Abstract

This study aims to analyze the implementation of Pancasila values within the Corporate Social Responsibility (CSR) programs of PT Telkom Pekalongan, particularly those oriented toward environmental sustainability. The research is grounded in the urgency of integrating corporate social responsibility with the foundational philosophy of the state, which emphasizes a balanced interplay among social, economic, and environmental dimensions in sustainable development. Employing a qualitative method with a case study approach, the study seeks to obtain an in-depth and contextual understanding of the phenomenon. Data were collected through in-depth interviews, field observations, and documentation analysis of the company’s CSR initiatives. The findings demonstrate that the value of Divinity is reflected in the ethical commitment to environmental preservation, the value of Humanity is manifested in efforts to enhance public awareness of a healthy environment, the value of Unity is realized through multi-stakeholder collaboration, the value of Democracy is evidenced by community participation in planning and implementation processes, and the value of Social Justice is embodied in the equitable and sustainable distribution of program benefits. These findings affirm that the internalization of Pancasila values in CSR policies functions not merely as normative legitimacy but also as an effective institutional strategy for strengthening corporate sustainability governance and contributing substantively to sustainable development.

Abstract

Penelitian ini bertujuan untuk menganalisis keterwakilan perempuan dalam Kelembagaan Adat Dayak di Kota Palangka Raya dalam perspektif hak sipil dan politik serta prinsip non-diskriminasi. Latar belakang penelitian didasarkan pada fakta empiris bahwa seluruh Damang Kepala Adat di Kalimantan Tengah berjenis kelamin laki-laki, meskipun Peraturan Daerah Nomor 16 Tahun 2008 tidak secara eksplisit membatasi berdasarkan jenis kelamin. Penelitian ini menggunakan pendekatan yuridis empiris dengan teknik wawancara mendalam terhadap 12 informan (Damang, mantir adat, tokoh perempuan adat, dan akademisi), observasi partisipatif, serta analisis dokumen normatif. Data dianalisis melalui analisis tematik dengan triangulasi sumber. Hasil penelitian menunjukkan bahwa norma patriarki struktural membatasi representasi perempuan secara substantif. Dalam perspektif teori representasi politik Pitkin, keterlibatan perempuan masih bersifat deskriptif dan belum mencapai representasi substantif. Secara normatif, praktik tersebut berpotensi bertentangan dengan Pasal 28I UUD 1945 dan prinsip CEDAW mengenai penghapusan diskriminasi terhadap perempuan. Kontribusi penelitian ini terletak pada integrasi analisis pluralisme hukum dan teori patriarki dalam konteks kelembagaan adat Dayak serta rekomendasi ius constituendum untuk reformasi regulasi daerah.

Abstract

The utilization of copyright certificates as objects of fiduciary security constitutes an alternative financing instrument with the potential to support the development of the creative economy and financial inclusion. Nevertheless, in Indonesian banking practice, the use of copyright as collateral continues to face various legal and regulatory challenges. This article aims to analyze the legal certainty of copyright certificates as objects of fiduciary security and to formulate an innovative and secure legal framework strengthening model applicable to banking practice. This study employs a normative legal research method using statutory, conceptual, and case approaches, through an analysis of the Copyright Law, the Fiduciary Security Law, banking regulations, as well as financing practices and relevant court decisions. The findings indicate that although copyright is normatively recognized as intangible movable property eligible for fiduciary security, substantive legal certainty has not been fully realized due to the absence of valuation standards, limitations in execution mechanisms, lack of integration within registration systems, and the absence of specific regulations governing intellectual property–based financing in banking law. This study proposes a legal certainty strengthening model encompassing cross-sector regulatory harmonization, registry interoperability, copyright valuation standardization, the formulation of execution guidelines, and enhanced collaboration between regulators and the banking sector. This model is expected to bridge the gap between normative recognition and practical implementation of intellectual property–based financing.

Abstract

The rapid growth of the property sector This research is motivated by the frequent practice of house sale and purchase transactions in the elite Alam Sutera area, which is often not accompanied by adequate legal understanding regarding the risks of default, particularly when the house certificate turns out to be still used as bank loan collateral. The study aims to examine the legal construction of agreement cancellation under the Indonesian Civil Code and the legal consequences arising from default on the rights and obligations of the parties. The method used is normative legal research with statutory and conceptual approaches, supported by descriptive-qualitative analysis. The findings reveal two specific results. First, although Article 1266 of the Civil Code requires that cancellation of a reciprocal agreement be sought through a court decision, in practice at Alam Sutera, the freedom of contract principle (Article 1338 of the Civil Code) is frequently invoked to include clauses waiving such requirement, thereby allowing unilateral cancellation by means of a formal notice (somasi). Second, the legal consequence of cancellation not only mandates the full return of the down payment but also imposes compensation for costs, losses, and interest (Articles 1243–1246 of the Civil Code) proportionally based on proof of actual damages, not automatically double the amount. This study concludes that a balance between legal certainty for developers and consumer protection must be enforced by limiting unilateral waiver clauses of Article 1266. Practically, consumers are advised to scrutinize resolutive condition clauses in the PPJB before signing the agreement.

