Abstract

The concept of crisis management has become one common terminology in various fields, especially in shariah science. This study, the presentation of this confrontation and how it confronts a global disease crisis known as the Corona "Covid-19 crisis". It demonstrates the practical and applied aspect of managing this crisis through the preventive and therapeutic aspects. It aims also to get out of it with the least losses possibility within the controls of Islamic law to fulfil the individual and the collective interests to preserve the necessities that must be preserved. The study reached several conclusions, including our prophets (peace be upon him) skill, and his companions (may Allah be pleased with them). In managing many of the crises they were subjected to. To show also that this knowledge was known to them even though not in its modern terms. As that the Glorious Sharia realizes through its faculties every crisis that arises in the Islamic Nation and finds out the legitimate solutions for it.

Abstract

Throughout this study, the researcher aims to learn some Quranic verses related to Palestine and Jerusalem, historically showing their paramount importance and raising the awareness of Muslims for their roles in protecting the land from usurpers. The researcher attempted to do his best to mention all holy verses talk about Palestine. In this study, the researcher adopted the historical analytical method dependent on holy Qur’an verses, right Hadiths and ulema sayings. About the research itself, the researcher attempted to tackle desk-based research, counting on books, Arabic major sources, dictionaries and Arabic lexical structures and other related sources, Which are indispensable for the researcher to deal well with the different search axes. The conclusions drawn from this research include that Palestine is one of the oldest modern easternmost kingdoms of the cities and an integral part of the Levant. It enriches its importance due to its geographical location as an old-world crossroad between Asia, Europe and Africa. Also, it is a bridge that connects Arab countries. The research showed that man had inhabited Palestine since the Paleolithic period (500 thousand - 14 thousand BC. Allah Almighty proved that Palestine, Jerusalem, and surrounding areas are all blessed. Also, it has the divine good, like the provident of groundwater. Physically, Palestine and all surrounding areas are the garden of the Lord, sacred land and consecrated.

Abstract

Among the reasons for the weakening role of waqf in Indonesian society is the existence of more than a few waqf lands that are not operating due to the financial deficit. The jurists try to offer a solution to this problem by presenting a set of contracts and financial transactions that are carried out by Nazhir and by those who are responsible for waqf management, depending on their financial capabilities available within waqf institution. This solution follows economic principles known as self-investment, without the need for another party involvement. Self-investment methods vary depending on different cases of endowment funds, including istibdal (exchange of waqf property/ selling and buying the waqf property in the same form). The jurists have different opinion regarding the permissibility of istibdal between narrow, expanded and impermissible practices. This research confirms what the Indonesian waqf law and Islamic jurisprudence agree upon the permissibility of istibdal. This is because istibdal is considered the most effective means of perpetuating the benefit of the waqf, in order to achieving the purpose of waqif, and the legitimate interest intended from it, by ordering specific restrictions and conditions that prevent the loss of waqf property as well as the possibility of that property being manipulated.

Abstract

The one who undertakes the interpretation of the Noble Qur’an and tries to understand its words, verses, rulings, and what it contains of commands and intentions, and carries out the task of enlightening people with the Book of God, which is the orbit of the religion of Islam and calling them to it, is the most honorable of people and has a high status among all scholars, just as his work is one of the noblest purposes and the most rewarding deeds. Numerous texts have been received from the Holy Qur’an, the Sunnah of the Prophet, and the works of the righteous predecessors, which indicate the high status of the interpreter among all scholars.

Abstract

The research aims to get acquainted with the book “Minhaj Al-Wushûl Ilâ ‘Ilm Al- Ushûl” by Al-Qadi Al-Baydawi more closely, and its author, and the importance of the book, and the books that were written on it. The inductive, descriptive and analytical approach, as the researcher uses the comparison between the available references related to the subject and the information presented to him. The most important findings of this research is that the book Minhâj Al Wushûl is one of the most important abbreviations and al-mutûn in the ‘Ilm Ushul Al Fiqh (Fundamentals of jurisprudence), and it has many books written on this book, including the many explanations (syurûh) which number up to forty-four explanations.

