Abstract

In Malaysia, drug abuse and drug trafficking began affecting the society seriously around the 70s and, the trend has continued unabatedly in the first decade of the new millennium. The outcomes are staggering, as it is the cause of various social ills such as murder, burglary, prostitution, and even causes family disintegration and erodes social relations. The main objective of this study is to analyze from the Islamic perspective on the death penalty based on the siyāsah Syar’iyyah principles since the punishment by death for drug trafficking is not an offence directly stated in the al-Quran and al-Sunnah under the hudud law. Based on textual analysis, the study finds that the death penalty meted out against drug traffickers is justified based on the severity of the act in affecting the individual involved, society and the nation.

Abstract

Human resource (spirit and body, aql, heart, and soul)  which is granted by Allah has a very powerful force as through it human is able to manage the existence resources of the universe. Principally, the entire creations of Allah are for the sake of human. Therefore, the resources must be managed properly through education in accordance with the mandate given by Allah as it is stated in Sura al ‘Alaq: 1-5.  The enrichment of human resource quality is an obligation in Islam to optimize the existing resource. Allah and His Messenger Muhammad (peace be unto him) order human to pursue the knowledge unlimitedly to find the power of Allah. Thus, all resources are bestowed by Allah must be used solely to seek His pleasure. To reach, educational institutions, teaching-learning place, play a great role, and must be well managed and planned in order to produce qualified students with good character in conformity with the teachings of the Qur’an and Hadith.

Abstract

Islam as a religion of rahmatan li al'alamin, very much its contribution to the national development which is oriented to the whole human development. The presence of religion is always accompanied by "two faces". On the one hand, inherently religion has an identity that is exclusive, particularistic, and primordial. At the same time, however, it is also rich in inclusive, Universalist and transcending identities. In its role as a directive system, religion is placed as the main reference in the process of change. Religion will serve as a supreme morality that provides the basis and strength of the society's spiritual elite as they dialectics with change. Likewise as a defensive system, religion becomes a kind of resistance force for society when it is in an increasingly complex circle of life issues amid the rapid flow of change. Islamic education as agents of social change that is in the atmosphere of modernization and globalization today is required to be able to play its role dynamically and proactively, both at the theoretical and practical intellectual level. Islamic education is not just a process of cultivating moral values to fortify itself from the negative excesses of globalization. But the most important thing is how the moral values that have been invested in Islamic education are able to act as a liberating force from the crush of poverty, ignorance and socio-cultural and economic backwardness. This paper aims to explore the role of Islamic education in public social education which is the main foundation of a nation's development.

Abstract

Women prophethood has always been an alien concept to Islamic theology. According to modern as well as mediaeval mainstream Islamic schools of exegeses, jurisprudence and even according to everyday schools of fatwa: women are either too inferior, too week, or even not pure enough to meet the requirements or handle the challenges associated with prophethood. However, rethinking the Quranic text, in isolation from mediaeval gender biased narrow preferences, proves this view to be wrong. In this paper I provide a unique linguistic analysis of the Quranic story of Maryam, the mother of Jesus and the only woman mentioned by name in Quran. Maryam as I argue, is acknowledged in Quran as a female prophet: chosen equally to all chosen men, i.e., male prophets and above all women. In addition, a logical analysis in favor of Maryam’s prophethood will be provided. The juxtaposition of both evidence supports women prophethood.

Abstract

This research moved from the process and formulation mekanism of Jinayat Law into Positive Law in Aceh in Indonesia's legal system is influenced by a variety of legal systems and ideologies that developed there in. The object of this study is the Aceh Qanun No. 6 of 2014 on the law Jinayat that the legislative process takes place during two periods of provincial parliament. This study is qualitative, by combining the research literature (library reseacrh) with field research (field reseacrh). The approach used consisted of approach law (statute approach), normative-empirical approach and conceptual approaches. Type of research data in the form of descriptive analysis. The results showed the legal legislation jinayat Aceh is gradually taking into account the socio-cultural conditions of the community in accepting the substance of the law jinayah, adaptive law enforcement and crime rates are dominant in society. Parties involved in the formulation of the substance Raqan jinayah Aceh, among others: Ulama Consultative Assembly (MPU), law enforcement agencies (Syari'yyah Court, the Prosecutor, the Police and the WH) as well as the public through non-governmental organizations. The Aceh Government also involves the Expert Team Expert Team Executive and Legislature in the substance of the discussion on the draft jinayah. The dynamics of thought that emerged in the formulation of the substance of the criminal law (Jinayah) should be sought common ground in order Raqan jinayah be passed along between the legislative and the executive.

Abstract

The guidance of Allah for mankind is contained in the scriptures se t down by Him through the Prophets and Messengers. These scriptures are numerous due to the number of the Prophets. But, the mentioned and prominent ones include Zabur which was given to Prophet Dāwūd, Suhuf which was given to Prophet Ibrahim, Tawrāh which was given to Prophet Musa, Injil which was given to Prophet Isā and the Qur'ān which was given to Prophet Muhammad. However, the most circulated ones in the contemporary world are the Qur’ān and Bible. These two contain direct and indirect information about different issues and concepts. In spite of the similarities in few areas, the points of divergence are substantial. Hence this paper is aimed at examining five out the areas of convergence as well as the areas of divergence of both the Qur’ān and Bible with empirical examples from both scriptures. Conclusion is made to juxtapose their similarities which are due to their divine qualities and their differences which are as a result of the abrogation and interpolation by the people. Thus, the people are encouraged to show due respect to these heavenly scriptures.

