Abstract

This paper on investment describes the legal system consisting of substance and apparatus. The purposes of this paper are: (1) to study more deeply and explain the process of implementing foreign investment in Indonesia in general and Central Java in particular, in terms of the applicable normative juridical aspects, and (2) to find out the obstacles or obstacles that may occur. in the implementation of the investment. Based on Law Number 25 of 2007 concerning Investment and Central Java Governor Regulation Number 152 of 2010, the general process of implementing foreign investment in Central Java is as follows: (1) Foreign investors submit investment plan files to be carried out to BPMD for registration. in order to obtain an investment permit in Central Java, (2) foreign investors who have obtained permits from BPMD obtain non-fiscal facilities such as Producer Importer Identification Numbers (API-P), Plans for Use of Foreign Workers (RPTKA), Recommendations for Visas to Work, Permits Employing Foreign Workers (IMTA), (3) Investors must establish a PT (Limited Company) in Central Java, and (4) Foreign investors carry out investment activities as planned. Obstacles and settlement of foreign investment in Central Java, among others: (1) obstacles in the form of political stability and security factors. The solution to this obstacle lies with the government; (2) Issues inthe form of “Nominee” Shareholders; (3) Incentives given to foreign investors have the potential to trigger foreign domination of the regional economy; and (4) investment disputes. The settlement of this dispute refers to Article 32 of Law Number 25 of 2007, namely through 4 ways: Deliberation and consensus, Arbitration, Alternative dispute resolution, and Courts.

Abstract

Lots of Illegal fishing boats have penetrated indonesian waters to takeadvantage by stealing marine assets owned by indonesia. This is of course very detrimental to the indonesian state both from an economic standpoint and a natural conversation point of view. Therefore,this action must be given an appropriate sanction to provide a deterrent effect on the perpetrator of illegal fishing. Besides that,it is also to ward off violations in the border areas of indonesia that could threaten the country”s sovereignty. One of the sanctions of ilegal fishing caught stealing indonesia's marine assets without official permission. With this sanction,there are pros and cons,such as the many protests from the flag state of the ship that sank its ship because it was proven to have stolen the natural wealth of theindonesian state without official permission.

Abstract

The regulation of space tourism and whether the position of a space tourist has the same position as an astronaut who is a human ambassador in space, especially the gap between the fact that space tourism activities are becoming more realistic and international law rules that have not yet regulated space tourism activities. in particular. This research uses literature study method with secondary research materials. Space tourism as a result of technological developments in the use of space activities is accommodated by the 1967 Space Treaty as the basis of international law regarding outer space. The presence of tourists in tourism activities is inseparable, their presence is protected by the Space Treaty 1967, the Liability Convention 1972, and the Registration Convention 1975. The occurrence of space tourism certainly requires the latest international legal products to become regulations related to space tourism activities, the need for a new international agreement that regulates space activities so that these activities have a concrete legal basis so that they do not cause problems from a regulatory perspective.

Abstract

The purpose and objective of supervision is to prevent or correct errors, irregularities, non-compliance with the implementation plan and others that are not in accordance with the assigned duties and authorities. So that the results of the implementation of the work are obtained accurately, efficiently and successfully in accordance with the 1 predetermined plan. The supervision carried out by the DPRD on the follow-up to the audit report by the BPK is very important to realize good regional governance, a government free from corruption, collusion and nepotism, as well as evaluation material for the use of regional finance and regional financial reports. recommendations by BPK as a manifestation of the need for improvement in the presentation of reports by regional governments, so that there is an obligation to regional governments to implement recommendations from BPK

Abstract

In the context of law enforcement, the process of investigating criminal acts is one of the sub-systems in the criminal justice system in Indonesia, which has a significant and strategic position, because investigations are the main gate and the beginning of the criminal justice process. Civil Servant Investigators (PPNS) are also given the authority to carry out professional investigations, in addition to the investigative authority of Polri Investigators. The investigation authority becomes a problem after there are various antinomical or contradictory provisions. In that context, it is interesting to analyze by first discussing the position of PPNS based on the criminal justice system and then discussing the harmonization of the provisionsof PPNS authority with Polri investigators in an integrated criminal justice system. The research method used in this study is normative, using a statute approach and a conceptual approach.

