Abstract

AbstractThis research aims to analyze the importance and the application of piercing the corporate veil in the legal policy of limited liability company. This research is included into juridical and normative research, utilizing library research to obtain secondary data. Such data deriving from legal principles, statutes, and literature are fither analyzed in a qualitative method, producing descriptive-analytical output. In addition, a study is conducted to compare the application of piercing the corporate veil in various jurisdictions. The result firstly shows the reasons that the doctrine of piercing the corporate veil is important in the legal policy of limited liability company: (1) to provide a legal certainty; (2) the existence of piercing the corporate veil in statutes will provide strict sanctions, hence achieving a deterrent effect; (3) to reduce litigation costs; (4) to encourage the implementation of piercing the corporate veil. Secondly, an expansion of regulation regarding piercing the corporate veil is found from the commercial code to Law Number 1 of 1995 and Law Number 40 of 2007.Key words: legal entity, limited liability company, piercing the corporate veil.AbstrakPenelitian ini bertujuan untuk mengetahui arti penting dan penerapan piercing the corporate veil dalam peraturan perundang-undangan di bidang Perseroan Terbatas. Penelitian ini merupakan penelitian yuridis  normatif  yang mendasarkan  pada penelitian kepustakaan  guna memperoleh data sekunder. Data yang diperoleh dari asas-asas hukum, peraturan-peraturan, dan buku-buku yang dianalisis dengan menggunakan metode kualitatif. Penelitian kualitatif ini menghasilkan data deskriptif-analitis. Selain itu, dilakukan juga studi untuk membandingkan penggunaan piercing the corporate veil di berbagai negara. Hasil penelitian menunjukkan bahwa pertama, arti penting pengaturan piercing the corporate veil dalam peraturan  perundang-undangan  di  bidang  perseroan  terbatas  adalah  karena:  (1)  untuk  memberikan kepastian hukum; (2) keberadaan piercing the corporate veil di undang-undang akan berimplikasi pada sanksi yang tegas sehingga efek jera dapat tercapai; (3) untuk menekan biaya litigasi; (4) untuk memotivasi penerapan piercing the corporate veil. Kedua, prinsip piercing the corporate veil di dalam perundang-undangan di bidang P.T di perluas dari KUHD sampai dengan UU Nomor 1 Tahun 1995 dan UU Nomor 40 Tahun 2007.Kata kunci: badan hukum, perseroan terbatas, piercing the corporate veil.

