ULUL ALBAB Jurnal Studi Islam (ISSN 1858-4349 and E-ISSN 2442-5249) is the journal published biannually by Universitas Islam Negeri Maulana Malik Ibrahim Malang. The journal puts emphasis on aspects related to Islamic studies, with special reference to Islamic law, Islamic education, Islamic politics, society, Islamic philosophy, Quran and hadith, and theology. Abstract

The government poverty alleviation program could not give a significant change to reduce poverty. It needed a support from other sub-system, such as zakah. Zakah, as one of the Islamic fiscal instruments has played a significant role in Islamic economic. The potential of zakah would cover several aspects like poverty alleviation program through social welfare system. Zakah could obtain a social welfare system such as workplace accident insurance, old age pension, pension insurance, and death insurace. In addition, other problems such as housing for the poor, capital investment and education could be cared through zakah if zakah was managed and developed in a maximal way.

Abstract

Pergulatan pemikiran kontemporer mengenai hadits, baik yang dilakukan oleh para pemikir muslim (insider) maupun para orientalis (outsider) agaknya juga mengalami dinamika perkembangan yang cukup signifikan. Hal ini tampak dari banyaknya para pengkaji hadits khususnya dari kalangan muslim yang mencoba memekarkan dan mengkritisi pemikiran tentang hadits, seperti Fazlur Rahman (Fazlur Rahman, 1984: 57), Muhamad al-Ghazali, Yusuf al-Qardhawi dan Mushthafa al-A'zami. Sedangkan dari kalangan non-muslim (orientalis), kajian hadits antara lain dilakukan oleh Sprenger, Ignaz Goldjiher, Montgomery Watt, Joseph Schacht dan yang lain (Wahyudin Darmalaksana, 2004: 96). Diakui atau tidak, hadits selalu menjadi kajian yang  menarik bagi para pemikir dan cendekia, baik yang mengkajinya sebagai pembela (kalangan Muslim) maupun sebagai penentangnya (yang kebanyakan adalah para orientalis) (Ensiklopedi Tematis, V.I: 81.)

Abstract

It was well known that Papua as large population of non muslim society. In fact, muslim already establish their community on 1512. Therefore, it is a need to explore how the existence of muslim in West Papua province nowdays. This research was applied qualitative approach which is grounded theory. In finding data, observation and in-depth interview were conducted. In addition, the main instrument was researcher itself, and then other instruments are observation sheet and interview guidance. This research shows three things, they are leadership and tradition, religiousity and diversity, and learning spirit. Those kinds of main findings means that muslim in the region not only preserve their tradition but also try to maintain the harmony to other religions. This attitude did not arise spontaneously, there was a long history of co-exist with the others as a family.

Abstract

In the history of religion and religious communities has resulted in monumental achievements and noble, which can still be seen today. Any civilization on earth would not be separated from the role of religion and religious people. Meanwhile, today's religious sentiments are often more easily ignited. Many bloody incidents and riots as motivated by understanding and actualization of religion by the religious community. Similarly, many political issues, economy, culture etc. are initially not religious issues suddenly by certain parties associated with religion, so the problem is getting bigger. In such a situation a comprehensive religious view is needed. Formalist-exoteric approach that has dominated the study of religion was not complete even further widened the gap between religious communities because more emphasis on the physical dimensions of these religious symbols. Approaches are possible and must be socialized and adopted is esoteric approach or see substansi of religion, because by looking subsatansi of religion will be able to eliminate the partition of the partition that limits their religious least in terms of his humanity or social relationships between people. One dimension that can be approached is esoteric mysticism, because every religion must have the dimensions of mysticism. And it turns out the substantive similarities of this dimension in any religion.

