Abstract

AbstractThe urgency of this study is to analyze the problem concerning the provision of preventive and repressive protection rights for farmers regarding to the International Food Trade based on Agricultural Law, by using normative legal research,  in order to owns a feasible position and competitiveness to the Indonesian Farmers as the subject of International Food Trade. The results of the study shows that the existing regulation has not being able to provide preventive and repressive protection rights for farmers in International Trade. Indonesian Government takes alternative solution by doing the harmonization of Indonesian Law which regulate the international trade, particularly the agricultural trade.

Abstract

The problems of disputes over land ownership of forest between the government (in this case is the state) and the community, has been occured tens of years ago, but the increase was higher along with just an era of reform. A possession of forest resources has been dominated by large employers with the strength of their capital, while the local community (in this case of indigenous people) who rely on forest resources for generations before this country stood, their fate was even more marginalized. In fact, the existence of indigenous people with local wisdom value, plays an important role in forest management, as recognized in Act No.41 of 1999 about Forestry. Inequality of distribution of forest resources this mastery was seen as a base for real social conflict happens in the life of the community law. Furthermore it was published constitutional court’s verdict of RI No.35/PUU-X/2012 to provid e access to justice for indigenous people over the mastery of the forest. This recognition is strengthened by the existence of a REDD + Program aims to reduce emissions from deforestation and forest degradation that requires the existence of a customary law society active participation through the empowerment of local wisdom values.

Abstract

AbstractFrom the juridical perspective, execution of death penalty in Indonesia is carried out by firing to death based on Law No. 2 Pnps 1964. Such a method was stressed again by Constitution Court in its sententce No. 21/PUU-VI/2008 which refused to change method of execution with the other one that would not be a torture for the condemned as requested by those condemned of death penalty in Bali bomb case, Amrosi and his friends. The Contitution Court considered that execution of death penalty based on this law has the risk of unaccuracy which can cause pain, but it is not a torture meant by Article 28I of the 1945 Constitu- tion. AbstrakEksekusi pidana mati di Indonesia ditinjau dari perspektif yuridis dilaksanakan dengan ditembak sampai mati berdasarkan UU No. 2 Pnps Tahun 1964. Hal ini ditegaskan kembali oleh Mahkamah Konstitusi (MK) dalam putusan No. 21/PUU-VI/2008 yang menolak mengganti cara eksekusi pidana mati dengan cara lain yang bersifat tidak menyiksa terpidana sebagaimana dimohon oleh para terpidana mati kasus bom Bali, Amrozi dan teman-temannya. MK berpendapat bahwa eksekusi pidana mati berdasarkan Undang Undang ini mengandung risiko terjadinya ketidaktepatan dalam pelaksanaan yang menimbulkan rasa sakit, namun hal itu bukan merupakan penyiksaan sebagaimana dimaksud Pasal 28I UUD 1945.

Abstract

The fulfillment of adequate housing is the part of the fulfillment of human rights as stated in the constitution. The state can not  ignore and have to do it when he has the ability to comply the adequate housing for poor people.  Adequate housing is more than material it is correlated with the human existence, hence it is categorized as human rights. As part of human rights, the fulfillment of this adequate housing is need to be respect, comply, and protect either by the state and society. The state need to take part to the fulfillment of adequate housing for those who can not afford it. As the state have the capability to realize the adequate housing for the poor, they can not ignore the human rights unfulfillment.  This research focused on law guarantee recognition and the pattern of the adequate housing fulfillment in Indonesia. It is revealed that the pattern is correlated with the state political law which is the policy in the form of laws and local regulation that decided the direction, purpose, and the law substance in housing. Beside its society, the policy also need the private sector involvement, as a result the fulfillment of the adequate housing rights has to be done by the three party.