Abstract

AbstractThis study aims to assess the regional autonomy in Indonesia in strengthening the republic of Indonesia based on Law No. 32/2004 and find a model that can strengthen the autonomy of the Unitary Republic of Indonesia. This research is normative law research that focused on the literature data. The approach used in this study is using the principles of law approach, systematic approach to legislation, research on the level of vertical synchronization, historical, as well as the hermeneutic approach using deductive research. data used in the study is from literature using primary and secondary materials. results of the study showed that affairs and supervision is the most important element in strengthening the framework of the Unitary State of the republic of Indonesia and is the basis for the implementation of special autonomy. Indicators used to determine that the Act No. 32/2004 can strengthen the republic of Indonesia or not is seen from the elements of affairs and supervision. If the writer sees affairs and the provisions of Law No. 32/2004 lead to the  interpreted assumption that lead to strengthen federalism and lead to recentralization model of autonomy that strengthen the unity of the State is to change the system of wide and broaden autonomy become wide autonomy, focused and responsibility. division System of the affair is defined for both the provincial government and local municipality government but it focuses on the reference to the distribution of the central and regional affair. The concurrent affairs division is only constitutes on government affairs in order to strengthen the unitary state republic of Indonesia. Using principles of decentralization, de-concentration and co-administration are done justly. Supervision of the implementation of obligatory affair is deleted because supervision has been done by the governor as a government representative. Form of autonomy that can strengthen Indonesia is local autonomy in the form of broaden autonomy and specific Autonomy or asymmetric decentralization.Keywords: regional Autonomy, strengthening, unitary state of the republic Indonesia, Law No. 32/2004.AbstrakPenelitian ini bertujuan mengkaji otonomi daerah di Indonesia dalam menguatkan Negara Kesatuan Republik Indonesia menurut UU No 32/2004 dan menemukan model otonomi daerah yang dapat menguatkan Negara Kesatuan Republik Indonesia. Penelitian ini merupakan penelitian hukum normatif memfokuskan pada data kepustakaan. Pendekatan yang dipergunakan dalam penelitian ini adalah menggunakan pendekatan asas-asas hukum, pendekatan sistematika peraturan perundang-undangan, penelitian terhadap taraf sinkronisasi vertical, sejarah serta menggunakan pendekatan Hermeneutic dengan menggunakan penalaran deduktif. Data penelitian yang digunakan adalah data dari studi kepustakaan yang berupa bahan hukum primer dan sekunder.Hasil kajian menunjukan bahwa, Urusan dan pengawasan merupakan elemen yang paling penting dalam rangka menguatkan Negara Kesatuan Republik Indonesia dan merupakan dasar bagi diterapkannya otonomi luas. Indikator yang digunakan untuk mengetahui bahwa UU No 32/2004 dapat menguatkan Negara Kesatuan Republik Indonesia atau tidak adalah dilihat dari elemen urusan dan pengawasan. Jika penulis melihat urusan dan pengawasan dalam ketentuan UU No 32/2004 menimbulkan asumsi penafsiran yang mengarah pada kecenderungan menguatkan kearah ke federalisme dan mengarah resentralisasi Model otonomi yang menguatkan Negara kesatuan terletak dengan mengubah system otonomi seluas-luasnya menjadi otonomi luas, focus dan bertanggung jawab. Sistem pembagian urusan diperincibaik bagi pemerintah daerah provinsi dan pemerintah daerah kabupaten/kota tetapi focus sesuai dengan  acuan dalam penyusunan system pembagian urusan pusat dan daerah. Pembagian urusan yang bersifat concurrent   hanyaterletak padaurusan pemerintah dalam rangka menguatkan Negara Kesatuan Republik Indonesia. Penggunaan asas desentralisasi, dekonsentrasi dan tugas pembantuan dilakukan secara seimbang. Pengawasan terhadap pelaksanaan urusan wajib, dihapus karena pengawasan telah dilakukan oleh gubernur sebagai wakil pemerintah. Bentuk otonomi yang dapat menguatkan Negara kesatuan republik indonesia adalah otonomi daerah dalam bentuk otonomi luas dan Otonomi Khusus atau desentralisasi asimetris.Kata kunci: Otonomi daerah, penguatan, Negara Kesatuan republik Indonesia, UU No 32/2004.

Abstract

AbstractThis research aims to get the characteristic of the reclamation land tenure, inventorying policies related to the reclamation and legal regulation models of reclamation in Madura. This empirical legal research results that the most of land tenure reclaimed comes from the head of village permission. Policies of the reclamation in fact sectoral even though fourth districts having local regulation on spatial planning. Local regulation about reclamation is needed for coordination and synchronization between central and local authorities, for supporting Act No. 27 Year 2007 about Coastal Management Areas and Small Islands, also Presidential Regulation No. 122 year 2012 about Reclamation. AbstrakPenelitian ini bertujuan untuk mendapatkan karakteristik penguasaan hak atas tanah hasil reklamasi, inventarisir kebijakan terkait reklamasi dan rumusan model pengaturan hukum reklamasi di Madura. Hasil penelitian hukum empiris ini mendapati bahwa kebanyakan penguasaan tanah hasil reklamasi berasal dari ijin yang diberikan oleh Kepala Desa. Kebijakan terkait pelaksanaan reklamasi masih bersifat sektoral meskipun keempat kabupaten telah mempunyai Peraturan Daerah tentang RTRW. Diperlukan “Peraturan Daerah” tentang reklamasi untuk menciptakan koordinasi dan sinkronisasi antara kewenangan pusat dan daerah. Peraturan Daerah tentang reklamasi ini untuk mendukung pelaksanaan UU nomor 27 tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil, juga Peraturan Presiden tentang reklamasi.