Abstract

Kaum sufi menapaki jalan yang berbeda untuk menuju hakikat, mereka tidak menggunakan akal dan rasio untuk sampai pada hakikat. Akan tetapi, akal bukan satu-satunya jalan untuk menuju hakikat. Karena kita sering melihat sesuatu yang di luar jangkauan akal dalam hidup ini. Jalan yang ditempuh kaum sufi untuk menuju hakikat seperti kasyf, dzauq, 'iyan, musyahadah dan sebagainya dinilai sebagai sesuatu yang samar, tidak mempunyai batasan dan kaidah pasti, bahkan sering kali bercampur dengan igauan, mimpi, khayalan dan angan-angan. Tapi yang perlu kita ingat adalah bahwa media-media tersebut telah mampu menuntun manusia untuk memecahkan sesuatu yang tidak bisa dipecahkan oleh akal dan hukum-hukum fisika. Tulisan ini akan mengkaji gagasan-gagasan dua tokoh tasawuf besar yaitu Ibnu Arabi dan Ibnu al-Farid yang hidup  pada abad keenam dan ketujuh Hijriah. Tulisan ini secara spesifik akan mengkaji tiga gagasan penting ke dua tokoh tersebut. Yaitu al hubb al Ilahi, wahdat al Wujud dan wahdat al adyan.

Abstract

The spirit and core of each something that is prescribed by Islam, is basically between humans and bring benefit to prevent danger to him. Thus, it is important to note that in addition to undergoing the whole law of God entrusted to his servant, there are also others, is to know the ins and outs of determining the intent and purpose of the pensyariatan a particular law. In this study, before determining how to define maqashid Islamic better writer would also browse and find out how to convey maqashid sharia (thuruq al ma'rifah li maqashid al Sharia), which by the way; research on the particulars of the Quran al Sunnah and al Ijma, in addition, specific temporal aspects, the approach can be based on the proposition logic (aqli) and optimization of the use of reason and the correct ratio through a series of experiments, the empirical habit, a collection of hypotheses. Abu Ishaq Ibrahim al Syathibi is among so many scholars' are very well known in this field of study. According to him, how to set maqashid al sharia: 1) Mujarrad al amr wa al nahy al ibtida'i at tasrihi, 2) Illat consider the context of each command and prohibition, 3) Nothing all maqashid derivatives (at tabi'ah), 4) The absence of information Sharai (sukut al syar'i).

Abstract

Pesantren is a native Indonesian educational institutions that have a strong tradition of roots within the community. In the era of modernization or the advancement of science and technology today, pesantren education system to be maintained. The purpose of this study to determine the model of modernization of education pesantren, pesantren education plus minus modernization, modern pesantren patterns. In this study, a type of qualitative research which uses a case study model. Data collection techniques used participant observation, in-depth interviews, documentary studies, the data analysis process begins by reviewing all available data from various sources, namely interviews, observation, which has been written in the field notes, personal papers, official documents, images, etc. From the analysis, the authors conclude that the modernization undertaken Pesantren Daarul Fikri is very different from the other Islamic pesantren in Indonesia. Pesantren Daarul Fikri has imposed a very strict curriculum. Students must follow all the rules in regular education and obedient. The curriculum combines Daarul Fikri trying to learn classical tradition with modern style is embodied in both the teaching and learning system.

Abstract

Ibnu Ashur is a contemporary figure of maqasid syariah which born in Tunisia. He was complement and continues of maqasid concept which previously created by  imam al Shatibi, al Ghazali, Izzudin bin Abd. Salam, Ibnu Taymiyah, Ibnu Qayyim al Jauziyah, and another. By Ibnu Ashur, maqasid syariah easily practice in contemporary problems so that Islamic law still suitable with period or be up to date or in Arabic we can call salihun li kulli zaman wa al makan. There are few reform used by Ibnu Ashur in maqasid syariah for instance all discipline law are good characteristic is muamalah (transaction) or ibadah (religious service), all has illat (reason). For implementation maqasid theory by three steps: maqam khitab al syar’iy (situation dan condition of khitab syar’iy), al tamyiz baina al wasilah wa al maqshud (differentiate between infrastructure and purpose), istiqra’ (induction). Maqasid syariah theory by Ibnu Ashur however, globallly based on maqashid al ammah and maqashid al khasah. However, foundation thought for decide maqasid using by fitrah, maslahah, and ta’lil. For knowing something that has benefit or not, he was classified it by three categories benefit for community, benefit for group or person, and realize necessary.