Abstract

This study aims to analyze and synthesize the legal construction of the Supreme Court justices in deciding the value added tax dispute of coal companies so that they can be used as legal considerations for tax authorities and taxpayers who are in the coal mining sector in fulfilling their tax obligations. The method used is doctrinal research which analyzes primary and secondary legal sources. The results of the study show that the construction of the Supreme Court judge in deciding the value added tax dispute for coal companies is not only guided by written regulations and documents, but also explores, follows, and understands the legal values and sense of justice that live in the coal business world. The Supreme Court judge is of the opinion that the Certificate of Origin is not the basis for calculating the volume of coal delivery, income from debt payments is not an object of value added tax, foreign exchange income is not an object of value added, and sales of assets which according to their original purpose were not traded by coal mining companies are not value added tax object.

Abstract

Child labor is a form of exploitation in employing minors for small wages. Child labor often occurs in the informal sector, such as the palm oil industry, due to the absence of formal recruitment and proper supervision of the company. Law Number 13 of 2003 concerning Manpower expressly prohibits the exploitation of children for economic motives. The purpose of this study: 1) to find out the condition of casual daily workers in the oil palm sector in Indonesia, 2) to find out the factors that influence the existence of child labor in the oil palm sector in Indonesia. 3) find out the legal efforts taken to tackle child labor in the oil palmsector in Indonesia. This study uses a normative juridical methodology by analyzing relevant studies and research on the research topic. The data obtained in this study are secondary data through journals, news, reports, and data officially published by the relevant agencies. The results showed that the underlying factors of child labor are economic, social, cultural, and educational. The efforts made in overcoming child exploitation are in the form of providing supervision and warning to companies.

Abstract

Aesthetic dental care can be done in various ways, nowadays the most popular dental treatment is by applying veneers to the teeth. Even so, many people still do not understand that veneer treatment is the authority of dentists. This study aims to determine the regulation of veneer installation in positive law in Indonesia and the application of the law to violations of authority in veneer installation in Indonesia. The result of the research is that although it does not specifically regulate the veneer method, based on the Dentist Competency Standards, Law Number 29 of 2004 concerning Medical Practice has become a positive legal arrangement inIndonesia which becomes the legal umbrella for all forms of general medical practice and dentistry. The application of the law against violations of authority in veneer installation should be able to include elements of a more complex crime in several positive legal regulations in Indonesia. This is intended so that the public can learn about the powers of medical treatment that can only be carried out by medical personnel or doctors or dentists.

Abstract

Anak sebagai bagian warga masyarakat merupakan generasi penerus cita-cita bangsa, oleh karena itu anak berhak untuk mendapat perlindungan. Berkaitan dengan politik kriminal dalam perlindungan anak, diarahkan secara khusus pada politik kesejahteraan anak dan politik perlindungan anak. Perlindungan terhadap hak-hak anak berkaitan dengan permasalahan perlidungan hak-hak anak pada umumnya yang merupakan sub sistem dari perlindungan hak-hak anak. ulisan ini membahas tentang kebijakan perlindungan anak meliputi: (1) Instrumen Hukum Perlindungan Anak, (2) Batasan Usia dan Pengertian Anak, dan (3) Politik Kriminal Anak yang Bermasalah Dengan Hukum.

Abstract

Corruption is a crime against humanity. The impact is not only in the economic sector, but also destroys the entire structure of state life, even more devastatingly destroying the mentality of the nation's children. No state institution is immune from the virus of corruption. Regional heads who should be role models, according to the data from the Ministry of Home Affairs in 2019, 300 regional heads were involved in corruption. Among them, some had been imprisoned, then participated in the Regional Head General Election, and were elected, repeating corruption. This study answers the driving factors for why regional heads are corrupt again and finds efforts to minimize the recurrence of corruption by regional heads. With a case study of the facts of the trial in the court of a regional head who had been in prison. The result is large political financing with limited capital based on misguided intentions, the regional head even though he has been in prison will certainly repeat corruption. Opportunities that are used are buying and selling promotions for state civil servants, as well as commercializing projects by determining the winner who has deposited funds to the regional head. The effort to close this opportunity is to make a rule to include the Provincial Inspectorate in the promotion of echelon II and III positions. Meanwhile, to determine the winner of the project auction, namely to make regulations that require the local government to form an independent team financed by the regional government to oversee the auction and determine the winner of the auction. Maximizing the role of the Corruption Eradication Commission to tap the trusted people of the regional head who commercialize the authority of the regional head.