Abstract

This research is motivated by the suboptimal integration between environmental law enforcement and the anti-money laundering (AML) regime in Indonesia, despite the large scale of illicit financial flows generated by environmental crimes. The urgency of this study lies in the need to understand the position of Green Financial Crime (GFC) as a predicate offense and to evaluate the effectiveness of the follow the money approach, which remains rarely examined academically. Employing a normative juridical method enriched with secondary data analysis of Indonesian Financial Intelligence Unit (PPATK) reports and related policy documents, this study reveals two key findings. First, the conceptual construction of GFC in Indonesia is formed through a three-layer interaction: the normative foundation of predicate offenses, the financial intelligence categorization practices by PPATK, and the structural risk mapping within the National Risk Assessment. Second, money laundering typologies from environmental crime not only follow the classical placement–layering–integration pattern but are specifically integrated into natural resource supply chains through the use of front companies, co-mingling practices, and cross-border transactions. These findings confirm that the effectiveness of the follow the money approach remains hindered by the dominance of sectoral enforcement and limited beneficial ownership transparency, thereby necessitating a repositioning of the AML regime as a primary instrument for depriving criminals of illegal profits.

Abstract

Gorontalo Provincial Regulation Number 4 of 2023 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities mandates inclusive education through Article 17 as an effort to provide equal educational opportunities. This study aims to analyze the juridical position of Article 17 as a legal basis for fulfilling the educational rights of persons with disabilities in Bongo Village, Batudaa Pantai District, Gorontalo Regency, and to identify gaps between normative mandates and field implementation. Using empirical legal research with a qualitative approach, data were collected through in-depth interviews with the Village Head, the Principal of SDN 03 Batudaa Pantai, and a parent of a student with disabilities, as well as through documentation studies. The findings indicate that Article 17 holds a normatively strategic position, aligning with national regulations and international human rights standards. However, implementation in Bongo Village faces significant gaps characterized by the absence of a Disability Service Unit (DSU), the lack of a Governor’s Regulation as a technical implementing rule, and limited accessible inclusive education facilities. These conditions result in the failure of both preventive and repressive legal protection for persons with disabilities.

Abstract

The aim is analyzes the suitability of imposing work training for children aligns with the regulation contained in Law Number 11 of 2012 “Law on the Juvenile Criminal Justice System”. This study uses a normative method with state approach, case approach. Result is judges consider the children’s psychological condition, background, and to ensure the child can continue their education, and impose work training sanctions that are below the minimum criminal penalty. These considerations reflect the existence of judicial discretion authority in deciding the appropriate sanctions for children. The judge is guided by Sema number 1 of 2017 point 5 letter a which basically stipulates that the minimum criminal threat in Article 79 paragraph (3) doesn’t apply if the perpetrator is a child, besides that the judge also weighs the main principle which is “The best interest for the child”. Discretion in sentencing children needs to be accompanied by strong and clear legal arguments or considerations to ensure legal certainty without neglecting the goal of restorative justice.

Abstract

Freedom of expression is a fundamental right in democratic states, functioning as a means of public participation and oversight of power. However, this right may be restricted through criminal law to protect individual honor and maintain public order. Problems arise when criminal defamation norms are broadly formulated and lack clear limitations, creating legal uncertainty in their enforcement. Such conditions may generate a chilling effect, where individuals restrain expression due to fear of criminal sanctions. This study aims to analyze the concept of the chilling effect in restricting freedom of expression and evaluate criminal defamation regulations from a legal certainty perspective. Using normative legal research methods, this study finds that broadly interpreted norms may encourage self-censorship, highlighting the need for clearer, more precise, and proportionate legal formulations. The findings also imply that ambiguous insult provisions in the Indonesian Penal Code risk undermining democratic discourse and require judicial safeguards to prevent excessive restriction of public criticism. Therefore, a balanced approach between reputation protection and freedom of expression is essential.

Abstract

This study aims to analyze the legal arrangements regarding the return of state losses in corruption crimes in Indonesia and examine the motives for state refunds by post-investigation officials and their implications for law enforcement. The research method used is normative legal research with legislative, conceptual, and case approaches. The legal materials used include primary, secondary, and tertiary legal materials that are qualitatively analyzed. The results of the study show that normatively, legal arrangements regarding the return of state losses have been comprehensively regulated through various instruments, such as payment of compensation, asset forfeiture, and civil lawsuits. This arrangement contributes to supporting the state's financial recovery, strengthens the legal restorative function, and provides a preventive effect against corruption. However, in its implementation, there are still various obstacles, such as limitations in asset tracking and recovery, weak coordination between law enforcement agencies, and not optimal asset recovery-based approach. In addition, the motive for state refunds after a corruption investigation is not always based on legal awareness, but is often influenced by pragmatic considerations, legal pressure, and reputational interests.

Abstract

The decarbonization of maritime transport is a preventive measure to address the climate crisis. However, its implementation remains hindered by the fragmentation of international law and issues of injustice faced by developing countries. This study aims to analyze the regulatory coherence between the 1982 UNCLOS and the technical instruments established by the International Maritime Organization (IMO), as well as to examine the realization of justice through the principle of Common but Differentiated Responsibilities (CBDR). This research employs a normative legal method using statutory and conceptual approaches. The findings reveal legal dualism within the maritime decarbonization regime, in which maritime decarbonization targets and the Net-Zero Emission 2050 agenda remain categorized as soft law, while hard law instruments such as the Energy Efficiency Design Index (EEDI) and the Ship Energy Efficiency Management Plan (SEEMP) are limited to technical aspects and remain ineffective because they primarily apply only to newly built ships. The study identifies structural injustice resulting from the implementation of uniform treatment under the principle of No More Favourable Treatment, without considering the economic and technological disparities of developing countries. Therefore, the integration of legal norms, global financing mechanisms, and technology transfer is necessary to support a just maritime energy transition.