Abstract

Muhammad was born in Mecca between AD 570 and 580 in the Banu Hashims,a reputable family of Quraysh. In Mecca, Muhammad is portrayed as a privatecitizen, as he had to limit himself and adapt his behavior to face the situationduring jahiliyyah era. While, in Medina he governed the community and guidedthem in religious life. His arrival in Medina has significant contribution towardhis role as political leader. His power in this city had protected himself and hisfollowers from violent opposition of the Quraysh. The doctrines he employedin politics were inseparable from the religious values rooted from the Quran.Through his innovation and skillful diplomacy, he had converted the peopleof Mecca and Medina into brighter Arab civilization. Such a positive changereflected his monumental accomplishment for the people.Muhammad lahir di kota Makkah antara tahun 570 sampai 580 Masehi dikeluarga Bani Hasyim, suku Quraisy terkemuka di Arab. Di kota Makkah,Muhammad dianggap sebagai masyarakat biasa, sebab ia harus membatasidirinya dan menyesuaikan prilakunya dalam menghadapi keadaan yangterjadi pada zaman jahiliyyah. Sedangkan di Madinah, ia dianggap sebagaipemimpin masyarakat dan menjadi pembimbing umat dalam hidup beragama.Kedatangannya di Madinah juga memberikan konstribusi besar pada perannyasebagai pemimpin politik. Kekuasaan di kota ini sangat membantu dirinya danpara pengikutnya dari kerasnya kelompok oposisi Quraisy. Doktin-doktrin yangdigunakan Muhammad dalam dunia politik juga tidak lepas dari nilai-nilaiagama yang bersumber dari al Quran. Dengan kreatifitas dan inovasinya dalammemimpin, Muhammad mampu mengarahkan masyarakat Makkah dan Madinah menuju kebangkitan peradaban bangsa Arab yang lebih cemerlang.Kondisi yang semakin membaik tersebut, tidak lain merupakan sebuah karyadan jasa monumental yang telah diukir oleh Muhammad untuk umatnya.

Abstract

Canonization of sunnah into hadith massively appears to deal with extremismand arbitrary interpretations that have been critical to the sunnah of the Prophet.It marks the end of the interpretation process of the sunnah, including ‘theliving sunnah’ because it was freely appreciated and interpreted by others andsubsequently was turned into a verbal form. At this stage comes the new movementpioneered by Imam Shafi’i who spread the dogma that the required one is thesunnah of the Prophet. The sunnah that has validity as a source of Islamiclaw is the provable one through verbal transmission mechanism (hadith). Thehistorical point of view shows difference, intersection and similarity between thehadith and sunnah. Tracing both the meaning of hadith and sunnah in depthwill change the mindset of understanding the hadith and sunnah.Kanonisasi sunnah ke dalam bentuk hadits muncul dalam skala besar untukmenghadapi ekstrimisme dan penafsiran sewenang-wenang yang sudah gawatterhadap sunnah Nabi. Ini menandai berakhirnya proses penafsiran terhadapsunnah Nabi, termasuk ‘sunnah yang hidup’ karena sunnah Nabi yang semulabebas dipahami dan ditafsirkan oleh generasi sahabat dan setelahnya sudahberubah bentuk menjadi verbal. Pada tahap ini muncullah gerakan baruyang dipelopori oleh Imam Syafi’i yang menyebarkan dogma bahwa sunnahyang harus dipegang adalah sunnah yang berasal dari Nabi. Sunnah yangmemiliki keabsahan sebagai sumber hukum islam adalah sunnah yang dapatdibuktikan berasal dari Nabi melalui mekanisme transmisi verbal (hadits).Dengan pendekatan sejarah, diketahui adanya perbedaan dan persinggunganserta kesamaan antara hadits dan sunnah. Dengan menelusuri kedua maknahadits dan sunnah secara mendalam akan merubah pola pikir pemahamanterhadap hadits dan sunnah.
