Abstract

Abstract: In Indonesia where the majority of the population is Muslims, pesantren that has thrived since the arrival of Islam to the shore of the archipelago is still out of the central field of the national educational system. As such, pesantren was and is forced to continually be aware with ongoing new educational developments in the country as the result of modernisation and globalisation. The foundation of Ma’had Aly is one of the ways taken by the pesantrens to response to the current developments within Muslim communities, to define or even maintain their central roles as well as to preserve their tradition in such a modernised and globalised Indonesia. By exploring the foundation of Ma’had Alys in Kuningan as a case study, this article closely elaborates how the pesantren world engages these processes both in their cirricular settings and practices and provides how it negotiates with the ongoing changes within its surrounding communities.Key Word: Pesantren, modernity, Ma’had ‘Ali Kuningan

Abstract

Abstract: The process and the scintifc result will depend on their philosophical bases, covering theoretical framework, scientifc paradigm and basic assumption. The three bases become the philosophical base that function to allot framework, direction and scientific colour  that will be produced. The Islamic wordview in the perspective of  the philospy of science basically serves as the theological-methaphisical assumntion or hard core in the scientifc field of the Islamic eduation. It is the special characteristic that makes it different from the secular education. Abstract

Abstract: This paper deals with the existence of customary courts in Aceh in the national judicial system. From formal-juridical perspective, the existence of customary courts is not clearly stated; however, the practices of community have indicated that most of civil disputes and criminal offenses were resolved by the customary courts in Aceh. The question relates to such issues as administration of Aceh’s customary courts, duties of functionaries in this customary courts, and its existence within the national judicial system. This paper shows that, although the local government of Aceh does not legally include customary court as one of the state official justices, this kind of court has been sociologically recognized in resolving disputes that occur in the society. Furthermore, the local government of Aceh has codified it in the form of qānūn (legal code).Kata Kunci:  Peradilan Adat, Peradilan Nasional, pluralism hokum, hokum adat, qanunh

Abstract

Abstract: Allah swt. lowering of the Sharia to mankind is not without purpose. Sharia is the revelation of the purpose to provide the benefit to mankind and prevent them from things that are not good. However, the understanding sharia scholars about the purpose and application procedures are not always the same. Therefore, the problem maqasid al-Sharia become the object of a separate study in Islamic law. One scholar who specifically addresses this issue is As-Syatibi in his book al-Muwafaqāt. Sharia is not the same as the Pancasila as the latter is nothing more than the ideas of the freedom fighters of Indonesia, yet it contains the philosophy to the benefit of the people of Indonesia in this context, the principal study in this paper focus on the actualization Maqasid al-Sharia in the philosophy of Pancasila values.Kata Kunci: maqasid al-syariah, syariat, al-saytibi, falsafah Pancasila

Abstract

This article discusses Gadamers hermeneutics in the study of political theology. The question of meaning is at the heart of hermeneutic study. The significance or meaning comes from the German word "meinen" which means "in the mind or true". Thus, the meaning of a text, actions, relationships, and so on is what is in the mind of the author in implementing or generating text. According to Gadamers hermeneutics, the meaning is never involved any of the elements (agents and intentions), but the two elements that must be interpreted (acts, texts and the like) and its interpreter. The Gadamer outlook is what will be used in the view of political realities, particularly the relation between religion and state in the context of Indonesian-ness.Kata Kunci: Hermeneutik Gadamer, Politik, teologi, makna, teks, interpreter.

Abstract

Abtract:  The Islamic  law of inhreritance serves as one of the objects discussed in  studies of  Islamic law. However, the implementation of  the Islamic  law in the field of  inheritance  is not neccerally the same as that implemented in  Muslim countires. The Muslim countries such as Tunis, Syria, Egypt and Indonesaia implement the Islamic law of  inheritance but they do not possess the same understanding on the implementation of Islamic law of inheritance. The differencies lay on whoever elegible to receive the the property left by the dead persons and how many of the properties can be inherited; and whoever have the right to accept the inheritance from the dead person are among the questions discussed in this article in the respect of  the implemenatiuon of Islamic law of inheritance in the four Muslim Countries.Kata Kunci:  hukum keluarga,  wasiat,  ahli waris,  Negara Muslim

Abstract

Abstract: This paper deals with the typology of fatwā (Islamic legal opinion) in a contemporary era. It is assumed that change of paradigm will give an impact to changes in knowledge and its media of transmision. This also applies to fatwā. Due to this change of paradigm, fatwā has also undergone changes either in content or media of transmission. In this globalization era, which is characterised with the advance of information technology, fatwā can be divided into such categories as state, personal, individual, collective, and online fatwās. Abstract: Compilation of Islamic law contains the rules of Islamic law in accordance with the conditions of the legal requirements and the legal awareness of Indonesian Muslims. Abstract

Abstract: Indonesia is a country  whose population is majority Muslim. Thus, the aspects of sharia (Islamic law) should color the religiousity of Indonesian Muslims. However, the shariah is not something static, but rather something  dinasmic as it always  gets in contact with social aspects. In this context  that the reactualization and reconstruction of Islamic  jurisprudence should be continually performed. The reactualization of the Islmamic jurisprudence related to pragmatic values covering the daily life patterns of the Muslims while the reconstruction the Islamic jurisprudence thought more focuses on conceptual intellectuality values. Based on the  relationship of  the idea of  reactualization and reconstruction of the Islamic jurisprudence can be concluded that the latter is an infrastructure, while the renewal is a means to realize the function of  shariah (Islamic law) as a social control and social engineering.Kata Kunci: rekonstruksi pemikiran fikih,  reaktulisasi fikih, syariat, mazhab

Abstract: In essence, marriage is one of the things desired by everyone, male or female, in their lives. It is also seen as a change of status in a person from living in single life into family one through the media dealing with this. In terms of kinship, the relationship between society and family can occur through marriage and mate selection in order that a new family is established. This is an event in people’s life which is considered important and sacred in their lives.
