Abstract

The essence of labor inspection is the activity of supervising and enforcing the implementation of laws and regulations in the manpower sector. The relationship between supervision and welfare is an inseparable pair, if you expect a maximum achievement. In terms of labor inspection it is not enough to be limited to supervision, but for the continuity of the realization of the supervision, a systematic, recorded and integrated supervision must be carried out, so that the results of the inspection must be applied in the world of work and be effective in improving the welfare of workers. and enforce the implementation of laws and regulations in the manpower sector, so that in this effort the government also establishes a labor inspection work unit from the top to the lowest as stipulated in Law Number 13 of 2003. Employees of the Labor Inspection, even ministers also have duties in this field. Protection between labor inspection and work success is always carried out in an integrated, coordinated and integrated inspection system which includes the work unit of labor inspection, labor inspectors and labor inspection procedures.

Abstract

Investment is any form of investment activity, either by domestic investors or byforeign investment to carry out business in the territory of the Republic of Indonesia. This study aims to determine the importance of investment in economic growth. The presence of investment can drive the country's economy, in addition to creating a multiplier effect which is expected to increase added value for the government and society. In developing countries, including Indonesia, the inflow of foreign capital is quite profitable if it is actually used for national development, especially to drive the country's economy. Investment facilities are provided with consideration of the foreign power level of the economy and the country's financial condition and are promotive compared to those provided by other countries. The importance of the certainty of this investment facility encourages more detailed regulation of the form of fiscal facilities, land rights facilities, immigration facilities, and import licensing facilities. In conclusion, if a country is to achieve sustainable economic growth, it must have a certain economic structure, that is, it must be able to mobilize all its capital and natural resources capabilities so that it can achieve a productive investment level of 10% of its maximum income

Abstract

The purpose of this study is to find out more closely the millennial generation'sperspective on Pancasila. The founding fathers formulated Pancasila, which aims to direct the nation to achieve its goals and become an inclusive nationality. The position of Pancasila as a source of identity, personality, morality, and the course of national safety. Pancasila is one of the essential components in the concept of National Resilience in ideology that provides directions and guidelines for achieving national goals, namely the nation's survival and state. However, the fact is that the Pancasila Ideology position is now increasingly being forgotten by the Indonesian people, including the millennial generation with a large population. In the future, it will become the next generation. The fading of the appreciation and practice of Pancasila values is partly due to the various challenges facing the Indonesiannation. The method used is qualitative research with Conventional Content Analysis (CCA), the subject of this research is the millennial generation who live in DKI Jakarta. The results of this study are six categories describing the views of the millennial generation towards Pancasila, including: (1) Guidelines; The urgency of deepening Pancasila; (3) Interests; (4) The problem of understanding the values of Pancasila with two subcategories, namely language and no concrete examples; (5) Pancasila is synonymous with government; (6) Adaptive.

Abstract

The application of a No Smoking Area (KTR) is a space or area where smoking is prohibited, selling, advertising or promoting tobacco products. Places that are placed into smoking-free areas include health service facilities, learning places and schools, children's playgrounds, places of worship, public transportation, workplaces and public facilities, both government and private. This study examines how the implementation of the Medan city regional regulations regarding smoking-free areas and the effectiveness of the Medan city regional regulations regarding smoking-free areas in Sunggal Village. This researcher uses research methods. descriptive analytical with a normative juridical approach. Where the data and information will be collected both in terms of assessment and management. Secondary data in the form of primary, secondary and tertiary legal materials and the information are then analyzed juridically qualitatively with mandalam. The application of this Medan City Regional Regulation in Sunggal Urban Village. Since the issuance of the Medan City Regional Regulation, Sunggal Urban Village, especially the Sunggal Urban Village Office, have implemented a No Smoking Area. However, for those in the Sunggal sub-district, some residents still do not know about Medan City Regional Regulation Number 3 of 2014 concerning No-Smoking Areas. It is necessary to apply to each Head of the Environment in order to inform residents about the information of the Medan Kotam Regional Regulation Number 3 of 2014 concerning No-Smoking Areas and it needs residents' awareness to apply these regulations so that they can create a Smoking-Free Area in Sunggal Village.

Abstract

Nowadays, in line with technological advances in the field of transportation and telecommunications, in a developing society various new legal institutions are widelyused in practice in our country, namely what we know as periodic sale and purchaseagreements. Judging from the seller's point of view, the emergence of this form of agreement certainly does not cause too many problems. However, it feels safe when viewed from the seller's point of view, it is not the case with the situation felt by the buyer. There are many problems faced by buyers as a result of making regular sale and purchase agreements, especially when we look at the portrait of buyers who make periodic sales and purchase agreements, most of them are buyers whose economic conditions are weak. From the background of the problems that become the problem are: 1) How is the legal protection for buyers who suffer losses due to the making of a periodic sale and purchase agreement 2) How to build a fair law for the parties in a periodic sale and purchase agreement? From the results of the study of the above problems, it can be seen that the main legal protection for buyers is torefer to the contents of the agreement made by the parties and the Consumer Protection Law as its legal umbrella, while efforts to build a fair law for the parties certainly need to pay attention to the existence of various principles underlie the making of an agreement such as the principle of good faith that underlies the making of an agreement.

