Abstract

The current modernization brings considerable changes to the entire Indonesian life, the especially Muslim community in Jakarta. Today the Muslim community in the capital of Indonesia seem to experience decadency, especially in terms of ethics, manners, association, lifestyle and care for fellow Muslim people who are increasingly indifferent. Another negative impact that is very concerning is the change that tends to lead to a moral crisis in Muslim society today, especially in the younger generation, such as the phenomenon of a free lifestyle, television broadcasts containing films that provoke the Muslim to date, pornography and porn-action. Those give rise to many complex problems that hit the country due to moral degradation.

Abstract

This research aims to demonstrate the great importance of the evidence of sadd al-zarai’ (avoid doing destructions), and its application to some contemporary social models. This research employs the inductive and analytical approach. The research contained an introduction, three sections and a conclusion. The first and second sections talked about the concept of sadd al-zarai’, indicating the definition, the pillars, the conditions and the parts. The third section was applied to some social models and the extent to which the controls were achieved to sadd al-zarai’ in them, and began by mentioning applied models from the Qur’an, the Sunnah, and the contemporary reality which included three models: Hajj and Umrah in light of the spread of the Corona virus (Covid 19 -), Qat in Yemen, and the Prophet’s birthday. This article found that sadd al-zarai’ is a legitimate argument based on the Holy Qur’an, the Prophet’s Sunnah and the work of the Companions. Also, that sadd al-zarai’ is complementary to maslahah mursalah, through which the tolerance of Islamic law, its expansion and validity for every time and place is confirmed by: bringing interests and multiplying them, preventing and minimizing destructions, and showing its great impact in containing jurisprudential developments and emerging issues in various fields, especially social field, through the diversity of sources of ijtihad and deduction.

Abstract

Hadith scholars agree on the fact that a narrator hearing a saying from his shaikh is strong evidence of the sanad connection. They also agree that this condition has the highest degree of endurance in proving the connection between the narrator and those who narrated from him. That’s why critic Imams have caringly and carefully used it in judging whether a narration is continuous or disconnected. And Imam al-Bukhari was among those who stipulated hearing as a condition for authenticity, whether in his collective Sahih or his other books like “the Great History” (Attarikh Alkabir)  or what was reported from him by his student Imam  Al-Tirmidhi in his Al-Ilal Alkabir  book, as the latter often asked his Shaikh about his opinion on narrations and he answered him with acceptance or denial based on lack of evidence of hearing between the narrator and his Shaikh, which emphasises the importance of this matter and its research. This is why this research’s objective is to highlight this issue according to Imam Al-Bukhari through what his student Al-Tirmidhi reported from him in the chapters on purification (Attahara), in his two books Al-Ilal Al-Kabir and Al-Jami. Three methods are used in this paper: The inductive method was adopted when collecting the examples mentioned in the study, and the analytical and critical approaches when studying the sayings. Three important conclusions can be mentioned. First, denying or proving that a narrator heard a saying with his own ears is one of the most prominent clues that indicate the connection of the narration chain or its interruption. Second, that Imam al-Bukhari relied on this presumption in accepting and refuting the narrations in most examples of these chapters. Thirdly, that sometimes Imam al-Bukhari does not rely on the presumption of hearing alone in the authentification of the narration, but rather supports it with other evidence.

Objective scientific critical study, in this research, the researcher pursued an objective analytical and critical approach. It also relies on the study of hadith books, their collections, and abundant encyclopedias. It is based on the aspect of hadith sciences, in a sufficiently library method, so that it is based on the study of references and available sources specialized in the subject in question, and the most important findings of the researcher through research and reading of this. The matter is that judging a hadith is a matter of discretion, so it is the case of a mujtahid in jurisprudential rulings that he is right and wrong.

Abstract

The developments that took place in the sciences in Islam throughout its history were not without a clash or an epistemological, ontological and axiological conflict between the religious sciences and the general sciences. This conflict has led to a kind of duality or antagonism between the religious sciences and the general sciences, or between the sciences of this world and the sciences of the afterlife, so to speak. There is an integrated perspective of science and knowledge that includes all its types and all its sections, which benefit a man to continue his life in the world and the hereafter, in his present and future, in his condition and his destiny, in the matter and beyond matter. This research attempts to answer the most important models of cognitive integration among Muslim thinkers, and how to apply scientific and cognitive integration at Syarif Hidayatullah State Islamic University (UIN) Jakarta as a model. To answer these questions, the analytical deductive method was used. One of the results of this research is that there are different models for the integration of religious and general sciences, whether at the global or local levels in Indonesian universities. Almost all of them agree that there is no separation between religious and general sciences, and that religious values are the spirit of those sciences in general.

Abstract

Contemporary life is witnessing rapid change and tremendous development in all aspects in which number of matters, incidents and cases have appeared requiring scholars to explain on their legal description and the legal rules. This research attempts to clarify the status of the main purposes of Sharia and its pivotal authority in the process of creating Sharia rules on an incident. The research revealed the role of the purposes of Sharia in the particular ijtihad in order to ensure the fulfillment of the intended goals by the God because the process of creating the rules pays attention on achieving the purposes, public goods, and goals sought by the Sharia by legislating those rules. The research employed the inductive and analytical approach, based on approved references and sources. The research concludes that the purposes of Sharia have a major central role in the process of creating a rule on an incident. This central role is represented in five basic matters: in realizing the basis of the rule, in changing the rule in order to change its area, in postponing the application of the rule in urgent circumstances, in excluding an incident from the general rule, and in favoring a jurisprudential opinion that is appropriate to the place of judgment and achieves the intended interests of the Sharia.

Abstract

The jurists believe that the authority or the imamate was placed among the nation in order to fulfill the function of prophethood in guarding religion and the politics of the world. This matter can only be achieved if the authority is given to those who have the capacity to manage the affairs of the nation, both religiously and worldly. Among the important matters in managing the affairs of the nation is a legislative matter in legislating laws on which the nation relied in their lives. With the diversity of the affairs of the nation, including what is purely religious, and what is purely worldly, and what is mixed between religious and worldly matters, what has been legislated by the religious institution and what has been proven by the civil authority may be confronted. On this basis, this research proceeds to study the relationship between the religious institution and the civil authority, and how that relationship should be according to Islamic political jurisprudence. Among the hypotheses of this research, the first: that the civil authority, as an official legislative authority, needs to monitor the religious institution so that the laws it legislated do not contradict the religious values that the nation needs. Second: The religious institution, as a religious authority, needs the help of the civil authority to know the reality of the nation in order to achieve the spirit of bringing benefit and warding off corruption in some changing issues related to guarding religion and its lofty values. Third: The relationship between the religious institution and the civil authority in the perspective of Islamic political jurisprudence should be an integrative, cooperative and monitoring relationship in order to achieve the supreme goal of the existence of the authority, which is to bring the interest and ward off corruption to the Islamic community in the light of building security and social stability in order to preserve the protection of religion and worldly politics.