Abstract

AbstractThis research is a legal empirical research by using the statute approach. The study is a descriptive analysis. Primary and secondary data used in this study analyzed qualitatively. The results of the research shows that the Government of Bireuen in the period of 2007 up to 2012 has issued the number of local regulations in particular such as Qanun as much as 73 Qanun. From 73 of those Qanun are still found the number of Qanun which did not in accordance with the applicable legislations, both from the aspect of the substance and procedural aspects/procedures for its formation. AbstrakPenelitian ini merupakan penelitian hukum empiris (empirical research) dengan menggunakan pendekatan perundang-undangan (statute approach). Penelitian bersifat deskriptif analitis. Data primer dan data sekunder yang digunakan dalam penelitian ini dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa Pemerintah Kabupaten Bireuen periode tahun 2007 – 2012 telah mengeluarkan sejumlah produk hukum daerah khususnya berupa qanun (Peraturan Daerah) sebanyak 73 qanun (Peraturan Daerah). Dari 73 qanun (Peraturan Daerah) tersebut masih ditemukan sejumlah qanun (Peraturan Daerah) yang tidak atau belum sesuai dengan Peraturan Perundang-undangan yang berlaku, baik dari aspek substansi maupun dari aspek prosedur/tata cara pembentukannya.

Abstract

The Security Law, which regulates the land mortgage has significance meaning to move real sector, thus it can support the development of national economy. In this case, the traders, on the one hand, need capital for business activities, while on the other side of the capital owners seek to profit from their investment. Bank as an intermediary is required to be careful. An implementation of the precautionary principle is to have collateral for loans to businesses. One of the collateral is immovable asset (land), which is secured by the Mortgage. In practice, stipulation of mortgage is still more in favor of the bank. If this is allowed, it can be conditions that would adversely affect the parties. Thus, we need to make updates Security Law that balances position of banks and businesses, which in accordance with the attitude of mutual cooperation with based on the fundamental values which are reflected in the philosophical basis of the Indonesian nation.

Abstract

The rise ofhuman trafficking casesinIndonesia, raisesits own concerns. Various cases ofhuman trafficking is happening right now based on reports in the mass media and electronic media as well as some research show human trafficking especially in women and children need serious attention. Trafficking of women and children that occurred in Indonesia usually for prostitution, pornography, begging and domestic servants. This studyaims to determine the factors that cause the occurrence of women and children trafficking and find difficulties in handling cases of trafficking in women and children. This research was conducted with the juridical sociological analytical descriptive. Primary data and secondary data collected through free guided interview techniques, library research and documentation. Determination ofthe respondents conducted bypuporsive sampling. Data that has been collected analyzed qualitatively.The study concluded that: (a) the factors that influencehuman trafficking especiallyof women and children in general because of poverty, lack of education, lack of information andare in thesocio-cultural conditions that are less favorable for their development. (b) Constraints in the handling ofcases ofhuman trafficking apart due to lack ofknowledge ofthe law enforcement in implementing UU No.21 Year2007 on Pemberantasan Tindak Pidana Perdagangan Orang is also due tothe lack ofcross-sectoral coordinationin the handling ofthe case.

Abstract

Abstractcurrently reappears demands change as a result of the 1945 constitution as a evaluation 10 years after the 1945 constitution implementation after change. In this period there have been several issues submitted to the constitutional court about the testing of individual candidates in the presidential election, additional authority in perppu, constitutional complaint and the constitutional question by the court, the role of legislation optimalization dpd. This paper initiated a change the 1945 constitution more participatory through the constitutional commission more independent than the previous constitutional commission, with a mandate to prepare draft changes the 1945 constitution. Learning from the experience of various countries are also undergoing transition to democracy and constitutional reform, we should initiate to engage the court in a change in  1945 constitution.Keywords: constitutional court, participatory, constitutional commission.AbstrakSaat ini muncul kembali tuntutan perubahan (ulang) terhadap UUD 1945 sebagai hasil evaluasi 10 tahun lebih implementasi UUD 1945 pasca perubahan. Dalam kurun waktu tersebut sudah ada beberapa persoalan yang diajukan ke Mahkamah Konstitusi pengujian tentang calon perseorangan dalam pemilihan presiden, tambahan kewenangan Perppu, constitutional complaint dan constitutional question oleh MK, optimlisasi peran legislasi DPD, dan lain-lain. Tulisan ini menggagas perubahan (ulang) UUD 1945 yang lebih partisipatoris melalui Komisi Konstitusi yang lebih independen dibandingkan Komisi Konstitusi yang sebelumnya, dengan mandat menyiapkan draft perubahan (ulang) UUD 1945. Belajar dari pengalaman berbagai Negara yang juga mengalami transisi demokrasi dan reformasi konstitusi, ada baiknya kita menggagas untuk melibatkan MK dalam perubahan (ulang) UUD 1945.Kata Kunci: Mahkamah Konstitusi, Partisipatif, Komisi Konstitusi

