Abstract

Abstract

This writing shows that work of film which signs and defines realities through separation and election of meaning network fitting to certain view has limited audiences’ paradigm in defining their social realities; as if what given by film is a usual happening and should be a direction for the audiences to behave and act. The direction then is tightly attached with identification for differing between good and bad, wrong and right, friend and foe, us and them, even the most liked by the audiences is: sexual differentiation between man and woman. In this respect, to be a man or woman is presented as a different experience and cannot be the same in terms of behavior, action and role in whole life aspects. By this meaning construction, cultural hegemony starts.DOI: 10.15408/ref.v13i4.912

Abstract

This paper deals with the reaction of al-Shinqīṭī towards this latter way of mystical vision, particularly in the case of Aḥmad al-Tijānī. For al-Shinqīṭī, sufis’ claim of having a fully consciousness physical contact with the Prophet after his death is impossible because nothing, whether religious or rational proofs, can sustain it. The extreme case of such claim is expressed by Aḥmad al-Tijānī who, insists that a sufi (ṣūfī) can really see the Prophet with his physical eyes. In al-Tijānī’s opinion, the ability of the physical eyes to see the Prophet when awake was a common trait of those who attained the status of pole (quṭb).DOI: 10.15408/ref.v13i3.902

Abstract

Abstract

This paper discusses inheritance discourse based on verses of the Qur’an according to modern interpreters, Muḥammad Shaḥrūr with Munawir Sjadzali. Both interpreters are appointed because they can be considered to have tried in their respective contexts to answer the emergence of ambiguous attitudes in implementing inheritance law from Muslim societies. Muḥammad Shaḥrūr understands and applies it in a way that is different from the opinions and concepts, as seen in the 'four classical patterns of calculation' (al-amalīyāt al-arba 'fī al-ḥisāb) as well as in social aspects, such as the concept of patrilinialism in society and the spirit of kinship and family spirit and ethnicity which became the benchmark for the distribution of inheritance in the past century or in political aspects, such as overlapping concepts of inheritance law which confuse ownership, law and prophetic authority. From this there is a clear relevance between the boundary theory proposed by Shaḥrūr and the efforts to reform Islamic law which are expected to grow with justice and be able to answer the needs of the community. Whereas Sjadzali developed the concept of inheritance contained in the Qur'an, to look for the relevance of Islamic teachings to the times, especially in the context of Modern Indonesia. Since al-Qur'an is multidimensional, as hudan li al-nās, the concept of Sjadzali's inheritance law has its own value, namely by teaching the principle of equality as the division of men is twice as large as women is no longer relevant. He also did not explain the division of inheritors who have an upward line adequately. This is because Sjadzali only sees from the side of the historicity of the region as the birth of his 1: 1 inheritance concept, without regard to other aspects such as heirs and heirs.

Abstract

Abstract

Abstract

This article shows that in the Shī‘ite (Shī‘a) madhhab (school) is different opinion concerning Ḥadīth/Sunna as ḥujja (allegation of law). One faction states that all aspects of the Prophet’s life are ḥujja, whilst another party claims that only some aspects of his life i.e. the aspect which connotes tashrī‘(law guidance) can be a ḥujja. In between these two sides, the most appropriate view point is the latter one, for it is more objective and proportional in looking at him as an ordinary human being, in one dimension, and as an apostle, in another one. The controversy then has enlarged into the ḥujja of ḥadīth/khabar al-āḥād. For some people, khabar al-āḥād is absolutely refused; another some admits it absolutely; while some receives it under certain prerequisites; and even a number of scholars accept it with the very tight and stiff requisites. In this context, again, the least group’s idea is more objective, logic and contextual. This conclusion is resulted from uṣūl al-fiqh approach and philosophical analysis.DOI: 10.15408/ref.v13i3.907