Abstract

The principle of law as a crystallization of the values that live in society, of course, must be in accordance with the conditions in which the community is located. In this case, of course, the principles of the Indonesian people must be in accordance with the values contained in the associations and the outlook of life of the nation itself; namely Pancasila as a source of legal principles for the Indonesian nation. In general, law is positioned as a tool to achieve the goals of the State, thus it is a tool or means and steps that can be used by the government to create a national legal system in order to achieve the ideals of the nation. It is the principle of unity and oneness that can achieve the goals expected by the Indonesian nation, namely a just and prosperous society or in the words of wisdom "Gemah Ripah Loh Jinawi- Tata Tentrem Kerta Raharja".

Abstract

This study aims to analyze the legal aspects of the use of credit cards as a meansof payment and settlement efforts from the bank in the event of a customer who does not pay the credit card. This research is a juridical-normative research, with the approach used, namely the statutory regulation approach and legal norms in accordance with existing legal issues related to the structure and principles of the applicable law. The results of the first research are that the legal aspects related to the use of credit cards in Indonesia include various regulations such as Law Number 19 of 2016 to Bank Indonesia Regulations, namely Bank Indonesia Regulation Number 14/2/PBI/2012 concerning Amendments to Bank Indonesia Regulation Number 11/11/PBI/2009 concerning the Implementation of Card-Based Payment Instrument Activities. Second, there are several attempts made by the bankingsector in solving problems when there is default by the customer, these efforts can be carried out by conducting Negotiation, Mediation, Conciliation, Arbitration and Judiciary. With the existence of several alternatives in solving the problem, the bank can choose the efforts to be taken, such as the Cirebon Branch of Bank Rakyat Indonesia which chose mediation as the solution to the problem. Mediation is the main solution carried out at BRI Cirebon Branch, it is more effective and efficient in solving the problem, mediation as an effort to solve problems also has a strong legal basis and legitimacy as stipulated in Bank Indonesia Regulation Number 8/5/PBI/2006 concerning Banking Mediation.

Abstract

The Covid-19 pandemic that hit Indonesia in 2020 has caused increased fatalities and property losses. There is still no discovery of a vaccine that can cure patients infected with Covid-19, so that these patients have to be hospitalized according to their medical needs and this is of course cost a lot. Then the question is whether the cost of medical care at the hospital due to Covid-19 will be borne by BPJS Kesehatan (Healthcare and Social security Agency)? Due to that aboved concern, this paper would like to discuss how the role of BPJS Kesehatan in covering the costs of caring for patients with confirmed Covid-19 in health facilities? and second, what are the challenges and obstacles if BPJS Kesehatan covers the costs of caring for Covid-19 patients in health facilities? This research uses a normative juridical research with a descriptive analytical approach. The results showed that in this pandemic era, BPJS Kesehatan only acts as a verifier for hospital costs that treat patients confirmed Covid-19. Optimizing the role of BPJS Kesehatan as guarantor of health costs will encounter several challenges and obstacles, including the revision of Presidential Decree No. 82/2018, the health budget shall be being a priority for the government, as well as improving the governance of BPJS Health.

Abstract

Informed Consent is the approval of medical action given by the patient or his / her closest family after receiving a detailed explanation of the medical action to be performed on the patient. This is regulated in Law Number 29 Year 2004 Concerning Medical Practice, Paragraph 2, Article 45. Informed Consent is required for various medical actions, such as surgery (surgery), invasive procedures, and other high-risk measures. However, in its implementation there are still obstacles where there is a mismatch between the reality and the intended legality, both in terms of the completeness of the form, the quality of data filling, and the content of the information provided. This is caused by several causes, among others; There is a lack of understanding of medical personnel, medics, and patients about informedconsent, barriers to the medical language provided, in addition to constraints onunderstanding and patient education and the existence of patient disease status The legal position of patients and doctors is basically equal because they both have rights and obligations. For this reason, the legal position of patients in informed consent in terms of health laws and consumer protection laws is a position that must be protected as regulated therein. Each can exercise their rights and obligations freely without pressure from any party. In addition to improving the implementation of informed consent in health facilities, socialization is needed to medical staff and patients about its benefits. In addition, it is important to reconstruct the laws and regulations so that it can be guaranteed that the patient's rights are fulfilled for medical treatment and that there is legal protection for them.

Abstract

This study examines further from previous studies that have discussed the regulation and form of food consumer protection through the realization of an optimal integrated food safety system. With the sociological juridical approach method, it not only examines normative matters, but empirical data collection is also carried out in the field through observation and comprehensive interviews with related parties as well as qualitatively analysed. The thing that is more emphasized from the results of this research is focused on the aspects of the realization of the protection of home industry food consumers through strengthening the food safety system more broadly and reaching all levels of society. The results of this study in principle put more emphasis on efforts to increase the strengthening of working relationships balanced with proportional clarity of the main tasks and functions of the stakeholder agencies, so that the final target leads to a more effective, strong and reliable consumer protection.