Abstract

AbstractThe nationalization of Netherland plantation which became the national possession in 1958, regulated in the Act No. 86 of 1958 was the starting point of the loss of natural resource rights of the Malay indigenous people of Deli and also was the starting point of the conflict between the Malay indigenous people and the plantation party. When the plantation party which belong to the country (now PT Perkebunan Nusantara 2 (Persero)/National Plantation Company 2) was no longer continuing the right as received by the indigenous people from the time of Netherland plantation, third parties’ claims without any basis of rights (recht title) were occurred on the land. Nationalization has shown its mistake to nationalize the rights on the land of the society (not the possession of the foreign), whereas the meaning of nationalization is to nationalize what was not belong to the country. Was not the land belong to the Malay Indigenous people of Deli which is the society of Indonesia? Was not the Indigenous people stand as the possessor of this country? But the Act of Nationalization which clearly stated that what is nationalized was the Netherland’s companies which were listed in the Company Asset Listing such as Deli Maatschapij, Arrensburg Maatschapij and Deli Rubber Maatschapij. These objects of land were not listed as company asset that belong to foreign company (Netherland’s Company). What should have happened was the national company as the receiver post-nationalization was just continuing the vested rights, so that when the vested rights ended, the object of the vested rights (the land) must be given back to the original possessor (Deli Sultanate and Malay Indigenous people of Deli). AbstrakNasionalisasi perkebunan Belanda menjadi perkebunan milik negara pada tahun 1958, melalui Undang- undang No. 86 Tahun 1958 merupakan awal hilangnya hak-hak sumber daya alam Masyarakat Adat Deli sekaligus merupakan awal konflik masyarakat hukum adat Melayu dengan pihak perkebunan. Ketika pihak perkebunan negara tersebut (sekarang PT. Perkebunan Nusantara 2 (Persero)) tidak lagi meneruskan hak sebagaimana hak yang diterima masyarakat hukum adat dari pihak perkebunan Belanda dahulu, maka bermuculanlah klaim-klaim pihak ketiga yang tidak memiliki alas hak (recht title) di atas lahan tersebut. Nasionalisasi telah memperlihatkan kekeliruannya karena menasionalkan hak-hak atas tanah milik masyarakat (bukan milik asing), padahal pemaknaan nasionalisasi adalah menasionalkan yang bukan milik nasional. Bukankah tanah-tanah itu adalah milik Masyarakat Adat Deli yang notabene adalah rakyat Indonesia ? Bukankah masyarakat hukum adat itu adalah pemilik negeri ini ? Akan tetapi, undang-undang nasionalisasi yang secara tegas menyatakan bahwa yang dinasionalisasi adalah perusahaan Belanda dalam arti yang dinasionalisasi itu adalah asset yang terdaftar dalam Daftar Asset perusahaan semisal Deli Maatschapij, Arrensburg Maatschapij dan Deli Rubber Maatschapij. Obyek tanah tidak terdaftar sebagai asset perusahaan milik perusahaan asing (perusahaan Belanda). Seyogyanya perusahaan negara sebagai penerima asset pasca nasionalisasi hanyalah meneruskan hak-hak konsesi itu (vested rights), sehingga ketika hak konsesi itu berakhir, maka obyek konsesi itu (tanah) harus dikembalikan kepada pemiliknya (Kesultanan dan Masyarakat Adat Deli).

Abstract

Privacy, as a part of Human Rights, is the right of freedom of private matters. The basic concept of privacy is “the right to be let alone” which state that every individual have the right to have his own solitude without intervention. One of the most important information which also can be associated with Information Privacy is Personal Data that shall be protected as a form of protection to the privacy itself. Some of the personal data has been used as the requirements of the SIM Card Registration, thus making new problems regarding its personal data protection since the comprehensive regulation still covered only by the Ministral Regulation. Research method used in this paper is Descriptive Analytic in which the writer analyze the research object by explaining the situation and the condition of the personal data protection obtained from literatures on the facts that can be associated with the implementation of SIM Card Registration Policy according to Indonesia’s Positive Law and International Law. According to the result of the study, the Ministral Regulation already covered most of the basic data protection needed in the SIM card registration policy, however the protection provided by the Ministral Regulation still has not covered the third party involved. The Involvement of this third party is inevitable and should be protected immediatelyin order to prevent any abuse of personal data.