Abstract

Most of the texts of Shari'ah came in the form of fundamental principles and general provisions. The texts are often general and flexible at a large extent, so that it would not be narrowed for the people. In addition, the texts, which encompass the partial and detailed provisions of Shari'ah, are drafted in such a way that can accommodate more than single understanding and particular interpretation. Consequently, this leads to the presence of multiple Schools and standpoints in the Islamic law. Nevertheless, all these Schools of law are right, based on the standard fundamentals, and derived from single source. Yes, these Schools may lead the nation to separation and dispersion if the followers were unaware of the issue of pluralism and ignorant about the reasons of disagreement among the scholars. This study discusses the essence of the Schools of Islamic law (madhahib) elucidating the fundamental nature thereof, and provides mechanisms and methodology to deal with these Schools, ensuring the peaceful coexistence among their followers. It might be understood that the intention here is to try to change the Schools and their stands to make them closer to each other. This is not intended and in fact this is not required. There should be respect for the autonomy of the Schools and their natures and standpoints. However, it is required to ensure that following these Schools is not based on the intolerance towards other Schools, or ignoring them, or attacking them. Rather, it remains within the framework of plurality of views and opinions without abusing the relationship of brotherhood and unity among Muslims. Thus, the aim must be here to work on the approximation among the followers of the Schools. This is because in principle these Schools are close to each other since they should be in accordance with the same fundamentals, while the dispute is limited to the corollaries and particulars. Nevertheless, it is not the aim here to abolish the Schools, or to remove the scholarly disputes, or to merge the Schools with each other, or to find a new School. Last but not least, the study aims to highlight the common features, and to respect the differences within the framework of emphasis on unity of the nation. This is further confirmed in sharing one view by multiple Schools regarding many particulars and subsequent issues. Hence, it is quite common to find single and same opinion that is adopted and advocated by more than one School of Islamic law.

Abstract

Isra Mi'raj raises many riddles from the scholars and scientists. It also raises many doubts among Muslims about the validity. Based on that journey, many questions arise whether the physical and the spirit of Muhammad as a whole or just soul which is tripped by God. The speed of light which is expressed as the highest speed in science is not enough to make that far trip in a short time. This paper discuss about the information that leads to the new indication, even though the truth cannot be ascertained. This paper used the zero Celvin theory to interpret Surah Al-Isra verse 1.

Abstract

It is not the physical world consist in itself as to what reality is, but proof of ultimate reality. Reality does not change by changing the process rather attributable quality named from A to B or This to that but essence remains the same. Process in metaphysics has two inseparable parts according to philosophers, cause and effect, which in any case intrinsic to every event coming into being. Denying either one makes impossibility of event. Once cause with all necessary condition fulfilled, cannot delay its effect by necessity, which is the sole premise with philosophers to assume worlds pre-eternity. On the contrary, according to Islamic theologians, it is not necessary and condition for event to have causal connection and it is possible to delay effect in presence of cause also and this is possible in conventional as well as rational and reasoning level. The central issue rose by Imam Al-Gazali (rahmatullahali) in his `Tahafut Al-falasifa concerning the world’s pre-eternity rotate around the cause and effect. He showed the incoherence of arguments posed by philosophers and proposed that it’s possible to delay the effect. Now, after 800 years, creation already unveiled mysteries in the form, which both the parties (Philosophers and theologians) did not know. However, who won the debate over world’s pre-eternity is still open. This paper will try to fill that gap by attempting direct discussion of Tahafut Al-falasifa on the issue of world pre-eternity, considering cause and effect as central debate and will show that what Imam Al-Gazali (rahmatullahali) proposed was correct: The delay in effect with cause is possible. This will be a contribution to the Islamic theology collecting physical facts from science, which anyhow reached to the same level where it meets metaphysics. This will be the latest debate on the issue, and provide new insights on some of core results of scientific theories, which are not considered yet.

Abstract

The literary inimitability of the Holy Quran and its wisdom, it’s rhythmical and phonetically excellence, in its perfect meanings, in its unmatched literary styles and its perfect grammatical structure has been discussed thorough out the Islamic History. The most important point of Quran’s miracle which means the words and expressions applied in Quran are arranged in a very specific and precise way that any movement changes the meaning. The Quran’s challenges everyone mostly to make only one verse in terms of rhetoric and eloquence like Quran, So far no one has surmounted this challenge. The Quran is neither prose nor poem while majority of the words are either prose or poems. It is not poem on the ground that it doesn’t have the basic elements of rhyme. In addition to rhyme another element of poem is imagination which is not applied in Quran and the words in it are imagination free. The Quran indeed contains an ocean of information relating to a wide variety of subjects. They include: religious and moral guidance, lessons from the lives of the peoples of the past, the message of the Prophets and Messengers of Allah, the physical sciences and historical accounts of important events. But all of this is delivered with the most fantastic literary rhythm and excellence. The Quran achieved this unique literary form by fusing together metrical and non-metrical speech. This fusion of metrical and non-metrical composition is present throughout the whole of the Quran and cannot be found in any Arabic text, past or present. The aim of this paper is to study three basic aspects that have been propounded by scholars including literary, linguistic, and scientific miraculousness. The paper also highlights the literary miracles of the Holy Quran as well as rediscover it uniqueness in modern age. A full understanding of its merit as a literary masterpiece requires a fresh approach to the study of the scriptures that present the literary beauty of the Quran in the most precise and coherent fashion.
