Abstract

The role of marks in the era of globalization of markets is very important, especially in maintaining fairbusiness competition and preventing piracy of marks that will be detrimental to the registered mark, bothdomestically and internationally. Therefore, the business requires international trademark registrationprocedures in order to obtain legal protection in both countries of origin and in other countries where theexpansion of business is required. Along with the development of international trade, the need to protectthe international brand is also getting stronger. International conventions on the protection of brands arepresent in the Paris Convention for the Protection of Industrial Property, Nice Agreement (Concerningthe International Classification of Goods and Services for the Purposes of the Registration of Marks),Madrid Agreement Concerning the International Registration of Mark and Madrid Protocol.The Madrid Protocol is an international treaty governing international trademark registration, with oneapplication, one language and one currency. The Madrid Protocol provides effective legal protection ofregistered marks and facilitates national brands into global brands able to compete with foreign marks.The ratification of the Madrid Protocol, expected to be done by the government, is a positive step insupporting the protection of domestic brands and is extensive and efficient; however, it requires goodhuman resource readiness, facilities and infrastructure such as technology to support effectiveimplementation of the Madrid Protocol in the protection of this brand.

Abstract

Land dispute is a complicated problem, especially when this problem includes some parties or masspublic. The rise of land dispute is caused by inequality of land possessing and control amongstgovernment, state plantation, private, and tenant farmers. Land dispute in Sidodadi Asri versus PTPerkebunan Nusantara VII is a conflict of land control based on Right to Cultivate (or HGU) and erfpachtright which was a conversion from colonial law upon land control of colonialist heritage that causedeffects such as eviction and expulsion with force to tenant farmers. The objective of this research is tostudy event chronologies causing the land dispute, to elaborate causing factors, to identify efforts thathave been done, and to find out solutions upon land dispute based on social approach. This research isstudied through social philosophy approach and descriptive analysis.Land dispute in Sidodadi Asri village of South Lampung regency has been occurring since 1999.Many efforts of settlements had been conducted either by means of traditional mediation, formal method(court), or land mediation which was formed in environment of National Land Agency (or BPN). Courtsettlement and mediation did not always give solutions to satisfy and give sense of justice for public.Main findings in this research are that [1] land disputes cause miseries to tenant farmers; [2] land disputecausing factors are historical backgrounds; [3] based on philosophical perspective, land disputes are statenegligence in making provisions that regulate basic natural rights of people upon land, and based ontheology philosophy and limited state power; a state is built by people and to welfare people and thisbecome philosophical foundation from egocentric ethic; [4] the land dispute involving public requiressettlements based on social, culture and theological aspects because land dispute settlement process basedon normative law always produces weak position for people; [5] reformation of right upon land rightcannot be limited by proof of possession, land use, or land control only, but it should embark fromdemocratic government policies oriented to tenant farmer welfare. Therefore, the Right to Cultivategranted by the state should not be absolute, but considering public and social factors.The author recommends philosophically and socially compromised efforts for land dispute settlementswith public by involving roles of limited state power and by not prioritizing law channel factors that causepeople miseries, and the efforts need to honor local wisdom values. Government should be wiser ingiving land right and more concern about local people’s interests who physically control the land, and togive proper compensation. Government should be able to improve social order with more justice relatedto land controlling, possessing, and using.

Abstract

There is fenomenal gap that amount of Indosat’s outlets have increased as41,76% in year 2007 until 2008,while Net Profit Margin have decreased as 18,66 % in year2008. Also there is research gap which saidthat competitive advantage have influence on performance sales, meanwhile other research result sellinginperformance has influence oncompetitive advantage. The purpose of this research is to test theinfluences of service qualityoutlet , differentiation, corporate image, quality of relationship with outlet ,environmentadaptability, on competitive advantage which is targeted to increase selling-in performance.The samples size of this research is 123 outlets of PT. Indosat. By using the Structural EquationModeling(SEM) with AMOS software , the results show that the service quality outlet,differentiation, corporateimage, quality of relationship with outlet, environment adaptabilityhave influence on competitiveadvantage which is targeted to increase selling-in performance.

