Abstract

Customary marriages, also known as unregistered marriages, are often misunderstood as unannounced (siri) marriages, even though not all unregistered marriages are siri (secret) in nature. This study aims to explain the nature of unregistered marriage, its difference from the syar'i marriage, official marriage and unannounced marriage. At the same time, this study also adresses that customary marriage, even though it is legal according to Islamic fiqh, is not recommended since it contradicts with the Qur'anic commandment regarding the need of muslim to comply with waliyyul amr or those who hold authority. The customary marriage also may results in mafsadat which can actually be avoided by registering marriages according to government regulations. Meanwhile, under Indonesian legal system, customary marriage has no legal justification, and as a result there is no legal guarantee for married couples. As well, this study confirms that customary marriage ignores the legal existence to women and children who will be born, such practise is not in accordance with the purpose of the marriage itself.

Abstract

The Arabic language is considered a global international language, so references and sources were used in arabic and this language is not taught just for religious language but this language is taught to find out the arabic texts or references and sources written in arabic and to understand them well as well as to understand the Qur’anic texts and the purified prophetic texts or in other words as it has circulated on the tongues of the majority of the people of Indonesia that the Arabic language is the religious language because most of the Indonesian society were muslims as they used in some of their traditions and the application of some of the teachings of their religion in the Arabic language such as invitations, prayers, dhikr, supplications, wirds and the like, because the Arabic language has unique natures, distinct and universal, as this language is characterized by special and unique natures that differ from other languages, and the universality of this language is evident in the availability of a set of common values between the Arabic language and other languages.

Abstract

The study aimed to explore anxiety as a psychological phenomenon, including its types, causes, and treatment methods in light of the Holy Quran and modern psychology. The research employed a descriptive-analytical approach by collecting relevant Quranic verses and comparing these concepts with those found in psychology books, as well as examining the insights of Muslim scholars and modern psychology regarding anxiety, its types, causes, and treatment. The study found that anxiety is a modern psychological concept that affects individuals due to fear, stress, or excessive thinking about certain life issues, often of unknown origin, and is a source of psychological pressure. It also revealed that the verses in the Quran addressing doubt and suspicion refer to anxiety in its modern sense. Additionally, the study showed that Quranic stories illustrate the levels and types of anxiety experienced by the prophets in different situations, including psychological anxiety, social anxiety, and objective anxiety related to their prophetic missions. Furthermore, the Quranic verses focused on the anxiety of specific groups, such as hypocrites and disbelievers, particularly concerning their doubt and suspicion in receiving the divine message and opposing the prophets. The study recommends incorporating psychological studies rooted in Islamic heritage into university curricula and encourages researchers to conduct in-depth studies on such topics. It also advocates for integrating psychological studies from the Quran and Sunnah with modern psychology.

Abstract

This research aims to know the Ash'ari scholars in Indonesia in the fifteenth and sixteenth centuries, in view of what was circulated among the people in Indonesia that the Nine Saints who contributed to the Islamization of the land of Java were the Ash'aris. In other words, the research wants to answer the question: Are the Nine Saints Ash’arite? Who are they and their classes? Therefore, the research attempts to achieve this and verify it according to an academic scientific method. The research is carried out with an integrated qualitative method, using a historical and analytical approach (heuristic), which collects all relevant data through induction, library research, documentation. It relies mainly on basic references such as the book Suluk Wujil and the book of Primbon Bonang by Sunan Bonang, and it also relies on second sources such as the book Atlas of the Nine Saints by the Indonesian historian Agus Sunyoto. This research is distinguished from other similar previous studies in its focus on revealing and investigating the ideology of the Nine Saints. The results reached by the research are that nine saints are of Ash'arism.

Abstract

Islamic law permits Muslims to engage in activities that bring them enjoyment, such as playing online games. However, this is subject to the rules and regulations established by Sharia, which aim to ensure that all aspects of a Muslim's life adhere to Islamic principles and do not violate them. This research aims to analyze the ruling on playing electronic games according to Islamic fatwas, taking into account the impact of technological developments on Islamic societies. The study addresses scholars' opinions on the legal aspects of online games, including conditions for permissibility and prohibitions, as well as potential risks and benefits. An analytical approach was used, wherein research describes the ruling on gaming in Islam and analyzes data from jurisprudential sources, the Quran, and Hadith literature. The findings indicate that the basic ruling on playing online games is permissibility, provided it is not associated with any legal violations and does not lead to any harmful consequences. This permissibility may extend to other legal rulings based on the relevant context; however, it pertains to two matters: the contents of the game and its outcomes, such as player behavior and the resulting effects.

