Abstract

Human rights conditions still have not significant progress yet. It will be shown in the absence of serious measures and well-planned by the government for the fulfillment of human rights both in the field of economic, social and cultural as well as in the field of civil and political rights. This research was conducted to describe the problems as follows: (1) How is the process of formulating the values of human rights in the draft of local regulations?, and (2) What is the impact of local regulations in the fulfillment of ESC rights of citizens? The aims of the study are: identify and assess the process of formulating the values of human rights in the draft regulations, and the impact of local regulations in the fulfillment of ESC rights. This is a normative legal research, its find the truth based on the logic of the legal thougth. The analysis conducted on the laws and regulations, which its containing norms of protection and fulfillment of ESC rights. In terms of empirical conducted to assess the impact of the local regulation on the community. The research conclusion are the Government District of Bantul have included ESC rights values into ones that are made in the period 2005-2009, although not all values can be accommodated into the local regulation. Regulation set a positive impact in the effort to fulfill the responsibility of the local government in fulfillment and protection of ESC rights.

Abstract

The regulation of land ownership had already existed and stipulated in the UUPA. Article 42 of UUPA regulate the land ownership stipulation for foreigners, i.e. foreigners can only have use rights and leasehold. Government Regulation No. 41 of 1996 stipulates that the use rights for foreigners may occur on State Land, Properties Land and land management rights. The regulation of land rights for foreigners in Indonesia stipulated in Government Regulation No.41 of 1996 on Live Home or Residential Ownership by Foreigners domiciled in Indonesia. Law No. 1 of 2011 on Housing and Settlement Zone, which in Article 52 stipulated that foreigners could inhabit or occupy the home by rights of leases or rights of use. Government Regulation No. 41 of 1996 intended to provide the possibility of legal certainty for foreigners to have a house or dwelling which is located in Indonesia, however, the implementation has not been able to provide a clear legal for foreign citizen in related with property investment in Indonesia, as well as the emergence of smuggling law of land by foreigners which cannot be handled due to the lack of oversight and follow-up sanctions.

Abstract

Hak Cipta secara esensial merupakan hasil dari suatu ide intelektual manusia yang dituangkan pada suatu karya cipta tertentu. Semakin berbobot karya-karya intelektual seseorang semakin tinggi pula nilai ekonomi dari suatu karya, sehingga karya yang dihasilkan merupakan “kekayaan” yang dimiliki oleh para pemilik atau yang menghasilkan karya tersebut. Secara yuridis menyangkut konsepsi hukum tentang kepemilikan yang mengacu pada konsep kebendaan yaitu benda immateriil, sehuhungan dengan itu karena menyangkut tentang 'hak' atas suatu benda, maka secara yuridis bagaimana memanfaatkan dan mempertahankan hak tersebut. Untuk itu perlu diperhatikan bagaimana penegakan hukum yang dapat dilakukan.

Abstract

Dalam rangka menghadapi globalisasi ekonomi dan memajukan perekonomian, Indonesia sebagai salah satu negara yang telah meratifikasi beberapa konvensi internasional mengenai perdagangan dan juga telah membentuk perjanjian internasional baik berskala regional maupun internasional, dituntut untuk mematuhi ketentuan yang telah disepakati bersama dan perlu menyesuaikan peraturan perundang-undangan nasional yang berhubungan dengan perdagangan internasional tersebut.

Abstract

Keberadaan konsultan hukum pasar modal diperlukan untuk dapat memberikan pendapat hukum mengenai kondisi suatu perusahaan dan transaksi yang akan mereka lakukan di pasar modal. Untuk itu konsultan hukum wajib untuk terlebih dahulu melakukan uji tuntas (due diligence) untuk memperoleh fakta atau informasi material yang menggambarkan kondisi perusahaan dan transaksi yang akan dilakukan. Profesi konsultan hukum sebagai salah satu profesi penunjang di pasar modal memegang peranan yang sangat urgen dalam memberikan keterangan informasi berupa laporan pemeriksaan hukum (legal audit) dan laporan pendapat hukum (legal opinion) yang digunakan oleh investor dalam menentukan keputusannya di pasar modal. Peranan konsultan hukum pasar modal didalam menjalankan fungsi profesinya bertanggungjawab untuk mendorong terciptanya mekanisme perlindungan investor, sehingga dituntut untuk bekerja secara independen, profesional dan bertanggungjawab.