Abstract

The purposes of this research is to explore the role of Blackberry Messenger (BBM) as one of marketingcommunication`s tool by analyzing Sumber Tiket Murah travel strategy in advertising its brand. BBM belongs toBlackberry Smartphone application and nowdays recently used as mobile sales promotion. The level of brandawareness is the output based on four stages e.g recognition, recall, top of mind, brand dominance. It used aqualitative approach using a written interview to gather information through 10 (ten) informants as the sample.The stages of data analysis were followed by data collection and subsequent data reduction which wasimplemented to present the data and drawing conclusions. Particular attention was given to analyze the role ofBBM as one of the marketing communication which expressed through BBM and also as shown in the qualitativeresearch interview.The analysis concludes that there were four main conclusions. The result from the interview showed that theinformants were aware about Sumber Tiket Murah as a travel agent provides the cheapest price for airline ticketstheir purchased. They also stated that Sumber Tiket Murah was proper to referenced to colleagues or friends.Moreover, the results also indicate that they found ticket information from other agents (eg. MMBC, TerminalTiket and others). But another informants were also loyal to Sumber Tiket Murah. It was because Sumber TiketMurah have some uniqueness, such as trustworthy, always provide cheaper tickets, discount prices, salepromotion by quiz, and can perform other transactions besides selling airlines ticket.Based on this research Sumber Tiket Murah has reached the stage brand recall. The travel experience showsthat maintaining consumers more difficult than look for new customers. Although informants stated they awareabout Sumber Tiket Murah travel because of its uniqueness, but Sumber Tiket Murah has not become thedominant brand among informants yet. Therefore, Sumber Tiket Murah need to have unique characteristics thatare spesific, such as providing souvenirs from various regions in Indonesia. Otherwise, Sumber Tiket Murah mustbe able to maintain uniqueness that already exist today. Moreover, by expanding the lines of business, it willincrease brand awareness of Sumber Tiket Murah.

Abstract

This study is aimed to investigate the effect of corporate governance indicators such as the board of directors, audit committee and audit quality to the bank performance which is proxied by Camel ratio such as CAR, NPL, LDR, ROA, BOPO and ROE. The samples were 30 listed banks in the Indonesia Stock Exchange. Structural Equation Modelling (SEM) was used to test the influence of corporate governance indicators to the bank performance. The test results proved that the board of commissioners had a significant positive correlation to the bank performance. It means the higher the commissioners’ supervision the better the performance of the bank. Similarly, the audit quality also has a significant positive correlation to the bank performanc which means the higher the audit quality, the better the performance of the bank. It has also been revealed that the audit committee, although positively related to bank performance but it is not significantly proved. The results of this study support the previous studies, the research of Nasution and Setiawan (2007), Abeysekera (2008), and Xie et. al. (2003).

Abstract

In general the function ofcommunication is toachieve thesense one to another, to build trust, to coordinateactions, to planstrategies, to perform division of labor, to perform a groupactivity, and to share the same sense. As thecommunication of government bureaucracy tasks are to serve, to regulate, to supervise, and to gain the relationshipbetween the governmentand thesociety, just imaginewhen thegovernment bureaucracydoes notinterpretthe importance ofcommunication, of course,the service process, the regulation, the supervision as well as the relationshipbetween the governmentand the societywill not run. In the end there come problems ofbothtrivialanddue toalack ofcommunicationwithin thegovernment bureaucracy. This makes the changes in the organizational culture in the government on the one hand can improve performance, but on the other hand can also fail if not properly maintained and prepared. However, what to watch is to know when the right time to make a change organizational culture is. The change in organizational culture is required in case if there is an un-avoided development in the environment. On the other hand, the changes become the internal need of the organization; it is perceived as a necessity. It is also required an understanding of how to have proper process to run the organizational change and to know what obstacles might be encountered. Errors can result in the emergence of resistance and failure in the attempt to change the organizational culture.

Abstract

Service innovation is a new or significantly improved service concept that is taken into practice. It can be for example a new customer interaction channel, a distribution system or a technological concept or a combination of them. A service innovation always includes replicable elements that can be identified and systematically reproduced in other cases or environments. The replicable element can be the service outcome or the service process as such or a part of them.(Finland, 2009)Being developed for centuries, Hotel Industry has been in its maturity period for a long time. Confronted with fierce competition and the current global economic crisis, it becomes a hot topic in Hotel Industry how to maintain and raise revenues. By shifting focus from „Goods-Dominant Logic‟ to „Service-Dominant Logic‟, Service Science presents a new perspective on value creation and service experience. In this new perspective, value is co-created by various roles, experienced and evaluated by customers. However, the problem is how to implement theories in a specific industry.The purposeofthis researchisto discuss the importance of using service innovationin hotel industry in order to win acompetition in this highly competitive industry .

Abstract

This research proposes a development model that explains productivity performance impacts of IS at the individual level. This research aims to test productivity performace’s model by adding new constructs such as self-efficacy, trust, system quality and information quality as well as analyze the causality impact among variabels of productivity performance’s model in PT Pindo Deli Paper Products. The sample used were 265 respondent. The results show that all variabels in this research have significant impact to productivity performance. This development model can gain a fuller understanding of IS-productivity performance impact not only by using the IS and nature of IS use but also by including self-efficacy, trust, system quality and information quality. The theoritical contribution of this research lies in the development of a model for productivity performance impact of IS that have significantly higher explanatory power than the existing models.

Abstract

The process of globalization is a one-way order and one face. But it is an ambivalent order to the ambiguous direction, the kindness and friendliness of globalization with the ugliness and evil of globalization. In this ambiguity understanding, the effects of globalization on the democracy journey will also depend on what angle we look. Two different angles will result to the different view of democratization. The two angles are not necessarily to be opposed to, moreover seen as the right versus wrong. Both are realities, which means we must understand and see with the wisely view angle. Because the globalization debates on democracy, whether it is good or bad is the same length as the history of the human existence on the earth.