Abstract

AbstractThe purpose of this study is to formulate legal drafting a model policy formulation Regional Regulation based Green Legislation in order to develop the practices of good governance in the region through strengthening the role of the executive (such as the leading sector of legal department Sector, BLH, Central Java Regional Environment and Parliament through strategies, mechanisms, and empowerment potential, and improving procedures for preparing regulations for environment conservation attention. This study is a juridical non-doctrinal, with a qualitative approach. The method will be used through the stages of: mapping the existing condition into the formulation of legal drafting which has been used, mapping of potential executive (leading sector) and the Parliament, to evaluate regulations that have been generated , identify and evaluate the constraints faced in the policy formulation stage, identify opportunities and strategies and formulate a model formulation that can be developed. The emphasis in the context of formulation of legal drafting by the Government to produce a green-based regulation legislation. The results of research are: First, the preparation of formulations Legal Drafting regulations made by the Government in accordance with Act No. 12 of 2011 and Act No. 32 of 2004, but not all use the Paper of Academic regulation in the formulation so that the Legal Drafting  Regional Regulation not meet the criteria of a good legal system. Second, participation has not been effective and not all regulation is preceded Academic Paper. Third, the constraints in the formulation of legal drafting regulations include limitations of the preparation of draft environmental preservation, the ability to assess the regulation, the ability to formulate an explicit policy, concrete , clear and operational.

Abstract

AbstractForest management must consider the cultural values of society, aspirations and perceptions, and involve local communities in forest management in the presence of community-based forest management (PHBM). One of the areas that have the potential wealth of natural / forest resources is Kendal. Formulation of the problem, 1) forest management in Kendal?, 2) The role and participation in PHBM in Kendal?, 3) Barriers in PHBM in Kendal ?. This research is a kind of juridical empirical research. Engineering analysis was performed by descriptive analysis. Based on the results of the study, 1) Implementation of forest management in Kendal done involving the community, with the PHBM models, 2) The role and participation of the community with the establishment of the Institute of Forest Village Community (LMDH) / Forest Village Community Association (PMDH), 3) Barriers, less fast accessing information with a range of obstacles. Advice that can be given, among others, 1) Model Forest Management (PHBM) is considered effective. 2) Increasing community participation in the management of forest resources. 3) In order to overcome the obstacles of rural communities to be pro-active with each other to obtain information for the development of forest resource management. AbstrakPengelolaan hutan harus memperhatikan nilai-nilai budaya masyarakat, aspirasi dan persepsi masyarakat, dan melibatkan masyarakat setempat dalam pengelolaan hutan dengan adanya pengelolaan hutan berbasis masyarakat (PHBM). Salah satu daerah yang memiliki potensi kekayaan alam / sumber daya hutan adalah Kabupaten Kendal. Perumusan masalah, 1) Pengelolaan hutan di Kabupaten Kendal ?, 2) Peran dan partisipasi masyarakat dalam PHBM di Kabupaten Kendal ?, 3) Hambatan dalam PHBM di Kabupaten Kendal?. Penelitian ini adalah jenis penelitian yuridis empiris. Tekhnik analisis dilakukan secara deskriptif analisis. Berdasarkan hasil penelitian, 1) Pelaksanaan pengelolaan hutan di Kabupaten Kendal dilakukan mengikutsertakan masyarakat, dengan model PHBM, 2) Peran dan partisipasi masyarakat dengan pembentukan Lembaga Masyarakat Desa Hutan (LMDH) / Perkumpulan Masyarakat Desa Hutan (PMDH), 3) Hambatan, kurang cepat mengakses informasi dengan berbagai kendala. Saran yang bisa diberikan antara lain, 1) Model pengelolaan hutan bersama masyarakat (PHBM) dianggap efektif.2) Meningkatkan peran serta masyarakat dalam pengelolaan sumber daya hutan. 3) Untuk mengatasi hambatan masyarakat desa bersikap saling pro aktif untuk memperoleh informasi untuk pengembangan pengelolaan sumber daya hutan.