Abstract

Education is the most important for human being, because without it the human being can not achieve many things.UUD1945 said that education is one of the human right whereby state must fill it. Many legal policies about education are declared, for example Law No. 20 of 2003 and Law No. 14 of 2005, as a serious effort to make Indonesian educated people. But it must be realized that it was not adequate tool to see policy just from the law. It is needed contribution many sector eg: social, cultural, economics, and politics to develop great commitment and to make progress education.

Abstract

Legal relationship between doctor and patient in health care is often tinged with neglect of the rights of patients, causing a conflict or dispute. Mediation is a form of alternative dispute resolution (ADR) or alternative dispute resolution outside the court. Mediation is considered more profitable the parties since the mediator has no authority to decide, but only as a mediator of the agreement by the parties. The advantages of using mediation path is a simple procedure, effective, inexpensive, decisions are still in control the parties to the dispute, even though mediation is not a panacea to overcome distortions paradigm of litigation and can not be applied to all disputes.

Abstract

Implementation of local government as regulated by Law Number 23 Year 2014 contains three functions. The first function is the planning of activities of local government tasks that are acceded by the Regional Development Planning Agency (Bappeda), the second function is the implementation of the tasks of local government that are represented and implemented by the Regional Device Organization (OPD) in the local government, and the third function is supervision the implementation or implementation of local government implemented by the Regional Inspectorate as the supervisor of the local government. Internal supervision (Inspectorate) is formed in order for the implementation of loca government tasks that are run by all existing regional devices can run well, effective, efficient and effective on target according to predetermined plans.  herefore, the Inspectorate's role in overseeing the tasks of all the Regional  ApparatusOrganizations in the local government is very important. In order to obtain an effective supervision, it is necessary to meet two principles of supervision, namely first, is the existence of a specific plan and the giving of instructions; second, giving clear authority to subordinates. The first basic principle is a must, because the plan is a standard, a measure of the work performed by subordinates. If this principle is well executed, then the implementation of good local government will be achieved well too.

Abstract

Political parties initially formed on the basis of a desire to unite the various groups of people who have the same vision and mission, so that the mind and their orientation can be consolidated. Departing from that, it can be described that political parties are organized groups, where members have an orientation, values , and ideals of the same, which aims to realize these goals by acquiring political power and seize the political. In order to achieve the objectives of political parties should be able to carry out their functions properly. The functions of political parties are as follows: (1) Means of Political Communication, (2) Means of Political Socialization, (3) Means of Political Recruitment, and (4) Means Regulatory Conflicts. Post-reform in Indonesia, political parties are not able to function properly as a pillar of democracy. Several factors could be the cause of the failure of political parties in Indonesia to perform its functions, namely (1) the party system in Indonesia, (2) cultural elitism, and (3) political pragmatism itself. To improve the conditions said, one of the political parties as democratic institutions that play an important role in the democratic process should be able to provide political education for the people of Indonesia, and to be able to put its position actively and creatively in order to carry out the duties and functions both in the preparation for the general election and in the aftermath of the elections.

Abstract

The main matter, a case can be investigated trial by International court of justice is human right violence for instance genocide, war, ethnic killing, human trafficking and salve. No all legal action or law suit could be submitted to International court. Based on the background, could be inferred : How about the existence of International court of justice to take trial human crime ? The matter could be conclude that International court of justice one of United Nation organ which have the main task to solve the International dispute, human crime and human right violence in a country.