Abstract

Amid the many choices of conventional insurance products that are echoed by the private sector and the government, such as health insurance, education, employment, and old age insurance. Besides conventional insurance options, there are also Sharia insurance options. One of the interesting sharia insurance products is sharia child future insurance by AXA Mandiri Syariah. The purpose of this study is to see Maslahah Mursalah in the use of this insurance. This paper will present the position of ushul fiqh in Islamic insurance, a study on the Islamic future insurance program for children by AXA Mandiri Syariah. The analysis used to see this is a literature study related to the literature of the ushul fiqh school. The results of this study indicate that the benefits of using Islamic future insurance are more than not using it. Using the sharia insurance system adds value to the program so that both insurance managers and insurance participants benefit from the program.

Abstract

Customary marriages, also known as unregistered marriages, are often misunderstood as unannounced (siri) marriages, even though not all unregistered marriages are siri (secret) in nature. This study aims to explain the nature of unregistered marriage, its difference from the syar'i marriage, official marriage and unannounced marriage. At the same time, this study also adresses that customary marriage, even though it is legal according to Islamic fiqh, is not recommended since it contradicts with the Qur'anic commandment regarding the need of muslim to comply with waliyyul amr or those who hold authority. The customary marriage also may results in mafsadat which can actually be avoided by registering marriages according to government regulations. Meanwhile, under Indonesian legal system, customary marriage has no legal justification, and as a result there is no legal guarantee for married couples. As well, this study confirms that customary marriage ignores the legal existence to women and children who will be born, such practise is not in accordance with the purpose of the marriage itself.

Abstract

This study aims to show the greatness of the Arabic language, by searching for the grammatical vowel, which is part of the study of the origins of grammar. Inflection, and it has a special sign of inflection, which is assertiveness. Also, it is not permissible to enter the preposition that is the special sign of inflection for nouns, and it is necessary to study the grammatical cause of this issue in order to reveal the secrets and phenomena of the Arabic language that were developed by linguists and grammarian. This study relies on the descriptive, analytical and comparative approach, and the researcher collects the sayings of grammarians from the most important grammatical books in the chapter on the reason for the inflection of the presenttense, such as the book by Sibawayh.The grammatical arguments of al-Zujaji, the characteristics of Ibn Jinni, the insight and the remembrance of al-Saimar, the explanation of the detailed explanation of Ibn Ya’ish, the explanation of the facilitation of Ibn Malik, and the memorization of al-Hawami’ by al-Suyuti. Then you analyze it and compare these sayings and make comments and weighting                                                                                                                                                                    The result of this research is that the grammatical reason has indicated the richness of the Arabic language and the eloquence of its people and revealed the Arabic secrets, especially in understanding the inflection of the present tense and its reason in being specialized in assertiveness and not entering the preposition in it

Abstract

يهدف هذا البحث إلى دراسة وتحليل نصوص أحاديث النبي صلى الله عليه وسلم التي تتعلق بأسلوب التقديم والتأخير. فإن الحديث النبوي الشريف يعد مصدرا معتمدا من مصادر اللغة و منبعا أساسيا لها، لأن صاحبه عليه الصلاة والسلام أفصح من نطق بها، لذلك وجه بعض الباحثين في العصر الحديث جهودهم نحو لغة الحديث، وقامت دراسات وبحوث في هذا الموضوع. رغم ذلك لا تزال لغة الحديث الثرية وأساليبه المتنوعة بحاجة ماسة إلى الدراسة. وقد اختار الباحث في هذا البحث بعض الأحاديث النبوية كنموذج في كشف هذه الظواهر اللغوية والإشارة إلى بلاغة النبي صلى الله عليه وسلم في استعماله هذا الأسلوب لتحقيق أهدافه ومواقفه وتوظيفه في دعوته لنشر الرسالة. وقد اتبع الباحث المنهج الوصفي التحليلي الذي فرضته طبيعة الموضوع. فالمنهج الوصفي يسعى لوصف الظواهر اللغوية كما هي موجودة في الحديث النبوي ويمكن من خلاله وصف الظاهرة اللغوية وتحليلها والكشف عن أسرارها البلاغية، مع التركيز على رصد النصوص المتضمنة لأسلوب التقديم والتأخير الذى وظفه الرسول صلى الله عليه وسلم في أحاديثه والتى تعد الشواهد التطبيقية لما ورد في الجانب النظري. استطاع النبي صلى الله عليه وسلم من خلال استخدامه هذا الأسلوب التأثير في المتلقين ولفت انتباههم وإقناعم والارتقاء بهم وتحويل موقفهم من موقف سلبي إلى آخر إيجابي، أو بغرض إخبارهم بأمر مهم وغيرها من المقاصد والأغراض المتوفرة لديه صلى الله عليه وسلم.