Abstract

Abstract Since the entry into force of the ASEAN Charter in 2008, it is widely said that ASEAN has moved from a loose organization to a rule-based one based on. As an international organization which is distinguished by its member states, ASEAN has legal authority to conclude an international agreement with external party. This is governed in the Article 3 Juncto Article 41 (7) ASEAN Charter. In order to examine this provision, has been produced the 2011 Rules of Procedure for the Conclusion of International Agreements by ASEAN. Unfortunately in practice, the implementation of this provision is affected by the strong presence of the principle of state sovereignty held by each ASEAN member states. In this paper, the writer will analysis on ASEAN Legal Authority in Conclusion of International Agreement with External Party Based on ASEAN Charter. AbstrakSejak Piagam ASEAN dinyatakan berlaku pada tahun 2008, dapat dikatakan bahwa ASEAN telah berubah dari sebuah organisasi kawasan yang longgar menjadi sebuah organisasi yang berdasarkan aturan. Sebagai sebuah organisasi internasional yang mandiri dan dibedakan dengan negara anggotanya, ASEAN mempunyai kewenangan hukum untuk membuat perjanjian internasional dengan pihak eksternal. Hal ini diatur dalam Pasal 3 Juncto Pasal 41 ayat (7) Piagam ASEAN. Untuk melaksanakan ketentuan tersebut dikeluarkanlah the 2011 Rules of Procedure for the Conclusion of International Agreements by ASEAN. Akan tetapi dalam praktik, pelaksanaan ketentuan ini dipengaruhi oleh kuatnya keberadaan prinsip kedaulatan negara yang dianut oleh masing-masing negara anggota ASEAN. Dalam tulisan ini, penulis akan menganalisis mengenai kewenangan hukum ASEAN dalam membuat perjanjian internasional dengan pihak eksternal berdasarkan Piagam ASEAN.

Abstract

AbstractThe purpose of this reseach is to describe the reality of peace at investigation levels,  then compared to islah according to Islamic law as the reason of criminal removing, to find / to know the relevance. Based on the relevance, it possible become material for the legislators to formulate islah as a model of law enforcement at the level of investigation. This research is the normative research supported by empirical research. The data used was primary and secondary data. Data was collected by means of study documentation and interviews. Data were analyzed quatitatively dan and presented quatitatively. The research showed that the completion of criminal case based on the agreement between perpetrator and victim, along the case have not reached the judge. If the agreement is violated, they agreed to use the formal law. Criminal case which are resolved with peace/islah personalized and value of the loss is relatively small. Islam placing islah as an alternative the completion of criminal matters, along the case have not reached the judge. In the literature and practice, settling disputes with peace  known as Alternative Dispute Resolution (ADR), which is based on Restorative Justice Theory. Al Qur’an has set peace/islah as a model the completion of criminal matters, long before these theories arises.  Peace/ islah in the completion of a criminal case at the level of investigation relevant to satisfy the principle of fast, simple, and inexpensive. AbstrakTujuan penelitian ini adalah mendeskripsikan realitas perdamaian pada tingkat penyidikan, selanjutnya akan dibandingkan dengan islah menurut hukum Islam sebagai alasan penghapus pidana, untuk diketahui/ ditemukan relevansinya. Berdasarkan relevansi tersebut, dimungkinkan menjadi bahan bagi pembentuk undang-undang  untuk menformulasikan islah sebagai model penegakan hukum pidana pada  tingkat penyidikan. Penelitian ini merupakan penelitian normatif  yang didukung dengan penelitian  empiris. Data yang digunakan mencakup data primer dan data sekunder. Teknik pengumpulan data  dilakukan dengan cara studi dokumentasi dan wawancara. Data dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukan penyelesaian perkara pidana dengan perdamaian pada tingkat penyidikan mendasarkan kesepakatan pelaku dan korban. Apabila kesepakatan itu dilanggar, mereka sepakat untuk menggunakan hukum formal. Perkara pidana yang diselesaikan dengan perdamaian/ islah, bersifat personal dan nilai kerugiannya relatif kecil. Islam menempatkan perdamaian/islah sebagai alternatif penyelesaian perkara pidana, sepanjang perkara tersebut belum sampai ke tangan hakim. Dalam literatur dan praktik,  penyelesaian perkara dengan perdamaian disebut Alternative Disput Resolution (ADR) yang mendasarkan pada teori Restorative Justice. Al-Qur’an telah menetapkan Perdamaian/ Islam sebagai model penyelesaian perkara pidana, jauh sebelum teori-teori itu muncul. Perdamaian/ Islah  dalam penyelesaian perkara pidana ditingkat penyidikan, relevan untuk pemenuhan asas cepat, sederhana dan biaya ringan.Kata Kunci: Islah, Hukum Islam, Relevansi dan Penyidikan

