Abstract

The essay Synchronising Constitutional Philosophy and the Challenges of Globalisation discusses how the constitution, as the highest legal document, must adapt to global dynamics without losing the fundamental values of a nation. Globalisation brings universal values such as democracy, human rights, and the supremacy of law that often clash with traditional values and local wisdom. In this context, constitutional philosophy plays a role as a foundation in determining legal principles that remain relevant amidst global change. This essay outlines the various challenges faced by the constitution in facing globalisation, including the harmonisation of national law with international standards and the dilemma between openness to change and preservation of national identity. To achieve this balance, this essay proposes a selective and contextual approach in adopting global values, strengthening civic education, encouraging intercultural dialogue, and strengthening the role of constitutional institutions. With the right approach, the constitution is expected to remain the central pillar in maintaining the stability and sovereignty of the state amidst the flow of globalisation. This essay emphasises that the synchronisation between constitutional philosophy and the challenges of globalisation must be carried out carefully to not sacrifice the nation's identity.

Abstract

Abstract:The Ministry of Home Affairs Through the Director General of Politics and Public Administration conducts a series of activities to counteract any potential threats, obstacles, and disruptions to the implementation of General Elections in Indonesia. The expert team identified three electoral vulnerabilities in an area, namely: vulnerability to suffrage, the existence of disputes in the form of election objections adjudication, minority representation, public participation, candidate participation, election supervision, gender rights, campaigns, voter participation and voting. Therefore, Kominda is a form of prevention of the indication of vulnerability.Keywords: Kominda, Election, Ministry of Home Affairs Abstrak:Kementerian Dalam Negeri Melalui Dirjen Politik dan Pemerintahan Umum melakukan serangkaian kegiatan guna menangkal segala potensi ancaman, hambatan, dan gangguan terhadap terselenggaranya Pemilihan Umum di Indonesia. Tim ahli mengidentifikasi ada tiga kerawanan pemilu pada suatu daerah, yaitu: kerawanan hak pilih, adanya sengketa berupa ajudikasi keberatan pemilu, representasi minoritas, partisipasi publik, partisipasi kandidat, pengawasan pemilu, hak gender, kampanye, partisipasi pemilih dan pelaksanaan pemungutan suara. Oleh karena itu dilakukan Kominda sebagai bentuk pencegahan indikasi kerawanan tersebut.Kata Kunci: Kominda, Pemilu, Kemendagri

Abstract

Abstract:The obligation of every human being is to keep the environment green. Healthy humans are people who value their environment. The Constitution of the Republic of Indonesia has stipulated in Article 28h paragraph (1) that "Every person has the right to live in an inner and outer prosperity, to live and get a good and healthy environment and the right to receive health services."This means that there is a legal guarantee for everyone who lives in the territory of Indonesia to get a healthy and green environment. Therefore this paper analyzes the extent of the role and contribution of various groups in the creation of the green environment.Keywords: Green Environment, Green Constitution, Healthy Environment Abstrak:Menjaga lingkungan hidup tetap hijau merupakan kewajiban dari setiap manusia. Manusia yang sehat adalah manusia yang menghargai lingkungannya. Konstitusi Republik Indonesia telah mengatur dalam pasal 28h ayat (1) bahwa “Setiap orang berhak hidup sejahtera lahir batin, bertempat tinggal dan mendapatkan lingkungan hidup yang baik dan sehat serta berhak memperoleh pelayanan kesehatan.” Artinya ada jaminan hukum bagi setiap orang yang hidup di wilayah Indonesia untuk mendapatkan lingkungan yang sehat dan hijau. Oleh karenanya tulisan ini mengalisis sejauh mana peran dan kontribusi berbagai kalangan dalam penciptaan lingkungan hijau tersebut.Kata Kunci: Lingkungan Hijau, Green Konstitusi, Lingkungan Sehat

Abstract

Abstract:Freedom of religion and worship is a basic right for every human being. So is the German Muslim community, which is the third largest religion in Germany after Catholicism and Protestantism. The German government has guaranteed the same freedom and equality for citizens and immigrants who are Muslim to carry out religious activities, even given the right to enter the Islamic curriculum in teaching in schools. Freedom which tends to be hard to find in the plains of Europe is now starting to open up. This paper wants to conduct elaborative research on the extent of religious freedom in Germany, especially for Muslims.Keywords: Freedom, Islam, Germany Abstrak:Kebebasan beragama dan menjalankan ibadah merupakan hak asasi bagi setiap manusia. Begitu pula dengan komunitas muslim Jerman yang merupakan agama terbesar ketiga di Jerman setelah Katolik dan Protestan, Pemerintah Jerman telah memberikan jaminan kebebasan dan kesetaraan yang sama bagi warga negara dan pendatang yang beragama Islam untuk melakukan kegiatan keagamaan, bahkan diberikan hak untuk memasukkan kurikulum agama Islam dalam pengajaran di sekolah-sekolah. Kebebasan yang cenderung susah didapatkan di dataran eropa saat ini sudah mulai terbuka. Tulisan ini ingin melakukan riset elaboratif sejauhmana kebebasan beragama di Jerman, khususnya bagi umat Islam.Kata Kunci: Kebebasan, Islam, Jerman

