Abstract

This article proves that the modernization of inheritance law is a form of reformation in Islamic law by taking into account the sociological condition of the society to achieve maslahah (maqasid al-shariah). Islamic inheritance law is influenced by the Arabic inheritance law in the pre-Islam era that followed patrilineal system, which influenced the mainstream thoughts of Islamic scholars in understanding inheritance law. This, in turn, resulted in patriarchal Islamic inheritance law. For that reason, it is necessary to re-interpret the law in order to construct a comprehensive fiqh (Islamic law). Hazairin’s thoughts are a revolutionary of inheritance law in Indonesia, such as bilateral inheritance, ahli waris pengganti and kala>lah. Some inheritance law reform contained in KHI are not addressed in conventional fiqh, because there are several aspects to be taken by Indonesian scholars whose ideas are not in conflict with the principles of Sharia (maslahah).

Abstract

The grand conclusion of this dissertation is the more contextual the qiyiis the more beneficial it is for the people. In line with that, there is a shift paradigm from "habs al-esl" (maintaining the immortality of the wakaf object )  to a pradigm of "tasbil  al- thamsreli” (preservance  and development of the benefit of waqf) which opens the path selectively to  the istibdal of waqf objects to be relevant with the share waqf management at present time.The finding is that in practice of istibdal in Tabung Wakaf Indonesia (TWI), the tendency of to use of the Hanafi understanding in the context of the continuing exclusion of qadi (judge/government) for having their associated sigh at of wakif istibdal in relation with process can be done by Nazhir. In addition, in the context of replacing old waqf object (shares) with a new waqf objects that are not similar (parking lot behind the financing and other waqf stock name) is based on the principles of the Hanbali Islamic school. This type of research is qualitative through field study and library research. In conducting this research, the author analyzes the sociolegal approach (socio legal research).

Abstract

This article discusses the poetic style of the Qur’anic translation. It demonstrates that the poetic style of the Qur’anic translation has become an instrument in revealing the beauty of the Qur’an. Showing that poem or poetry is one aspect of literature which posses a lofty esthetical value, it argues that Mahjiddin’s technique of translation is truly concerned with writing style, lexical choice, structure, tone and voice as found in poem or poetry, and that the poetic style or form of translation will not change the accuration of meaning and comprehension of texts in the Qur’an.