                                                                                                                                                      AbstractThe process of local elections is the right of every citizen to choose their leaders directly correspond running from an independent path to meet certain requirements. Concurrent local elections 2015 in Indonesia,  which is in North Central Timor  with a single candidate pair. Couples candidate election time carried out. This article is the result of research exploring: 1) analyzing the relationship between political communicator (single candidate pair) to the effects (voting behavior of society); 2) analyzing the relationship between the political message to the effect (voting behavior of society); 3) analyzing the relationship between media and interpersonal channels of the effect (voting behavior of society); 4) effects (voting behavior of society); As for the type of research is quantitative research with survey method. The study population was the whole community voters in District Kefamenanu City. The conclusions of the research and discussion is no relationship between political communicator with effect (voting behavior of society), there is a relationship between a political message to the effect, there is a relationship between are not have a relationship with the effects.AbstrakProses Pemilihan Kepala Daerah merupakan hak bagi setiap warga negara untuk memilih langsung pemimpinnya sesuai keyakinan dan penilaiannya terhadap calon yang diusulkan oleh masing-masing partai atau gabungan partai, atau yang mencalonkan diri dari jalur independen dengan memenuhi syarat tertentu. Pilkada serentak Tahun 2015 di Indonesia, salah satunya di Provinsi NTT, yaitu di Kabupaten Timor Tengah Utara (TTU) dengan pasangan calon tunggal. Proses pilkada pasangan calon tunggal merupakan hal yang menarik karena sepanjang sejarah demokrasi dan sistem politik Indonesia baru pertama kali dilakukan. Artikel ini merupakan hasil penelitian yang mengeksplorasi: 1) Menganalisis hubungan komunikator politik (pasangan calon tunggal) terhadap efek (perilaku memilih masyarakat); 2) Menganalisis hubungan pesan politik terhadap efek (perilaku memilih masyarakat); 3) Menganalisis hubungan media dan saluran interpersonal terhadap efek (perilaku memilih masyarakat); 4) Menganalisis hubungan model pendekatan sosiologis (agama yang dianut dan jenis pekerjaan) terhadap efek (perilaku memilih masyarakat); adapun jenis penelitian yang digunakan adalah penelitian kuantitatif dengan metode survei. Populasi penelitian adalah seluruh masyarakat pemilih di Kecamatan Kota Kefamenanu. Adapun kesimpulan dari hasil penelitian dan pembahasan adalah ada hubungan antara komunikator politik dengan efek (perilaku memilih masyarakat), ada hubungan antara pesan politik dengan efek, ada hubungan antara media dan saluran dengan efek, model pendekatan sosiologis (agama yang dianut dan jenis pekerjaan) tidak mempunyai hubungan dengan efek.

Abstract

 This article aimed to observe the safety protection of public road transportation and some public areas in Yogyakarta and Surakarta. The Road and urban public transport terminals, station, and transshipment centres were mainly established at the meeting points of different traffic lines.  If we compare the terror-threat against infrastructure, building, and vehicles, then we can see that much more terrorist attacks were directed against the vehicles, than against bridges or tunnels. Safety protection on public road transportation and its  public areas is one of the efforts to enforce  right to life and right to sustain life in line with article 28A of Indonesian Constitution of 1945.  This issue is  important to be observed because two cities are prone to be attacked by terrorist and sometimes passengers or visitors are not responsive to disasters as long as they are on public road transportation and public areas.  This article have two important problem to be observed, first problem is  how already passengers  or visitors of public road transportation and its  public areas understand safety procedures of those areas?; second problem is how policy of safety protection need to be enforced on two public road transportation and public areas in order to protect right to life safely of passengers? The normative and empirical legal research is used  to this research by using interviews and field observation. The result of this research concisely state that at this time the bus station and rail  station is still not implemented maximum safety and security procedures to passengers and passengers or visitors do not understand about safety procedures and are not responsive to dangerous circumtances surrounded  them. Maximum safety protection is important to prevent  terrorism  crime, narcoticss crime, and prevent any casualties due disasters. Security officers should check the condition of bags and luggage of passengers or visitors in order to prevent any threats there. Safety briefing is also implemented to keep a passengers concer. Â