Abstract

The research aims to know the role of women in teaching legal rulings before society in Surat An-Nahl: 125, a comparative study between the interpretations of Al-Bahr Al-Moheet and Nizam Al-Durar in the proportion of verses and surahs. As for the research method, it is the comparative method, which is that the interpreter relies on a group of Qur’anic verses in one place, so he explores the views of the interpreters following what was written in the interpretation of that sentence of verses by describing the methods of interpretation of Sheikh Abi Hayyan Al-Andalusi and Sheikh Burhan Al-Din Al-Baq’i through their interpretations, and then I analyze their ideas about the role of women in teaching Islamic rulings before society in Islam in Surat An-Nahl, verse 125, and then compare their opinion with the discussion. As for the method of this research, it is a library method by collecting information from sources and references related to the topic from books of interpretation. and the sciences of the Qur’an. One of the results of this research is that the Sufi color that approached the interpretation of Abu Hayyan Al-Andalusi and learned the occasion when interpreting the Bekaa’i, this interpretation was able to draw the role of women in teaching the legal rulings before the community. Abu Hayyan al-Andalusi and al-Biqaa’i said that God commands the caller to call to the religion of Islam with wisdom, i.e. the Qur’an, and by the preaching of the Qur’an, he means by good exhortation and by means of arguing with kindness and gentleness. This is the way to achieve success in the field of calling to the path of God.

Abstract

Hajj is a pillar of Islam, obligatory for every Muslim who is financially and physically capable. This research focuses on the health condition as a key requirement for performing Hajj in Indonesia, particularly for pilgrims in long queues. Ensuring health and safety before, during, and after Hajj has become a critical aspect, mandated by Islamic law and Indonesian regulations. The condition of health and the ability to provide food and equipment, constitutes a fundamental part of the "ability" (istita'ah) required for Hajj and Umrah. This research presents some important questions about the concept of ability in Islamic jurisprudence and Indonesian law, to what extent which the meaning of ability can be applied to reality due to the large number of pilgrims queuing up for many years. This research used library studies by quoting opinions and ideas from major jurisprudential books and contemporary research as well as Indonesian law concerned with this issue. This research concludes that it is possible to reconcile Islamic jurisprudence in obligating the condition of ability for anyone who wants to perform the Hajj obligation, especially for the queues pilgrims that could not fulfill this kind of requirement, where someone can act on his behalf, as happened during the era of the prophet Muhammad PBUH.

Abstract

This research is aimed at looking at scientific interpretation method in Indonesia and its application. The literature that is the object of this research is a book entitled Time in the Perspective of the Qur'an and Science which was written by a group of ulama and scientists from Lajnah Pentashihan Mushaf al-Qur'an and the Indonesian Institute of Sciences (LIPI). This research belongs to the type of library research, where the data source is obtained from books and papers. In analyzing research objects, the author uses the formulation of the scientific interpretation method written by Abdul Jabbar Saqa and the author of the book Time in the Perspective of the Qur'an and Science. From the results of this research, it was found that the book Time in the Perspective of the Qur'an and Science was written by popular scholars in Indonesia: tafsir scholars and scientists. From all the descriptions it is understood that this book pays attention to aspects of linguistic rules, al-Qur'an sciences, and the interpretations of previous scholars. This book of tafsir also separates interpretation and scientific findings, both of which are different. Scientific findings are not interpretations of the Qur'an, but are part of the expansion of the Qur'an's instructions where changes to the findings will not affect the sanctity of the Qur'an.

Abstract

Maqashid sharia has transformed into an independent scientific discipline through some developments from late scholars. They took part in constructing the concept of maqashid sharia, outlining the epistemological foundation and the mechanism of its implementation. This research aims to examine the basis of the thoughts and ideas of Ahmad Ar-Raisuni, one of the central figures of contemporary maqashid sharia. Ar-Raisuni has made a great contribution to the maqashid of sharia both academically, theoretically, and practically. Ar-Raisuni not only called for the actualization of maqashid sharia in the construction and formulation of fiqh, but also prioritized the basic thoughts and ideas of the concept of maqashid sharia, actualized the maqashid approach in ijtihad, and formulated the scientific methodology of fiqh with the maqashid approach. This article employs a qualitative approach by exploring the main ideas of Ar-Raisuni in his works. This research concludes some of Ar-Raisuni's principal thoughts: the style of maqashid sharia thought, ijtihad based on the maqashid approach, analysis of objectives and orientation to the benefit of law, and the development of a law enforcement methodology that collaborates: text, purpose and reality, as well as formulating the principles of maqashid sharia.

Abstract

Bank is an institution that operates without interest, whose activities are to realize material benefits through the collection and distribution of funds in accordance with sharia, where aspects of the implementation of prudential principles and good governance are supervised by the OJK. While the system and mechanism for the fulfillment of sharia compliance, the institution that has an important role is the National Sharia Council (DSN) of the MUI to issue a fatwa on the conformity of sharia for a bank product. Then the POJK emphasized that all Islamic banking products should only be offered to the public after the bank received a fatwa from the DSN MUI and obtained permission from the OJK. In the operational order, each Islamic bank is also required to have a Sharia Supervisory Board (DPS) which functions for sharia supervision and as an advisor in answering questions regarding whether its activities are sharia-compliant or not.Islamic banking in Indonesia continues to develop gradually and progress. In recent years, Islamic Banking has been on the rise, triggered by the great desire of the public to obtain halalness in conflict with banks. This shows that the prospect of Bank Syariah Indonesia will improve, especially with the merger of three Islamic Banks in Indonesia, namely PT. Bank Mandiri Syariah, PT. BNI Syariah and PT. BRIS, Tbk. To become Bank Syariah Indonesia Tbk, which is expected by the government so that Indonesia can become a barometer of the Islamic economy in the world and will be ranked seventh in Indonesia based on assets.