Abstract:Drug abuse is an endemic problem in chronic modern society. This disease recurs repeatedly in the community and must be addressed universally and maximally, both from the spiritual, physical, and social aspects. In this study, educative actions were taken to overcome the crime of drug abuse. The approach taken is by the method of Islamic education. Build spiritual awareness to no longer consume drugs.Keywords: Educative Actions, Drug Abuse Abstrak:Penyalahgunaan Narkoba merupakan masalah endemik dalam masyarakat modern yang kronik. Ia selalu berulang kali kambuh dalam masyarakat dan harus ditanggulangi secara universal dan maksimal, baik dari aspek spiritual, jasmani, dan sosial. Dalam kajian ini diupayakan tindakan edukatif guna menanggulangi kejahatan penyalahgunaan narkoba tersebut. Pendekatan yang lakukan adalah dengan metode pendidikan Islam. Abstract

Abstract:Terrorism is an extraordinary crime that threatens security and state sovereignty. Therefore, prevention must be carried out with an extraordinary legal basis. The debate that occurred was the policy of firing on the spot against suspected perpetrators of terrorism. So that the process of law enforcement and verification has not yet been carried out, because the perpetrators had been shot dead during the arrest by the police. This is the focus of the discussion in this simple article.Keywords: Terrorism, Extraordinary Crime, Shoot Dead Abstrak:Terorisme merupakan kejahatan luarbiasa yang mengancam stabilitas keamanan dan kedaulatan negara. Karenanya, pencegahan yang dilakukan harus dengan payung hukum yang luar biasa pula. Perdebatan yang terjadi adalah kebijakan melakukan tembak di tempat terhadap pelaku yang masih terduga terorisme. Sehingga proses penegakan hukum dan pembuktian belum sempat dijalankan, karena pelaku sudah mengalami tembak mati saat penangkapan oleh pihak kepolisian. Abstract

Abstract:Conditional release of prisoners can be given when the convict has fulfilled the terms and conditions that apply in article 82 of Permenkumham Number 3 Year 2018. However, problems arise when the president takes the initiative to provide parole to prisoners, especially terrorism prisoners. Even though there are no provisions in the president's prerogative provisions that directly give authority to the president to be able to release prisoners, except the provisions that require prisoners to file clemency, amnesty, abolition and rehabilitation. Because of this, in this simple article the author conducted a discussion.Keywords: Conditional Release, President's Authority, Terrorism Abstrak:Pembebasan bersyarat terhadap narapidana dapat diberikan pada saat terpidana telah memenuhi syarat dan ketentuan yang berlaku pada pasal 82 Permenkumham Nomor 3 Tahun 2018. Namun, permasalahan muncul pada saat presiden berinisiatif untuk memberikan pembebasan bersyarat terhadap narapidana khususnya narapidana terorisme. Padahal dalam ketentuan mengenai hak prerogatif presiden tidak ada ketentuan yang secara langsung memberikan kewenangan kepada presiden untuk dapat membebaskan narapidana. Kecuali ketentuan yang mensyaratkan narapidana mengajukan grasi, amnesti, abolisi dan rehabilitasi. Karena hal inilah, dalam artikel sederhana ini penulis melakukan pembahasan. Kata Kunci: Pembebasan Bersyarat, Kewenangan Presiden, Terorisme

Abstract

Politik hukum satu negara berbeda dengan politik hukum negara yang lain. Perbedaan ini disebabkan karena adanya perbedaan latar belakang kesejarahan, pandangan dunia (world-view), sosio-kultural, dan political will dari masingmasing pemerintah. Dengan kata lain, politik hukum bersifat lokal dan partikular (hanya berlaku dari dan untuk negara tertentu saja), bukan universal. Namun bukan berarti bahwa politik hukum suatu negara mengabaikan realitas dan politik hukum internasional.

AbstractInformation and communication technology is developing very rapidly. The community is directed to use communication channels that are personal, effective and efficient. This condition leads to the allure of communication via the internet. The allure of internet communication is because the internet frees information and users to move without restrictions. Ignorance of internet users to access news from healthy sources, and spontaneity to share news without checking and rechecking, resulting in hoaks easily spread in the community.Keyword: Hoaks, Internet, Social Media AbstrakTeknologi informasi dan komunikasi berkembang sangat pesat. Masyarakat terarah untuk menggunakan saluran komunikasi yang bersifat pribadi, efektif dan efisien. Kondisi ini mengarah kepada daya pikat komunikasi melalui internet. Daya pikat komunikasi internet disebabkan karena internet membebaskan informasi dan penggunanya untuk bergerak tanpa batasan. Ketidaktahuan pengguna internet untuk mengakses berita dari sumber yang sehat, dan spontanitas berbagi berita tanpa check dan recheck, mengakibatkan hoaks mudah tersebar dalam masyarakat.Keyword: Hoaks, Internet, Media Sosial
